<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 775</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210316">March 16, 2021</action-date><action-desc><sponsor name-id="S373">Mr. Cassidy</sponsor> (for himself and <cosponsor name-id="S309">Mr. Casey</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require institutions of higher education to disclose hazing-related misconduct, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Educational Notification and Disclosure of Actions risking Loss of Life by Hazing Act</short-title></quote> or the <quote><short-title>END ALL Hazing Act</short-title></quote>.</text></section><section id="idf7e0c02a54704fc5b151e339f9840292"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="idfc8944e4dd50466d81fa2ad506ba2ad4"><enum>(1)</enum><text>Hazing is a problem in the United States, but most especially in our Nation’s educational system.</text></paragraph><paragraph id="id6d50531b378a4346b4b69a00fc6dfd29"><enum>(2)</enum><text>Hazing undermines the educational experience of the victims and the perpetrators. Hazing often perpetuates a cycle in which students who have been hazed feel the need to haze other students as a rite of passage to join a student organization.</text></paragraph><paragraph id="id64c1279dfccf41aeaf05def1b8b3a9b3"><enum>(3)</enum><text>While hazing takes many forms, including menial labor, disparagement, public or private humiliation, and forced exercise, the combination of alcohol or drug consumption as a form of hazing has caused bodily injury to thousands of students and has been fatal in many instances.</text></paragraph><paragraph id="id15a384f8389446f78cf789bc3c2c0ebc"><enum>(4)</enum><text>Numerous students have died as a result of collegiate hazing. Some of the recent tragedies include Nicky Cumberland, Max Gruver, Tim Piazza, Dalton Debrick, Collin Wiant, Marquise Braham, and Harrison Kowiak.</text></paragraph></section><section id="idb72717f9a9404caea6011a24fdc9318e"><enum>3.</enum><header>Hazing reporting requirements for institutions of higher education</header><text display-inline="no-display-inline">Section 485 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092</external-xref>) is amended—</text><paragraph id="idffcd1f0c024f43a88830fbb6cb410c80"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph id="idd54736dab5b0411a90cb7c6288f40cd5"><enum>(A)</enum><text>in subparagraph (U), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id5491b3c1f5b14caa94e9feabc5be44ff"><enum>(B)</enum><text>in subparagraph (V), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id64eb5d624a334de09018c7182cb70d63"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3f49f4776f5d4f60b59cf28c20b952c3"><subparagraph id="idc0b04c7351424fd4aae329453325ecea"><enum>(W)</enum><text>the hazing reports prepared by the institution pursuant to subsection (n).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idd755d61c0dbd4d8a94842fc2d49b8f81"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idac539b93d8c943a291c7546665ff76c6"><subsection id="id9afebf4ddafa4c3f8589d740b90ef23b"><enum>(n)</enum><header>Disclosures of hazing-Related misconduct</header><paragraph id="id03e42fa02e0143079e4acc178683f20a"><enum>(1)</enum><header>Mandatory hazing reports</header><text>Each eligible institution participating in any program under this title, other than a foreign institution of higher education, shall on August 1, 2022, begin to collect information with respect to hazing-related misconduct and anti-hazing policies of that institution and prepare, in accordance with this subsection, a report containing the information required by this subsection and make the report publicly available beginning on January 1, 2023, and each July 1 and January 1 thereafter, or on dates determined by State law.</text></paragraph><paragraph id="idcf27c47ffbc74d23bb17c1c8d47b309a"><enum>(2)</enum><header>Report content</header><subparagraph id="id9e3fdd40c6b84920a494a0caad66951f"><enum>(A)</enum><header>In general</header><text>A report required by paragraph (1) shall include each finding by the institution that a student organization committed—</text><clause id="idae63feafdd7743deb0eac93c2a3e4b3f"><enum>(i)</enum><text>a violation of the institution’s standards of conduct, or of Federal, State, or local law, relating to hazing; or</text></clause><clause id="id99cd7a3e0ca84fc69b431a6b748d7cae"><enum>(ii)</enum><text>other hazing-related conduct that threatens a student’s physical safety, including a violation involving the abuse or illegal use of alcohol or drugs.</text></clause></subparagraph><subparagraph id="idc40ae215dd1849dca78ba6165a5cc4a6"><enum>(B)</enum><header>Incident information</header><text>A report required by paragraph (1) shall include, for each finding by the institution of a violation described in subparagraph (A), the following:</text><clause id="id2666916fa9fc4888ae699177c40e0a9d"><enum>(i)</enum><text>The name of the student organization that committed the violation.</text></clause><clause id="id7f994f83eeee4f9b9e2f31bb1afa5962"><enum>(ii)</enum><text>A general description of the violation, the charges, the findings of the institution, and the sanctions placed on the organization.</text></clause><clause id="idd3c5801791b24c5289b8d022a54c46e9"><enum>(iii)</enum><text>The dates on which—</text><subclause id="id655bbc824c2042b9aacdc9593903f344"><enum>(I)</enum><text>the violation was alleged to have occurred;</text></subclause><subclause id="id8e66ac0d6a7e4718a65fd4d5e144bef0"><enum>(II)</enum><text>the student organization was charged with misconduct;</text></subclause><subclause id="id36c54c3e9a0c449192662651e7344032"><enum>(III)</enum><text>the investigation was initiated; and</text></subclause><subclause id="ida7efcb7fd06341a0a2a596a4ba6f06b0"><enum>(IV)</enum><text>the investigation ended with a finding that a violation occurred.