Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for grants for States that require fair and impartial police training for law enforcement officers of that State and to incentivize States to enact laws requiring the independent investigation and prosecution of the use of deadly force by law enforcement officers, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2608A08052414539BAFCED4E6DBA84E3"><section section-type="section-one" id="HFAF9B1275A6243BE9EF2D59D01BAB49E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Police Training and Independent Review Act of 2021</short-title></quote>.</text></section><section id="HFFB32D83E37A4B729B7DA323D120E967"><enum>2.</enum><header>Grants for training and independent investigation and prosecution</header><text display-inline="no-display-inline">Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10101">34 U.S.C. 10101</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3DA8EE6AA843420CA9F8178E147797BA"><part id="H657015245982488E98514EDB06FA76B5"><enum>PP<?LEXA-Enum OO?></enum><header>Grants for training and independent investigation and prosecution</header><section id="H3E87AEE810424892B1C0DDD4F3A2AEDF"><enum>3061.</enum><header>Grant authority</header><subsection id="id041E1CE3A5724BD189BFED36AC6CAC96"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General may make a grant to a State for purposes of implementing the training requirements described in section 3062(a) and an independent prosecution of law enforcement statute as described in section 3063.</text></subsection><subsection id="idE6902038B2254E68B5B43E2292BC2ACB"><enum>(b)</enum><header>Term</header><text display-inline="yes-display-inline">The term of a grant under subsection (a) shall be 1 fiscal year.</text></subsection></section><section id="HDBE848CF4ACA498486E8D51429576B0A"><enum>3062.</enum><header>Training on fair and impartial policing</header><subsection id="HB0F43057B44842DC8B81C2F9F9B7A195"><enum>(a)</enum><header>Training requirement</header><text>The requirements of this subsection are as follows:</text><paragraph id="HADF4933A16B74A948061195745DBDA67"><enum>(1)</enum><text>A State shall require that all individuals enrolled in an academy of a law enforcement agency of the State and all law enforcement officers of the State complete a training session on fair and impartial policing each year, which includes—</text><subparagraph id="idC93E263DDC864737AA82ABA0C66E56BE"><enum>(A)</enum><text>anti-bias training on implicit and explicit bias on the basis of race, religion, ethnicity, national origin, gender, sexual orientation, gender identity, and disability;</text></subparagraph><subparagraph id="id195C838BE8904FA3B85AA8611E36D23B"><enum>(B)</enum><text>training regarding—</text><clause id="idD5C4BB93466A4B388C3FA6C5DB4DCBD9"><enum>(i)</enum><text>cultural diversity;</text></clause><clause id="id7CA5E4436D4A4D2BA35C919E6678A338"><enum>(ii)</enum><text>police interaction with individuals with mental illness or behavioral, mental, or physical disabilities;</text></clause><clause id="id1B394C9B341944F2AB95E0D2D3A4960B"><enum>(iii)</enum><text>crisis intervention; and</text></clause><clause id="id2C73FC54D7BF416DAD78AA42D5A50B71"><enum>(iv)</enum><text>de-escalation tactics;</text></clause></subparagraph><subparagraph id="id61E021CD80EF4B789FBE7D7AEC053ADB"><enum>(C)</enum><text>scenario-based training; and</text></subparagraph><subparagraph id="idABC58955DE8A43CCAC59600C118DC2F7"><enum>(D)</enum><text>a requirement that officers demonstrate proficiency in the subjects of the training through scenario-based tests.</text></subparagraph></paragraph><paragraph id="id284513BAF2094532A8BB0F1533C8BA41"><enum>(2)</enum><text>Each law enforcement officer and each individual enrolled in an academy of a law enforcement agency of a State shall complete—</text><subparagraph id="idF31C22C7111A42E9A4467D3A1C980D05"><enum>(A)</enum><text>initial training described in paragraph (1) of not less than 8 hours; and</text></subparagraph><subparagraph id="id0C8884CCC5E6415B930B278C22660CC8"><enum>(B)</enum><text>not less than 4 hours of training described in paragraph (1) every year thereafter.</text></subparagraph></paragraph><paragraph id="H02CF1FEBFAAF4CD4A35A40FADA69380F"><enum>(3)</enum><text>A State shall certify to the Attorney General of the United States that such training sessions have been completed.</text></paragraph></subsection><subsection id="id84D31CBF3A5043119CFEF2221C7FCB8C"><enum>(b)</enum><header>Compliance and ineligibility</header><paragraph id="id2B215882CC2D4C3DA3ADB195DE2540A8"><enum>(1)</enum><header>Compliance date</header><text>To be eligible for a grant under this part, a State shall, subject to paragraphs (2) and (3), be in compliance with the training requirements under subsection (a) not later than 240 days after the date of enactment of this part, except that the Attorney General may grant an additional 120 days to a State that is making good faith efforts to comply with such subsection.</text></paragraph><paragraph id="idBDAD56B1532649FB9EA722D8EA730306"><enum>(2)</enum><header>Compliance before start of fiscal year</header><text>A State that fails to achieve compliance with the training requirements under subsection (a) in accordance with paragraph (1) of this subsection shall be eligible for a grant under this part for a fiscal year (subject to section 3063) if, on the last day of the previous fiscal year, the State is in compliance with such requirements.