with persons that have business operations with the Maduro regime, and for other purposes.</official-title></form><legis-body><section section-type="section-one" changed="not-changed" id="id1027cb9e-81de-46c4-92ed-40b1f89bee80"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Banning Operations and Leases with the Illegitimate Venezuelan Authoritarian Regime Act</short-title></quote> or the <quote><short-title>BOLIVAR Act</short-title></quote>.</text></section><section changed="not-changed" id="id04309f70-19d2-49b3-9d62-9cc0bb1fcea4"><enum>2.</enum><header>Prohibition on contracting with persons that have business operations with the Maduro regime</header><subsection id="id71595252c85747bb82cf09a8ee34dc56" changed="not-changed"><enum>(a)</enum><header>Prohibition</header><text>Except as provided in subsections (b), (c), and (d), the head of an executive agency may not enter into a contract for the procurement of goods or services with any person that the head of an executive agency determines, with the concurrence of the Secretary of State, knowingly engages in significant business operations with an authority of the Government of Venezuela that is not recognized as the legitimate Government of Venezuela by the United States.</text></subsection><subsection id="idc92d78681b5042a382da032448f5f7a1" changed="not-changed"><enum>(b)</enum><header>Exceptions</header><paragraph id="id1e6dd45f241d4f219ef2e562b0ac1bc6" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The prohibition under subsection (a) does not apply to a contract that the Secretary of State determines—</text><subparagraph id="idb2726165d59643d490646e65eb16171d" changed="not-changed"><enum>(A)</enum><text>is necessary—</text><clause id="idf6dde64d306e496ab3f0e8ddd2f0bc61" changed="not-changed"><enum>(i)</enum><text>for purposes of providing humanitarian assistance to the people of Venezuela;</text></clause><clause id="id67a4af9cb5c04969be13b1d50ad149ca" changed="not-changed"><enum>(ii)</enum><text>for purposes of providing disaster relief and other urgent life-saving measures; or</text></clause><clause id="id3b06147035b943488f88c4e861ea8c75" changed="not-changed"><enum>(iii)</enum><text>to carry out noncombatant evacuations; or</text></clause></subparagraph><subparagraph id="id928b5bab5f684afca36094a7d3e6b8ea" changed="not-changed"><enum>(B)</enum><text>is in the national security interests of the United States.</text></subparagraph></paragraph><paragraph id="idd7afde20052443c6b8f2a96b94927d0c" changed="not-changed"><enum>(2)</enum><header>Support for United States Government activities</header><text>The prohibition in subsection (a) shall not apply to contracts that support United States Government activities in Venezuela, including those necessary for the maintenance of United States Government facilities in Venezuela, or to contracts with international organizations.</text></paragraph><paragraph id="id0a442a12d92f46f3a0b515015546f143" changed="not-changed"><enum>(3)</enum><header>Notification requirement</header><text>The Secretary of State shall notify the appropriate congressional committees of any contract entered into on the basis of an exception provided for under paragraph (1).</text></paragraph></subsection><subsection id="id3d36008730cc4226ae6a1b351050f3d3" changed="not-changed"><enum>(c)</enum><header>Office of foreign assets control licenses</header><text>The prohibition in subsection (a) does not apply to a person that has a valid license to operate in Venezuela issued by the Office of Foreign Assets Control.</text></subsection><subsection id="idc543938c843c474ba7ed1ca73e731bde" changed="not-changed"><enum>(d)</enum><header>American diplomatic mission in Venezuela</header><text>The prohibition in subsection (a) does not apply to contracts related to the operation and maintenance of the United States Government’s consular offices and diplomatic posts in Venezuela.</text></subsection><subsection id="id0ee5970b5e3740de864b94d9a61003e9" changed="not-changed"><enum>(e)</enum><header>Waiver</header><text>The Secretary of State may waive the requirements of subsection (a) if the Secretary of State determines that to do so is in the national interest of the United States.</text></subsection><subsection id="id9a8bb14b-fe17-4e87-a737-f404d10aeb84" changed="not-changed"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idD54FE92EBDF64C4BABAD0BFB2A883E58" changed="not-changed"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives.</text></paragraph><paragraph id="idcfa5aadc-b681-4d92-9025-7e32c6554ea1" changed="not-changed"><enum>(2)</enum><header>Business operations</header><text>The term <term>business operations</term> means engaging in commerce in any form, including acquiring, developing, maintaining, owning, selling, possessing, leasing, or operating equipment, facilities, personnel, products, services, personal property, real property, or any other apparatus of business or commerce.</text></paragraph><paragraph id="idaedb0375-def1-45cb-a072-26edafbbce1e" changed="not-changed"><enum>(3)</enum><header>Executive agency</header><text>The term <term>executive agency</term> has the meaning given the term in section 133 of title 41, United States Code.</text></paragraph><paragraph id="id9197f64190444a638daa7c01461c361e" changed="not-changed"><enum>(4)</enum><header>Government of Venezuela</header><subparagraph commented="no" display-inline="yes-display-inline" id="idFBE42E43403F42979DE0D7541BDE22A4" changed="not-changed"><enum>(A)</enum><text>The term <term>Government of Venezuela</term> includes the government of any political subdivision of Venezuela, and any agency or instrumentality of the Government of Venezuela.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" changed="not-changed" id="id6d1bd5a495c3495b9ad6197f10cff10a" indent="up1"><enum>(B)</enum><text>For purposes of subparagraph (A), the term <term>agency or instrumentality of the Government of Venezuela</term> means an agency or instrumentality of a foreign state as defined in section 1603(b) of title 28, United States Code, with each reference in such section to <quote>a foreign state</quote> deemed to be a reference to <quote>Venezuela</quote>.</text></subparagraph></paragraph><paragraph id="idacbbd0d6-8d83-4335-91e9-5bdc87d2a149" changed="not-changed"><enum>(5)</enum><header>Person</header><text>The term <term>person</term> means—</text><subparagraph id="id66c8f1ee-ca4d-44bf-ae4a-e75cdeed746c" changed="not-changed"><enum>(A)</enum><text>a natural person, corporation, company, business association, partnership, society, trust, or any other nongovernmental entity, organization, or group;</text></subparagraph><subparagraph id="idaa93c518-5eb3-4d50-935b-7057a6b555fb" changed="not-changed"><enum>(B)</enum><text>any governmental entity or instrumentality of a government; and</text></subparagraph><subparagraph id="id3bf43eb9-2714-49bd-86eb-eb90957a152f" changed="not-changed"><enum>(C)</enum><text>any successor, subunit, parent entity, or subsidiary of, or any entity under common ownership or control with, any entity described in subparagraph (A) or (B).</text></subparagraph></paragraph></subsection><subsection id="idfb1964f4-009d-4def-81d0-6fc18ae6e234" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header>Applicability</header><text>This section shall apply with respect to any contract entered into on or after the date of the enactment of this
