<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 756</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210315">March 16, 2021</action-date><action-desc><sponsor name-id="S389">Mr. Kennedy</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Patient Protection and Affordable Care Act to ensure that preexisting condition exclusions with respect to enrollment in health insurance coverage and group health plans continue to be prohibited.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC62138701DB94C6A920F3D6942489C6B"><section section-type="section-one" id="H5912BD33FA7542408815ACC989B84598"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Continuing Coverage for Preexisting Conditions Act of 2021</short-title></quote>.</text></section><section id="H93EAC30041434F1194EA70E79B244356"><enum>2.</enum><header>Ensuring the prohibition of preexisting condition exclusions with respect to enrollment in health insurance coverage and group health plans</header><text display-inline="no-display-inline">Part I of subtitle F of title I of the Patient Protection and Affordable Care Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>) is amended by adding at the end the following section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H06950EDFE5FE45D3A3062FBD0EB993E5"><section id="HAC417FD68C2F475088F7F1213A08F47F"><enum>1503.</enum><header>Severability</header><text display-inline="no-display-inline">If subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/26/5000A">section 5000A</external-xref> of the Internal Revenue Code of 1986, as added by section 1501(b), is to any extent illegal, unconstitutional, otherwise invalid, or incapable of being enforced, the validity and enforceability of sections 2701 through 2705 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg">42 U.S.C. 300gg</external-xref> through 300gg–4), as added by section 1201, shall not be affected.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
