which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Agriculture to temporarily suspend increased line speeds at meat and poultry establishments, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H411E0DC63C3743F89900DBE6141BF5EF"><section section-type="section-one" id="H78880122E9DB4569AB28092DAE616702"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Line Speeds During COVID–19 Act of 2021</short-title></quote>. </text></section><section id="H6DC2A4101F7F4C8AB0DDC694FEE88F8A"><enum>2.</enum><header>Temporary suspension of increased line speeds at meat and poultry establishments</header><subsection id="HC238E611050F40578902BB60C1D28325"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H16F39975B01B4E819BAB4C2344540FD7"><enum>(1)</enum><header>Covered establishment</header><text>The term <term>covered establishment</term> means—</text><subparagraph id="idF98595912CEF4AEF81C726202959B4A7"><enum>(A)</enum><text>an official establishment (as defined in section 301.2 of title 9, Code of Federal Regulations (or successor regulations)) that is subject to inspection under the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601</external-xref> et seq.); and</text></subparagraph><subparagraph id="idD3717005E93A4C6285CEA208D86AEF3D"><enum>(B)</enum><text>an official establishment (as defined in section 381.1 of title 9, Code of Federal Regulations (or successor regulations)) that is subject to inspection under the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/451">21 U.S.C. 451</external-xref> et seq.).</text></subparagraph></paragraph><paragraph id="HE1A82DB47D4545118232D2107D3E12EA"><enum>(2)</enum><header>Covered period</header><text display-inline="yes-display-inline">The term <term>covered period</term> means the period beginning on the date of enactment of this Act and ending on the date that is 90 days after the date on which the COVID–19 emergency is lifted. </text></paragraph><paragraph id="id2C2FDEC9913F4070835770F7796C9D3A"><enum>(3)</enum><header>COVID–19 emergency</header><text>The term <quote>COVID–19 emergency</quote> means the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on January 31, 2020, with respect to COVID–19. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5A7032C8388C48A993C54A1210217752"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="H098B7255AC21469AAEE307CECA605329"><enum>(b)</enum><header>Temporary suspension of waivers</header><paragraph id="id0B54874D2D014BDFA6CB733B04E631C4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law (including regulations, including sections 303.1(h) and 381.3(b) of title 9, Code of Federal Regulations (or successor regulations)), during the covered period, the Secretary, acting through the Administrator of the Food Safety and Inspection Service—</text><subparagraph id="H02F035D8A72F4BBE96F538E7448BCA1C"><enum>(A)</enum><text display-inline="yes-display-inline">shall suspend any waivers issued before the date of enactment of this Act relating to—</text><clause id="id486462772AC147E69125D5FDD9A640CF"><enum>(i)</enum><text display-inline="yes-display-inline">line speeds at covered establishments; and </text></clause><clause id="idA3BA17AFADAD4C1396926175D3D5BE26"><enum>(ii)</enum><text display-inline="yes-display-inline">inspection staffing requirements for covered establishments; </text></clause></subparagraph><subparagraph id="id15C241A8407545F2ACFAA9E550964A13"><enum>(B)</enum><text display-inline="yes-display-inline">shall not issue any waiver described in subparagraph (A) to covered establishments; and</text></subparagraph><subparagraph id="H1F9CE2AE560840D6B226214A4715465D"><enum>(C)</enum><text display-inline="yes-display-inline">shall suspend implementation of, and conversion to, the New Swine Slaughter Inspection System described in the final rule entitled <quote>Modernization of Swine Slaughter Inspection</quote> (84 Fed. Reg. 52300 (October 1, 2019)).</text></subparagraph></paragraph><paragraph id="HAC9A7B12A5104D6D9614E507EEE52982"><enum>(2)</enum><header>Limitation on authority over line speeds</header><text display-inline="yes-display-inline">None of the funds made available to the Secretary during the covered period may be used to develop, propose, finalize, issue, amend, or implement any policy, regulation, directive, constituent update, or any other agency program that would increase line speeds at covered establishments.</text></paragraph><paragraph id="HBD233C95A1ED4062ADD9F79376C47E94"><enum>(3)</enum><header>Effect on State Law</header><subparagraph id="idEE3F0495BAF54FA68D56A2D5E2A82814"><enum>(A)</enum><header>In general</header><text>This subsection shall not preempt or limit any law or regulation of a State or a political subdivision of a State that—</text><clause id="id4675C1F4515D403D8B93194712664388"><enum>(i)</enum><text>imposes requirements that are more protective of worker safety or animal welfare than the requirements of this subsection; or </text></clause><clause id="idBFADE29D5194428EBA829CEB2B3E1887"><enum>(ii)</enum><text>creates penalties for conduct regulated by this subsection.