which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize funds to prevent housing discrimination through the use of nationwide testing, to increase funds for the Fair Housing Initiatives Program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="H03F79806D81D4BF98952351DB00C4DD9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Housing Fairness Act of 2021</short-title></quote>.</text></section><section id="id143BD3286E4F480BBDB0E7AAC3629B11"><enum>2.</enum><header>Definition</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></section><section id="HCA7966B9056F432496E8441231D36807"><enum>3.</enum><header>Testing for discrimination</header><subsection id="H124CAFB93E5742CA8CC004C996BDA82E"><enum>(a)</enum><header>Eligible activity under FHIP</header><paragraph id="id73EE2F51940E4EA89885BF6334B0728C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 561(a) of the Housing and Community Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a(a)</external-xref>) is amended—</text><subparagraph id="id75F66BE7A9B04E96A2D7D70CBB8909A7"><enum>(A)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and adjusting the margins accordingly;</text></subparagraph><subparagraph id="HA132375FEB68426DBDA4F2357E9EDA24"><enum>(B)</enum><text>in the matter preceding subparagraph (A), as so redesignated—</text><clause id="id1953343C5C7A4AC685EEE2966FB77FCA"><enum>(i)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2062DBA382F8450DADF6855345D022BB"><paragraph id="id8CC0F822FAD242CF89F310893ED895B3"><enum>(1)</enum><header>Grants, contracts, and cooperative agreements</header><text>The Secretary</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="idB44716E190F14918A3B112EBEE5E44FB"><enum>(ii)</enum><text>by inserting after <quote>discriminatory housing practices</quote> the following: <quote>or, in the case of grants, contracts, or cooperative agreements for activities under subparagraph (C), with qualified private, nonprofit fair housing enforcement organizations that have demonstrated expertise in managing and implementing regional or national testing programs to address systemic fair housing issues</quote>;</text></clause></subparagraph><subparagraph id="HD03C1E0DD93648AE8394E806664A36C8"><enum>(C)</enum><text>in subparagraph (A), as so redesignated, by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HC2C430006CBF4F21A94EDF00F0A093E9"><enum>(D)</enum><text>in subparagraph (B), as so redesignated, by striking <quote>paragraph (1).</quote> and inserting <quote>subparagraph (A); and</quote>; and</text></subparagraph><subparagraph id="H32D1557019FD41AB9A86D199450065D8"><enum>(E)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7A9CA5F31EA040B59541D79EA6A55508"><subparagraph id="H67889A93C7FA484695AD5616829F3456"><enum>(C)</enum><text display-inline="yes-display-inline">programs of regional or national testing and investigations to—</text><clause id="id0896A04C9E5D4F92A0556F59E8911A67"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="idDE79DE5669F94C74A7D3B3C80931E7D5"><enum>(I)</enum><text display-inline="yes-display-inline">detect and document differences in the treatment of persons seeking to rent or purchase housing or obtain or refinance a home mortgage loan; and</text></subclause><subclause id="id8F6119CAB2094818BC9E0FB3F46C2166" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">measure patterns of differential treatment because of the status of a renter, home buyer, or borrower as a member of a protected class under the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601</external-xref> et seq.); and</text></subclause></clause><clause id="id43CA1491D7A04F15AE5AD0853A0D7C7D"><enum>(ii)</enum><text display-inline="yes-display-inline">measure the prevalence, nature, and extent of discriminatory practices covered under the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601</external-xref> et seq.).</text></clause></subparagraph><paragraph id="idF727CA18D7DF464EB8F410FE15DDE0E3"><enum>(2)</enum><header>Enforcement actions</header><subparagraph id="id421B9B017E90493C9F8A55B8B71B134E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The results of any testing and investigations under paragraph (1)(C) may be used as the basis for the Secretary, any Federal agency authorized to bring such an enforcement action, or any State or local government or agency, public or private nonprofit organization or institution, or other aggrieved party within the meaning of the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601</external-xref> et seq.) or other substantially equivalent State or local fair housing law, or other public or private entity with which the Secretary has entered into a contract or cooperative agreement under this section to commence, undertake, or pursue any investigation or enforcement action to remedy any discriminatory housing practice (as defined in section 802 of the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3602">42 U.S.C. 3602</external-xref>)) uncovered as a result of the testing and investigations.