 title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energy Security Cooperation with Allied Partners in Europe Act of 2021</short-title></quote>.</text></section><section id="idAC4FCB3005794039952F1747735811A3"><enum>2.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text><paragraph id="idEB1776BA57F544FC8F8FADB7E8E1E627"><enum>(1)</enum><text>to reduce the dependency of allies and partners of the United States on Russian energy resources, especially natural gas, in order for those countries to achieve lasting and dependable energy security;</text></paragraph><paragraph id="id4CC030AFDCE84851A7960AB8B0E24B7B"><enum>(2)</enum><text>to condemn the Government of the Russian Federation for, and to deter that government from, using its energy resources as a geopolitical weapon to coerce, intimidate, and influence other countries;</text></paragraph><paragraph id="id7D374730F42D4EBD8EDE5BDF26E3CD7B"><enum>(3)</enum><text>to improve energy security in Europe by increasing access to diverse, reliable, and affordable energy;</text></paragraph><paragraph id="id1F8447E6130D479A96D7A057CE171778"><enum>(4)</enum><text>to promote energy security in Europe by working with the European Union and other allies of the United States to develop liberalized energy markets that provide diversified energy sources, suppliers, and routes;</text></paragraph><paragraph id="id0AF1A4B23F5A4E22A5BD5BB0D0F88E36"><enum>(5)</enum><text>to continue to strongly oppose the Nord Stream 2 pipeline based on its detrimental effects on the energy security of the European Union and the economy of Ukraine and other countries in Central Europe through which natural gas is transported; and</text></paragraph><paragraph id="id047C66711AD14B6E96DD813FEB2E3125"><enum>(6)</enum><text>to support countries that are allies or partners of the United States by expediting the export of energy resources from the United States.</text></paragraph></section><section id="id6831781088EF4942B716A8A9B5F9BDC7"><enum>3.</enum><header>North Atlantic Treaty Organization</header><text display-inline="no-display-inline">The President should direct the United States Permanent Representative on the Council of the North Atlantic Treaty Organization (in this Act referred to as <quote>NATO</quote>) to use the voice and influence of the United States to encourage NATO member countries to work together to achieve energy security for those countries and countries in Europe and Eurasia that are partners of NATO.</text></section><section id="id8C5A7A6C08224E8C98455059F82A06FD"><enum>4.</enum><header>Transatlantic energy strategy</header><subsection id="id44449CD5337D48EF85E79BBD1662BC05"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the United States and other NATO member countries should explore ways to ensure that NATO member countries diversify their energy supplies and routes in order to enhance their energy security, including through the development of a transatlantic energy strategy.</text></subsection><subsection id="id4A3B0EF124C94D0C9E74025D6826962B"><enum>(b)</enum><header>Transatlantic energy strategy</header><paragraph id="idF4E1F2E3FC184374BE725B4AD47E6DBE"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State, in coordination with the Administrator of the United States Agency for International Development and the Secretary of Energy, shall submit to the appropriate congressional committees a transatlantic energy strategy for the United States—</text><subparagraph id="idC3F52173BB1F43AB8FD93A1471C00E3D"><enum>(A)</enum><text>to enhance the energy security of NATO member countries and countries that are partners of NATO; and</text></subparagraph><subparagraph id="idE88DA319F5464CA6836C78461E1F9C37"><enum>(B)</enum><text>to increase exports of energy from the United States to such countries.</text></subparagraph></paragraph><paragraph id="id87A6A1C1B5474C2695C3E5BA378304ED"><enum>(2)</enum><header>Appropriate congressional committees defined</header><text>In this subsection, the term <term>appropriate congressional committees</term> means—</text><subparagraph id="idF7699E4CAF114CF6AFC4737637820BA9"><enum>(A)</enum><text>the Committee on Foreign Relations of the Senate; and</text></subparagraph><subparagraph id="idBCCF0E83DDED423CBAA532CDCDB9DC19"><enum>(B)</enum><text>the Committee on Foreign Affairs of the House of Representatives.</text></subparagraph></paragraph></subsection></section><section section-type="subsequent-section" id="id12F03C963D464258904E5BB7897D4B22"><enum>5.</enum><header>Expedited approval of exportation of natural gas to United States allies</header><subsection id="idDB2799D1F23548049E59520426E48FC6"><enum>(a)</enum><header>In general</header><text>Section 3(c) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717b">15 U.S.C. 717b(c)</external-xref>) is amended—</text><paragraph id="idD44B067C3B8A492BBEEB57BAA086C000"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> before <quote>For purposes</quote>;</text></paragraph><paragraph id="idB830605B14144EAB8D47C7ADB340D151"><enum>(2)</enum><text>by striking <quote>nation with which there is in effect a free trade agreement requiring national treatment for trade in natural gas</quote> and inserting <quote>foreign country described in paragraph (2)</quote>; and</text></paragraph><paragraph id="idEE8759CD40F2425BA13C18327AEF8673"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2C06F00A87B54727AFE559800651CF34"><paragraph id="idCCB00FDDA6354D03B536E4185E32F386" indent="up1"><enum>(2)</enum><text>A foreign country described in this paragraph is—</text><subparagraph id="idEB670DD10CEB46258E9D6EEDCD3A5F0A"><enum>(A)</enum><text>a nation with which there is in effect a free trade agreement requiring national treatment for trade in natural gas;</text></subparagraph><subparagraph id="id6222D37C53A44686BA5CF05CBBA14C53"><enum>(B)</enum><text display-inline="yes-display-inline">a member country of the North Atlantic Treaty Organization;</text></subparagraph><subparagraph id="idDFD2564F8DF14ED6B43F81A1A771A33F"><enum>(C)</enum><text display-inline="yes-display-inline">subject to paragraph (3), Japan; and</text></subparagraph><subparagraph id="idC87B8F46E5674ECD8E0193C47EB3AF80"><enum>(D)</enum><text>any other foreign country if the Secretary of State, in consultation with the Secretary of Defense, determines that exportation of natural gas to that foreign country would promote the national security interests of the United States.