</text></clause></subparagraph><subparagraph id="idC7AF3C047AC94792B7C5D8B0E4A8853E"><enum>(B)</enum><header>Other laws</header><text>The requirements of this subsection are in addition to, and not in lieu of, any other laws protecting worker safety and animal welfare. </text></subparagraph></paragraph></subsection><subsection id="H62F9316133784FD6A370A053D9BD5D6B"><enum>(c)</enum><header>GAO review</header><paragraph id="idC9B8604EAADB4D8180E61C2104499ADF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the end of the covered period, the Comptroller General of the United States shall carry out, and submit to Congress, a review of the actions taken by the Secretary, the Secretary of Labor, and the Secretary of Health and Human Services in response to the COVID–19 pandemic to determine the effectiveness of those actions in protecting animal, food, and worker safety.</text></paragraph><paragraph id="idD74EC9B485D446E29A614843A64CCB6F"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The review carried out under paragraph (1) shall include information on, and an analysis of, with respect to covered establishments—</text><subparagraph id="H946C3AF2050E484CB011DC87D1442508"><enum>(A)</enum><text display-inline="yes-display-inline">all policies and regulations relating to inspection of those establishments that have been implemented by the Secretary, the Secretary of Labor, and the Secretary of Health and Human Services during the COVID–19 emergency and the covered period;</text></subparagraph><subparagraph id="H92715FC3F8214DA9AE81A4629EEC7E70"><enum>(B)</enum><text>the pandemic emergency preparedness plans of those establishments;</text></subparagraph><subparagraph id="H0C72195BAFD14DAE9BB8509B1504F6DD"><enum>(C)</enum><text display-inline="yes-display-inline">the extent to which those establishments have implemented guidance and recommendations to space workers 6 feet apart on production lines and in break rooms, locker rooms, and all other workspaces;</text></subparagraph><subparagraph id="HF8E970DDF6E74FBDA17B4DD3CE55B29E"><enum>(D)</enum><text>the quantity and usage of personal protective equipment by workers at those establishments;</text></subparagraph><subparagraph id="H51C62F9FF85B4F679BF47BB61A67C0E5"><enum>(E)</enum><text display-inline="yes-display-inline">any guidance provided to inspectors of those establishments by the Secretary, Secretary of Labor, or the Secretary of Health and Human Services during the COVID–19 emergency;</text></subparagraph><subparagraph id="HB412C10D39AA4F4A9F0723B804D54122"><enum>(F)</enum><text display-inline="yes-display-inline">actions taken by the Secretary, the Secretary of Labor, and the Secretary of Health and Human Services to protect workers, animals, and food at establishments that have reported cases of COVID–19; </text></subparagraph><subparagraph id="HC6BDBAA8750842BCBD47F43C7BD09089"><enum>(G)</enum><text display-inline="yes-display-inline">all humane handling reports issued, and enforcement actions taken, by the Secretary during the COVID–19 emergency pursuant to—</text><clause id="idDCA5D1A0DD6646CDB47DEFAAC44FB6FB"><enum>(i)</enum><text display-inline="yes-display-inline"> <external-xref legal-doc="public-law" parsable-cite="pl/85/765">Public Law 85–765</external-xref> (commonly known as the <quote>Humane Methods of Slaughter Act of 1958</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/7/1901">7 U.S.C. 1901</external-xref> et seq.); and </text></clause><clause id="id80512044CD5846B9A6196C46F4BD7BB8"><enum>(ii)</enum><text display-inline="yes-display-inline">good commercial practices regulations promulgated under the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/451">21 U.S.C. 451</external-xref> et seq.);</text></clause></subparagraph><subparagraph id="HDC0A99824A8E4D2E9627E4D09A529620"><enum>(H)</enum><text>the impact of faster line speeds on the ability of those establishments to maintain protections for workers; and</text></subparagraph><subparagraph id="HEB945838C4D647C293A20E1246439C80"><enum>(I)</enum><text display-inline="yes-display-inline">any instance of interference by a Federal agency with a review of a covered establishment experiencing an outbreak of COVID–19 conducted by personnel of the Centers for Disease Control and Prevention.</text></subparagraph></paragraph></subsection><subsection id="HE72018565E034A82B2368CBD802B4575"><enum>(d)</enum><header>Reports to Congress</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary, the Secretary of Labor, and the Secretary of Health and Human Services shall each submit to the Committees on Agriculture, Nutrition, and Forestry and Health, Education, Labor, and Pensions of the Senate, and the Committees on Agriculture and Education and Labor of the House of Representatives, a report that—</text><paragraph id="idAA5656A2812D41319B45F2798215D7B1"><enum>(1)</enum><text display-inline="yes-display-inline">describes the actions taken by that Secretary to ensure worker, animal, and food safety during the COVID–19 emergency; and</text></paragraph><paragraph id="id67CB05F7DCDE4C7F9F417003EAD8FD96"><enum>(2)</enum><text>includes an analysis of the issues described in subparagraphs (A) through (H) of subsection (c)(2).</text></paragraph></subsection></section></legis-body></bill>
