which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To enable certain hospitals that were participating in or applied for the drug discount program under section 340B of the Public Health Service Act prior to the COVID–19 public health emergency to temporarily maintain eligibility for such program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Eligibility exception for the drug discount program due to the COVID–19 public health emergency</header><subsection id="id8F23013AEBDD4C4E9FA72257F900A3A4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a hospital described in subsection (b) that, for an applicable calendar quarter, otherwise meets the requirements for being a covered entity under subparagraph (L), (M), or (O) of subsection (a)(4) of section 340B of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/256b">42 U.S.C. 256b</external-xref>) and is in compliance with all other requirements of the program under such section, but that, for such calendar quarter, does not meet the applicable requirement for the disproportionate share adjustment percentage described in subsection (c), shall be deemed a covered entity under such respective subparagraph for such applicable calendar quarter.</text></subsection><subsection id="id82213E1C7F194FF6B8E6E273996BEED8"><enum>(b)</enum><header>Hospitals</header><text>A hospital described in this subsection is—</text><paragraph id="idA580341DF82748ECAF7021B8E8537623"><enum>(1)</enum><text>an entity that, on the day before the first day of the COVID–19 public health emergency, was a covered entity described in subparagraph (L), (M), or (O) of subsection (a)(4) of section 340B of the Public Health Service Act participating in the drug discount program under such section; or </text></paragraph><paragraph id="id35E834C7F4F6474EBA5966236244ECC4"><enum>(2)</enum><text>an entity that—</text><subparagraph id="id0A8E1A4BBC624C94967444D1B917AAED"><enum>(A)</enum><text>prior to the COVID–19 public health emergency, submitted an application for participation in such program as a covered entity described in subparagraph (L), (M), or (O) of section 340B(a)(4) of the Public Health Service Act;</text></subparagraph><subparagraph id="id2E52358FA6834ECB9BB6689AA3636DE5"><enum>(B)</enum><text>prior to or during such emergency, was approved for such participation; and </text></subparagraph><subparagraph id="id8B9703EF66F04B13B696D36561715D8C"><enum>(C)</enum><text>during such emergency, began participating in such program. </text></subparagraph></paragraph></subsection><subsection id="id70C81D280BA442F6A0B2B23B9C422063"><enum>(c)</enum><header>Applicable requirement for disproportionate share adjustment percentage</header><text>The applicable requirement for the disproportionate share adjustment percentage described in this subsection is—</text><paragraph id="id6190F0587A98454FB2E8BDD18122AAF8"><enum>(1)</enum><text>in the case of a hospital described in subsection (a) that otherwise meets the requirements under subparagraph (L) or (M) of section 340B(a)(4) of the Public Health Service Act, the requirement under subparagraph (L)(ii) of such section; and</text></paragraph><paragraph id="id34F05692537F4BE9B48B1A5E7ABB8EA8"><enum>(2)</enum><text>in the case of a hospital described in subsection (a) that otherwise meets the requirements under subparagraph (O) of such section 340B(a)(4), the requirement with respect to the disproportionate share adjustment percentage described in such subparagraph (O).</text></paragraph></subsection><subsection id="id6E03498B2E0746BCA589045380DF45E8"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id377548F9FE844AC88D859A1A0B8C60BF"><enum>(1)</enum><header>Applicable calendar quarter</header><text>The term <term>applicable calendar quarter</term> means a calendar quarter for which eligibility for the drug discount program under section 340B of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/256b">42 U.S.C. 256b</external-xref>) is based on a cost reporting period for which the COVID–19 public health emergency is in effect for all or part of such cost reporting period.</text></paragraph><paragraph id="id22DA8410270D4B578A010DE04938845F"><enum>(2)</enum><header>Covered entity</header><text>The term <term>covered entity</term> has the meaning given such term in section 340B(a)(4) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/256b">42 U.S.C. 256b(a)(4)</external-xref>).</text></paragraph><paragraph id="id20AF0AB7C5B34B73A4088EFF241B73B4"><enum>(3)</enum><header>COVID–19 public health emergency</header><text>The term <term>COVID–19 public health emergency</term> means the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on January 31, 2020, with respect to COVID–19.</text></paragraph></subsection></section></legis-body></bill>
