improve the management of information technology projects and investments of the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7A15840C6013427B8379D7CDD44681C2"><section section-type="section-one" id="H00C0BA5C048B499D96FF93892B107DC5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Veterans Affairs Information Technology Reform Act of 2021</short-title></quote>.</text></section><section id="H5BCD14AAE93546CD8850F8B225FA36F5"><enum>2.</enum><header>Management of major information technology projects</header><subsection id="HAA11E2D97B734BFABF3729EA99D80066"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/81">Chapter 81</external-xref> of title 38, United States Code, is amended by adding at the end the following new subchapter:</text><quoted-block style="USC" display-inline="no-display-inline" id="HBCA5DF686DB14EE69056167E5649F0D5"><subchapter id="H98E750FD654D4D96A030BAD71BCBF7A2"><enum>VI</enum><header>Information technology projects and activities</header><section id="H64901980D5C949AF959D5997BE725097"><enum>8171.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text><paragraph id="HAA3193A2530249DD8FD44AD99DBA6BD2"><enum>(1)</enum><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="H3CFD9308137E4E36AB1D67AA78BCF4FA"><enum>(A)</enum><text>the Committee on Veterans' Affairs and the Subcommittee on Military Construction, Veterans Affairs and Related Agencies of the Committee on Appropriations of the Senate; and</text></subparagraph><subparagraph id="id1C6E613D6BEE4CF098BBCBEC77A489CF"><enum>(B)</enum><text>the Committee on Veterans’ Affairs and the Subcommittee on Military Construction, Veterans Affairs and Related Agencies of the Committee on Appropriations of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H99BF07FBD3D34506810D9AC026E2BD95"><enum>(2)</enum><text>The term <term>information technology</term> has the meaning given that term in section 11101 of title 40.</text></paragraph><paragraph id="id82332C87C1EE4D6DB6748F57362F61E3"><enum>(3)</enum><text>The term <term>information technology project</term> means a project or program of the Department (including a project or program of any element of the Department) for, or including, the acquisition or implementation of an information technology system.</text></paragraph><paragraph id="HA01813F541234CC5A29E65BDAB21DC96"><enum>(4)</enum><text>The term <term>life cycle costs</term> means all direct and indirect costs to acquire, implement, operate, and maintain an information technology system.</text></paragraph><paragraph id="H34D9DA4811ED458AAF0E8554AEB1873B"><enum>(5)</enum><text>The term <term>major information technology project</term> means an information technology project if—</text><subparagraph id="H5A50B61DCCF84CFC8708D030D4C67F42"><enum>(A)</enum><text>the project is designated—</text><clause id="H324FAA9B1CE84CDE90D5C60E993977B6"><enum>(i)</enum><text>by the Secretary or the Chief Information Officer of the Department as a major information technology project; or</text></clause><clause id="H1CA05D65CD7444B28F7A00850B57EF11"><enum>(ii)</enum><text>by the Director of the Office of Management and Budget as a major information technology investment, as defined in section 11302 of title 40; </text></clause></subparagraph><subparagraph id="HF437F6F226134EF0B6411F27AD884A51"><enum>(B)</enum><text>the dollar value of the project or program is estimated by the Secretary to exceed—</text><clause id="H22FC1E05166B429D83D7AAA6060AB870"><enum>(i)</enum><text>$50,000,000 (as adjusted for inflation pursuant to section 1908 of title 41) for all project costs in a single fiscal year;</text></clause><clause id="H45E5A233F4D74F98A39B505B5EBF1B21"><enum>(ii)</enum><text display-inline="yes-display-inline">$200,000,000 (as adjusted for inflation pursuant to section 1908 of title 41) for all project acquisition or implementation costs for the duration of the project; or</text></clause><clause id="HB7FE292238444AB7A36DC4AD51FBFFA0"><enum>(iii)</enum><text display-inline="yes-display-inline">$500,000,000 (as adjusted for inflation pursuant to section 1908 of title 41) for the total life cycle costs of the project; or</text></clause></subparagraph><subparagraph id="HA877627D376841A58FDEAEBCC7E5B14D"><enum>(C)</enum><text>any increment of the project separately meets the requirements of subparagraphs (A) or (B).</text></subparagraph></paragraph></section><section id="HBC5FB55F4F284FDE82DDDDF9F702DC0E"><enum>8172.</enum><header>Management of major information technology projects</header><subsection id="HB69E89E44E6240D0B85646EFA76E5F2B"><enum>(a)</enum><header>Cost, schedule, and performance information</header><paragraph commented="no" display-inline="yes-display-inline" id="id82607666D1864A5783A347F5E23E3C0D"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary may not obligate or expend funds for any major information technology project that begins after the date of the enactment of the <short-title>Department of Veterans Affairs Information Technology Reform Act of 2021</short-title> unless the Secretary, acting through the Chief Information Officer of the Department, submits to the appropriate congressional committees a report containing information on the cost, schedule, and performance of such project.