which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Health and Human Services to convene a task force to advise the Assistant Secretary for Mental Health and Substance Use on a national strategy for preventing mental health and substance use crises during a public health emergency, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE96F21385FE3404FA246A22601D9042D"><section section-type="section-one" id="HC34F97776E5C47FBB34A05F6F4064B51"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Mental Health and Substance Use Crises During Emergencies Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H087635C14D904F4795FCD109234BF095"><enum>2.</enum><header>Findings</header><subsection id="H12096DA7254249D381DC0CFA88825FE9"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text><paragraph id="H1B906CB353924DA6909F8CFEC8B2E759"><enum>(1)</enum><text display-inline="yes-display-inline">The United States invests annually in the public mental health of people of the United States.</text></paragraph><paragraph id="H8C2F42C9A74B4EDC987D4B28F1935CEF"><enum>(2)</enum><text display-inline="yes-display-inline">Congress appropriated $3,600,000,000 in fiscal year 2020 to the Substance Abuse and Mental Health Services Administration.</text></paragraph><paragraph id="H641A447256E145BF9ADDC5E638C512A8"><enum>(3)</enum><text>Funds are also appropriated to address mental health and substance use in targeted populations through the Department of Veterans Affairs, the Department of the Interior, and the National Institute of Mental Health.</text></paragraph><paragraph id="H5319D6737993436CAFA4377F2546AAF0"><enum>(4)</enum><text display-inline="yes-display-inline">On January 31, 2020, the Secretary of Health and Human Services declared a public health emergency due to the spread of COVID–19, and extended such declaration, most recently, on October 2, 2020.</text></paragraph><paragraph id="H1F538E80530E490C94850C1D516ACA03"><enum>(5)</enum><text display-inline="yes-display-inline">As of August 1, 2020, Congress provided an additional $725,000,000 in supplemental funding to augment mental health and substance use services during the COVID–19 pandemic.</text></paragraph><paragraph id="H927512CD740045F8AEC0853C05A200B1"><enum>(6)</enum><text display-inline="yes-display-inline">Such supplemental funding included $425,000,000 to the Substance Abuse and Mental Health Services Administration, of which—</text><subparagraph id="HA7B41C04C57D49BF91C38EB6A3659C80"><enum>(A)</enum><text display-inline="yes-display-inline">$110,000,000 was allocated for emergency grants for behavioral health services;</text></subparagraph><subparagraph id="H38764239C5E54DA1A2F1A71662DD2AE7"><enum>(B)</enum><text>$250,000,000 was allocated for the Certified Community Behavioral Health Centers program; and</text></subparagraph><subparagraph id="H403E3D8D6D594B5B845D7297E08449E1"><enum>(C)</enum><text>$50,000,000 was allocated for suicide prevention.</text></subparagraph></paragraph><paragraph id="HE386547B9C5643B5AF83796513B2544F"><enum>(7)</enum><text display-inline="yes-display-inline">The COVID–19 pandemic has exacerbated concerns about the mental health and well-being of the people of the United States.</text></paragraph><paragraph id="H25D25D96637F4E708289D55EAE0F0362"><enum>(8)</enum><text>A third of people in the United States are feeling severe anxiety, according to Census Bureau data, and nearly a quarter show signs of depression.</text></paragraph><paragraph id="H7B4C4501D41D4214BFBBD71BE473CDF6"><enum>(9)</enum><text>A recent poll by the Kaiser Family Foundation found that the pandemic had negatively affected the mental health of 56 percent of adults.</text></paragraph><paragraph id="H2A87DEA22A11453C8A2BE06A4420BEE1"><enum>(10)</enum><text>In April, texts to a Federal emergency mental-health line were up 1,000 percent from the year before.</text></paragraph><paragraph id="H1A97D4B09A1A4EF2AC451447D1F0E5CD"><enum>(11)</enum><text display-inline="yes-display-inline">The situation is particularly dire for certain vulnerable groups that face a significant risk of post-traumatic stress disorder, including—</text><subparagraph id="H5C1A97A63F014D2CA89DEE19AB281C2F"><enum>(A)</enum><text display-inline="yes-display-inline">health care workers;</text></subparagraph><subparagraph id="HDAF8C3220AD34B478BEA6BC879808C3B"><enum>(B)</enum><text>COVID–19 patients with severe cases; and</text></subparagraph><subparagraph id="HE09AA534E35E4206B24D4B8B95D45CCA"><enum>(C)</enum><text>individuals who have lost loved ones.