			 <quote>intimate partner</quote> and <quote>misdemeanor crime of domestic
 violence</quote> expanded</header><text display-inline="no-display-inline">Section 921(a) of title 18, United States Code, is amended—</text><paragraph id="id5226aa80f2e8476ebaf552c524470f26"><enum>(1)</enum><text>by inserting before paragraph (32) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3E2B1D996CFB4C2BBC47CBEB2914642A"><paragraph id="idFE8CAA2ED7DF4E7C90630201E9A9C4B5"><enum>(31)</enum><text>The term <term>covered domestic violence court order</term> means a court order—</text><subparagraph id="idDE03FEB25ACB4622B961A1253735B003"><enum>(A)</enum><text>that was issued—</text><clause id="id2D8C2ADA0341443B8AFA37CFF1D2A8A1"><enum>(i)</enum><text>after a hearing of which such person received actual notice, and at which such person had an opportunity to participate; or</text></clause><clause id="idB983CFC34959494C8792911252C4281C"><enum>(ii)</enum><text>in the case of an ex parte order, relative to which notice and opportunity to be heard are provided—</text><subclause id="id68CFB4A62E4D48D9AC5A8FB681D554F5"><enum>(I)</enum><text>within the time required by State, tribal, or territorial law; and</text></subclause><subclause id="idF905EE8241654218973636675EACF405"><enum>(II)</enum><text>in any event within a reasonable time after the order is issued, sufficient to protect the due process rights of the person;</text></subclause></clause></subparagraph><subparagraph id="idB8015F62257A48C8BDA8CCB2902A3043"><enum>(B)</enum><text>that restrains such person from—</text><clause id="id36093E409AE44D0B9E9B957BF7D36AAF"><enum>(i)</enum><text>harassing, stalking, or threatening an intimate partner of such person or child of such intimate partner or person, or engaging in other conduct that would place an intimate partner in reasonable fear of bodily injury to the partner or child; or</text></clause><clause id="idC4B094FCD2E54E8188A6396B7C094C5C"><enum>(ii)</enum><text>intimidating or dissuading a witness from testifying in court; and</text></clause></subparagraph><subparagraph id="idD504A9B11F8C428BAA4D8E1F15AB9AD5"><enum>(C)</enum><text>that—</text><clause id="idEC881501831C447288012B8E9E7563FD"><enum>(i)</enum><text>includes a finding that such person represents a credible threat to the physical safety of such individual described in subparagraph (B); or</text></clause><clause id="idCE13C7E7DC1B4787AE4E1330A269D50C"><enum>(ii)</enum><text>by its terms explicitly prohibits the use, attempted use, or threatened use of physical force against such individual described in subparagraph (B) that would reasonably be expected to cause bodily injury.</text></clause></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id3BD39EE745704499A6742548D504AA0E"><enum>(2)</enum><text>in paragraph (32), by striking all that follows after <quote>The term <term>intimate partner</term></quote> and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id1158bdfc3d154b5aa78d33754482f229"><text>—</text><subparagraph id="idc78acce181aa46f987f7e0b95efb4ee1" indent="up1"><enum>(A)</enum><text>means, with respect to a person, the spouse of the person, a former spouse of the person, an individual who is a parent of a child of the person, and an individual who cohabitates or has cohabited with the person; and</text></subparagraph><subparagraph id="id75e7e34301c34202a90e91fb8f3b1df8" indent="up1"><enum>(B)</enum><text>includes—</text><clause id="idb27142102cb4445980d2f34dc39d4e7f"><enum>(i)</enum><text>a dating partner (as defined in section 2266) or former dating partner; and</text></clause><clause id="idfd778d87bdcb44428ccf701bf13c2da7"><enum>(ii)</enum><text>any other person similarly situated to a spouse who is protected by the domestic or family violence laws of the State, local, or tribal jurisdiction in which the injury occurred or where the victim resides.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id7b28019ef9c9480bb3841cc79346468d"><enum>(3)</enum><text>in paragraph (33)(A)—</text><subparagraph id="id2b8b48a590ea412298224eb60b698443"><enum>(A)</enum><text>in clause (i), by inserting after <quote>Federal, State,</quote> the following: <quote>municipal,</quote>; and</text></subparagraph><subparagraph id="id7d6c4daf8915413ab1221d93ba1315a8"><enum>(B)</enum><text>in clause (ii)—</text><clause id="id5B224C113E73424ABADA9CE4D7DD7C86"><enum>(i)</enum><text>by striking <quote>or the threatened</quote> and inserting <quote>the threatened</quote>; </text></clause><clause id="id4839080A3BD34779A3E6BFDA05EE725D"><enum>(ii)</enum><text>by inserting <quote>or stalking</quote> after <quote>deadly weapon</quote>; and</text></clause><clause id="id459187156B8C46D5A96BB3B0AE57D3CE"><enum>(iii)</enum><text>by inserting <quote>dating partner (as defined in section 2266),</quote> after <quote>spouse,</quote> each place it appears. </text></clause></subparagraph></paragraph></section><section id="idC56B4D37576E43C1B4D6F142299C77EC"><enum>3.</enum><header>Unlawful sale of firearm to a person subject to court order</header><text display-inline="no-display-inline">Section 922(d)(8) of title 18, United States Code, is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9CEFA4F5A220483DAD77B33BA74FAE41"><paragraph id="idF642F267A6C848B2A1105D043058BFC7"><enum>(8)</enum><text>is subject to a covered domestic violence court order; or</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF040AE316C7149E5BC42FB36AA466454"><enum>4.</enum><header>List of persons
			 subject to a restraining or similar order prohibited from possessing or
 receiving a firearm expanded</header><text display-inline="no-display-inline">Section 922(g)(8) of title 18, United States Code, is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCD3122B38B9B4416AE05631F06DA4020"><paragraph id="idfbb203f9e22548b59a36a8c86ea49f40"><enum>(8)</enum><text>who is subject to a covered domestic violence court order; or</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id95648950D5F94ADCA580B9E483CF5663"><enum>5.</enum><header>Technical and conforming amendments</header><text display-inline="no-display-inline">The NICS Improvement Amendments Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/34/40902">34 U.S.C. 40902</external-xref> et seq.) is amended—</text><paragraph id="id83CC5DA7B23640CFA38FF79AC3E7F6C1"><enum>(1)</enum><text>in section 3(1) (<external-xref legal-doc="usc" parsable-cite="usc/34/40903">34 U.S.C. 40903(1)</external-xref>), by striking <quote>court order (as described in section 922(g)(8)</quote> and inserting <quote>covered domestic violence court order (as defined in section 921(a)</quote>; and</text></paragraph><paragraph id="idA169EF91AA094F0BB21ED53089AA0EF4"><enum>(2)</enum><text>in section 102(b)(1)(C)(v) (<external-xref legal-doc="usc" parsable-cite="usc/34/40912">34 U.S.C. 40912(b)(1)(C)(v)</external-xref>), by striking <quote>court order described in section 922(g)(8)</quote> and inserting <quote>covered domestic violence court order, as defined in section 921(a)</quote>. </text></paragraph></section></legis-body></bill>
