<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 700</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210311">March 11, 2021</action-date><action-desc><sponsor name-id="S357">Mrs. Fischer</sponsor> (for herself, <cosponsor name-id="S380">Mr. Peters</cosponsor>, <cosponsor name-id="S347">Mr. Moran</cosponsor>, <cosponsor name-id="S314">Mr. Tester</cosponsor>, and <cosponsor name-id="S311">Ms. Klobuchar</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a portal and database to receive and maintain information regarding blocked railroad-highway grade crossings and to require the Secretary of Transportation to evaluate the requirements of the railway-highway crossings program. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idD518226CE4B34C188E64009E3BB82717"><enum>1.</enum><header>Blocked railroad-highway grade crossings portal</header><subsection id="idde9fa5dcd6c04c18afb7bac8d3624f7c"><enum>(a)</enum><header>In general</header><text>The Administrator of the Federal Railroad Administration (referred to in this section as the <quote>FRA</quote>) shall establish and maintain a portal and corresponding database through which the FRA shall receive information on blocked railroad-highway grade crossings as a 3-year pilot program.</text></subsection><subsection id="id6E997DDDECE542A2BD7BF86C251419A1"><enum>(b)</enum><header>Contents</header><text>The portal established pursuant to subsection (a) shall—</text><paragraph id="idCBE08F15BF1F4CAFABD4F4F4B29DD780"><enum>(1)</enum><text>provide examples to users regarding common causes of blocked crossings, such as—</text><subparagraph id="idB2A8AC666EC244B2B43AE81D2C197F26"><enum>(A)</enum><text>idling or moving trains; or </text></subparagraph><subparagraph id="id3998EC7053524D95AE49FD8CAAD5B01D"><enum>(B)</enum><text>instances when lights or gates are activated when no train is present; </text></subparagraph></paragraph><paragraph id="id31ef5a4a29754481978e7d8b73c0f197"><enum>(2)</enum><text>provide the complainant with the contact information for reporting a blocked crossing to the relevant railroad; and </text></paragraph><paragraph id="id41FF9A966B37458892E311330E3AE4DC"><enum>(3)</enum><text>encourage the complainant to report the blocked crossing to the relevant railroad.</text></paragraph></subsection><subsection id="id18C7C33925F942CBA9E0E06A6160DBC5"><enum>(c)</enum><header>Complaints</header><text>The portal established pursuant to subsection (a) shall be programmed to receive complaints from the general public about blocked railroad-highway grade crossings. Any complaint reported through the portal shall indicate whether the complainant also reported the blocked crossing to the relevant railroad.</text></subsection><subsection id="id2846FE6C6A27456986E8D2310DD0B347"><enum>(d)</enum><header>Information received</header><text>In reviewing complaints received pursuant to subsection (c), the FRA, to the extent practicable, shall review the information received from the complainant to account for duplicative or erroneous reporting.</text></subsection><subsection id="idCCF266A2235243EE9182F3AE3FDA7F42"><enum>(e)</enum><header>Use of information</header><text>The information received and maintained in the database established pursuant to subsection (a) shall be used by FRA—</text><paragraph id="id526412A3EFAA424393E42B458444FDD1"><enum>(1)</enum><text>to assist the FRA in identifying the locations and potential impacts of frequent and long-duration blocked railroad-highway grade crossings;</text></paragraph><paragraph id="id276D0ECDF00C4BFE9E4450B5F8D98DC5"><enum>(2)</enum><text>as a basis for outreach to communities, emergency responders, and railroads; and </text></paragraph><paragraph id="id67B3030E98174FF29023CEBEB288F530"><enum>(3)</enum><text>to support collaboration in the prevention of incidents at railroad-highway grade crossings.</text></paragraph></subsection><subsection commented="no" id="idCCD64ABFAF424D01994ECE3958DC8B4E"><enum>(f)</enum><header>Sharing information received</header><paragraph commented="no" id="idD6AD63B518844AF984F3F4022CD10608"><enum>(1)</enum><header>In general</header><text>The FRA shall implement and make publicly available procedures for sharing any nonaggregated information received through the portal established pursuant to subsection (a) with the public. </text></paragraph><paragraph commented="no" id="idF108CAA3BE754B5BAAEC773C3BB05E39"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to authorize the FRA to make publicly available sensitive security information.