which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of Veterans Affairs to furnish a vaccine for COVID–19 to certain individuals who are not enrolled in the patient enrollment system of the Department of Veterans Affairs.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening and Amplifying Vaccination Efforts to Locally Immunize all Veterans and Every Spouse Act</short-title></quote> or the <quote><short-title>SAVE LIVES Act</short-title></quote>.</text></section><section id="ide595042ffa7c4233bab11d06d0382f49"><enum>2.</enum><header>Authority of Secretary of Veterans Affairs to furnish COVID–19 vaccine to certain individuals not enrolled in patient enrollment system of Department of Veterans Affairs</header><subsection id="id186862C0E3F54C22B0E44C4EA31C35E9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs may furnish a vaccine for COVID–19 to a covered individual during the COVID–19 public health emergency.</text></subsection><subsection id="id7be73e1710084fb289b082d4aeb769d3"><enum>(b)</enum><header>Prioritization</header><text>In furnishing vaccines for COVID–19 under the laws administered by the Secretary, the Secretary shall—</text><paragraph id="id91C2B37B95D34399ABE3E05C70830F71"><enum>(1)</enum><text>prioritize the vaccination of veterans who are enrolled in the patient enrollment system, veterans who receive hospital care and medical services pursuant to subsection (c)(2) of section 1705 of title 38, United States Code, and accompanying caregivers of such veterans before the vaccination of covered individuals not otherwise described in this paragraph; and</text></paragraph><paragraph id="idfcd8f57a44254061b88987bfceeca045"><enum>(2)</enum><text>only furnish vaccines for COVID–19 to covered individuals under this section to the extent that such vaccines are available.</text></paragraph></subsection><subsection id="id27f2eb1520914c3f915e2eeedbb100ae"><enum>(c)</enum><header>Timing of vaccines provided to spouses of veterans</header><text>To the extent practicable, the Secretary may offer a vaccine for COVID–19 under this section to the spouse of a veteran to permit the provision of the vaccine to the spouse near the same time that the veteran receives such vaccine from the Department of Veterans Affairs.</text></subsection><subsection id="idf36b62bd501549998f1e45bf67ff8702"><enum>(d)</enum><header>Vaccine allocation</header><text>It is the sense of Congress that, to the extent practicable based on the current national supply chain, the Secretary of Health and Human Services should adjust the allocation for the Department of Veterans Affairs for the vaccine for COVID–19 based on the additional eligibility of covered individuals under this section. </text></subsection><subsection display-inline="no-display-inline" commented="no" id="id0D95A4A09B9F4E3CAD989E6B1970AB68"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idfe93eda3dc5c41fe84c439e8659ac9b4"><enum>(1)</enum><header>Accompanying caregiver</header><text>The term <term>accompanying caregiver</term> means a caregiver described in subparagraph (D), (E), or (F) of paragraph (2) who is accompanying a veteran who is receiving a vaccine for COVID–19 furnished by the Department. </text></paragraph><paragraph id="idC17E6A7F8B324DFA8157C192C6E35605"><enum>(2)</enum><header>Covered individual</header><text>The term <term>covered individual</term> means any of the following individuals:</text><subparagraph id="id4c54ad4ce244470daee534b0de3e90b0"><enum>(A)</enum><text>A veteran who is not eligible to enroll in the patient enrollment system.</text></subparagraph><subparagraph id="idae84ee93729549e095925cf5f7e5fbe1"><enum>(B)</enum><text>A veteran who is eligible for care under section 1724 of title 38, United States Code.</text></subparagraph><subparagraph id="idb72fdd18e32f4e9985542ecaf62d5ed7"><enum>(C)</enum><text>A beneficiary under section 1781 of such title.</text></subparagraph><subparagraph id="id73b3b9a4d2614c078d9f6edac0b185b1"><enum>(D)</enum><text>A family caregiver of a veteran participating in the program of comprehensive assistance for family caregivers under section 1720G(a) of such title.</text></subparagraph><subparagraph id="id1F1F6C954A77434BB8960DDC691DCBC2"><enum>(E)</enum><text>A caregiver of a veteran participating in the program of general caregiver support services under section 1720G(b) of such title.</text></subparagraph><subparagraph id="id9CDE4FE9E83B428083E1E56B9F5A9B36"><enum>(F)</enum><text>A caregiver of a veteran participating in the Medical Foster Home Program, Bowel and Bladder Program, Home Based Primary Care Program, or Veteran Directed Care Program of the Department of Veterans Affairs.</text></subparagraph><subparagraph id="id53745DA165854E7A87D41AFC32854E07"><enum>(G)</enum><text>A spouse of a veteran.</text></subparagraph></paragraph><paragraph id="idf66e469d46a44fdfa0fa3f3b4e9a145a"><enum>(3)</enum><header>Covered public health emergency</header><text>The term <term>covered public health emergency</term> means an emergency with respect to COVID–19 declared by a Federal, State, or local authority.</text></paragraph><paragraph id="ide462faadbe4b478e9db56f378a9ec077"><enum>(4)</enum><header>COVID–<enum-in-header>19</enum-in-header></header><text>The term <term>COVID–19</term> means the coronavirus disease 2019. </text></paragraph><paragraph id="idC3B3C8683D794D71A1BD921E351F8820"><enum>(5)</enum><header>Patient enrollment system</header><text>The term <term>patient enrollment system</term> means the system of annual patient enrollment of the Department of Veterans Affairs established and operated under section 1705(a) of title 38, United States Code.</text></paragraph><paragraph id="idF7CB5BE08F2A4D119D05A99E4A2B6B37"><enum>(6)</enum><header>Veteran</header><text>The term <term>veteran</term> has the meaning given that term in section 101(2) of title 38, United States Code.</text></paragraph></subsection></section></legis-body></bill>