</text></subparagraph><subparagraph id="id06C3157EC0D24535BA67F49ADACC9623"><enum>(B)</enum><header>Testing</header><text display-inline="yes-display-inline">Testing conducted under paragraph (1)(C) shall not constitute a violation of any provision of criminal law or the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1601">15 U.S.C. 1601</external-xref> et seq.).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idF0D0DDD2A3FD4A5F9D97ECCE180E2217"><enum>(2)</enum><header>Technical and conforming amendment</header><text>Section 561(f)(2) of the Housing and Community Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a(a)(2)</external-xref>) is amended by striking <quote>subsection (a)(1)</quote> and inserting <quote>subsection (a)(1)(A)</quote>.</text></paragraph></subsection><subsection display-inline="no-display-inline" id="HF89BE59AEBA1401992037E53F6734939"><enum>(b)</enum><header>Regulations</header><paragraph display-inline="no-display-inline" id="id9725264C807C45279398279412A8EFCE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall issue regulations that apply the minimum tester training standards required under section 125.107 of title 24, Code of Federal Regulations (or any successor regulation), to organizations conducting testing under paragraph (1)(C) of section 561(a) of the Housing and Community Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a(a)</external-xref>), as added by subsection (a)(1)(E) of this section.</text></paragraph><paragraph display-inline="no-display-inline" id="id73760D6EF7814EB1BEBCCBF81C303F47"><enum>(2)</enum><header>Applicability to all testing activities</header><text display-inline="yes-display-inline">On and after the date on which the regulations issued under paragraph (1) take effect, the minimum tester training standards described in that paragraph shall apply to any testing activities conducted under section 561 of the Housing and Community Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a</external-xref>), as amended by subsection (a)(1) of this section.</text></paragraph></subsection></section><section id="HD602BAC5CA994DCD8296D5AC85B870A0"><enum>4.</enum><header>Fair Housing Initiatives Program</header><subsection id="H8F3729F8D2B34ACF804240D597D5256B"><enum>(a)</enum><header>Amendments to program</header><text display-inline="yes-display-inline">Section 561 of the Housing and Community Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a</external-xref>) is amended—</text><paragraph id="HC808B24DA7E245BB86760806C49EAA0C"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H2B1EEAFB5FA345F190B800C2F2845ECD"><enum>(A)</enum><text>in paragraph (1), by striking <quote>private nonprofit</quote> and inserting <quote>qualified</quote>; and</text></subparagraph><subparagraph id="H73511F3792AA4B22B82FA46954ECB924"><enum>(B)</enum><text>in paragraph (2), in the matter preceding subparagraph (A), by striking <quote>private nonprofit</quote> and inserting <quote>qualified</quote>;</text></subparagraph></paragraph><paragraph id="H7B5F5091240E409DA22C1DCBD2208AA3"><enum>(2)</enum><text>in subsection (c), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5D24BC3489474938A480F0F76103CDAA"><paragraph id="H5A4ED8DE2BDE49CAA96949C908628536"><enum>(3)</enum><header>Program-earned income</header><text display-inline="yes-display-inline">No restriction on the use of program-earned income received by a qualified fair housing enforcement organization shall apply after the grant period for the organization ends.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H3EB0DE95E49A4ACD9A3656D32986ABE0"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph id="H435D41C2A55B49DCBAB61CF017E4A806"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H25355B70C6A34818BAF4F1F6886C0687"><enum>(i)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end;</text></clause><clause id="H6B782B149CD7436A8EEB3B703812E531"><enum>(ii)</enum><text>in subparagraph (D), by striking the period and inserting <quote>; and</quote>; and</text></clause><clause id="H9E529D7EF3EE4DBA98D768B3814F9D72"><enum>(iii)</enum><text>by inserting after subparagraph (D) the following:</text><quoted-block style="OLC" id="H5936E20BE1A2410CBBD2D3AD98865FB6"><subparagraph id="HFA8E478AA7ED4112BAE0391326CEAC21"><enum>(E)</enum><text>websites and other media outlets.