</text></subparagraph></paragraph><paragraph id="H7B6809D15D9F4FAA980D71E7C749630E"><enum>(12)</enum><text>In overburdened intensive-care units, delirious patients are seeing chilling hallucinations.</text></paragraph><paragraph id="H2656858E23FB4574B7F042045F21EF50"><enum>(13)</enum><text>At least 2 overwhelmed emergency medical workers have died by suicide since the beginning of the COVID–19 pandemic.</text></paragraph><paragraph id="H1872081EC8BB47548487D24A7608E37B"><enum>(14)</enum><text display-inline="yes-display-inline">The public mental health crisis will continue after the COVID–19 pandemic subsides. </text></paragraph></subsection><subsection id="HE13F551ED03248BAA5FE44309B0176DE"><enum>(b)</enum><header>Statement of policy</header><text display-inline="yes-display-inline">It is the policy of the United States to protect the health and safety of all people of the United States during public health emergencies and to proactively lead public health efforts to advance the mental health of the Nation. </text></subsection></section><section id="HE80FE1356A3E47608FC2077A1434FBAE"><enum>3.</enum><header>Task force to prevent mental health and substance use crises</header><subsection id="H18CCA8ED81C14D4E8C00565AFCB1F0D7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services (referred to in this section as the <quote>Secretary</quote>) shall convene a task force known as the Task Force to Prevent Mental Health and Substance Use Crises (referred to in this section as the <quote>Task Force</quote>) to—</text><paragraph id="H256B42F9C4E64F5BAEC1C7FD306D98E4"><enum>(1)</enum><text display-inline="yes-display-inline">assess the response of the Federal Government with respect to mental health and substance use during and after the spread of COVID–19; and</text></paragraph><paragraph id="H5F3155942365402CB161E2F0D7E06709"><enum>(2)</enum><text display-inline="yes-display-inline">advise the Assistant Secretary for Mental Health and Substance Use on a national strategy for preventing mental health and substance use crises during a public health emergency.</text></paragraph></subsection><subsection id="HE166A8C6539F4737A4CB9795D3DD204F"><enum>(b)</enum><header>Assessment</header><text display-inline="yes-display-inline">In carrying out subsection (a), the Task Force shall assess—</text><paragraph display-inline="no-display-inline" id="HDF6A084075CF4091B223AE36155355B9"><enum>(1)</enum><text display-inline="yes-display-inline">the efficacy, outcomes, and cost of each Federal initiative taken during the spread of COVID–19 to support mental health and address substance use, including an identification of—</text><subparagraph display-inline="no-display-inline" id="H208AF83DF2694D98B12087F0CE0D4957"><enum>(A)</enum><text>any initiative that was not successful; and</text></subparagraph><subparagraph id="HAA3F360312F047F4981F8F19198B17E2"><enum>(B)</enum><text display-inline="yes-display-inline">best practices and strategies;</text></subparagraph></paragraph><paragraph id="H912FD09B31A64EE786BCA756E26B5D4A"><enum>(2)</enum><text display-inline="yes-display-inline">the ability of Federal agencies to coordinate mental health programs and services and allocate resources to respond to a public health emergency;</text></paragraph><paragraph id="HEE29B39140804EC5809D9F775707A267"><enum>(3)</enum><text display-inline="yes-display-inline">the ability of Federal agencies to use technology developed through the Small Business Innovation Research Program established under section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) to respond to a public health emergency;</text></paragraph><paragraph id="H85900B55CB8946088FC4E7AA2B6BA94A"><enum>(4)</enum><text display-inline="yes-display-inline">the ability of Federal, State, and local agencies to coordinate with other government agencies, nonprofit organizations, and entities in the private sector during a public health emergency;</text></paragraph><paragraph id="H584E2FBFE7B747B7ACEDEBAFC4024B2B"><enum>(5)</enum><text display-inline="yes-display-inline">any needed improvements to coordination described in paragraphs (2) and (4);</text></paragraph><paragraph id="H2DE9DBC577A84EE0BBC8B60FA1385964"><enum>(6)</enum><text>a review of research programs of the Federal agencies listed in subsection (c)(3) with respect to mental health and substance use during a public health emergency; and</text></paragraph><paragraph id="HD5739F92C1CC4C8C8177E32CB91942B6"><enum>(7)</enum><text display-inline="yes-display-inline">a review of the amount of funds used by such Federal agencies to support mental health and address substance use during a public health emergency.