</text></paragraph><paragraph id="id0973CFFA2616466F899D493CBB6E5BEA" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Each report submitted under paragraph (1) for a project shall include, with respect to such project, the following:</text><subparagraph id="H65C24DF7A24849619A802B5A7F592386"><enum>(A)</enum><text>An estimate of acquisition, implementation, and life cycle costs.</text></subparagraph><subparagraph id="H92D37DD288064C26AFBFDCF4D31DC773"><enum>(B)</enum><text>An intended implementation schedule indicating significant milestones, initial operating capability, and full operating capability or completion.</text></subparagraph><subparagraph id="H2A63BEA6D53C4C9BA89ECCD11D33326A"><enum>(C)</enum><text>Key business, functional, and performance objectives.</text></subparagraph></paragraph></subsection><subsection id="H40B5197309C149F590CB1E7ABC81C80C"><enum>(b)</enum><header>Baseline</header><paragraph commented="no" display-inline="yes-display-inline" id="HCBF6D9A5D1B444D39FFC3055A94121C4"><enum>(1)</enum><text>The Secretary shall use the information on the cost, schedule, and performance of a major information technology project included in the report under subsection (a) as the baseline against which changes or variances are measured during the life cycle of such project.</text></paragraph><paragraph id="H9848975FBF6D411995BD26CDB3AF0AD7" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary shall—</text><subparagraph id="HEAD822405E174A7E9E6E524EE2E72FFB"><enum>(A)</enum><text>annually update the baseline of a major information technology project pursuant to subsection (c); and</text></subparagraph><subparagraph id="H1E48905312EC468BAD0EA0E27831551E"><enum>(B)</enum><text display-inline="yes-display-inline">include such updated baseline in the documents providing detailed information on the budget for the Department that the Secretary submits to Congress in conjunction with the President's budget submission pursuant to section 1105 of title 31.</text></subparagraph></paragraph></subsection><subsection id="H3CA16A84F0C641E486B2AF957566F25D"><enum>(c)</enum><header>Changes and variances</header><paragraph commented="no" display-inline="yes-display-inline" id="H823E936B4DDC45AD848B1B0B1209A47E"><enum>(1)</enum><text>Not later than 60 days after the date on which the Secretary identifies a change or variance described in paragraph (2) in the cost, schedule, or performance of a major information technology project, the Secretary, acting through the Chief Information Officer, shall submit to the appropriate congressional committees a notification of such change or variance, including a description and explanation for such change or variance.</text></paragraph><paragraph id="H818D5170EF8745659566F9143E36417D" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A change or variance in the cost, schedule, or performance of a major information technology project described in this paragraph is—</text><subparagraph id="H87B1F3B17DB949769E03A8156E4D3D3B"><enum>(A)</enum><text>with respect to the acquisition, implementation, or life cycle cost of the project, or an increment therein, a change or variance that is 10 percent or greater compared to the baseline; </text></subparagraph><subparagraph id="H776B6D271B3F497187BC0F72600882DB"><enum>(B)</enum><text>with respect to the schedule for achieving a significant milestone, initial operating capability, or final completion of the project, a change or variance that is 180 days or greater compared to the baseline; or</text></subparagraph><subparagraph id="H12B33B0789D94C0283986780052A19F5"><enum>(C)</enum><text display-inline="yes-display-inline">with respect to the performance, an instance where a key business, functional, or performance objective is not attained, or is not anticipated to be attained, in whole or in part.</text></subparagraph></paragraph></subsection><subsection id="HF6AEA2DFF89E420BAAC1C103E74731F1"><enum>(d)</enum><header>Management</header><text>The Secretary shall ensure that each major information technology project is managed by an interdisciplinary team consisting of the following:</text><paragraph id="H21AFD9EB820042DC8CC16688DED2653C"><enum>(1)</enum><text>A project manager who is—</text><subparagraph id="HCD34B22B7DD74230B0B42B4845481205"><enum>(A)</enum><text>certified in project management at level three by the Department or the Department of Defense pursuant to section 1701a of title 10, or who holds an equivalent certification by a private sector project management certification organization, as determined appropriate by the Secretary; and</text></subparagraph><subparagraph id="HDAA5E80A306E4236A1F6500A17C771DC"><enum>(B)</enum><text>an employee of the Office of Information and Technology of the Department or an employee of an element of the Department at which the project originates.