which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Transportation to review laws relating to the illegal passing of school buses and to execute a public safety messaging campaign relating to illegal passing of school buses, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HA4059C2D3DD0433F99C8CF70FAD6763D"><section id="id28F3AE7279824C1FA73E6BFDF0CE6F27" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop for School Buses Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H0AE803BAF2C44BE9B59ED6D3BDFDDFD1"><enum>2.</enum><header>Illegal passing of school buses</header><subsection id="id6F08986A05A14F248300275D8959B610"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id94FA1317F5444BA397F52E1D86CCF60E"><enum>(1)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Transportation.</text></paragraph><paragraph commented="no" id="idD69BAB55199648F3976B96E69628F887"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph></subsection><subsection id="HA24055EBA85B430CBF0C943D7107004D"><enum>(b)</enum><header>Review of illegal passing laws</header><paragraph id="H85EB17ED5ED64795B0D7C1E1E6431D0E"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall—</text><subparagraph id="HD159622FA142407C8649B788E799BA77"><enum>(A)</enum><text>prepare a compilation of illegal passing laws in all States, including—</text><clause id="id9E4E9D85692149BFBBE1E7C863FBA5E9"><enum>(i)</enum><text>levels of enforcement and penalties and enforcement issues relating to those laws; and</text></clause><clause id="id82300FF6F5DC4C709E012C8222C73A9D"><enum>(ii)</enum><text>the impact of those laws on illegal passing of school buses in each State;</text></clause></subparagraph><subparagraph id="HBA858558DDC240A39E76CBBE88742752"><enum>(B)</enum><text>review existing State laws that may inhibit effective school bus loading zone countermeasures, including—</text><clause id="id92D39D91EFC84C51B2E652E2BC75076A"><enum>(i)</enum><text>laws requiring camera visibility of the face of a driver for enforcement action;</text></clause><clause id="id84D7F6498B664D869F6B357019F5B3B6"><enum>(ii)</enum><text>laws that may reduce stop-arm camera effectiveness;</text></clause><clause id="id744C4CF4FC2B428D9B8AC53550201A5C"><enum>(iii)</enum><text>laws requiring an officer to witness an event for enforcement actions relating to the event; and</text></clause><clause id="id5072590C0DB2456C8C7ADA4D88CE6F64"><enum>(iv)</enum><text>lack of primary enforcement for texting-and-driving offenses;</text></clause></subparagraph><subparagraph id="H0D381FCF96A74FF9BBB9C3F0AD35ECB6"><enum>(C)</enum><text>evaluate methods used by States to review, document, and report to law enforcement school bus stop-arm violations; and</text></subparagraph><subparagraph id="HE244C6FB104A4A4695392EAB869186D2"><enum>(D)</enum><text>on completion of the compilation under subparagraph (A), prepare recommendations regarding best practices for effective approaches to address illegal passing of school buses.</text></subparagraph></paragraph><paragraph id="HCF0E2F858806422F9382ECE5824F6CD5"><enum>(2)</enum><header>Publication</header><text>The Secretary shall publish the compilation and recommendations prepared under subparagraphs (A) and (D) of paragraph (1) on the website of the Department.</text></paragraph></subsection><subsection id="H844F3C976A774C7B86C44169D170BB37"><enum>(c)</enum><header>Public safety messaging campaign</header><paragraph id="H39844FB599794B738E1C6BFD9951AA57"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the Secretary publishes the compilation and recommendations under subsection (b)(2), the Secretary shall establish and carry out a public safety messaging campaign for distribution to States, divisions of motor vehicles, schools, and other public organizations to highlight the dangers of the illegal passing of school buses, including providing to students and the public information relating to safe loading and unloading of school buses.