<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 742</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210315">March 15, 2021</action-date><action-desc><sponsor name-id="S153">Mr. Grassley</sponsor> (for himself, <cosponsor name-id="S057">Mr. Leahy</cosponsor>, and <cosponsor name-id="S221">Mrs. Feinstein</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To modify the exemption for trade secrets and commercial or financial information in the Freedom of Information Act, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Open and Responsive Government Act of 2021</short-title></quote>.</text></section><section id="idAE4304974975419D8CABA6901B9D00D4"><enum>2.</enum><header>Amendments to the Freedom of Information Act</header><text display-inline="no-display-inline">Section 552 of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>) is amended—</text><paragraph id="id28DAF274CC3B412192DB087819D92017"><enum>(1)</enum><text>in subsection (b)(4), by inserting before the semicolon at the end the following: <quote>, provided that the term <quote>confidential</quote> means information that, if disclosed, would likely cause substantial harm to the competitive position of the person from whom the information was obtained</quote>; and</text></paragraph><paragraph id="idF21AC00E38CA42269BCF0E8068884C23"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph id="id1B7FE58D089C4BFABC2E48B59EEE4364"><enum>(A)</enum><text>by striking <quote>This section does not authorize withholding of information</quote> and inserting</text><quoted-block style="OLC" display-inline="yes-display-inline" id="idB9F844057BE5493F9D94FABD5CC18EEA"><text>This section—</text><paragraph id="id83B3BB6106CD4C41B255AE68F8842676"><enum>(1)</enum><text>does not authorize the withholding of information</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idB3DA3B339F8945649698E32610AC6CC7"><enum>(B)</enum><text>in paragraph (1), as so designated, by striking <quote>. This section is not authority to withhold information from Congress.</quote> and inserting a semicolon; and</text></subparagraph><subparagraph id="id28D13F1192E14644B8C091CACCAEF88C"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA286D89973694E79AEB667D870F8BAD9"><paragraph id="idB792B2DB8F334C4B8AA76F4CDBA008D2"><enum>(2)</enum><text>does not authorize the withholding of a portion of an otherwise responsive record on the basis that the portion is non-responsive; and</text></paragraph><paragraph id="id8B30C3E15A894922A042DFBA84D9D242"><enum>(3)</enum><text>is not authority to withhold information from Congress.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