</text></subparagraph></paragraph><paragraph id="HB24886954AB5439D957B42E40CEFA4DF"><enum>(2)</enum><text display-inline="yes-display-inline">A functional lead who is an employee of the element of the Department at which the project originates.</text></paragraph><paragraph id="HD990D7FDCD824C05935A5331ADA9DA4B"><enum>(3)</enum><text display-inline="yes-display-inline">A technical lead who is an employee of the Office of Information and Technology of the Department.</text></paragraph><paragraph id="HC1EF053E1D61461093B5EBDF0D17F87B"><enum>(4)</enum><text>A contracting officer.</text></paragraph><paragraph id="H2636EFD94DE8499CA187305C5E7F5EF3"><enum>(5)</enum><text>Sufficient other project management, functional, technical, and procurement personnel as the Secretary determines appropriate.</text></paragraph></subsection></section><section id="HCD505FE14E7B4BDB85E18F003450D984"><enum>8173.</enum><header>Information technology activities of the Financial Services Center</header><subsection id="H3BDDFBBCA7D641F393352BD608774A43"><enum>(a)</enum><header>Management</header><text>Consistent with sections 11302 and 11319 of title 40—</text><paragraph id="HD862001F89074804B69EA189CA36050D"><enum>(1)</enum><text>the Chief Information Officer of the Department shall—</text><subparagraph id="H6A10B3F3B5F84EB5AA2C766D70DFF0F4"><enum>(A)</enum><text>exercise authority over the management, governance, and oversight processes relating to information technology of the Financial Services Center of the Department, or such successor office; and</text></subparagraph><subparagraph id="HCA5B887E50B441EE96B02768F9EF9754"><enum>(B)</enum><text>supervise the information technology employees and contractors of the Financial Services Center; and</text></subparagraph></paragraph><paragraph id="H08B753F9A5DE46C6971E184B60AA82A9"><enum>(2)</enum><text>the Director of the Financial Services Center of the Department, or the head of such successor office, may not enter into a contract or other agreement for information technology or information technology services unless the contract or other agreement has been reviewed and approved by the Chief Information Officer.</text></paragraph></subsection><subsection id="H65AE1C56B4D642BB91F1B3B4AF94C237"><enum>(b)</enum><header>Oversight</header><text>The Chief Information Officer shall have oversight and operational authority over all information security practices of the Financial Services Center of the Department.</text></subsection></section><section id="HBF893D4CDFAC4EA48C105F25653F8B80"><enum>8174.</enum><header>Submission of annual reviews of information technology</header><subsection id="id828DF162705644919B6CAD9B235DA6A2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Chief Information Officer of the Department, shall submit to the appropriate congressional committees each annual review of the information technology portfolio of the Department conducted pursuant to section 11319(d)(3) of title 40.</text></subsection><subsection id="id99212F1F15214C46BFC9A4A4467681F6"><enum>(b)</enum><header>First submission</header><text display-inline="yes-display-inline">The first annual review submitted under subsection (a) shall include a copy of each previous annual review conducted under section 11319(d)(3) of title 40.</text></subsection></section><section id="idf69a1a6e6435401aac1d285203c5829c"><enum>8175.</enum><header>Information technology matters to be included in budget justification materials for the Department</header><subsection id="id791447BE6EAE416FA5ED00E78CA32147"><enum>(a)</enum><header>List of information technology projects in effect</header><paragraph commented="no" display-inline="yes-display-inline" id="id1B684FAB4B294418876AA0FD9A458CE8"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that whenever the budget justification materials are submitted to Congress in support of the Department budget for a fiscal year (as submitted with the budget of the President for such fiscal year under section 1105(a) of title 31), such budget justification materials include a list of every information technology project currently in effect at the Department.</text></paragraph><paragraph id="id207B0FE9F7D04022B4CD761100691C62" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Each list included under paragraph (1) shall include, for each information technology project included in the list, the following:</text><subparagraph id="idA6AD8983468D40DD85C9DF91A932F22E"><enum>(A)</enum><text>The expenditures to date.</text></subparagraph><subparagraph id="id3A11617E8F2D4F8FBB31BBE44E3A9FF3"><enum>(B)</enum><text>Planned expenditures for the upcoming fiscal year.