which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the publication of fossil-fuel powered travel by the President, the Vice President, and political appointees, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Executive Branch Emissions Transparency Act</short-title></quote>.</text></section><section id="id3F0AA0BDC76247DDB45899CB9469E88A"><enum>2.</enum><header>Database on fossil fuel-powered travel by the President, the Vice President, and political appointees</header><subsection id="idC742CD211C51492FB8D2129C43C19681"><enum>(a)</enum><header>Definitions</header><paragraph id="id3111E50CF6A341ECB0EEB01AE057BA50"><enum>(1)</enum><header>Covered individual</header><text>The term <term>covered individual</term> means—</text><subparagraph id="id5C163FF222FB4B34A2E3750CE5C3D284"><enum>(A)</enum><text>the President;</text></subparagraph><subparagraph id="id8802FBA279EB42E99B83CA6B6DBC2684" commented="no"><enum>(B)</enum><text>the Vice President; and</text></subparagraph><subparagraph id="idD5B93014ACA64071B627000F8C77CE19"><enum>(C)</enum><text>a political appointee.</text></subparagraph></paragraph><paragraph id="id97ECA93C519A46218329C9CDADEB9277"><enum>(2)</enum><header>Covered travel</header><text>The term <term>covered travel</term> means—</text><subparagraph id="idC5E6D1555EBB4CCFA33E2F0612C591F1"><enum>(A)</enum><text>travel that is powered by fossil fuels by a covered individual on official business; and</text></subparagraph><subparagraph id="idB788DAF93B424F55A33BD52805776370"><enum>(B)</enum><text>travel that is powered by fossil fuels by a covered individual that is paid for by a third party, if the covered individual is appearing in their official capacity.</text></subparagraph></paragraph><paragraph id="id2725BB4E97684722A3B8A2727B13424B"><enum>(3)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="idCEC8E2B9A6264F3997CF2B1D0C75554C" commented="no"><enum>(4)</enum><header>Political appointee</header><text>The term <term>political appointee</term> means any individual—</text><subparagraph commented="no" id="idDAFF0CDA37934F9C87A544ABAEDDF965"><enum>(A)</enum><text>occupying a position in the Executive Office of the President or in the Office of the Vice President for which appointment is made by the President or Vice President, without regard to whether the appointment is made by and with the advice and consent of the Senate; </text></subparagraph><subparagraph id="ida0da5556689c445584889f4cfb6207ab"><enum>(B)</enum><text>occupying position on the executive schedule under sections 5312 through 5316 of title 5, United States Code;</text></subparagraph><subparagraph id="id88168497ed2e4f0da262420f8b083976"><enum>(C)</enum><text>who is a limited term appointee, limited emergency appointee, or noncareer appointee in the Senior Executive Service as defined in paragraphs (5), (6), and (7) of section 3132(a) of title 5, United States Code, respectively; </text></subparagraph><subparagraph id="id8e089e54237843a58d677d30c8e26e6b"><enum>(D)</enum><text>occupying a position in the executive branch of the Government of a confidential or policy-determining character under Schedule C of subpart C of part 213 of title 5, Code of Federal Regulations;</text></subparagraph><subparagraph id="idE38BD7591A1D4E26B45E3F43FE1B6FF6"><enum>(E)</enum><text>occupying a position for which appointment is made by the President and does not require the advice and consent of the Senate;</text></subparagraph><subparagraph id="idCDE14E3C607C473B84CFEED534963C40"><enum>(F)</enum><text>who is an Ambassador; or </text></subparagraph><subparagraph id="idAE465894DD3249EFB4B76CCB71C83223"><enum>(G)</enum><text>who is—</text><clause id="idF46A2BB5DAD940E79C54B30CD14F5108"><enum>(i)</enum><text>a member of the staff of an Ambassador; </text></clause><clause id="id32D2AD53BE9442B3AA1E380426F356FD"><enum>(ii)</enum><text>not a member of the Foreign Service; and</text></clause><clause id="id8427774FACEA48AEAE4C011E9033A2F6"><enum>(iii)</enum><text>occupying a position for which appointment is made by the President, without regard to whether the appointment is made by and with the advice and consent of the Senate.