which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify responsibilities related to unaccompanied alien children, to provide additional protections and tracking mechanisms for such children, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Responsibility for Unaccompanied Minors Act</short-title></quote>.</text></section><section id="idFF5AAF77EC624968B0FDBA18261F19B0"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="id3E637656D11740C4A420A6002E10D354"><enum>(1)</enum><text display-inline="yes-display-inline">The Department of Health and Human Services, under Federal law as in effect on the date of the enactment of this Act, is responsible for the care of each unaccompanied alien child in the United States, including any such child placed with a sponsor, until the earlier of—</text><subparagraph id="id89897574B6CF459C8EA2BE2521092866"><enum>(A)</enum><text display-inline="yes-display-inline">the date on which the immigration proceedings of the child are concluded; or</text></subparagraph><subparagraph id="id679C5681BC9D4F058FF54FB50FBFBE5D"><enum>(B)</enum><text display-inline="yes-display-inline">the date on which the child attains 18 years of age.</text></subparagraph></paragraph><paragraph id="id94E7824E46404F20ACA26FBFA337BCEA"><enum>(2)</enum><text>Follow-up services provided to certain unaccompanied alien children released to sponsors under section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232</external-xref>) are valuable to help ensure child safety, integration, and appearance at immigration court proceedings.</text></paragraph></section><section id="idC6DAEAB0DE9342D2B8E2E3402689E5D7"><enum>3.</enum><header>Responsibilities of the Director of the Office of Refugee Resettlement</header><text display-inline="no-display-inline">Section 462(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3A188E28D4B54F3F9CF859E862E71BC4"><paragraph id="id87673209272D4C6E8698254125963E9A"><enum>(5)</enum><header>Clarification of period of care</header><subparagraph id="idBB21DCB67BC041E9924C6F783F324322"><enum>(A)</enum><header>In general</header><text>Pursuant to the obligation established under section 235(b)(1) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(b)(1)</external-xref>), the Director of the Office of Refugee Resettlement is authorized to care for and provide follow-up services to an unaccompanied alien child, including any such child placed with a sponsor, from the time the child is identified as an unaccompanied alien child until the earlier of—</text><clause id="id40CC8FC18B3548E1B00F633972308526"><enum>(i)</enum><text>the date on which the immigration proceedings of such child are concluded; or</text></clause><clause id="id8B0BF98CCF4843F4B01B6349E88D9866"><enum>(ii)</enum><text>the date on which the child attains 18 years of age.</text></clause></subparagraph><subparagraph id="id68F0049CFFDC49CA97DE4751C1FC486F"><enum>(B)</enum><header>Rule of construction</header><text>Nothing in this paragraph limits the authority of a State or local welfare or emergency services provider to address an allegation of abuse or neglect or an emergency situation.</text></subparagraph></paragraph><paragraph id="id5097286D568344BF87A1BBEAC28BF2C1"><enum>(6)</enum><header>Follow-up services</header><text display-inline="yes-display-inline">Before placing an unaccompanied alien child with a sponsor, the Director of the Office of Refugee Resettlement shall evaluate, to the extent possible, the need for such child to receive follow-up services once such child is placed with a sponsor.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id978F373A7B4F4945843654024B360AD1"><enum>4.</enum><header>Responsibilities of the Secretary of Health and Human Services</header><subsection id="id0106F7F243BC4845977F8BA783D8D749"><enum>(a)</enum><header>Sponsor care agreement; follow-Up services</header><text>Section 235(c)(3) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(c)(3)</external-xref>) is amended—</text><paragraph id="idA4AF1726232E41F88C846E9E04F3B746"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="id3E9CC79E947C4F2AAEA9FAEE21D3BC5A"><enum>(A)</enum><text>by striking <quote>custodian</quote> and inserting <quote>sponsor</quote>; and</text></subparagraph><subparagraph id="idDEF22758BAD549D89734332815A0F55F"><enum>(B)</enum><text>by striking <quote>custodian’s</quote> and inserting <quote>sponsor’s</quote>;</text></subparagraph></paragraph><paragraph commented="no" id="id0DAE7A109E9B41718AF3A271A7B282D5"><enum>(2)</enum><text>in subparagraph (B), by adding at the end the following: <quote>Neither an unaccompanied alien child nor any sponsor of such child may refuse the follow-up services required or authorized under the preceding sentence.</quote>;</text></paragraph><paragraph id="id8E1907F326A24E358F993B3FFD0602B4"><enum>(3)</enum><text>by redesignating subparagraph (C) as subparagraph (E); and</text></paragraph><paragraph id="id730C35B0369B4E26821F1CE3EFD9ABBF"><enum>(4)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6C702760FFB54AB89641183305AFB6FF"><subparagraph id="idfdfc4f25c125401a934478cc090c74ba"><enum>(C)</enum><header>Sponsor care agreement</header><clause id="id1BB4DD29522D4BE09773217FB5EA3A29"><enum>(i)</enum><header>In general</header><text>Before the Secretary of Health and Human Services places an unaccompanied alien child with a sponsor, the proposed sponsor shall execute a sponsor care agreement.