</text></subparagraph><subparagraph id="id745AF649B83841BFA949F43F445A98A2"><enum>(C)</enum><text>The scheduled completion date.</text></subparagraph><subparagraph id="idD5C1E29290C64DFA92DE1D0388E35137"><enum>(D)</enum><text>Any known deviation from the schedule, such as whether the information technology project is behind schedule.</text></subparagraph><subparagraph id="idB0067E8F8C25473BAE5B6378E2308A1C"><enum>(E)</enum><text>The planned or actual functionality delivered.</text></subparagraph></paragraph></subsection><subsection id="id0B2BD8853CA543C8BEE5D0D2EC1FC6BD"><enum>(b)</enum><header>Prioritized list of unfunded projects</header><paragraph commented="no" display-inline="yes-display-inline" id="id0201C8CF77474FC6B65BA22C2A1D541E"><enum>(1)</enum><text>In addition to the list included in the budget justification materials required by subsection (a), the Secretary shall ensure that the budget justification materials described in such subsection also include a prioritized list, in rank order, of every proposed project of the Department that is unfunded as of the time of the inclusion of the list under this paragraph.</text></paragraph><paragraph id="id4DC83801F6744226936BC9EA2257FF57" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In producing the list required by paragraph (1), the Secretary shall—</text><subparagraph id="idD1881F6D305F4599B8687582CA5BF56C"><enum>(A)</enum><text display-inline="yes-display-inline">ensure such list represents a ranking of all proposed projects that reflects the needs of all components of the Department;</text></subparagraph><subparagraph id="idECF3C3E3F04245969993FE9A1D16E3CF"><enum>(B)</enum><text>produce one unified list for the entire Department that shows how the various proposed projects of each of the components of the Department rank in priority with the projects of the other components of the Department; and</text></subparagraph><subparagraph id="idC0FFAC23DA4D4E6FA0108F03C2746E10"><enum>(C)</enum><text>ensure that the list—</text><clause id="idD9C5F1ED09754A1BA9966DE269D81C61"><enum>(i)</enum><text>does not disaggregate and rank projects based on component of the Department; and</text></clause><clause id="idE707091C85674D2DBE851B4BE91DCF00"><enum>(ii)</enum><text>does identify the component of the Department requesting the information technology project. </text></clause></subparagraph></paragraph><paragraph id="id44468997A93B417C95CBD8F10487A580" commented="no" display-inline="no-display-inline" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id40D7BA08716F48738D9F7522A4A97EFD"><enum>(A)</enum><text display-inline="yes-display-inline">In producing each list under paragraph (1), the Secretary shall prioritize and rank each information technology project based on an assessment of each of the following factors:</text><clause commented="no" display-inline="no-display-inline" indent="up1" id="idA000BBD7CFC44C4C8ACEF548DE4B91D1"><enum>(i)</enum><text display-inline="yes-display-inline">Tangible benefits to veterans created or produced by the information technology project.</text></clause><clause display-inline="no-display-inline" commented="no" indent="up1" id="idED518C46BCBD4E588BC5E26601E9A199"><enum>(ii)</enum><text>Operational or efficiency benefits to employees of the Department created or produced by the information technology project.</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id15D13EB8D76245FF9C5A01B602D513EB"><enum>(iii)</enum><text display-inline="yes-display-inline">The cost of the information technology project.</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id56D55DE03E014DD6BAACA16CB00907E5"><enum>(iv)</enum><text display-inline="yes-display-inline">The cost savings or cost avoidance yielded by the information technology project.</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id17ED8BD3EE374C4B8EB816AF4AFA74AA"><enum>(v)</enum><text display-inline="yes-display-inline">Time to completion of the information technology project. </text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="idACC81C7E7B4B4612A18F114A9727D9E6"><enum>(vi)</enum><text display-inline="yes-display-inline">The difficulty of the information technology project, the likelihood the information technology project will be completed, or the risks associated with undertaking the information technology project. </text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id1ABD17DBBB384ED1A22C31CAEE41A9A5"><enum>(vii)</enum><text display-inline="yes-display-inline">Such other factors as the Secretary considers appropriate.