<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 79</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210128">January 28, 2021</action-date><action-desc><sponsor name-id="S370">Mr. Booker</sponsor> (for himself and <cosponsor name-id="S253">Mr. Durbin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To eliminate the disparity in sentencing for cocaine offenses, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eliminating a Quantifiably Unjust Application of the Law Act</short-title></quote> or the <quote><short-title>EQUAL Act</short-title></quote>.</text></section><section id="id4cd325a4c1274ced8b77ff7ff2d8d4b3"><enum>2.</enum><header>Elimination of increased penalties for cocaine offenses where the cocaine involved is cocaine base</header><subsection id="ide6770eebd16b470185bdce0d8f2cc3ee"><enum>(a)</enum><header>Controlled substances act</header><text>The following provisions of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801</external-xref> et seq.) are repealed:</text><paragraph id="idf7707096ca86454ca35614c0ca37089a"><enum>(1)</enum><text>Clause (iii) of section 401(b)(1)(A) (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)(1)(A)</external-xref>).</text></paragraph><paragraph id="id663d0f8673ec4ff88b4a636422476f49"><enum>(2)</enum><text>Clause (iii) of section 401(b)(1)(B) (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)(1)(B)</external-xref>).</text></paragraph></subsection><subsection id="idd9912b49cbcc49d4acb024f85e54cef5"><enum>(b)</enum><header>Controlled substances import and export act</header><text>The following provisions of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/951">21 U.S.C. 951</external-xref> et seq.) are repealed:</text><paragraph id="idc2b6fda824604a3e9eb70d2653c61771"><enum>(1)</enum><text>Subparagraph (C) of section 1010(b)(1) (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960(b)(1)</external-xref>).</text></paragraph><paragraph id="idd6f820111dc54f788368ce0ff3b4653b"><enum>(2)</enum><text>Subparagraph (C) of section 1010(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960(b)(2)</external-xref>).</text></paragraph></subsection><subsection id="id8db6ff3ca2154fd6ac0cc572ce015365"><enum>(c)</enum><header>Applicability to pending and past cases</header><paragraph id="idce8c8b818507413ab14ceb6c16c86bc5"><enum>(1)</enum><header>Pending cases</header><text>This section, and the amendments made by this section, shall apply to any sentence imposed after the date of enactment of this Act, regardless of when the offense was committed. </text></paragraph><paragraph id="idee07427636a745a89e3e20d7f82609dc"><enum>(2)</enum><header>Past cases</header><text>In the case of a defendant who, before the date of enactment of this Act, was convicted or sentenced for a Federal offense involving cocaine base, the sentencing court may, on motion of the defendant, the Bureau of Prisons, the attorney for the Government, or on its own motion, impose a reduced sentence after considering the factors set forth in section 3553(a) of title 18, United States Code. </text></paragraph></subsection></section></legis-body></bill>