</text></paragraph><paragraph id="HC4EC199E50E6402EA2B4C661C9326F92"><enum>(2)</enum><header>Consultation</header><text>In developing materials for the campaign under paragraph (1), the Secretary shall consult with—</text><subparagraph id="idFB72D31B473A4A20B171A9736E964DCD"><enum>(A)</enum><text>public and private school bus industry representatives; and</text></subparagraph><subparagraph id="id135F941CDB0F4A6F9EF796AF95B2AB69"><enum>(B)</enum><text>States.</text></subparagraph></paragraph><paragraph id="H16B385B57E0F46108B909D66160402AA"><enum>(3)</enum><header>Updates</header><text>The Secretary shall periodically update materials for the campaign under paragraph (1).</text></paragraph></subsection><subsection id="H1B9836E6B35E4C84A271C2E775C0A3E7"><enum>(d)</enum><header>Review of technologies</header><paragraph id="H419D79E4B1F34BE8BF431E3D2B01D4D7"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall review and evaluate the effectiveness of various technologies to enhance school bus safety, including—</text><subparagraph id="id38C25F12607543BB9454B413DD68D279"><enum>(A)</enum><text>cameras;</text></subparagraph><subparagraph id="id832555536832416997ACFE3F08E97F01"><enum>(B)</enum><text>audible warning systems;</text></subparagraph><subparagraph id="idE5F1D543003F4351AE39D26353102809"><enum>(C)</enum><text>enhanced lighting; and</text></subparagraph><subparagraph id="id2A29DA586AA54F5DB5B506D112CFE595"><enum>(D)</enum><text>other technological solutions.</text></subparagraph></paragraph><paragraph id="H832A229F13244EA39E653F96873649AF"><enum>(2)</enum><header>Content</header><text>The review and evaluation under paragraph (1)—</text><subparagraph id="H9ECFABB74ED24D15A1ECC7869968CB9B"><enum>(A)</enum><text>shall include an evaluation of, as applicable—</text><clause id="idF070E6FDC67B44D58E8766693C965DD1"><enum>(i)</enum><text>the costs of new equipment;</text></clause><clause id="idFB0A0F68A9D347579E7AC2C3E2FCF98F"><enum>(ii)</enum><text>potential impacts on overall school bus ridership;</text></clause><clause id="H18BE7BFA5C504A8E931E13A5DDE40D1A"><enum>(iii)</enum><text>advanced technologies surrounding loading zone safety;</text></clause><clause id="HFF6D6FF7BB1745A2B1207AA444677EE2"><enum>(iv)</enum><text>motion-activated detection systems that are capable of—</text><subclause id="H59A925DE35EC46BEBAFFAE06EB83A2CD"><enum>(I)</enum><text>detecting pedestrians, bicyclists, and other road users located near the exterior of a school bus; and</text></subclause><subclause id="H06AF246EBC7A4FA08CC46DA4257A6A2F"><enum>(II)</enum><text>alerting the operator of a school bus of the road users described in subclause (I); and</text></subclause></clause><clause id="HF3A714D1F9E4486CBDD7B920605AA854"><enum>(v)</enum><text>school bus lighting systems, to ensure clear communication to surrounding drivers regarding appropriate actions; and</text></clause></subparagraph><subparagraph id="H2DD44493BA3A49C09AE1289BA0052DB2"><enum>(B)</enum><text>may include other technological solutions that enhance school bus safety.</text></subparagraph></paragraph><paragraph id="HEC73986EB7EA4E05BCF856871DC607F5"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">In conducting the review under paragraph (1), the Secretary shall consult with—</text><subparagraph id="id4B63299F037C416CA991C513FECAB695"><enum>(A)</enum><text display-inline="yes-display-inline">manufacturers of school buses or similar vehicles;</text></subparagraph><subparagraph id="idAD9277E00240407ABE4C88556167AF8C"><enum>(B)</enum><text display-inline="yes-display-inline">manufacturers of various technologies; and</text></subparagraph><subparagraph id="idE46AF397DB6545A2BB4B0A40128753F7"><enum>(C)</enum><text display-inline="yes-display-inline">school bus industry representatives.</text></subparagraph></paragraph><paragraph id="H06B6F9BB496E4F83879C4EEFD5ADB1C4"><enum>(4)</enum><header>Publication</header><text display-inline="yes-display-inline">The Secretary shall publish the findings of the review under paragraph (1) on the website of the Department.