 review of presidential actions</header><subsection id="id7FE0B8992DC44191A5358287A40E869A"><enum>(a)</enum><header>Investigations and determinations by Secretary of Defense</header><text>Section 232 of the Trade Expansion Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/19/1862">19 U.S.C. 1862</external-xref>) is amended—</text><paragraph id="id9F6BEE244C5945548E4E79C9F580D01C"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id35A95C21942F45EC8D7B8318F7229551"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="idBFF4980D304344C4BD46E8D941399923"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>Secretary of Commerce</quote> and all that follows through <quote><quote>Secretary</quote>)</quote> and inserting <quote>Secretary of Defense</quote>; and</text></clause><clause id="idA8ABAE621C19407CBE565E13F171D378"><enum>(ii)</enum><text>in subparagraph (B)—</text><subclause id="idBCBEBD956A064302A2FA634E2E9CABFD"><enum>(I)</enum><text>by striking <quote>Secretary shall</quote> and inserting <quote>Secretary of Defense shall</quote>; and</text></subclause><subclause id="idF2F2106C0A3341C6B6E380086E96A5C9"><enum>(II)</enum><text>by striking <quote>Secretary of Defense of</quote> and inserting <quote>Secretary of Commerce of</quote>;</text></subclause></clause></subparagraph><subparagraph id="id21C89EC07D67415497E537EF6E2A50E2"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idBF7EEEB7C37C439FB38B4F4F238B4518"><enum>(i)</enum><text>by striking subparagraph (B);</text></clause><clause id="id744DACE8D7874543934E0FC98EE5D2B3"><enum>(ii)</enum><text>in the matter preceding clause (i)—</text><subclause id="id1ED1F6A6BB6B4BEC9E60DE9CBE721268"><enum>(I)</enum><text>by striking <quote>(A) In</quote> and inserting <quote>In</quote>; and</text></subclause><subclause id="idA9257405CD1F430BA77E0CF7B6598249"><enum>(II)</enum><text>by striking <quote>Secretary</quote> and inserting <quote>Secretary of Defense</quote>; and</text></subclause></clause><clause id="id5CAEF22CD9CD4245A296381A108D1519"><enum>(iii)</enum><text>by striking clauses (i) through (iii) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id88E01283B3824EBAAB3BF18C4612B297"><subparagraph id="id4608C4650E1744669CA3E99F41B6572F" indent="up1"><enum>(A)</enum><text>consult with the Secretary of Commerce regarding the methodological and policy questions raised in any investigation initiated under paragraph (1);</text></subparagraph><subparagraph id="id5D7A40444B6A4CA8852D1600E30B653D" indent="up1"><enum>(B)</enum><text>prepare an assessment of the defense requirements and national security impact of any article that is the subject of an investigation, which shall focus on—</text><clause id="id04CBF1EAA1D0462F864B8F5C693B1D84"><enum>(i)</enum><text>the impact of the importation of the article on military readiness and critical infrastructure; and</text></clause><clause id="id42E55361404B4F7EAE157674714740E9"><enum>(ii)</enum><text>the need for a reliable supply of the article to protect national security;</text></clause></subparagraph><subparagraph id="idB824E18B9435442CA27D3BCFAB8C1DE0" indent="up1"><enum>(C)</enum><text>seek information and advice from the Secretary of Commerce;</text></subparagraph><subparagraph id="id7E9B3A374F41476ABAB570DEB02A383E" indent="up1"><enum>(D)</enum><text>consult with appropriate officers of the United States;</text></subparagraph><subparagraph id="id0D84F43949B44A9CA3865AD7AA480752" indent="up1"><enum>(E)</enum><text>consult with members of the Committee on Finance of the Senate and members of the Committee on Ways and Means of the House of Representatives; and</text></subparagraph><subparagraph id="id93247252683C47DE883FA118B659CF39" indent="up1"><enum>(F)</enum><text>hold public hearings, co-chaired with the Secretary of Commerce, or otherwise afford interested parties an opportunity to present information and advice relevant to such investigation.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id04D91BBB808B4EA3A38F3AB549114EF4"><enum>(C)</enum><text>by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6CFEC4AEF4DA4EC4BD068080C0CD60EF"><paragraph id="id3E684F38F6C94B3DB7FC99BB177F6807" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id4EA5090AA44549F9BAA9599049288AB2"><enum>(A)</enum><text>Not later than 200 days after the date on which the Secretary of Defense initiates an investigation under paragraph (1) with respect to an article, the Secretary of Defense shall submit to the President a report on the findings of such investigation with respect to the effect of the importation of such article in such quantities or under such circumstances on the national security of the United States.</text></subparagraph><subparagraph id="id8B4C6674BB5044F68AE7C0D68902EC8F" indent="up1"><enum>(B)</enum><text>If the report described in subparagraph (A) includes an affirmative finding that the importation of an article in such quantities or under such circumstances threatens to impair the national security, the President may direct the Secretary of Commerce to devise recommendations to address such threat.