which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a pilot program through which the Institute of Museum and Library Services shall allocate funds to States for the provision of internet-connected devices to libraries. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hotspots and Online Technology and Services Procurement for Our Tribes and States Act</short-title></quote> or the <quote><short-title>HOTSPOTS Act</short-title></quote>.</text></section><section id="id892273819f45416cb5a29b6a62564374"><enum>2.</enum><header>Internet hotspot pilot program</header><subsection id="idfc056f6982b646fc9394bbacb52445ec"><enum>(a)</enum><header>Definitions</header><text>In this section, the terms <term>library</term>, <term>State</term>, and <term>State library administrative agency</term> have the meanings given those terms in section 213 of the Museum and Library Services Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9122">20 U.S.C. 9122</external-xref>).</text></subsection><subsection id="id9a5d1779a32f403dbe018552c3e976a9"><enum>(b)</enum><header>Pilot program</header><paragraph id="ide6f6e8df069c43e4ab74ec1395500879"><enum>(1)</enum><header>In general</header><text>Not later than 21 days after the date of enactment of this Act, the Director of the Institute of Museum and Library Services (referred to in this section as the <quote>Director</quote>) shall establish a 2-year pilot program, through which the Director shall—</text><subparagraph id="id46115d09b2b1412f8880aebbd1bc5fb7"><enum>(A)</enum><text>reserve 2.5 percent of the amounts appropriated to carry out this section to make grants to Indian Tribes and to organizations that primarily serve and represent Native Hawaiians (as the term is defined in section 6207 of the Native Hawaiian Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7517">20 U.S.C. 7517</external-xref>)) to enable such Tribes and organizations to carry out the activities described in subsection (e); and</text></subparagraph><subparagraph id="id617166c42e6247bcac10606915c8c5be"><enum>(B)</enum><text>allocate grant funds to States in accordance with paragraph (2) to enable States, through the State library administrative agency, as appropriate, to carry out the activities described in subsection (e).</text></subparagraph></paragraph><paragraph id="id3e1713bb6270494fbdee8190a48cbac2"><enum>(2)</enum><header>Allotments to States</header><subparagraph id="idec9468ba13da4778b74061bae6376066"><enum>(A)</enum><header>Minimum allotments</header><clause id="id18a078e6e4244ee99a2280ec6bec2a25"><enum>(i)</enum><header>In general</header><text>For purposes of this paragraph, the minimum allotment for each State shall be $2,000,000, except that the minimum allotment shall be $200,000 in the case of the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, the Republic of the Marshall Islands, the Federated States of Micronesia, and the Republic of Palau.</text></clause><clause id="idf140fd7e50d24d74ae6c105cb495052b"><enum>(ii)</enum><header>Ratable reduction</header><text>Notwithstanding clause (i), if the sum appropriated to carry out this section is insufficient to fully satisfy the requirement of clause (i), each of the minimum allotments under such clause shall be reduced ratably.</text></clause></subparagraph><subparagraph id="idecdf892d5dee4b179c5765b61c77469b"><enum>(B)</enum><header>Remainder</header><clause id="ida78ef71a491446c99406ae613676b7ee"><enum>(i)</enum><header>In general</header><text>From the remainder of any sums made available to carry out this section and not reserved or allotted under subparagraph (A), the Director shall award grants to each State in an amount that bears the same relation to such remainder as the population of the State bears to the population of all States.</text></clause><clause id="idbc1b863a65834bd288be236ff0e8b68d"><enum>(ii)</enum><header>Data</header><text>The population of each State and of all the States shall be determined by the Director on the basis of the most recent data available from the Bureau of the Census.</text></clause></subparagraph></paragraph></subsection><subsection id="id754e8dfcec33423d8405cbcd94a798a5"><enum>(c)</enum><header>Grants, contracts, or cooperative agreements</header><text>From amounts appropriated under subsection (f), $2,000,000 shall be made available for the Director of the Institute of Museum and Library Services for grants, contracts, or cooperative agreements with Federal agencies, public and private organizations, and other entities determined to be eligible by the Director to enable those agencies, organizations, and entities to carry out the activities described in subsection (e).</text></subsection><subsection id="id07859e0f5d9a4a0987c69e51046b796e"><enum>(d)</enum><header>Grants for Indian Tribes</header><text>An Indian Tribe or organization described in subsection (b)(1)(A) that is eligible for support under section 261 of the Library Services and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9161">20 U.S.C. 9161</external-xref>) may designate a Tribal library or Tribal library consortium as a library or consortium that is eligible for grant funds under this section, without regard to whether the library or library consortium is eligible for assistance from a State Library Administrative Agency under the Library Services and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9121">20 U.S.C. 9121</external-xref> et seq.), if the library or library consortium is eligible for support from an Indian Tribe or organization described in subsection (b)(1)(A) under such section 261.</text></subsection><subsection id="id73fc8fd63fa248a3b382003e5f3f6ee9"><enum>(e)</enum><header>Use of grant funds</header><text>Each State, Indian Tribe, or other entity receiving a grant, contract, or cooperative agreement under this section shall use funding under this section to—</text><paragraph id="id3f9667d85f2946a9ae312e983115a76c"><enum>(1)</enum><text>expand digital network access by purchasing and distributing internet-connected devices, such as hotspots, to libraries in low-income and rural areas so that those libraries can—</text><subparagraph id="id5551eb5fb3d54f658be7b43176665002"><enum>(A)</enum><text>allow individuals to borrow internet-connected devices for home use; and</text></subparagraph><subparagraph id="id27d68c759dfe4d2bada031400246a724"><enum>(B)</enum><text>install or upgrade public Wi-Fi access points for use on or near library grounds, including modems, routers, items that combine a modem and a router, and other equipment that might be needed to support increased broadband capacity;</text></subparagraph></paragraph><paragraph id="idf923734b98ae4d929a0dd73ff1d6e670"><enum>(2)</enum><text>provide libraries with funds to pay the other expenses associated with such devices and related services, such as processing, training, associated connectivity, hardware and support, and other necessary expenses related to the retention of these devices and provision of these services; or</text></paragraph><paragraph id="id03b410ef69824a24837d99134bcaea6e"><enum>(3)</enum><text>encourage existing and new partnerships between State and local governments, libraries, nonprofit entities, agencies including the Federal Communications Commission, and telecommunication, broadband, and internet service providers to coordinate the distribution of hotspots and other internet-connected devices and services. </text></paragraph></subsection><subsection id="idE6034F70E1834F8F9768EB51B9670785"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $200,000,000.</text></subsection></section></legis-body></bill>