</text></clause><clause id="id14F21817A86040058A9608AD2E300398"><enum>(ii)</enum><header>Requirements</header><subclause id="id1EE8E1CFBE774678852B28FC2F562619"><enum>(I)</enum><header>In general</header><text>A sponsor care agreement required under clause (i) shall include an agreement by the sponsor—</text><item id="idef7187de189141fab8d4318eed7c3506"><enum>(aa)</enum><text>to provide for the physical and mental well-being of such child, including providing food, shelter, clothing, education, medical care, and other services, as needed;</text></item><item id="id442c353b94734a92bf10290653052b7f"><enum>(bb)</enum><text>to ensure the child’s presence at all future immigration proceedings related to such child;</text></item><item id="id82139266661443a7b45b9af4ce4221a4"><enum>(cc)</enum><text>to notify local law enforcement or the appropriate State or local child protective services agency if such child has been, or is, at risk of being physically, mentally, or sexually abused, abandoned, neglected, threatened, or kidnapped;</text></item><item id="idC4D272D3B42644399F2C7DB804DB5D68"><enum>(dd)</enum><text>to notify the Secretary of Health and Human Services if the sponsorship status of such child has changed for any reason, including a change of custodian or sponsor, kidnapping, or flight;</text></item><item id="id2d8549a82fa142f3b5f99ea19e640d4f"><enum>(ee)</enum><text>to accept any follow-up services authorized or required under subparagraph (B);</text></item><item id="id5691B02957B3401090AE0D235BD687CD"><enum>(ff)</enum><text>to comply with, and ensure the compliance of, such child with all lawful orders of a court of the United States or Federal agency with jurisdiction related to the child; and</text></item><item id="idE018FEE572A24AC3808A556C8C32B405"><enum>(gg)</enum><text>to notify the Secretary of Health and Human Services, the Director of U.S. Citizenship and Immigration Services, and the Director of the Executive Office for Immigration Review of the current mailing address of such child if such address changes.</text></item></subclause><subclause id="id7A16E97FBCEE4258B643A75C0406475F"><enum>(II)</enum><header>Other matters</header><text>A sponsor care agreement required under clause (i) may include such other matters as the Secretary of Health and Human Services considers appropriate.</text></subclause></clause></subparagraph><subparagraph id="id3d0099539cc2453698266c6380a09522"><enum>(D)</enum><header>Termination of sponsor</header><clause id="idC5250763589B4813954D46BE24F316B1"><enum>(i)</enum><header>Nonparental sponsors</header><subclause id="idBA0649198B4944A388D01C4EB4E73D2A"><enum>(I)</enum><header>In general</header><text>Except as provided in subclause (II), with respect to an unaccompanied alien child released to a sponsor who is not the parent or legal guardian of such child, the Secretary of Health and Human Services shall terminate the sponsorship arrangement and assume physical custody of such child if such sponsor fails to comply with the provisions of the sponsor care agreement required under subparagraph (C).</text></subclause><subclause id="id42CB27C1A0944006A0E778F0921B9E6D"><enum>(II)</enum><header>Exceptions</header><text>The Secretary of Health and Human Services shall not terminate a sponsorship arrangement under subclause (I)—</text><item id="idFAA72842037E492AA855DAD2183D339D"><enum>(aa)</enum><text>in the case of a minor violation of subparagraph (C)(ii)(I)(gg) that the sponsor timely remedies; or</text></item><item id="id45702457BF4F4160AC5D6A26EEA14448"><enum>(bb)</enum><text>if the Secretary finds that terminating the sponsorship arrangement would not be in the best interest of the child.</text></item></subclause><subclause id="idFD5D8404E46646B59A61AD7AB6088E28"><enum>(III)</enum><header>Duties of the Secretary</header><text>In the case of a termination of a sponsorship arrangement under subclause (I), the Secretary of Health and Human Services shall—</text><item id="id1B0724F5367449F1AEB51BFDA4EDA047"><enum>(aa)</enum><text>place the unaccompanied alien child with a new sponsor or in another placement that is in the best interest of the child; and</text></item><item id="id640E4B1CF064415FA6549B258DDCF256"><enum>(bb)</enum><text>on the date on which a sponsorship arrangement is terminated, provide to the individual the sponsorship of whom is terminated a written notification and justification of the decision to terminate the sponsorship, and information relating to the appeals process under subclause (IV).</text></item></subclause><subclause id="id3FECC6AD25CC435E9695CE62E7AF3E77"><enum>(IV)</enum><header>Appeals</header><item id="id299859A109C24F4190A537D6AD50CC19"><enum>(aa)</enum><header>In general</header><text>The Secretary of Health and Human Services shall establish a process by which an individual the sponsorship of whom is terminated under subclause (I) may appeal the termination.