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HB83B0B1083D7416BA256827BEDEEE90B"><enum>(B)</enum><text>in paragraph (2), by striking <quote>or other public or private entities</quote> and inserting <quote>or other public or private nonprofit entities</quote>;</text></subparagraph><subparagraph id="H1362C074BA404C3B94333458C12977A9"><enum>(C)</enum><text>in paragraph (3), by striking <quote>or other public or private entities</quote> and inserting <quote>or other public or private nonprofit entities</quote>; and</text></subparagraph><subparagraph id="H590D567DBA474997995DAECB4E23876E"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC5E1E204DF8D4B60B29EA3B4E403ADED"><paragraph id="H499FBAEECFC540BBA88D115D5F65EE9F"><enum>(4)</enum><header>Limitation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, a State or local agency certified by the Secretary under section 810(f) of the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3610">42 U.S.C. 3610(f)</external-xref>) may receive assistance under this subsection only to carry out activities eligible for assistance under this subsection in areas in which no qualified fair housing enforcement organization is available to carry out those activities.</text></paragraph><paragraph id="H2FA8EAD48E5B47369B69E2B1486FFA6B"><enum>(5)</enum><header>Eligibility</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, if an award of funding under subsection (b) for multiple fiscal years has been made to a qualified fair housing enforcement organization, the organization shall be, subject only to the availability of amounts provided in appropriation Acts, eligible to receive funding under this subsection for each fiscal year covered by the award under subsection (b).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H6D8A06AE502043A7AD0B0107B5863E1E"><enum>(4)</enum><text>in subsection (e)—</text><subparagraph id="H8509748CC2504E5ABA153AB87C5213EE"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="idB7928B218D7246C58D3A3C4B19F40438"><enum>(i)</enum><text>by inserting <quote><header-in-text level="paragraph" style="OLC">Congressional notification</header-in-text>.—</quote> after <quote>(1)</quote>; and</text></clause><clause id="id9138A03C773842FD96748BD7F24EAAF8"><enum>(ii)</enum><text>by striking <quote>Banking, Finance and Urban Affairs</quote> and inserting <quote>Financial Services</quote>; and</text></clause></subparagraph><subparagraph id="HBB15F20D77EC4937A953C6475D259BB8"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3970301227DD41A79C9ABD0616840CBB"><paragraph id="HC726E96F7FD24AC9BA10A58CFF22C220"><enum>(2)</enum><header>Priority</header><text display-inline="yes-display-inline">In providing assistance under this section with respect to a metropolitan statistical area for which there are multiple applications for assistance, the Secretary shall give priority to applications submitted by qualified fair housing enforcement organizations that have experience in conducting fair housing enforcement activities.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE859156D260A42158AAA1E7AFA1EF5A8"><enum>(5)</enum><text>by striking subsection (g) and inserting the following:</text><quoted-block style="OLC" id="HFDFF867FB8B441EB9F740526DD05E8DA"><subsection id="H8208D7BC7CF2429396E7FA60EA67B54F"><enum>(g)</enum><header>Authorization of Appropriations</header><paragraph id="HA2A06540C6E149A7BA608C409B0F5C0E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section—</text><subparagraph id="H2C6B8BB0A09D461B854BF3147363C805"><enum>(A)</enum><text display-inline="yes-display-inline">$58,000,000 for each of fiscal years 2022 through 2026, of which—</text><clause id="H7C26E068DD6B4D24B0B5AC554EDFD562"><enum>(i)</enum><text>$55,000,000 shall be available for any activities under this section other than programs under subsection (a)(1)(C), of which—</text><subclause id="HB8D56C850B024BB7910562D435BF4F30"><enum>(I)</enum><text display-inline="yes-display-inline">not less than $38,000,000 shall be for private enforcement initiatives authorized under subsection (b);</text></subclause><subclause id="H3A0AD42844904E1EA443F7F70B98C9D9"><enum>(II)</enum><text display-inline="yes-display-inline">not less than $1,500,000 shall be for the fair housing organizations initiative under subsection (c);</text></subclause><subclause id="H21C7C7FBB4E147D2B942109B01916F70"><enum>(III)</enum><text display-inline="yes-display-inline">not less than $10,000,000 shall be for the education and outreach initiative under subsection (d), of which—</text><item id="HEE310DDAED834EB7B717AF6121FB78EE"><enum>(aa)</enum><text>not less than $8,000,000 shall be for local education and outreach activities; and</text></item><item