which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Energy Policy Act of 2005 to establish a program to provide grants and loan guarantees to improve the energy efficiency of publicly owned wastewater treatment facilities, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wastewater Efficiency and Treatment Act of 2021</short-title></quote>.</text></section><section id="id4cabf5a1eceb4e50bf79b0d513f66f20"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="idc6b8f513ec694972921359dc044e19ed"><enum>(1)</enum><text>municipalities face high energy costs to operate and maintain the wastewater treatment facilities of the municipalities;</text></paragraph><paragraph id="idD4DA41D8ECD54D85AAD5EDD154F0DE94"><enum>(2)</enum><text>energy intensive operations at wastewater treatment facilities can include aeration, influent pumping, aerobic digestion, anaerobic digestion, building operations, and other critical components of the waste treatment process;</text></paragraph><paragraph id="idbb8013c12cc144e0a90a0d77f076b38c"><enum>(3)</enum><text>the utility energy costs of a municipality can exceed 30 percent of total energy costs of the municipality;</text></paragraph><paragraph id="ida146cf62ca034a06bbba33d18acf3720"><enum>(4)</enum><text>energy costs are part of the calculus in determining ratepayer rates;</text></paragraph><paragraph id="iddf6c8cede54245d8adacd0d44989541a"><enum>(5)</enum><text>wastewater treatment facilities that use anaerobic digestion can capture methane for conversion into energy for onsite power production, heating, transportation fuel, export of renewable natural gas or electricity, and other uses;</text></paragraph><paragraph id="id2D616FF4D92D41369B12C296C6713053"><enum>(6)</enum><text>the process described in paragraph (5) may be enhanced through innovative technologies, such as codigestion of fats, oils and grease, food waste, and other organic waste;</text></paragraph><paragraph id="id3CAB006EB9334940881B342C0C77B8ED"><enum>(7)</enum><text>all wastewater treatment facilities, regardless of type of treatment or size, can benefit from energy audits and installation of energy efficient components;</text></paragraph><paragraph id="id2DAEEC01FCF246B98C3D63C92EE78FBE"><enum>(8)</enum><text>investment in recovery technologies for use by wastewater treatment facilities may result in—</text><subparagraph id="idb4454ebdb6aa4d0498820476a488ce47"><enum>(A)</enum><text>reduced energy costs for the wastewater treatment facility;</text></subparagraph><subparagraph id="id10c6593b846d47c98a1f95654565da11"><enum>(B)</enum><text>improved energy resiliency of the wastewater treatment facility; and</text></subparagraph><subparagraph id="id07d56f3e91194e0ca27725e02ec7d44f"><enum>(C)</enum><text>potential revenue generating streams for the municipality that owns the wastewater treatment facility;</text></subparagraph></paragraph><paragraph id="id8565d3b223f44544ae2d2015b7b0b678"><enum>(9)</enum><text>many existing Federal programs relating to water infrastructure remain inaccessible because municipality officials and utility managers may not have resources—</text><subparagraph id="id46650E99BFC84E1DA0560699EDC576E9"><enum>(A)</enum><text>to upgrade the infrastructure of the wastewater treatment facilities of the municipality for energy efficiency; or</text></subparagraph><subparagraph id="id67FF57DB497B4AEB86D17723CE607EF7"><enum>(B)</enum><text>to transition wastewater treatment facilities of the municipality towards energy resiliency; and</text></subparagraph></paragraph><paragraph id="iddd428b25bd714b89b8e1f43a059262c9"><enum>(10)</enum><text>this Act will substantially benefit wastewater treatment facilities in the United States by addressing the gap in funding for wastewater treatment facility projects for large and small municipalities by making loan guarantees and grants available to municipalities to reduce borrowing costs and accelerate water infrastructure investment.</text></paragraph></section><section id="id5237E2A54B414E5EA28EACE394702F93"><enum>3.</enum><header>Water and Energy Efficiency Program</header><subsection id="id7DBD79321E304FFB99087DE5125398C4"><enum>(a)</enum><header>Water and Energy Efficiency Program</header><text display-inline="yes-display-inline">The Energy Policy Act of 2005 is amended by inserting after section 1705 (<external-xref legal-doc="usc" parsable-cite="usc/42/16516">42 U.S.C. 16516</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id947236873CA64841B374034BB1CF497F"><section id="id9CA33E0A7CA04698A5B55FA5E3649AF0"><enum>1706.