</text></subparagraph></paragraph><paragraph id="id7FDADB892F904654A312D14F21A133E6" indent="up1"><enum>(3)</enum><text>The exportation of natural gas to Japan shall be deemed to be consistent with the public interest pursuant to paragraph (1), and applications for such exportation shall be granted without modification or delay under that paragraph, during only such period as the Treaty of Mutual Cooperation and Security, signed at Washington January 19, 1960, and entered into force June 23, 1960 (11 UST 1632; TIAS 4509), between the United States and Japan, remains in effect.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idA3CAE9ECD527427DB2CAC93F7E6D1D1C"><enum>(b)</enum><header>Effective
 date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to applications for the authorization to export natural gas under section 3 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717b">15 U.S.C. 717b</external-xref>) that are pending on, or filed on or after, the date of the enactment of this Act.</text></subsection></section><section section-type="subsequent-section" id="idEF10883A829140E4B54EB42C862A48BD"><enum>6.</enum><header>Mandatory sanctions with respect to the development of pipelines in the Russian Federation</header><subsection id="id218D888644FD40EDB346560FB3D58C15"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall impose five or more of the sanctions described in section 235 of the Countering America's Adversaries Through Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9529">22 U.S.C. 9529</external-xref>) with respect to a person if the President determines that the person knowingly, on or after the date of the enactment of this Act, makes an investment described in subsection (b) or sells, leases, or provides to the Government of the Russian Federation, or to any entity owned or controlled by that government, for the construction of Russian energy export pipelines, goods, services, technology, information, or support described in subsection (c)—</text><paragraph id="idB4D5D83D8D3C4846879E2471347B99BD"><enum>(1)</enum><text display-inline="yes-display-inline">any of which has a fair market value of $1,000,000 or more; or</text></paragraph><paragraph id="id372508CCD91F4353873728AF6F25CA72"><enum>(2)</enum><text>that, during a 12-month period, have an aggregate fair market value of $5,000,000 or more.</text></paragraph></subsection><subsection id="idD963084A1EDE48DDB6722FD32000F046"><enum>(b)</enum><header>Investment described</header><text>An investment described in this subsection is any contribution of assets, including a loan guarantee or any other transfer of value, that directly and significantly contributes to the enhancement of the ability of the Government of the Russian Federation, or any entity owned or controlled by that government, to construct energy export pipelines.</text></subsection><subsection id="idC84590707AB74C28B1A93A0524DEDFFF"><enum>(c)</enum><header>Goods, services, technology, information, or support described</header><text>Goods, services, technology, information, or support described in this subsection are goods, services, technology, information, or support that could directly and significantly facilitate the maintenance or expansion of the construction, modernization, or repair of energy export pipelines by the Government of the Russian Federation or any entity owned or controlled by that government.</text></subsection><subsection id="id52B57F55B1C04FBD9BB57739AB104062"><enum>(d)</enum><header>Presidential waiver authority and notice to Congress</header><paragraph id="id66478FB5235445BF923F6ACE3B9970EA"><enum>(1)</enum><header>Presidential waiver authority</header><text>The President may waive the application of sanctions under this section if the President determines that it is in the national security interests of the United States to waive such sanctions.</text></paragraph><paragraph id="id99D6CDAA973446AC92533ABF01638B3C"><enum>(2)</enum><header>Notice to Congress</header><text>Not less than 15 days before taking action to waive the application of sanctions under paragraph (1), the President shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a notification of, and written justification for, the action.</text></paragraph></subsection><subsection id="id781ae73f26344a38a0f91a2a9282700f"><enum>(e)</enum><header>Exception for importation of goods</header><paragraph id="idb9c97b07d204484487e19f8fce58cffb"><enum>(1)</enum><header>In general</header><text>The authority to impose sanctions under subsection (a) shall not include the authority to impose sanctions with respect to the importation of goods.</text></paragraph><paragraph id="id60ed9dc9bc204cb093dc20d30987175e"><enum>(2)</enum><header>Good defined</header><text>In this subsection, the term <term>good</term> means any article, natural or manmade substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text></paragraph></subsection></section></legis-body></bill>