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id5858A13D82A846B6BCE8A8F072E4E847"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that each list produced under paragraph (1) includes, for each information technology project included in the list, a brief description of the findings of the Secretary with respect to each assessment carried out by the Secretary for each factor for the information technology project under subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="id4A79652A434F46A9B58096153A219D1B"><enum>(c)</enum><header>Projected funding needs</header><paragraph commented="no" display-inline="yes-display-inline" id="id65B7622271E6463199AB512AB2ECD602"><enum>(1)</enum><text display-inline="yes-display-inline">In addition to the matters included under subsections (a) and (b), the Secretary shall ensure that the budget justification materials described in subsection (a) also include a projection of the one-year, five-year, and 10-year funding needs of the Department for information technology, disaggregated by major business line of the Department that requires the funding.</text></paragraph><paragraph id="id2D59C2ABA4A9434F8AC6573243D064A2" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In addition to the projections under paragraph (1), the Secretary shall include a description of the following, with respect to each of the periods set forth in such paragraph, disaggregated by major business line of the Department:</text><subparagraph id="id4268D17B52AE47619334A2D1FEF8A8F9"><enum>(A)</enum><text display-inline="yes-display-inline">The information technology infrastructure and equipment requirements.</text></subparagraph><subparagraph id="id737A605E54D548AEA3DE170AB44A4DF4"><enum>(B)</enum><text display-inline="yes-display-inline">The funding required for development.</text></subparagraph><subparagraph id="idEA240C82B56741F98242885D9644821A"><enum>(C)</enum><text display-inline="yes-display-inline">The funding required for operations and maintenance.</text></subparagraph><subparagraph id="id2995375A90AB4F12B83B7FD735E22D2D"><enum>(D)</enum><text>The funding required by cybersecurity.</text></subparagraph><subparagraph id="idF1B2D39A27184C42A52DFB8AB5962B16"><enum>(E)</enum><text display-inline="yes-display-inline">Such other categories of the information technology needs of the Department as the Secretary considers relevant and important.</text></subparagraph></paragraph></subsection><subsection id="id6932C38B9ECC421087C71A719E2B5417"><enum>(d)</enum><header>Decommissioning of information technology systems</header><paragraph commented="no" display-inline="yes-display-inline" id="id209EC8DF10E046449E01020F95E4C22D"><enum>(1)</enum><text display-inline="yes-display-inline">In addition to the matters included under subsections (a), (b), and (c), the Secretary shall ensure that the budget justification materials described in subsection (a) also include information about the decommissioning of information technology systems and applications of the Department.</text></paragraph><paragraph indent="up1" id="id259306EEA240467FAB0292E425756E44"><enum>(2)</enum><text>Information included under paragraph (1) shall include the following:</text><subparagraph id="id35C462A081B34C1ABA2182C569539AED"><enum>(A)</enum><text display-inline="yes-display-inline">A list of information systems and applications of the Department that have been scheduled for decommissioning or the Secretary proposes decommissioning.</text></subparagraph><subparagraph id="id2DF0E0B87542477EA07BBA98A2F2C5C8"><enum>(B)</enum><text display-inline="yes-display-inline">For each information technology system and application listed under subparagraph (A), the following:</text><clause id="idC3428C288A04435D88C8A4AFDE8C3483"><enum>(i)</enum><text display-inline="yes-display-inline">The cost of maintaining the information technology system or application.</text></clause><clause id="id0B6FC5A01B754DB6B8201AF068A1BA80"><enum>(ii)</enum><text display-inline="yes-display-inline">A projection of the cost avoided if the information technology system or application were to be decommissioned.</text></clause><clause id="id1BE5463E0BC6422BBFD8F283377B9795"><enum>(iii)</enum><text display-inline="yes-display-inline">A schedule for decommissioning the information technology system or application.</text></clause><clause id="id5BC81E342C454F61AB3127A972328AEC"><enum>(iv)</enum><text display-inline="yes-display-inline">Whether a transition plan for the functionality of the information technology system or application to be provided, when appropriate, by other information technology systems or applications of the Department report</header><paragraph id="H8A7895BF81764E339FFED9C359F1CCDE"><enum>(1)</enum><header>Current and new projects</header><text display-inline="yes-display-inline">Except as specifically provided in subsection (a) of section 8172 of title 38, United States Code, as added by subsection (a) of this section, such section 8172 shall apply with respect to major information technology projects that begin before, on, or after the date of the enactment of this Act.