</text></subclause></clause></subparagraph><subparagraph id="id36cf7a47066f49c8bad04436a3b57b39"><enum>(C)</enum><header>Exclusions</header><text>A report required by paragraph (1) shall not include—</text><clause id="id559e2cf3ae1d425eb3a17665f07008a5"><enum>(i)</enum><text>any information related to allegations or investigations of hazing that do not result in a formal finding of a violation of the standards of conduct of the institution; or</text></clause><clause id="id67aee2dc99e94ec9ad73ef8afa4bedef"><enum>(ii)</enum><text>any personally identifiable information on any individual student or member of a student organization.</text></clause></subparagraph><subparagraph id="id7696c0a325ce457791ffecbfb5d25033"><enum>(D)</enum><header>FERPA compliance</header><text>The report required by paragraph (1) shall be subject to the requirements of section 444 of the General Education Provisions Act (commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>).</text></subparagraph></paragraph><paragraph id="idc306e2659d0d42d389c11fc85580058c"><enum>(3)</enum><header>Availability</header><subparagraph id="id798897c114264c9f9c2a5c1ed9f0c005"><enum>(A)</enum><header>Public website</header><text>Each institution shall provide, in a prominent location on the institution’s website, a link to the web page that contains each report required under paragraph (1). Such web page shall include a statement notifying the public—</text><clause id="id9f6faf7f4d7a407e8c881e28603ebaf8"><enum>(i)</enum><text>of the availability of information, including findings or sanctions, except information protected under section 444 of the General Education Provisions Act (commonly known as the <quote>Family Education Rights and Privacy Act of 1974</quote>);</text></clause><clause id="id4cd2a419f7ea4aa4bd00090fc0ca26c8"><enum>(ii)</enum><text>a description of how a member of the public may obtain such information; and</text></clause><clause id="id3f720609d89e4aedb9250a5ca944fa24"><enum>(iii)</enum><text>a statement that the institution is required to provide such information pursuant to this subsection.</text></clause></subparagraph><subparagraph id="id8343441b70594cb7830481f3dd82b8df"><enum>(B)</enum><header>Maintenance period</header><text>Each institution shall maintain each report required under paragraph (1) on its website for a period of 5 academic years.</text></subparagraph></paragraph><paragraph id="id96f5124fb6d04daeb7eb6173d77d792e"><enum>(4)</enum><header>Reports to law enforcement</header><text>Each institution participating in any program under this title, other than a foreign institution of higher education, shall report to campus police and appropriate law enforcement authorities any allegation of hazing that involved serious bodily injury or a significant risk of serious bodily injury that is reported to the institution, campus authorities, or any student organization officially recognized by the institution. Such an allegation shall be reported to campus police and appropriate law enforcement authorities not later than 72 hours from the time the institution is first notified of the allegation.</text></paragraph><paragraph id="id51ccbf87249b484c818e17abb47966e5"><enum>(5)</enum><header>Applicability to multi-institution student organizations</header><text>In the case of an allegation that a multi-institution student organization was involved in a hazing incident, the requirements of this subsection shall apply only to the institution or institutions at which the students involved in such allegation are enrolled (or were formerly enrolled), including any student who was a victim in the alleged incident.</text></paragraph><paragraph id="id4a9e4e65832c45e4b8987b26a565ee18"><enum>(6)</enum><header>Definitions</header><text>For the purposes of this Act—</text><subparagraph id="idda98e8aec6bd426382db1e3f71f72f7a"><enum>(A)</enum><header>Hazing</header><text>The term <term>hazing</term> means any intentional, knowing, or reckless act committed by a student, or a former student, of an institution of higher education, whether individually or in concert with other persons, against another student, that—</text><clause id="idb0dfff5f93134c23bc1f063ed9391c77"><enum>(i)</enum><text>was committed in connection with an initiation into, an affiliation with, or the maintenance of membership in, any student organization; and</text></clause><clause id="idc7e294a457f548f39d255878338dd67c"><enum>(ii)</enum><text>causes, or contributes to a substantial risk of, physical injury, mental harm, or personal degradation.</text></clause></subparagraph><subparagraph id="id71e4a306877e4fde8a43f04ff355fee2"><enum>(B)</enum><header>Student organization</header><clause id="id665a985a1a20426a8725aebaa5dbefd3"><enum>(i)</enum><header>In general</header><text>The term <term>student organization</term> means an organization that is officially recognized by or otherwise affiliated with an institution of higher education and that has a membership that is made up primarily of students enrolled at such institution.</text></clause><clause id="id24b3de540cb34f39bec7edfc40470692"><enum>(ii)</enum><header>Multi-institution student organizations</header><text>The term <term>multi-institution student organization</term> means a student organization that includes students from more than one institution of higher education, including citywide, regional, State, and national chapters of student organizations.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