</text></item><item id="idF4A140E328674393BED14643F8F559E2"><enum>(bb)</enum><header>No judicial review</header><text>An appeal under item (aa) shall not be subject to judicial review.</text></item></subclause><subclause id="idA1E404B6C12D42E8AEE63C577FC99055"><enum>(V)</enum><header>Right to reapply for sponsorship</header><text>An individual the sponsorship of whom is terminated under clause (i)(I) may reapply to serve as a sponsor after the date on which the individual has remedied the one or more conditions on which the termination was based.</text></subclause></clause><clause id="id7396AF6370E943B384B4C0A7AB790F9F"><enum>(ii)</enum><header>Parental sponsors</header><text>With respect to an unaccompanied alien child released to a sponsor who is the parent or legal guardian of such child, in the case of the failure by the sponsor to comply with the provisions of the sponsor care agreement required under subparagraph (C), the Secretary of Health and Human Services shall notify the State agency responsible for administering the State plans under parts B and E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/621">42 U.S.C. 621</external-xref> et seq., 670 et seq.).</text></clause><clause id="id1F9C4D2FF86940FC8B9CE06D4CEF732D"><enum>(iii)</enum><header>Reporting</header><subclause id="id745CE3A9A20D40E790C8E631EA45E3EA"><enum>(I)</enum><header>Definition of appropriate committees of Congress</header><text>In this clause, the term <term>appropriate committees of Congress</term> means—</text><item id="id978AC919E5294773B266AA3633C3A74F"><enum>(aa)</enum><text>the Committee on Homeland Security and Governmental Affairs, the Committee on the Judiciary, and the Committee on Health, Education, Labor, and Pensions of the Senate; and</text></item><item id="idB44AB1EA5AEF4280B846A705BC757BBD"><enum>(bb)</enum><text>the Committee on Homeland Security, the Committee on the Judiciary, and the Committee on Energy and Commerce of the House of Representatives.</text></item></subclause><subclause id="idCFCBEE2AA3D24F06A74DCFD33CC62C47"><enum>(II)</enum><header>Quarterly report</header><text>Not later than 90 days after the date of the enactment of the <short-title>Responsibility for Unaccompanied Minors Act</short-title>, and quarterly thereafter, the Secretary of Health and Human Services shall submit to the appropriate committees of Congress a report that includes, for the preceding quarter—</text><item id="id814E3AA4AC8C4402A61061C6BCB73CDD"><enum>(aa)</enum><text>a description of each instance in which a sponsor failed to comply with a provision of the sponsor care agreement under subparagraph (C)(ii) and the action taken under clause (i) or (ii), including—</text><subitem id="id7693C81959C54163842D624AD38ABDED"><enum>(AA)</enum><text>with respect to a sponsor who is not a parent or legal guardian of the child, whether the sponsorship arrangement was terminated, an analysis whether termination is contrary to the best interests of the child, and whether the individual the sponsorship of whom was terminated filed an appeal under clause (i)(IV); and</text></subitem><subitem id="idFD043253FC8F48A393B57492893EBD62"><enum>(BB)</enum><text>with respect to a sponsor who is a parent or legal guardian of the child, whether the Secretary of Health and Human Services notified the State agency responsible for administering the State plans under parts B and E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/621">42 U.S.C. 621</external-xref> et seq., 670 et seq.); and</text></subitem></item><item id="idA0B588306B0840928D85829E80CBB624"><enum>(bb)</enum><text>in the case of a determination by the Secretary of Health and Human Services that a sponsor is not in compliance with a provision of the sponsor care agreement but termination of sponsorship is not in the best interest of the child, an explanation of the reasons for such determination.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id5CE34C4342744A94A9D863CE55F740F1"><enum>(b)</enum><header>Notifications</header><text>Section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232</external-xref>) is amended—</text><paragraph id="id13DC626D6F7F43C8B891AC8772824C7F"><enum>(1)</enum><text>by redesignating subsection (h) as subsection (j) and moving such subsection so that it appears immediately after subsection (i); and</text></paragraph><paragraph id="id079271C4CE0A4AE5BEF8129B7A2689FF"><enum>(2)</enum><text>by inserting after subsection (g) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7041D45F415047B59FA4EE1C0C50604C"><subsection id="idEBD5624700304F41A4C378C63C4C896A"><enum>(h)</enum><header>Notifications</header><paragraph id="id12575396BC9F46C093290C0766238D44"><enum>(1)</enum><header>In general</header><text>Before releasing any unaccompanied alien child to a sponsor, the Secretary of Health and Human Services shall submit to the State agency responsible for administering the State plans under parts B and E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/621">42 U.S.C. 621</external-xref> et seq., 670 et seq.)