which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 40, United States Code, to direct the Administrator of General Services to incorporate practices and strategies to reduce bird fatalities resulting from collisions with certain public buildings, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H136A9686B3C048DA88382F5DF83C917B"><section section-type="section-one" id="H979BEA7B7D724375B30A7D32B58A2570"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Bird Safe Buildings Act of 2021</short-title></quote>.</text></section><section id="H8369A18E894A4E90A245F1BAD54F1AFD"><enum>2.</enum><header>Use of bird-safe features, practices, and strategies in public buildings</header><subsection id="H5A3F89E73C2E436BB062EA060E16CF98"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/33">Chapter 33</external-xref> of title 40, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HA9F0EBE59C004866BC6BCABAD0ECA7A8"><section id="HD7CEAEABB12C42E18D449BE30AB64B63"><enum>3319.</enum><header>Use of bird-safe features, practices, and strategies in public buildings</header><subsection id="HAC57C3C342844E63A5B7B36EB74D0812"><enum>(a)</enum><header>Construction, alteration, and acquisition of public buildings</header><text display-inline="yes-display-inline">The Administrator of General Services (referred to in this section as the <quote>Administrator</quote>) shall incorporate, to the extent practicable, features, practices, and strategies to reduce bird fatalities resulting from collisions with public buildings for each public building—</text><paragraph id="H3870B49E2C874272BE46E5F2714CDFE5"><enum>(1)</enum><text>constructed;</text></paragraph><paragraph id="H878F25F780C94FB9ADD4026A2BDFD459"><enum>(2)</enum><text>acquired; or</text></paragraph><paragraph id="HBD4F281B302C4B39819B187C13E1F67B"><enum>(3)</enum><text>of which more than 50 percent of the facade is substantially altered, as determined by the Commissioner of Public Buildings.</text></paragraph></subsection><subsection id="HC4CB1045C44F4977A122C52F858D7BA4"><enum>(b)</enum><header>Design guide</header><text display-inline="yes-display-inline">The Administrator shall develop a design guide to carry out subsection (a) that includes the following:</text><paragraph id="HC4E1733098BA4231912ABBEAB0A6A8EE"><enum>(1)</enum><text display-inline="yes-display-inline">Features for reducing bird fatalities resulting from collisions with public buildings throughout all construction phases, taking into account the number of bird fatalities that occur at different types of public buildings.</text></paragraph><paragraph id="H588CBA19CFF64EE7B5E2103F1C17A65D"><enum>(2)</enum><text display-inline="yes-display-inline">Methods and strategies for reducing bird fatalities resulting from collisions with public buildings during the operation and maintenance of those buildings, including installing interior, exterior, and site lighting.</text></paragraph><paragraph id="HED66AE74C6AA40579E976C354902F7EB"><enum>(3)</enum><text display-inline="yes-display-inline">Best practices for reducing bird fatalities resulting from collisions with public buildings, including—</text><subparagraph id="HB29C6170B1844B3582570AFE73765C4A"><enum>(A)</enum><text>a description of the reasons for adopting the practices; and</text></subparagraph><subparagraph id="H38405FA49E63484A840B00B573C577A9"><enum>(B)</enum><text>an explanation for the omission of a best practice identified under subsection (c).</text></subparagraph></paragraph></subsection><subsection id="HC0F750FC8CDF4E7B85BCC5108802C16E"><enum>(c)</enum><header>Identifying best practices</header><text display-inline="yes-display-inline">To carry out subsection (b)(3), the Administrator may identify best practices for reducing bird fatalities resulting from collisions with public buildings, including best practices recommended by—</text><paragraph id="H7EA8A7FF76EE4477AAA12E5FE9033F6C"><enum>(1)</enum><text>Federal agencies with expertise in bird conservation;</text></paragraph><paragraph id="HE762F13B3A174466BCA163D9BC821373"><enum>(2)</enum><text>nongovernmental organizations with expertise in bird conservation; and</text></paragraph><paragraph id="H95AE511AD9E0498C87973DABE175AB6A"><enum>(3)</enum><text>representatives of green building certification systems.</text></paragraph></subsection><subsection id="H0F015209F510484C8FFEE5D38D17A34F"><enum>(d)</enum><header>Dissemination of design guide</header><text display-inline="yes-display-inline">The Administrator shall disseminate the design guide developed under subsection (b) to all Federal agencies, subagencies, and departments with independent leasing authority from the Administrator.</text></subsection><subsection id="HA157FC7A1B7F477DA32D68383E1F0568"><enum>(e)</enum><header>Update to design guide</header><text display-inline="yes-display-inline">The Administrator shall, on a regular basis, update the design guide developed under subsection (b) with respect to the priorities of the Administrator for reducing bird fatalities resulting from collisions with public buildings.</text></subsection><subsection id="HF6559E688CDF47DA815D8653352BA982"><enum>(f)</enum><header>Exempt buildings</header><text>This section shall not apply to—</text><paragraph id="H55A97654665E4F6694E100810C5050B2"><enum>(1)</enum><text display-inline="yes-display-inline">any building or site listed, or eligible for listing, on the National Register of Historic Places;</text></paragraph><paragraph id="HCAC3BF9B1D06488CAA66B378232443EC"><enum>(2)</enum><text display-inline="yes-display-inline">the White House and the grounds of the White House;</text></paragraph><paragraph id="H7204C9D7378C4E3EB68DC16DA511B12A"><enum>(3)</enum><text display-inline="yes-display-inline">the Supreme Court building and the grounds of the Supreme Court; or</text></paragraph><paragraph id="H2A94C0315FB34D9BBB3C3134230F160F"><enum>(4)</enum><text display-inline="yes-display-inline">the United States Capitol and any building on the grounds of the Capitol.</text></paragraph></subsection><subsection id="HA44BE32D55024F5796BF098BD9A6F419"><enum>(g)</enum><header>Certification</header><text display-inline="yes-display-inline">Not later than October 1 of each fiscal year, the Administrator, acting through the Commissioner of Public Buildings, shall certify to Congress that the Administrator uses the design guide developed under subsection (b) for each public building described in subsection (a).</text></subsection><subsection id="HD8E69620D8CB422DBF67FC0462FA8C18"><enum>(h)</enum><header>Report</header><text>Not later than October 1 of each fiscal year, the Administrator shall submit to Congress a report that includes— </text><paragraph id="H418175EC237B4DF59BEFD2FBD82F0E29"><enum>(1)</enum><text>the certification under subsection (g); and</text></paragraph><paragraph id="HA24ABAB4AF38467D9785E1837CD5B4DA"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent practicable, the number of bird fatalities that occurred as a result of a collision with the public buildings occupied by each Federal agency.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H32B0A802BAB74864A323B7172B858A6A"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/33">chapter 33</external-xref> of title 40, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7066F1C2DDD84706BF874F22C59C5960"><toc regeneration="no-regeneration"><toc-entry level="section">3319.