</enum><header>Water and Energy Efficiency Program</header><subsection id="idea5edb8bd47b41618b2fd03b3e042db4"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to provide grants and guarantees—</text><paragraph id="idC7F6655700F64CC184C6B61096308E6F"><enum>(1)</enum><text>to improve energy efficiency, energy production, and nutrient recovery at wastewater treatment facilities;</text></paragraph><paragraph id="id2323ed77145046f7970f5ed8fd348804"><enum>(2)</enum><text>to generate energy from waste in the treatment process of wastewater treatment facilities; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc3a70afbc50d4bab88c8212f3c699f66"><enum>(3)</enum><text>to reduce the energy consumption of eligible municipalities and Tribes in which wastewater treatment facilities are located.</text></paragraph></subsection><subsection id="id57416e9c3dc74d4095bd4881f2b2e0a8"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id8B455F633243431F9F280B471BBE6104"><enum>(1)</enum><header>Eligible municipality or Tribe</header><text>The term <term>eligible municipality or Tribe</term> means a municipality or Indian Tribe determined to be eligible under the criteria developed under subsection (c)(2).</text></paragraph><paragraph id="id5883580b05824b3cb61b204b3372b168"><enum>(2)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term> in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC1FCDE80E9F84EAB8EAFA85261376BF8"><enum>(3)</enum><header>Program</header><text>The term <term>Program</term> means the Water and Energy Efficiency Program established under subsection (c)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99cd243660a5495794a6273a2c531f4a"><enum>(4)</enum><header>Wastewater treatment facility</header><text>The term <term>wastewater treatment facility</term> has the meaning given the term <term>treatment works</term> in section 212 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>).</text></paragraph></subsection><subsection id="ida0bb51145efe4072b2eb4e704fc67f0f"><enum>(c)</enum><header>Establishment</header><paragraph id="id8DC5B6755B6746578D130CA391F9CA03"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this section, notwithstanding section 1703, the Secretary shall establish a program, to be known as the <quote>Water and Energy Efficiency Program</quote>, to provide—</text><subparagraph id="idC81B8E3DC44449269115E56D5EBAC92F"><enum>(A)</enum><text>grants under subsection (d); and</text></subparagraph><subparagraph id="idCBF5356B7BA3427B8CBE1DEBDFBFACE2"><enum>(B)</enum><text>guarantees under subsection (e).</text></subparagraph></paragraph><paragraph id="id9E4DB3C80B08490CACED111F7FD9FBF6"><enum>(2)</enum><header>Criteria</header><text>The Secretary shall develop application criteria for providing grants and guarantees under the Program, including criteria to determine whether a municipality or Indian Tribe is eligible for a grant or guarantee under the Program.</text></paragraph></subsection><subsection id="id68313CED81684F67AD42AFF6486AFE8F"><enum>(d)</enum><header>Water efficiency grants</header><paragraph id="id5CEB3EEEFC504C029244EB7ECAD993BA"><enum>(1)</enum><header>In general</header><text>Under the Program, the Secretary, acting through the Assistant Secretary for Energy Efficiency and Renewable Energy, shall award grants to eligible entities described in paragraph (2) to carry out 1 or more eligible projects described in paragraph (3).</text></paragraph><paragraph id="id10FC9813FE454A77B7AD810EDBC2B1FF"><enum>(2)</enum><header>Eligible entities</header><text>An entity eligible to receive a grant under this subsection is a small publicly wastewater treatment facility that serves—</text><subparagraph id="id0A469BFF1FD842DF9DA2E99AF083942E"><enum>(A)</enum><text>a population of not more than 10,000; or</text></subparagraph><subparagraph id="idB8D9720481E6458DB8D6911D455B5253"><enum>(B)</enum><text>a disadvantaged community, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="id5db47cb64f134d80a626ee7f20c79d12"><enum>(3)</enum><header>Eligible projects</header><text display-inline="yes-display-inline">An eligible project referred to in paragraph (1) is—</text><subparagraph id="idc50604894b9d4b709b4e42160bc4a8ba"><enum>(A)</enum><text>a project to carry out an energy efficiency audit of