</text></clause></subparagraph></paragraph><paragraph id="idA4C9B7BC71AA4F1D92FF52B1D654A9CB"><enum>(5)</enum><header>Relevant head</header><text>The term <term>relevant head</term> means—</text><subparagraph id="id4BD50F9DF15B4D4C98C9296B3FC96921"><enum>(A)</enum><text>with respect to a political appointee described in subparagraph (B), (C), (D), or (E), the head of the Federal entity in which the political appointee occupies their position;</text></subparagraph><subparagraph id="idC3F1180BE44441558A252FE500029822"><enum>(B)</enum><text>with respect to the President, the Vice President, or a political appointee described in paragraph (4)(A), the White House Office of Management and Administration; and</text></subparagraph><subparagraph id="idA682D39CC1C0409CA71956DC737E3942"><enum>(C)</enum><text>with respect to a political appointee described in subparagraph (F) or (G) of paragraph (4), the Secretary of State.</text></subparagraph></paragraph></subsection><subsection id="id212217D7FA8A48458B0F7080767E5459"><enum>(b)</enum><header>Database</header><paragraph id="id4F9BB9544D0943ECBD3E4FBC3D7E0248"><enum>(1)</enum><header>Establishment</header><text>Not later than 90 days after the date of enactment of this Act, the Director shall establish and maintain a publicly accessible and searchable database of covered travel.</text></paragraph><paragraph id="idF54E94AD7BBD42CD9AB6C52F321C41C8"><enum>(2)</enum><header>Submission to relevant head</header><text>Not later than 30 days after the date on which a covered individual has taken covered travel and has returned to the origin of the trip, the covered individual shall submit to the relevant head a report on the covered travel, which shall include—</text><subparagraph id="id6ED97E8921344D2685EFEA20008FA25B"><enum>(A)</enum><text>the name of each covered individual on the covered travel;</text></subparagraph><subparagraph id="idF475724C32B44E0CA6D4438CBDF8DE19"><enum>(B)</enum><text>the mode of travel;</text></subparagraph><subparagraph id="id991BBDE27EA946C8A166A9151A745D6C"><enum>(C)</enum><text>the origin and destination;</text></subparagraph><subparagraph id="id97E11F039C6F45069317A3984B023F5B"><enum>(D)</enum><text>a description of the covered travel;</text></subparagraph><subparagraph id="idB1C2D76DB1AA4E24BF3CEC07CDD53211"><enum>(E)</enum><text>miles traveled;</text></subparagraph><subparagraph id="id5E5E58031E1D4BE1A180E672C42F443D"><enum>(F)</enum><text>the estimated carbon emissions resulting from the covered travel; and</text></subparagraph><subparagraph id="id95C342A4534B4346A41CCA123D16AD07"><enum>(G)</enum><text>a description of any action taken to limit the carbon emissions associated with the covered travel.</text></subparagraph></paragraph><paragraph id="idE1492472ED8A4D858432CDD0AE441894"><enum>(3)</enum><header>Submission to OMB</header><text>Not later than the 1st of each month, each relevant head shall submit to the Director a report that includes the information received under paragraph (2) during the preceding month relating to covered travel.</text></paragraph><paragraph id="id376809FC515B4862A5D19563323051F8"><enum>(4)</enum><header>Publication by OMB</header><text>Not later than the 15th of each month, the Director shall update the database established under this subsection with the reports submitted under paragraph (3) during the preceding month.</text></paragraph><paragraph id="id88A9C0636C0A4E5CBA2B8137EE3E0516"><enum>(5)</enum><header>Exception for national security risk</header><text>The Director shall not publish on the database established under this subsection information described in paragraph (2) if the publication of that information could be deemed a national security risk.</text></paragraph></subsection></section></legis-body></bill>
