<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 822</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210318">March 18, 2021</action-date><action-desc><sponsor name-id="S396">Mrs. Blackburn</sponsor> (for herself, <cosponsor name-id="S355">Mr. Cruz</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, <cosponsor name-id="S412">Mr. Tuberville</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S399">Mr. Hawley</cosponsor>, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, and <cosponsor name-id="S384">Mr. Tillis</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Higher Education Act of 1965 to require program participation agreements between institutions of higher education and Hanban if a Confucius Institute operates on the campus of the institution.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transparency for Confucius Institutes Act</short-title></quote>.</text></section><section id="idCF742015D95D4BE496B92EF1CD33D1A2"><enum>2.</enum><header>Program participation agreements between institutions and Hanban</header><text display-inline="no-display-inline">Section 487(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB691FA46EB2A4EDFB63C67D576A6D380"><paragraph id="id22775631C6114E54BDCC8B281944A3AD"><enum>(30)</enum><text>If a Confucius Institute (as defined in section 1091 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (132 Stat. 1997; <external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>)) operates on the campus of the institution, the institution shall enter into a program participation agreement with the Office of Chinese Language Council International (commonly known as <quote>Hanban</quote>) that—</text><subparagraph id="idB12E3E9ED5F84249A9936E569AB46F61"><enum>(A)</enum><text>clearly delineates between the Confucius Institute's programs and the institution’s own Chinese language programs;</text></subparagraph><subparagraph id="idDBF717BD94C141C6B80A723789590AB5"><enum>(B)</enum><text>locates the Confucius Institute physically apart from the Chinese language programs, Chinese history programs, and Chinese cultural programs within the institution’s organizational structure and separates promotions for the Confucius Institute from promotions for the institution’s Chinese language programs, Chinese history programs, and Chinese cultural programs; </text></subparagraph><subparagraph id="id3946ACE865BE4C988FB0E4DBAEB8324D"><enum>(C)</enum><text>removes the Chinese assistant director position from the Confucius Institute;</text></subparagraph><subparagraph id="idEEB9F3E3614840B49A59EAFF9E0A7353"><enum>(D)</enum><text>subjects the staff and professors of the Confucius Institute to appropriate background checks; </text></subparagraph><subparagraph id="id0FFDAFAD6AC24F94BF251ABA15709979"><enum>(E)</enum><text>is publicly available in its entirety online; </text></subparagraph><subparagraph id="id58F5F91DCD5B4E438BDF0E6C46FABD4E"><enum>(F)</enum><text>does not have a confidentiality section; and</text></subparagraph><subparagraph id="id3B7B33A36F914F59AEFDE47A330EF9E0"><enum>(G)</enum><text>provides that the institution has final decision-making authority, including with regard to conference themes, guest speakers, and topics for events on campus at the institution.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