a wastewater treatment facility to identify opportunities in the operations of the wastewater treatment facility—</text><clause id="id2758fa6690254e2db61645d682b2c168"><enum>(i)</enum><text>to reduce electrical demand; or</text></clause><clause id="idab236ac659c642b48271b070209a01d5"><enum>(ii)</enum><text>to reduce losses in the wastewater treatment facility system; and</text></clause></subparagraph><subparagraph id="id2f67852bf33b4ea68a774059213d6adb"><enum>(B)</enum><text>a project to replace equipment or to carry out other small capital projects to update components of a wastewater treatment facility based on the results of an energy efficiency audit of the wastewater treatment facility.</text></subparagraph></paragraph><paragraph id="id13334ae70a684eaba31e0dd619048bf7"><enum>(4)</enum><header>Amount of grant</header><text>The amount of a grant made under this subsection shall not exceed $25,000.</text></paragraph><paragraph id="id1F22812FF42A4620891AE82B81C5C36B"><enum>(5)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this subsection $5,000,000 for fiscal year 2021 and each fiscal year thereafter, of which not more than 4 percent each fiscal year shall be used for administrative costs.</text></paragraph></subsection><subsection id="idCA3630579D614D20A2ED11D60B0D880A"><enum>(e)</enum><header>Water and energy efficiency guarantees</header><paragraph id="idE31B8B4E832247EC8E05127C0E9ACB26"><enum>(1)</enum><header>In general</header><text>Under the Program, the Secretary shall provide guarantees to eligible municipalities and Tribes to carry out 1 or more eligible projects described in paragraph (2).</text></paragraph><paragraph id="id73b706d1fd9544da872b3fece72b5c8c"><enum>(2)</enum><header>Eligible projects</header><text>An eligible project referred to in paragraph (1) is—</text><subparagraph id="idDBF715B95428411DBF31C65FB5A2BABA"><enum>(A)</enum><text>a project to convert waste in the treatment process of the wastewater treatment facility into renewable fuels, biosolids, or other byproducts, including—</text><clause id="idadd716da23864b44a349c2e8dccdb83d"><enum>(i)</enum><text>predigestion solids treatment;</text></clause><clause id="ida9122a43b73943728753a8e1390a76e0"><enum>(ii)</enum><text>installation of anaerobic digesters;</text></clause><clause id="id79ffa2567f824ffdbdce420eb6327100"><enum>(iii)</enum><text>biogas capture;</text></clause><clause id="ida400aaffea95434e972b3ffd0b1d0c7b"><enum>(iv)</enum><text>energy transfer;</text></clause><clause id="id9fb6b7ab5a594cdfbc0cdbdf34617c12"><enum>(v)</enum><text>enhanced nutrient recovery;</text></clause><clause id="idC2FC1C2F88474852B2F2759C86944B64"><enum>(vi)</enum><text>material feedstocks;</text></clause><clause id="id799f93c6f9f74dea803622387201d2ae"><enum>(vii)</enum><text>facility upgrades and retrofits necessary to create or improve waste-to-energy systems; and</text></clause><clause id="id29a983e633df4b06aafd9df6ebea7006"><enum>(viii)</enum><text>other emerging technologies that transform waste to energy; and</text></clause></subparagraph><subparagraph id="id51943365ef4a470498b9d229d88a66ba"><enum>(B)</enum><text>a project that is being carried out pursuant to an existing plan that, as determined by the Secretary, will assist in transitioning a wastewater treatment facility towards the use of energy-efficient technologies.</text></subparagraph></paragraph><paragraph id="idd9924a2d86104debbf098bac3b88ae57"><enum>(3)</enum><header>Covered costs</header><text>A guarantee provided under this subsection may be used for—</text><subparagraph commented="no" id="ide882b78aad4e47f4b415b991f42bba0c"><enum>(A)</enum><text>predevelopment costs associated with the eligible project or existing water and wastewater systems that are part of the eligible project, including energy assessments; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id287e15efaeaf4a9886a9ad90bff0055b"><enum>(B)</enum><text>construction and equipment costs incurred in carrying out an eligible project under this subsection.</text></subparagraph></paragraph><paragraph commented="no" id="id4798d3cdcfe1441999c023db22bf2a63"><enum>(4)</enum><header>Additional activity</header><text>In providing guarantees under this subsection, the Secretary shall promote technologies to reduce pollution in wastewater, including enhanced nutrient recovery and other innovative technologies.