—</text><subparagraph id="id10EE001388234B739065D5D0FC6A185C"><enum>(A)</enum><text>written notification of the specific location at which the unaccompanied alien child will reside while in such jurisdiction; and</text></subparagraph><subparagraph id="idE6351C7D754A4D99A42607388863A6DE"><enum>(B)</enum><text>written certification that—</text><clause id="idB9A1CBC8CCE34932987173C870041D12"><enum>(i)</enum><text>the unaccompanied alien child will have undergone appropriate health screenings and received appropriate vaccinations; and</text></clause><clause id="id29575ABC14294EAD880F56DDCA4FA67A"><enum>(ii)</enum><text>the Secretary of Health and Human Services has completed background checks under section 5(a)(3) of the <short-title>Responsibility for Unaccompanied Minors Act</short-title> with respect to each individual who will be a sponsor of an unaccompanied alien child to be placed in the State and has determined that the individual does not present a risk to the unaccompanied alien child.</text></clause></subparagraph></paragraph><paragraph id="id4691D8837FB844EE8B8CC55CB780A1A0"><enum>(2)</enum><header>Exempt from disclosure</header><text>Any personally identifiable information submitted under paragraph (1)—</text><subparagraph id="idD030DAB88D3B496C8DC2CA229F6ED4A8"><enum>(A)</enum><text>shall be exempt from disclosure under section 552(b)(6) of title 5, United States Code; and</text></subparagraph><subparagraph id="idC17C51E47E904267919F89A9831A4BF5"><enum>(B)</enum><text>may not be disclosed by the recipient State agency (directly or indirectly) to any nongovernmental entity.</text></subparagraph></paragraph><paragraph id="id79C2CFC17FED4026B445F2ACE87557F6"><enum>(3)</enum><header>Purpose</header><text>The purpose of this subsection is to facilitate cooperation between the Federal Government and the States to promote the best interests of unaccompanied alien children.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idDB54827202D74F02946F3AE15149B130"><enum>(c)</enum><header>Conforming amendments</header><text>Section 235(c)(4) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(c)(4)</external-xref>) is amended—</text><paragraph id="id645A4754BA1B4C659440FD6D470D7ED7"><enum>(1)</enum><text>by striking <quote>custodians</quote> and inserting <quote>sponsors</quote>; and</text></paragraph><paragraph id="id24128161AEB84403AABE29825874269C"><enum>(2)</enum><text>by striking <quote>custodian's</quote> and inserting <quote>sponsor’s</quote>.</text></paragraph></subsection></section><section id="idd3177af2d18440d5bbcf9a8676dc62e0"><enum>5.</enum><header>Releasing unaccompanied minor children to sponsors</header><subsection id="id4C0DE98E061943B3BCE681894FEAD7B7"><enum>(a)</enum><header>Mandatory background checks</header><text display-inline="yes-display-inline">Before releasing any unaccompanied alien child (as defined in section 462(g) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)</external-xref>)) to a sponsor, including a sponsor who is the parent or legal guardian of the unaccompanied alien child and any other sponsor, the Secretary of Health and Human Services shall—</text><paragraph id="id2263F19E8D9749B098D26575304B9E24"><enum>(1)</enum><text display-inline="yes-display-inline">verify the sponsor’s identity and relationship to the unaccompanied alien child;</text></paragraph><paragraph id="id65e7a07c7dae4293a3fdd61ce061535f"><enum>(2)</enum><text>interview the sponsor; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4b30091001424178b7d26267ea32d402"><enum>(3)</enum><text>conduct a background check on the sponsor and all other adults living in the household in which the unaccompanied alien child will reside, which shall include a fingerprint check against the information maintained by law enforcement agencies.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id973C928AA6654DB5AF9E31333DAF05BD"><enum>(b)</enum><header>Limitation on liability</header><paragraph id="id8e0e434953ee4e8b9f162597fff59fbc"><enum>(1)</enum><header>Injunctive relief</header><text>Any individual with standing to challenge an action by the Department of Health and Human Services that violates this Act or section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232</external-xref>), as amended by section 4, or any entity representing such an individual, may bring an action in an appropriate Federal court for injunctive relief.</text></paragraph><paragraph id="id29D4369176804E16983EF063B14B2C77"><enum>(2)</enum><header>Prohibition against monetary damages</header><text>A court may not award monetary damages to a plaintiff in a lawsuit described in paragraph (1).</text></paragraph></subsection></section><section id="idbbe66b7b59ec46849401185aa283bf81"><enum>6.</enum><header>Emergency immigration judge resources</header><text display-inline="no-display-inline">The Attorney General shall increase the number of immigration judge teams by not fewer than 225, as compared to the number of immigration judge teams on the date of the enactment of this Act.</text></section></legis-body></bill>