</text></paragraph><paragraph id="id91FD4C8DF06046DF841A9C80F92A84A5"><enum>(3)</enum><header>Ineligibility</header><text>A State that was eligible for a grant under this part and that, as of the last day of a fiscal year, is not in compliance with the training requirements under subsection (a) shall not be eligible for a grant under this part during the next fiscal year.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3F68B63DCCE946A3AC6C7114D68457DB"><enum>(c)</enum><header display-inline="yes-display-inline">Verification</header><text display-inline="yes-display-inline">The attorney general of a State receiving a grant under this part shall verify that the training of individuals enrolled in an academy of a law enforcement agency of the State and all law enforcement officers of the State meets the requirements under subsection (a).</text></subsection><subsection id="id498ea80bae244b8da38d3894bfcecfe3"><enum>(d)</enum><header>Audit requirements</header><text>For each fiscal year for which grants are made under this part, the Inspector General of the Department of Justice shall conduct audits of an appropriate number, as determined by the Inspector General, of States receiving such a grant to ensure compliance with the training requirements under subsection (a).</text></subsection></section><section id="HEC9090BBFA794FAA9C023F248116F3B2"><enum>3063.</enum><header>Independent review of law enforcement use of deadly force</header><text display-inline="no-display-inline">To be eligible for a grant under this part for a fiscal year, a State shall, as of the last day of the prior fiscal year, have enacted and have in effect an independent prosecution of law enforcement statute.</text></section><section id="H240D3D1A67B54732BA64972F1783DFFD"><enum>3064.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text><paragraph id="HD2A0F1278B06459083663EBE68656919"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>deadly force</term> means that force which a reasonable person would consider likely to cause death or serious bodily harm.</text></paragraph><paragraph id="id5eec4b177ce848e8a53f4ee6068c24c8"><enum>(2)</enum><text>The term <term>independent prosecution</term>, with respect to a criminal investigation or prosecution of a law enforcement officer’s use of deadly force, includes using one or more of the following methods:</text><subparagraph id="idf6b6dd6891984527926618978ed28458"><enum>(A)</enum><text>Using an agency or civilian review board that investigates and independently reviews all officer use of force allegations.</text></subparagraph><subparagraph id="id69d2138598de4bdd9cf8214622fd8f2a"><enum>(B)</enum><text>Assigning the attorney general of the State in which the alleged crime was committed to conduct the criminal investigation and prosecution.</text></subparagraph><subparagraph id="iddcccc5ad495f490fb5b467f2918bea9a"><enum>(C)</enum><text>Adopting a procedure under which an automatic referral is made to a special prosecutor appointed and overseen by the attorney general of the State in which the alleged crime was committed.</text></subparagraph><subparagraph id="id7ab1f00c64da4718b63973d2150d7ded"><enum>(D)</enum><text>Having law enforcement agencies agree to and implement memoranda of understanding with other law enforcement agencies under which the other law enforcement agencies—</text><clause id="id2AB127C10EE0441E93159E26F3B6B4C7"><enum>(i)</enum><text>shall conduct the criminal investigation; and</text></clause><clause id="id40F2B0F00240485F831EECABA3EC93C5"><enum>(ii)</enum><text>upon conclusion of the criminal investigation, shall file a report with the attorney general of the State containing a determination regarding whether—</text><subclause id="id9D74A5A5C3834F87900BD07A24646A05"><enum>(I)</enum><text>the use of deadly force was appropriate; and</text></subclause><subclause id="id43D32618A35E422D920F3989A6784A1E"><enum>(II)</enum><text>any action should be taken by the attorney general of the State.</text></subclause></clause></subparagraph><subparagraph id="id6a2db191324045bea8d502a3bd68ebbf"><enum>(E)</enum><text>Using an independent prosecutor.</text></subparagraph></paragraph><paragraph id="ide6e8171443d64af098e4c83f6efaffcd"><enum>(3)</enum><text>The term <term>independent prosecution of law enforcement statute</term> means a statute requiring an independent prosecution in a criminal matter in which—</text><subparagraph id="id661eb23e987d4095a61ec310fb1d6f07"><enum>(A)</enum><text>one or more of the possible defendants is a law enforcement officer;</text></subparagraph><subparagraph id="idcf5af89a735c41a29e92239138a1f7b1"><enum>(B)</enum><text>one or more of the alleged offenses involves the law enforcement officer’s use of deadly force in the course of carrying out that officer’s duty; and</text></subparagraph><subparagraph id="id85c0b70dd1664167915d0dc14725360a"><enum>(C)</enum><text>the law enforcement officer’s use of deadly force resulted in a death or injury. </text></subparagraph></paragraph><paragraph id="H1E0385AB8F644712B16D1FAA2361BA16"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>independent prosecutor</term> means, with respect to a criminal investigation or prosecution of a law enforcement officer’s use of deadly force, a prosecutor who—</text><subparagraph id="id1893b95756784e2ebc98f67adeb40175"><enum>(A)</enum><text>does not live or work in the same county as the county in which the alleged crime was committed; and</text></subparagraph><subparagraph id="idd7ddb6be7d8e41c9b1361237b0f7542d"><enum>(B)</enum><text>would not be involved in the prosecution in the ordinary course of that prosecutor’s duties.</text></subparagraph></paragraph></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