id="H03A70422768F426EB5B14082969832F3"><enum>(bb)</enum><text>not less than $2,000,000 shall be for national media activities; and</text></item></subclause><subclause id="HE6467403BBDB4BD9B9ADD7D8869C1752"><enum>(IV)</enum><text display-inline="yes-display-inline">any remaining amounts shall be used for any program activities authorized under this section; and</text></subclause></clause><clause id="H4DC9748EC781409088F042DC6989A743"><enum>(ii)</enum><text>$3,000,000 shall be available only for programs under subsection (a)(1)(C); and</text></clause></subparagraph><subparagraph id="HEA914C23F42D47D3A8AF749EF965D2C7"><enum>(B)</enum><text display-inline="yes-display-inline">$70,000,000 for each of fiscal years 2027 through 2032, of which—</text><clause id="HACF320F059A642A0BB5E51E786C12EAE"><enum>(i)</enum><text display-inline="yes-display-inline">$65,000,000 shall be available for any activities under this section other than programs under subsection (a)(1)(C), of which—</text><subclause id="H311A06C6A9EE4BE899486BC803BEFA9C"><enum>(I)</enum><text>not less than $44,000,000 shall be for private enforcement initiatives authorized under subsection (b);</text></subclause><subclause id="HABF17929A5CA47DF8D295020075968F5"><enum>(II)</enum><text>not less than $1,500,000 shall be for the fair housing organizations initiative under subsection (c);</text></subclause><subclause display-inline="no-display-inline" id="HED1CCEA35BB541A6A4F0042CECE7D64B"><enum>(III)</enum><text display-inline="yes-display-inline">not less than $12,500,000 shall be for the education and outreach initiative under subsection (d), of which—</text><item id="H71AE41385E8E4FC38DC8298A1C486CB0"><enum>(aa)</enum><text>not less than $10,000,000 shall be for local education and outreach activities; and</text></item><item id="H9ECC628370A74CE88FA4746E48E6578F"><enum>(bb)</enum><text>not less than $2,500,000 shall be for national media activities; and</text></item></subclause><subclause id="H82407146B2E44F34BF2599734071C703"><enum>(IV)</enum><text>any remaining amounts shall be used for any program activities authorized under this section; and</text></subclause></clause><clause id="H53FA53BD4C1E417FBC8B8A2A08E13E1F"><enum>(ii)</enum><text display-inline="yes-display-inline">$5,000,000 shall be available only for programs under subsection (a)(1)(C).</text></clause></subparagraph></paragraph><paragraph id="HECF411C61EB24E2AAD9C67619B6F1E95"><enum>(2)</enum><header>Availability</header><text>Any amount appropriated under this section shall remain available until expended to carry out the provisions of this section.</text></paragraph><paragraph id="HF4A8B2EAFB54457F93392C8F25142055"><enum>(3)</enum><header>Award of funding</header><subparagraph id="idA4F2F5F51C5C4AB98D9FFBC85010260B"><enum>(A)</enum><header>Notice</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of any Act making amounts available to carry out this section, the Secretary shall issue a Notice of Funding Availability with respect to the amounts.</text></subparagraph><subparagraph id="idA03984DC990B4100959C433145F8FC47"><enum>(B)</enum><header>Award</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of any Act making amounts available to carry out this section, the Secretary shall award the amounts.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HBFEFB11199B64C42B0AF9AF1BF478BE7"><enum>(6)</enum><text>in subsection (h)(1), in the matter following subparagraph (C), by inserting <quote>and meets the criteria described in subparagraphs (A) and (C)</quote> before the period at the end; and</text></paragraph><paragraph id="H5DEB909BC30D43F2BDF35F872C2F73F4"><enum>(7)</enum><text>in subsection (j)—</text><subparagraph id="H471DB6791EC040E68C1986F7EFDABE6A"><enum>(A)</enum><text>in the matter preceding paragraph (1), by inserting <quote>regarding that fiscal year,</quote> after <quote>comprehensive report</quote>;</text></subparagraph><subparagraph id="H0D134BB82D524E9087CE42B85612EE8A"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>and the use of such funds during the preceding fiscal year</quote> and inserting <quote>, the use of such funds, and outcomes such as the number of housing units made available and accessible to protected classes under the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601</external-xref> et seq.)</quote>;</text></subparagraph><subparagraph id="id36C37687DE2A4105B852ACAC6E8FCF58"><enum>(C)</enum><text>in paragraph (3), by striking <quote>during the preceding fiscal year</quote>; and</text></subparagraph><subparagraph id="id4C0F15CF038C4417B91E183A37A91AAA"><enum>(D)</enum><text>in paragraph (4), by striking <quote>during the preceding fiscal year</quote>.