</text></paragraph></subsection><subsection id="H5F741BB2422A4F66AE9721265678F93A"><enum>(e)</enum><header>Review of driver education materials</header><paragraph id="H0C0E8348430742B48F96C0A70634D575"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall—</text><subparagraph id="H31330CECD9354D749C770598C8D2D550"><enum>(A)</enum><text>review driver education materials across all States to determine whether and the method by which illegal passing of school buses is addressed in—</text><clause id="idBCB89E74A70A4ECE95DADC43DB74217C"><enum>(i)</enum><text>driver education manuals;</text></clause><clause id="idF034EA9DE2F44123BD25F76755CD3A6E"><enum>(ii)</enum><text>noncommercial driver’s license testing;</text></clause><clause id="id1CAF1CFC29254ED892F6F93FB277AADD"><enum>(iii)</enum><text>road tests; and</text></clause><clause id="id5A9C7D0B20934A319C1BD58A79A46909"><enum>(iv)</enum><text>any other driver education materials; and</text></clause></subparagraph><subparagraph id="HDD3EA077AE5C4FE49D5ABB4E2CB20C63"><enum>(B)</enum><text>provide to Congress recommendations regarding the means by which States can improve education regarding illegal passing of school buses, particularly with respect to new drivers.</text></subparagraph></paragraph><paragraph id="HC9BCB5AF13E1473A8D881265C7AB0D80"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">In conducting the review under paragraph (1), the Secretary shall consult with—</text><subparagraph id="idAE42F0F62501485FB6DB2D5F71E2F3E9"><enum>(A)</enum><text display-inline="yes-display-inline">school bus industry representatives;</text></subparagraph><subparagraph id="idC6C11AC6EF86497D9C3FFCEFD1104DE4"><enum>(B)</enum><text display-inline="yes-display-inline">States;</text></subparagraph><subparagraph id="idE77AAB08A52D4026BCC57535CBCD928E"><enum>(C)</enum><text display-inline="yes-display-inline">motor vehicle administrators; and</text></subparagraph><subparagraph id="idDEB297F0DF2245DD8DF8252D8CC6D4DD"><enum>(D)</enum><text display-inline="yes-display-inline">other appropriate motor vehicle experts.</text></subparagraph></paragraph><paragraph id="id377296DAB8CA4274AFB31F5EDCFC40B9"><enum>(3)</enum><header>Publication</header><text display-inline="yes-display-inline">The Secretary shall publish the findings of the review under paragraph (1) on the website of the Department. </text></paragraph></subsection><subsection id="H83FD3CFFC60D43DFB5566D8AFFF37FFF"><enum>(f)</enum><header>Review of other safety issues</header><paragraph id="H406E645DF8A44F6691F3B82B75217355"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall—</text><subparagraph id="H29C83ABD6DC1425F9375B03D70ACD946"><enum>(A)</enum><text>conduct research relating to the connections between illegal passing of school buses and other safety issues, including—</text><clause id="idD4AEC445D5924B89BB1C46B6EEB2B4E0"><enum>(i)</enum><text>distracted driving;</text></clause><clause id="idB8BFF6DD9EC545649463BDAF85A2F277"><enum>(ii)</enum><text>morning darkness;</text></clause><clause id="id7A05D6AFB8FD4A8AB4E0654B92236FE6"><enum>(iii)</enum><text>poor visibility;</text></clause><clause id="idA7639A1D37EA462A9598EF12E25F4F2A"><enum>(iv)</enum><text>illumination and reach of vehicle headlights;</text></clause><clause id="id5D4514C662D944D7B3BE8713446B9162"><enum>(v)</enum><text>speed limits; and</text></clause><clause id="id335FD79B043748B4BB281D008E137474"><enum>(vi)</enum><text>school bus stop locations in rural areas; and</text></clause></subparagraph><subparagraph id="H1C28A03D5BDD4341812FEA54CC136677"><enum>(B)</enum><text>prepare a report describing the findings of the research conducted under subparagraph (A).</text></subparagraph></paragraph><paragraph id="id61040F145E35498E9D5C48D333DBAE56"><enum>(2)</enum><header>Publication</header><text display-inline="yes-display-inline">The Secretary shall publish the report prepared under paragraph (1)(B) on the website of the Department.</text></paragraph></subsection></section></legis-body></bill>