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0f55974e40e042a2824e2331467d0af5"><enum>(f)</enum><header display-inline="yes-display-inline">Small-Scale Extension Services Program</header><text display-inline="yes-display-inline">In carrying out the Program, the Secretary shall establish a small-scale extension services program to provide assistance to rural communities through grants, outreach, training, and technical assistance regarding energy-efficient technologies at wastewater treatment facilities in eligible municipalities and Tribes.</text></subsection><subsection id="id4914a0795a78469f87b1676128da133d"><enum>(g)</enum><header>Administration</header><paragraph id="id6912940ADEEF49A286F8AF1252695545"><enum>(1)</enum><header>Effect on State, Tribal, and local permits</header><text display-inline="yes-display-inline">The provision of a grant or guarantee for an eligible project under the Program shall not—</text><subparagraph id="id2d0ce8c7eee245ad8e9209795249068f"><enum>(A)</enum><text>relieve any recipient of the grant or guarantee of any obligation to obtain any required State, local, or Tribal permit or approval with respect to the project;</text></subparagraph><subparagraph id="idcabcb9b8dd9f450ebaf9b1b58c040e3e"><enum>(B)</enum><text>limit the right of any unit of State, local, or Tribal government to approve or regulate any rate of return on private equity invested in the project; or</text></subparagraph><subparagraph id="id445239376f8946bf8c86e4d07a99eb12"><enum>(C)</enum><text>otherwise supersede any State, local, or Tribal law (including any regulations) applicable to the construction or operation of the project.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6fb8968274e74e25b82490a1f37507b5"><enum>(2)</enum><header display-inline="yes-display-inline">Clean Water Act</header><text>Nothing in this section precludes, preempts, or supersedes any requirement under the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251</external-xref> et seq.) (commonly referred to as the “Clean Water Act”).</text></paragraph></subsection><subsection id="id25eef93028cc40238eacd1e53ddab7d4"><enum>(h)</enum><header>Reports</header><text display-inline="yes-display-inline">As soon as practicable after the end of each fiscal year for which amounts are made available to carry out this section, the Secretary shall publish on a dedicated, publicly accessible internet website information describing—</text><paragraph id="idA6158BA4E44A4152B19CB7F43D81B8CF"><enum>(1)</enum><text>with respect to that fiscal year—</text><subparagraph id="id0daed66810564d0bb346ec9478f2cd4c"><enum>(A)</enum><text>each application received for assistance under the Program;</text></subparagraph><subparagraph id="id21efd1631c2b4334ac005a22bd70e334"><enum>(B)</enum><text>a list of the projects selected for assistance under the Program, including—</text><clause id="id95185c01aaa04afc994224ca7837ea85"><enum>(i)</enum><text>a description of each project;</text></clause><clause id="id949e29881efc464b8356940149db2259"><enum>(ii)</enum><text>the amount of financial assistance provided for each project; and</text></clause><clause id="idae5c2ea692f241809882c67d29b270f3"><enum>(iii)</enum><text>the basis for the selection of each project with respect to the requirements of this section; and</text></clause></subparagraph><subparagraph id="ide8ada55d484e4b538c7658352db6948d"><enum>(C)</enum><text>an overview of technical assistance and outreach activities provided during that fiscal year to—</text><clause id="id5eea12c493d74286ae73ead4923c3427"><enum>(i)</enum><text>each eligible municipality and Tribe; and</text></clause><clause id="idbcb36daa2c284d919d3f0a774c7c228d"><enum>(ii)</enum><text>wastewater treatment facilities serving populations of not more than 10,000; and</text></clause></subparagraph></paragraph><paragraph id="idFF113FD5EF2B4FD0908A132E8B35BBA5"><enum>(2)</enum><text>the technical assistance and outreach activities proposed to be provided over the next 2 fiscal years to the entities described in clauses (i) through (iii) of paragraph (1)(C).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id2346D37556CF4467B6420C841B3D5D7C"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; 119 Stat. 604; 123 Stat. 145) is amended by inserting after the item relating to section 1705 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF8043D2510F54FBB95F4F0C0A8B0D4E6"><toc><toc-entry bold="off" level="section">Sec. 1706.