</text></paragraph></subsection><subsection id="HE6C6E190232A4701890CF53F98496490"><enum>(c)</enum><header>Membership</header><paragraph id="H35716800B59C42F698B4F25F37BE1842"><enum>(1)</enum><header>Chair</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this section, the Secretary shall appoint an individual to serve as the Chair of the Task Force.</text></paragraph><paragraph id="HE6FAE513BC7A4317B03A91C896E2269B"><enum>(2)</enum><header>Composition</header><text>The Task Force shall be composed of—</text><subparagraph id="H85A1A4AF9E844F34B155586E62714F04"><enum>(A)</enum><text display-inline="yes-display-inline">representatives of Federal agencies, including the agencies listed in paragraph (3);</text></subparagraph><subparagraph id="H887408A065F84AAEBA3BDD8D0004EB5C"><enum>(B)</enum><text display-inline="yes-display-inline">representatives of nongovernmental organizations;</text></subparagraph><subparagraph id="H15CE7B08C5E94222A907D87953A99AA3"><enum>(C)</enum><text>patient advocates; and</text></subparagraph><subparagraph id="HABA007B5EC3546DC9B127F8AC3A61120"><enum>(D)</enum><text display-inline="yes-display-inline">State and local public health experts who specialize in mental health and substance use.</text></subparagraph></paragraph><paragraph id="H43398415B3A14523B358F59AA64FB38A"><enum>(3)</enum><header>Federal agencies</header><text display-inline="yes-display-inline">The agencies represented under paragraph (2)(A) shall, at a minimum, include the following:</text><subparagraph id="HBE99B8C0163947AEB5E479B01A156D8C"><enum>(A)</enum><text>The Centers for Disease Control and Prevention.</text></subparagraph><subparagraph id="H185BF15C3AFF4046814D6038CF7D6BAA"><enum>(B)</enum><text>The National Institute of Mental Health.</text></subparagraph><subparagraph id="HEFB48E86E4FB47A5B672B61A2E80849E"><enum>(C)</enum><text>The National Institutes of Health.</text></subparagraph><subparagraph id="HA3B19FA1D1FC42CABA45095DDC51C2FD"><enum>(D)</enum><text>The National Institute on Drug Abuse.</text></subparagraph><subparagraph id="HE76730E926EB42B7B0B17147FF22776A"><enum>(E)</enum><text>The Food and Drug Administration.</text></subparagraph><subparagraph id="H5EFEB19A80FE47BA82A48FB0AD570B35"><enum>(F)</enum><text>The Health Resources and Services Administration.</text></subparagraph><subparagraph id="HB339E6B3CC2B4EEFA6CCE50B7E407E3B"><enum>(G)</enum><text>The Substance Abuse and Mental Health Services Administration.</text></subparagraph><subparagraph id="H71FEDCD9FC02401FA7AFF4463816CA51"><enum>(H)</enum><text display-inline="yes-display-inline">The Agency for Healthcare Research and Quality.</text></subparagraph><subparagraph id="HEACAAE526EF0492B9DF533112B302D68"><enum>(I)</enum><text>The Administration for Children and Families.</text></subparagraph><subparagraph id="H547C5A7A9E254F8DA9DCC218F3803BA3"><enum>(J)</enum><text display-inline="yes-display-inline">The Centers for Medicare &amp; Medicaid Services.</text></subparagraph><subparagraph id="HA0A58305369A4DD7B9BB2FA9E683E5CD"><enum>(K)</enum><text>The Department of the Interior.</text></subparagraph><subparagraph id="H45475C72AD9F4BBDB206FF4F0E9883FC"><enum>(L)</enum><text>The Department of Veterans Affairs.</text></subparagraph><subparagraph id="H7D25821CA8E14F3C895837853DFB68AD"><enum>(M)</enum><text>The Department of Education.</text></subparagraph><subparagraph id="HBB4771D3B4734A0BB51E4A274EE9EB1F"><enum>(N)</enum><text>The Department of Defense.</text></subparagraph><subparagraph id="H11A6146933714753BF3607C2B121AEAD"><enum>(O)</enum><text>The Department of Justice.</text></subparagraph><subparagraph id="H6E44AF6EB5254C91A1872056D493096B"><enum>(P)</enum><text>The Department of Housing and Urban Development.</text></subparagraph><subparagraph id="H6D3ED5C15EF14C968075664A070B0FEF"><enum>(Q)</enum><text>The Administration for Community Living.