</text></subparagraph></paragraph></subsection><subsection id="H415E7EF2A35D47E4ACAA11D0B4ED402E"><enum>(b)</enum><header>Study</header><paragraph id="id43AAA4BD7AE94CD083F641E45282B60A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall conduct a study to determine—</text><subparagraph id="id9FFF3E8334DA462799216B907CEC184B"><enum>(A)</enum><text display-inline="yes-display-inline">the feasibility, efficiency, and effectiveness of converting the Fair Housing Initiatives Program under section 561 of the Housing and Community Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a</external-xref>), as amended by this Act, into a noncompetitive entitlement program to provide general operating funding to qualified fair housing enforcement organizations, as defined in subsection (h) of that section;</text></subparagraph><subparagraph id="id31DAF4C1FE3A4058BD4C32605BE905AD"><enum>(B)</enum><text display-inline="yes-display-inline">the appropriate levels of funding for such a program, taking into consideration the number of such qualified fair housing enforcement organizations; and</text></subparagraph><subparagraph id="id133A4BCCDC4B43A88755E3B16F9A84EC"><enum>(C)</enum><text display-inline="yes-display-inline">the factors that should be considered in providing for an equitable distribution to qualified fair housing enforcement organizations.</text></subparagraph></paragraph><paragraph id="idBD9822E8C21744E3A25D6AD201017034"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall submit a report to Congress setting forth the results of the study conducted under paragraph (1), which shall include any recommendations regarding such conversion of the program.</text></paragraph></subsection></section><section id="HDD3E3C19D762446A818014BFBBEF4329"><enum>5.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the Secretary should—</text><paragraph id="HA3872DA034874EBAA638AA255F0648C5"><enum>(1)</enum><text display-inline="yes-display-inline">fully comply with the requirements of section 561(d) of the Housing and Community Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a(d)</external-xref>), as amended by this Act, to establish, design, and maintain a national education and outreach program to provide a centralized, coordinated effort for the development and dissemination of—</text><subparagraph id="H8CD9FF0CCB904D0C82131AB682DA7161"><enum>(A)</enum><text>materials and information about the fair housing rights of individuals who seek to rent, purchase, sell, or facilitate the sale of a home; and</text></subparagraph><subparagraph id="HBEC06000BFCD4C7CBC51495D86A54C57"><enum>(B)</enum><text display-inline="yes-display-inline">materials and information about the fair housing responsibilities of industry professionals providing products and services covered under the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601</external-xref> et seq.);</text></subparagraph></paragraph><paragraph id="HFB758ABB1A1940A2A9BA2A86AD57A673"><enum>(2)</enum><text display-inline="yes-display-inline">expend for the education and outreach programs described in paragraph (1) all amounts appropriated for those programs;</text></paragraph><paragraph id="H770ADD7AFE02490DA7DB40863C00A300"><enum>(3)</enum><text>fully reinstate the regulations promulgated on July 16, 2015 (80 Fed. Reg. 42271), regarding the fair housing obligations of each recipient of Federal housing and community development funds to affirmatively further fair housing, as that term is used in the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601</external-xref> et seq.); and</text></paragraph><paragraph id="H79B3B57C289349E2A512CC789AE3A5BC"><enum>(4)</enum><text display-inline="yes-display-inline">fully comply with the requirements of section 810(a) of the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3610">42 U.S.C. 3610(a)</external-xref>).</text></paragraph></section><section id="H69E9A65CEF354B07A2A2624E9E04E215"><enum>6.</enum><header>Grants to public and private entities to study housing discrimination</header><subsection id="H495B557B57E545E5964AC9F00E534396"><enum>(a)</enum><header>Grant Program</header><text>The Secretary shall carry out a competitive matching grant program to assist public and private nonprofit organizations in—</text><paragraph id="H40EB73EF1968408EA48D0FA8137DD772"><enum>(1)</enum><text>conducting comprehensive studies that examine—</text><subparagraph id="H5B7C0C7C7EEA44A1A8C376FBA8A3FCB5"><enum>(A)</enum><text>the causes of housing discrimination and segregation;</text></subparagraph><subparagraph id="H17AEE317201542DBAFC69CEC4E028E43"><enum>(B)</enum><text>the effects of housing discrimination and segregation on education, poverty, economic development, health, and other socioeconomic factors; or</text></subparagraph><subparagraph id="HD0A5308BD3104E2C8AECE7AC795997F9"><enum>(C)</enum><text display-inline="yes-display-inline">the incidences, causes, and effects of housing discrimination based on veteran and military status; and</text></subparagraph></paragraph><paragraph id="HF06C89B007D94B918DB835D1DD45CB1B"><enum>(2)</enum><text>implementing pilot projects that test solutions that will help prevent or alleviate housing discrimination and segregation.