</text></paragraph><paragraph commented="no" id="HD70C900167AC43EB97D255E18A98EA0F"><enum>(2)</enum><header>Report on current projects</header><subparagraph commented="no" id="HB2D33FE41CB7499398B2617E9FC17BBA"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the appropriate congressional committees a report on each major information technology project that the Secretary is carrying out as of the date of the report.</text></subparagraph><subparagraph commented="no" id="idEC828B269C5A433B9DF2BB6DF9E1766C"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">The report submitted under subparagraph (A) shall contain, with respect to each project described in such subparagraph, information on the cost, schedule, and performance of the project as described in subsection (a) of section 8172 of such title, as so added.</text></subparagraph></paragraph><paragraph commented="no" id="H5F5C8CD21F7D4251AFEC2D7FCF4A2DFE"><enum>(3)</enum><header>Definitions</header><text>In this subsection, the terms <term>appropriate congressional committees</term> and <term>major information technology project</term> have the meanings given those terms in section 8171 of title 38, United States Code, as added by subsection (a) of this section.</text></paragraph></subsection><subsection commented="no" id="idDC66CFB2D87A481F818334C1BFC36EC5"><enum>(d)</enum><header>Effective date of requirement for projects in budget justification materials</header><text>Subsection (c) of section 8175 of such title, as added by subsection (a) of this section, shall take effect on the first Monday in the second January beginning after the date of the enactment of this Act.</text></subsection><subsection commented="no" id="id41F0B0AC01D74840B1E22AF74D3572BB"><enum>(e)</enum><header>Effective date of decommissioning performance element of budget justification materials</header><text>Clause (v) of section 8175(d)(2)(B) of such title, as added by subsection (a) of this section, shall take effect on the first Monday in the second January beginning after the date of the enactment of this Act.</text></subsection></section><section id="H05F429E4A77545F89294ED6CB83EED54"><enum>3.</enum><header>Assessment of suitability of cloud migration investments</header><subsection id="HBD48D7962B8E405AA52E41A503DA9D80"><enum>(a)</enum><header>Assessment</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs, acting through the Chief Information Officer of the Department of Veterans Affairs, shall conduct an assessment, in accordance with guidance from the Office of Management and Budget, of all information technology investments of the Department of Veterans Affairs to determine the suitability of the investments for migration to a cloud computing service.</text></subsection><subsection id="HEDBBA87E01CA409D92FBDBC24B1F6C37"><enum>(b)</enum><header>Consistent mechanism</header><text>The Secretary, acting through the Chief Information Officer, shall establish a consistent and repeatable mechanism to track savings and cost avoidances from—</text><paragraph id="H9AFF4F3654EB4497BC1B6FADCC743A96"><enum>(1)</enum><text>the migration of information technology investments to cloud computing services; and</text></paragraph><paragraph id="HD72E127EF114482E8B4F17169B27D606"><enum>(2)</enum><text>the deployment of cloud computing services.</text></paragraph></subsection></section><section id="H584B7075E994457C89EF5D807FA24CDC"><enum>4.</enum><header>Report on information technology dashboard information</header><subsection id="H6337AEE40E9B49E8B8BCDB1DCD91B12A"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of Veterans Affairs, acting through the Chief Information Officer of the Department of Veterans Affairs, shall submit to the appropriate congressional committees a report containing—</text><paragraph id="H04C63FC358C54E5BB6B238EA6627944A"><enum>(1)</enum><text display-inline="yes-display-inline">an explanation of the ratings, rankings, and risk categorizations used by the Chief Information Officer pursuant to subparagraph (C) of section 11302(c)(3) of title 40, United States Code, with respect to the information technology dashboard of the Office of Management and Budget developed under such section; and</text></paragraph><paragraph id="HBFF8BF821F0F4188B960E4E1A0A87C19"><enum>(2)</enum><text display-inline="yes-display-inline">copies of supporting or explanatory information provided by the Chief Information Officer to the Office of Management and Budget with respect to submissions by the Chief Information Officer to the information technology dashboard for the fiscal year in which the report is submitted (other than information not otherwise made public pursuant to such section).</text></paragraph></subsection><subsection id="H184E28207FD94C209DAE18160EA534AF"><enum>(b)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> has the meaning given such term in section 8171 of title 38, United States Code, as added by section 2.</text></subsection></section></legis-body></bill>