</text></subparagraph><subparagraph id="H5C1A4058233845B398ADB09B90962633"><enum>(R)</enum><text>The Indian Health Service.</text></subparagraph><subparagraph id="HAE9D805CA53945C0B7BDF490EB6B0077"><enum>(S)</enum><text>The Department of Labor.</text></subparagraph></paragraph></subsection><subsection id="H3EFBF9529132408091947D68EA07CD73"><enum>(d)</enum><header>Meetings</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, the Secretary shall convene a meeting of the Task Force and shall convene subsequent meetings on a periodic basis.</text></subsection><subsection id="H70F3033A91364565B92399C5507D803A"><enum>(e)</enum><header>Submissions to Congress</header><paragraph id="HAD62DEEA283B4498AFB65C73221FC18C"><enum>(1)</enum><header>Progress report</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this section, the Task Force shall submit to the appropriate congressional committees a report on the progress of the Task Force in carrying out subsection (a).</text></paragraph><paragraph id="H387A36DC15644641B78FB477CEB77D0E"><enum>(2)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this section, and annually thereafter, the Task Force shall submit to the appropriate congressional committees a report on the activities of the Task Force in carrying out subsection (a), including—</text><subparagraph id="H394967750AEB4F6CBDA1B0276E33AC98"><enum>(A)</enum><text>the results of the assessment under subsection (b); and</text></subparagraph><subparagraph id="HDDDE3733151641F09B86CA6F2C7D1E0C"><enum>(B)</enum><text>any findings, conclusions, and recommendations. </text></subparagraph></paragraph></subsection><subsection id="H7DCA8ACE883E4CC19798F72909F667C3"><enum>(f)</enum><header>Disposition of records</header><text display-inline="yes-display-inline">Upon dissolution of the Task Force, the records of the Task Force shall become records of the Assistant Secretary for Mental Health and Substance Use.</text></subsection><subsection id="HF57488A449F046BC8FAAB5A8A612E71F"><enum>(g)</enum><header>Public health emergency defined</header><text>In this section, the term <term>public health emergency</term> means a public health emergency declared pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>).</text></subsection></section><section id="HB4CEFA74091A497E9D64EE008C6B5B77"><enum>4.</enum><header>National strategy on mental health and substance use during a public health emergency</header><text display-inline="no-display-inline">Section 501 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290aa">42 U.S.C. 290aa</external-xref>) is amended—</text><paragraph id="H75C5FC28C98D4B58A7A4BF11E20A2979"><enum>(1)</enum><text>by redesignating subsection (q) as subsection (r); and</text></paragraph><paragraph id="H8395F639E72148F5B29A0A627FABC80E"><enum>(2)</enum><text>by inserting after subsection (p) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3FD4FBD9063F40D793A6E378DF9060F2"><subsection id="HC8509135EF6F4B52A818F14D476F8A0E"><enum>(q)</enum><header>National strategy during public health emergencies</header><text display-inline="yes-display-inline">Not later than 30 months after the date of enactment of the <short-title>Preventing Mental Health and Substance Use Crises During Emergencies Act</short-title>, and annually thereafter, the Assistant Secretary shall prepare and submit a national strategy to the appropriate congressional committees on preventing mental health and substance use crises during a public health emergency declared by the Secretary under section 319. Such strategy shall be based on the reports submitted to Congress by the Task Force to Prevent Mental Health and Substance Use Crises established under section 3 of the <short-title>Preventing Mental Health and Substance Use Crises During Emergencies Act</short-title> and shall include—</text><paragraph id="H4292019AB455471FACFAB5ACD1AEA75F"><enum>(1)</enum><text>advancements in research with respect to mental health and substance use during a public health emergency; and</text></paragraph><paragraph id="H4A8921766535444580A4F64BE20FCEB1"><enum>(2)</enum><text display-inline="yes-display-inline">a plan to increase the ability of Federal agencies to coordinate mental health programs and services and allocate resources to respond to a public health emergency.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