</text></paragraph></subsection><subsection id="id7d94063ff3444b9cb894dbcb37bf43db"><enum>(g)</enum><header>Additional information</header><text>If the information submitted to the portal established pursuant to subsection (a) is insufficient to determine the locations and potential impacts of frequent and long-duration blocked railroad-highway grade crossings, the FRA may collect, from the general public and from State and local law enforcement personnel, such additional information as may be necessary to make such determinations. </text></subsection><subsection id="ida8bdb430702a480d83242f9eed34f62d"><enum>(h)</enum><header>Limitations</header><text>Complaints, data, and other information received through the portal established pursuant to subsection (a) may not be used—</text><paragraph id="id63117790f25b43a993f88c13e4460076"><enum>(1)</enum><text>to infer or extrapolate the rate or instances of crossings beyond the data received through the portal; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcb27b024af1e4c19b56f411de02cd396"><enum>(2)</enum><text>for any regulatory or enforcement purposes except those specifically described in this section. </text></paragraph></subsection><subsection id="idABE6EA2FF0B6440CB45AABCB82D170E2"><enum>(i)</enum><header>Report</header><text>Not later than 3 years after the establishment of the pilot program under subsection (a), the Administrator of the FRA shall submit a report to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> that describes— </text><paragraph id="idc3bcded938144e33ad33e85b460b3cbe"><enum>(1)</enum><text>where, when, for how long, and what impacts have resulted from frequent and long-duration blocked highway-rail grade crossings based on the information received through the portal established pursuant to subsection (a);</text></paragraph><paragraph id="idea3a2cbd212e4662b451c55a50e9d3ad"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id0F489EE8277B4ECB9CA42E732FC8EE08"><enum>(A)</enum><text>whether and how the FRA verified the accuracy of the complaints submitted to such portal; and </text></subparagraph><subparagraph id="id118ABBD6107541ADA0C5B16C243A3DEE" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id622363D545E24350BDF525497EFCE076"><enum>(i)</enum><text>if the portal continues to be the most effective manner through which to collect such information; or </text></clause><clause indent="up1" id="id67FF3B31B9A04DD3B0E30016FD6EC9A5"><enum>(ii)</enum><text>if changes to the portal could improve its effectiveness;</text></clause></subparagraph></paragraph><paragraph id="id95b01150c18a4668a6625a388aa81d50"><enum>(3)</enum><text>how the FRA used the data compiled by such portal to assess the underlying cause and overall impacts of blocked crossings; and</text></paragraph><paragraph id="id9fd394a9cc7c46d485852a2531f69546"><enum>(4)</enum><text>the engagement of the FRA with affected parties in order to identify and facilitate solutions to any trends or problems identified by data received and maintained through the portal and corresponding database.</text></paragraph></subsection><subsection id="id437994FC89BC45BD9182AAB2863EFBF3"><enum>(j)</enum><header>Sunset</header><text>The section shall have no force or effect beginning on the date that is 3 years after the date of the enactment of this Act.</text></subsection></section><section id="idea89597eb20c429e82e1887aa7beb16d"><enum>2.</enum><header>Railway highway crossing program study</header><subsection id="id637d854fe28643dda2c68d24984448e2"><enum>(a)</enum><header>In general</header><text>The Secretary of Transportation shall evaluate the requirements of the railway-highway crossings program authorized under section 130 of title 23, United States Code, to determine whether—</text><paragraph id="idb5b84a183f774af6b28200e7c9297373"><enum>(1)</enum><text>the requirements of the program provide States sufficient flexibility to adequately address current and emerging grade-crossing safety issues;</text></paragraph><paragraph id="id8b3ea97008454fdabe866f6e6786ac76"><enum>(2)</enum><text>the structure of the program provides sufficient incentive and resources to States and local agencies to make changes at grade crossing that are most effective at reducing deaths and injuries;</text></paragraph><paragraph id="id222018ee1fab4bf39f91880a77f4c09e"><enum>(3)</enum><text>there are appropriate tools and resources to support States in using data-driven programs to determine the most cost-effective use of program funds; and</text></paragraph><paragraph id="id9683ec5aead44093a5031e4bb19e6ccf"><enum>(4)</enum><text>any statutory changes are necessary to improve the effectiveness of the program.</text></paragraph></subsection><subsection id="id4ae8d91e11794910ad2f5eaf1d10fb23"><enum>(b)</enum><header>Report</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Transportation shall submit a report to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>, the<committee-name committee-id="SSEV00"> Committee on Environment and Public Works of the Senate</committee-name>, and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> that describes the results of the evaluation under subsection (a), including any recommended statutory changes referred to in subsection (a)(4). </text></subsection></section></legis-body></bill>
