which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">chapter 110</external-xref> of title 18, United States Code, to prohibit gender reassignment medical interventions on minors, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE8EE23893E8D4FD1A2610009A51A56F7"><section section-type="section-one" id="H4D53B5ED704F40E3AEC0666EC7CEF3FA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Children From Experimentation Act of 2021</short-title></quote>.</text></section><section id="HA39FD57AB3CB42A4AFEFCF1CA181E2E2"><enum>2.</enum><header>Gender reassignment medical interventions on minors prohibited</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States Code, is amended—</text><paragraph id="HB629D753241444A6A1711D8E2D18C60C"><enum>(1)</enum><text>by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="H6DDFBBDABDB442F290B0D4A51601C582"><section id="HEE678F82797D43F8B6C5D28D54112285"><enum>2260B.</enum><header>Gender reassignment medical interventions on minors</header><subsection id="H3019285267DE4420964BFC82808928E7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Whoever knowingly performs any gender reassignment medical intervention on a minor shall be fined under this title, imprisoned not more than 5 years, or both. </text></subsection><subsection id="H07BE8C13A0F34C5EB8A736C988725226"><enum>(b)</enum><header>Prohibition on prosecution of person on whom intervention is performed</header><text>No person on whom the gender reassignment medical intervention under subsection (a) is performed may be arrested or prosecuted for an offense under this section.</text></subsection><subsection id="H8BCBE25B0B774AC3843273C0AF2D902E"><enum>(c)</enum><header>Civil action</header><text>A person on whom a gender reassignment medical intervention is performed under this section may bring a civil action for appropriate relief against each person who performed the gender reassignment medical intervention.</text></subsection><subsection id="HB321FB51ACDB4AB480C2CAD77001DB3A"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H3AEE776FCA3B4579B62AE3A06F60EAA2"><enum>(1)</enum><header>Gender reassignment medical intervention</header><subparagraph id="H3C3FAFBC3E3E4AF480FCF733A1EABB40"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this chapter, except as provided in subparagraph (B), the term <term>gender reassignment medical intervention</term> means—</text><clause id="H44EB0B2AEFB8440FBF8646636702D26A"><enum>(i)</enum><text>performing a surgery that sterilizes an individual, including castration, vasectomy, hysterectomy, oophorectomy, metoidioplasty, penectomy, phalloplasty, and vaginoplasty, to change the body of such individual to correspond to a sex that is discordant with biological sex;</text></clause><clause id="HE1FCD17EB5AD4DA0A87586F272F51D0C"><enum>(ii)</enum><text>performing a mastectomy on an individual for the purpose described in clause (i); or</text></clause><clause id="HB210E15B2F4442F79CB021B23607CEC6"><enum>(iii)</enum><text display-inline="yes-display-inline">administering or supplying to an individual medications for the purpose described in clause (i), including—</text><subclause id="HB7CFB67BFBBF4A32B7443A68ACF40EDA"><enum>(I)</enum><text>GnRH agonists or other puberty-blocking drugs to stop or delay normal puberty;</text></subclause><subclause id="H8C6BB6DCEEF1417A9BEB1C7C6B0A723F"><enum>(II)</enum><text>testosterone or other androgens to biological females at doses that are supraphysiologic to the female sex; or</text></subclause><subclause id="H6072A4416D5A4185AA3490536A780D0B"><enum>(III)</enum><text>estrogen to biological males at doses that are supraphysiologic to the male sex.</text></subclause></clause></subparagraph><subparagraph id="HEC8E357BC7484526B5A366FF3EC2003A"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">Subparagraph (A) shall not apply to the following individuals:</text><clause id="H9FA45AAA14DA4AB7816464C10F4BBAE4"><enum>(i)</enum><text>An individual with external biological sex characteristics that are irresolvably ambiguous, such as those born with 46 XX chromosomes with virilization, 46 XY chromosomes with undervirilization, or having both ovarian and testicular tissue.</text></clause><clause id="HAE724625E30B469B973CBDB7E479715B"><enum>(ii)</enum><text>An individual with respect to whom a physician has determined through genetic or biochemical testing that the individual does not have normal sex chromosome structure, sex steroid hormone production, or sex steroid hormone action for a biological male or biological female.</text></clause></subparagraph></paragraph><paragraph id="HCAD8658E9F1D4A50B0E926779F4F8FDF"><enum>(2)</enum><header>Minor</header><text display-inline="yes-display-inline">The term <term>minor</term> means any person under the age of eighteen years.</text></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H95EB44CC63E94D4EA9A1C5A92B1B9F42"><enum>(2)</enum><text>by amending the table of sections for such chapter by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HA851088B9378420F9F415AA1805C5EE3"><toc regeneration="no-regeneration"><toc-entry level="section">2260B. Gender reassignment medical interventions on minors.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