</text></paragraph></subsection><subsection id="HE834D19E7A23467886C3F85C81F68E49"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this section, a public or private nonprofit organization shall—</text><paragraph id="H48507D7C1BBA47AE93E4EF4B1BAD6B2E"><enum>(1)</enum><text>submit an application to the Secretary that contains—</text><subparagraph id="HEEF723AC076240688C0EB6925C495067"><enum>(A)</enum><text display-inline="yes-display-inline">the issues the applicant will address and a justification for the need to address those issues;</text></subparagraph><subparagraph id="H54B51ABA90054B37B0EA8AD352B06197"><enum>(B)</enum><text>the applicant’s experience in formulating or carrying out programs or activities described in this section; </text></subparagraph><subparagraph id="H38F44DEB11E6458BAB8DAFF4F1DBAF91"><enum>(C)</enum><text> the geographical area and period of time to be studied; and</text></subparagraph><subparagraph id="id48607a442aa940f8ba35dc77e306c27a"><enum>(D)</enum><text>a certification that the applicant has consulted with a qualified fair housing enforcement organization in the design of its proposed area of study; and</text></subparagraph></paragraph><paragraph id="H8867765D02DF4B4BA72F6241421787E2"><enum>(2)</enum><text>agree to provide matching non-Federal funds for 10 percent of the total amount of the grant, which matching funds may include monetary donations and items donated on an in-kind contribution basis.</text></paragraph></subsection><subsection id="H2C4E9529DC604C0683EAB6CB88CC8FAA"><enum>(c)</enum><header>Partnerships with academic institutions</header><text display-inline="yes-display-inline">A public or private nonprofit organization applying for a grant under this section may partner with an academic or educational organization or institution for the purpose of carrying out activities assisted with the grant amounts.</text></subsection><subsection id="H4DF9435FBBE346329B3FA5CFE5FDB43D"><enum>(d)</enum><header>Report</header><paragraph id="id24E14D67BB3E4CB38689D9491D39D493"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall submit a report to Congress on a biennial basis that provides a detailed summary of the results of the comprehensive studies and pilot projects carried out under subsection (a), together with any recommendations or proposals for legislative or administrative actions to address any issues raised by the studies and pilot projects.</text></paragraph><paragraph id="idDAA2096ED1E64B558375C7975BDD84FC"><enum>(2)</enum><header>Concurrent submission</header><text display-inline="yes-display-inline">The Secretary may submit the reports required under paragraph (1) as part of the reports prepared in accordance with paragraphs (2) and (6) of section 808(e) of the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3608">42 U.S.C. 3608(e)</external-xref>) and section 561(j) of the Housing and Community Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a(j)</external-xref>).</text></paragraph></subsection><subsection id="H45A7CDF9FF87416C978C095BAC4DBAFD"><enum>(e)</enum><header>Authorization of Appropriations</header><text>There are authorized to be appropriated to carry out this section $5,000,000 for each of fiscal years 2021 through 2025.</text></subsection></section><section id="HEF30EBCA62C4414B975ADB763AADD7C3"><enum>7.</enum><header>Limitation on use of funds</header><subsection id="id5F212FE0DAF846438BB9136EDA234375"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>lobbying</term> means an activity the costs of which are unallowable under paragraph 25 of attachment B to Circular A–122 of the Office of Management and Budget, entitled <quote>Cost Principles for Non-Profit Organizations</quote>.</text></subsection><subsection id="idADEF93177610430DB456A08A90F7182B"><enum>(b)</enum><header>Prohibition</header><text display-inline="yes-display-inline">None of the funds made available under this Act, or the amendments made by this Act, may be used for any political activities, political advocacy, or lobbying, or for expenses for travel to engage in political activities or preparation of or provision of advice on tax returns.</text></subsection></section></legis-body></bill>