</text></subparagraph><subparagraph id="id402FBBF591F245C790127187E96F2634" indent="up1"><enum>(C)</enum><text>Not later than 100 days after receiving from the President under subparagraph (B) a direction to devise recommendations with respect to an article, the Secretary of Commerce, in consultation with the United States Trade Representative, the Secretary of Defense, members of the Committee on Finance of the Senate, and members of the Committee on Ways and Means of the House of Representatives, shall submit to the President a report that includes—</text><clause id="id776B0852AD124376A7943F94DF6687AE"><enum>(i)</enum><text>recommendations for action or inaction under this section with respect to the article; and</text></clause><clause id="idC704699BD80D40CAAA06CAF7966C0DF5"><enum>(ii)</enum><text>the findings of the Secretary of Commerce with respect to the investigation by the Secretary of Defense under paragraph (1).</text></clause></subparagraph><subparagraph id="H87A51AA0DAC142C29D4E1C9FAC095FF0" indent="up1"><enum>(D)</enum><text>Any portion of the report submitted by the Secretary of Defense under subparagraph (A) or the report submitted by the Secretary of Commerce under subparagraph (C) that does not contain classified information or proprietary information shall be published in the Federal Register.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idD1A58CAAD64B4C73ABA67E7AD6A4116A"><enum>(D)</enum><text>in paragraph (4), by inserting <quote>of Defense, in consultation with the Secretary of Commerce,</quote> after <quote>The Secretary</quote>;</text></subparagraph></paragraph><paragraph id="id4708A4F47FB247D3B5A9DAAAE9CE6B7D"><enum>(2)</enum><text>in subsection (c)(1), by striking subparagraph (A) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB8FA4B3587F4429FAE94D4A6B50DD2B0"><subparagraph id="idCBB98B3FB92347A0BA17F5501AA26246" indent="up2"><enum>(A)</enum><text>Not later than 60 days after receiving recommendations submitted under subsection (b)(3)(C)(i) with respect to an article, the President shall—</text><clause id="id5CEE74980D724CCEB13FAAF16D229A6F"><enum>(i)</enum><text>decide whether to take action based on such recommendations; and</text></clause><clause id="idD8BCC35C8AB146BBBC7225DFFB395E55"><enum>(ii)</enum><text>if the President decides to take action under clause (i), determine the nature and duration of the action to be taken to adjust the imports of the article and its derivatives so that such imports will not threaten to impair the national security.</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id836A540D26F94E19AB8AE16E4B49253E"><enum>(3)</enum><text>by redesignating the second subsection (d) as subsection (e);</text></paragraph><paragraph id="id79B93145DA1149BD978D510E4AFC8D35"><enum>(4)</enum><text>in subsection (d)—</text><subparagraph id="id1B670D89BAE24084A4C419C0A1E1D296"><enum>(A)</enum><text>by striking <quote>the Secretary and the President</quote> each place it appears and inserting <quote>the Secretary of Defense, the Secretary of Commerce, and the President</quote>; and</text></subparagraph><subparagraph id="idC139AAB62E20490FB2D2CAF1D7828480"><enum>(B)</enum><text>by inserting <quote>, the production of which is needed for national defense requirements and critical infrastructure in the United States</quote> after <quote>welfare of individual domestic industries</quote>; and</text></subparagraph></paragraph><paragraph id="id5B63A3FF3884410A83B5FEA6EEB1EDDA"><enum>(5)</enum><text>in subsection (e)(1), as redesignated by paragraph (3), by striking <quote>Secretary</quote> and inserting <quote>Secretary of Defense</quote>.</text></paragraph></subsection><subsection id="id77ADDA7E75AF4663ACD5F7C126011089"><enum>(b)</enum><header>Congressional disapproval of presidential action</header><paragraph id="id7BF6A6A7F4CB499C81317FB9A0F742EA"><enum>(1)</enum><header>In general</header><text>Section 232(f) of the Trade Expansion Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/19/1862">19 U.S.C. 1862(f)</external-xref>) is amended—</text><subparagraph id="idFA64EE6FA72145D9B5FA33DB7EAD4F85"><enum>(A)</enum><text>in paragraph (1), by striking <quote>of petroleum, or petroleum products</quote>; and</text></subparagraph><subparagraph id="id04CF2169BFB34D01B12D68EA67D77C0F"><enum>(B)</enum><text>in paragraph (2)(B)—</text><clause id="idEB6EA925C7DE4A349BC8B3B84A6BE7EF"><enum>(i)</enum><text>by striking <quote>petroleum imports</quote> and inserting <quote>imports</quote>; and</text></clause><clause id="id67C0E62E385445E0B481DD2DDB985C7F"><enum>(ii)</enum><text>by striking <quote>of petroleum or petroleum products</quote>.</text></clause></subparagraph></paragraph><paragraph id="idCB8A1F46868B4851A6D740F69D1FB9AB"><enum>(2)</enum><header>Applicability</header><subparagraph id="id2F7E53EFE45C42E6B667501BE374DACE"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), subsection (f) of section 232 of the Trade Expansion Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/19/1862">19 U.S.C. 1862</external-xref>), as amended by paragraph (1), shall apply to adjustments of imports under that section on or after July 1, 2018.</text></subparagraph><subparagraph id="idDA83B334D2D94D06B67DD409802C4B8A"><enum>(B)</enum><header>Exception</header><text>Subsection (f) of section 232 of the Trade Expansion Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/19/1862">19 U.S.C. 1862</external-xref>), as amended by paragraph (1), shall not apply to the presidential actions taken under that section on March 8, 2018, relating to the adjustment of imports of steel and aluminum, or any subsequent actions (including proclamations, Executive orders, or other Executive acts) relating to those presidential actions.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
