<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 755</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210316">March 16, 2021</action-date><action-desc><sponsor name-id="S395">Mrs. Hyde-Smith</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Administrator of the Environmental Protection Agency to provide additional assistance for public water systems damaged by Winter Storms Uri and Viola, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Water Infrastructure Improvements Act of 2021</short-title></quote>.</text></section><section id="id4239D98533154CE3B53E5FBFB273BAD5"><enum>2.</enum><header>Additional environmental infrastructure authority</header><text display-inline="no-display-inline">Section 219(f)(167) of the Water Resources Development Act of 1992 (<external-xref legal-doc="public-law" parsable-cite="pl/102/580">Public Law 102–580</external-xref>; 106 Stat. 4835; 113 Stat. 335; 121 Stat. 1263) is amended by striking <quote>$25,000,000</quote> and inserting <quote>$47,000,000</quote>.</text></section><section id="id36FDE6E84846449E9DFC14EA705674AA"><enum>3.</enum><header>Safe drinking water infrastructure</header><subsection id="id32797C7C60D84EC791917F04D6BDA0A2"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idE50D000D0B6E4EB79B9E7C0EFC492978"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="idC57433B6100C4432883BEBF77B1B710F"><enum>(2)</enum><header>Eligible State</header><text>The term <term>eligible State</term> means a State—</text><subparagraph id="id0A4CCC626D2D482B9039981BD258F66C"><enum>(A)</enum><text>for which the President has declared not fewer than 5 major disasters under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121</external-xref> et seq.); and</text></subparagraph><subparagraph id="idD92FAC5A321245FA8D9E94B1766409CB"><enum>(B)</enum><text>in which public water systems suffered major damage, as determined by the Administrator, from Winter Storms Uri and Viola.</text></subparagraph></paragraph><paragraph id="idE793312C696F4F4E8ABB92A36F66597A"><enum>(3)</enum><header>Eligible system</header><text>The term <term>eligible system</term> means a public water system that has been subject to an emergency administrative order pursuant to section 1431 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300i">42 U.S.C. 300i</external-xref>) during calendar year 2020.</text></paragraph><paragraph id="idC591F78C93C94A5187BE40B330B1306F"><enum>(4)</enum><header>Public water system</header><text>The term <term>public water system</term> has the meaning given the term in section 1401 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref>).</text></paragraph></subsection><subsection id="id289DECC01D3F42F4BB636BF1A3FEECE5"><enum>(b)</enum><header>State revolving loan fund assistance</header><paragraph id="id8AA73E6CD0E54460AD985CDCC7556392"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, an eligible system shall be—</text><subparagraph id="id22A5738D87144873A3B0B3139B61845F"><enum>(A)</enum><text>considered a disadvantaged community for purposes of subsection (d) of section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>); and</text></subparagraph><subparagraph id="idECB730B8E56347F08ED035BE7D4F1028"><enum>(B)</enum><text>eligible to receive the additional subsidization described in paragraph (1) of that subsection, including the forgiveness of principal described in that paragraph.</text></subparagraph></paragraph><paragraph id="id1B14CF8C1CEC4B85A7B10974476E1236"><enum>(2)</enum><header>Authorization</header><text>An eligible State may use funds made available under a capitalization grant provided under subsection (c) to provide the additional subsidization described in paragraph (1)(B) to an eligible system within the eligible State to address contaminants in drinking water, which may include the repair and replacement of water distribution system components.</text></paragraph></subsection><subsection id="idF0C37EA12C4E49588A780032D00A3752"><enum>(c)</enum><header>Drinking water State revolving funds</header><paragraph id="idF3BBAE8A18BE4AAC9997928AA7086C1B"><enum>(1)</enum><header>Appropriation</header><text>There is appropriated to the Administrator, out of any funds of the Treasury not otherwise appropriated, $150,000,000 to provide additional capitalization grants to eligible States pursuant to section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>) for the purposes described in subsection (b)(2), to remain available until expended.</text></paragraph><paragraph id="id372A6DCC141C469AA3864EB0522898CB"><enum>(2)</enum><header>Intended use plans</header><text>Not later than 30 days after the date on which an eligible State submits to the Administrator a revised intended use plan under section 1452(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(b)</external-xref>) that includes information with respect to projects described in subsection (b)(2) to be funded using amounts made available in a capitalization grant pursuant to paragraph (1), the Administrator shall make a capitalization grant to the eligible State in such amount as is necessary to fund the projects described in the revised intended use plan.</text></paragraph><paragraph id="idB5CCECE4CDD74669AF217EAE4899E3B9"><enum>(3)</enum><header>Requirement</header><text>Of the funds provided to an eligible State in a capitalization grant made pursuant to paragraph (1), the eligible State may use not more than 15 percent to provide assistance to an eligible system for the purposes of purchasing and installing new water meters and modernizing billing systems.</text></paragraph></subsection><subsection id="id5F1D840226134B7EABA5B318A500ADB9"><enum>(d)</enum><header>Nonduplication of work</header><text>An activity carried out using funds made available under this section shall not duplicate or impede the work of any other Federal or State department or agency.</text></subsection></section><section id="id4C8DD0E2DFA44F4296A590957BC90AB9"><enum>4.</enum><header>Economic adjustment assistance grants for drinking water infrastructure</header><text display-inline="no-display-inline">Of the amounts made available under the heading <quote><header-in-text style="appropriations" level="appropriations-small">economic development assistance programs</header-in-text></quote> under the heading <quote><header-in-text style="appropriations" level="appropriations-intermediate">economic development administration</header-in-text></quote> under title II of division B of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; 134 Stat. 510), or for grants for economic development assistance under the heading <quote><header-in-text style="appropriations" level="appropriations-small">economic development assistance programs</header-in-text></quote> under the heading <quote><header-in-text style="appropriations" level="appropriations-intermediate">economic development administration</header-in-text></quote> under title I of division B of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), that are unobligated on the date of enactment of this Act, the Secretary of Commerce shall provide not less than $25,000,000 to eligible systems (as defined in section 3(a)) to address contaminants in drinking water. </text></section></legis-body></bill>
