which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To report data on COVID–19 immigration detention facilities and local correctional facilities that contract with U.S. Immigration and Customs Enforcement, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>COVID–19 in Immigration Detention Data Transparency Act</short-title></quote>.</text></section><section id="idc68b951fffc34916a31c1ae25af66018"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idE7C86EFB3DC644028A7896D3E5F67939"><enum>(1)</enum><header>CBP detention facility</header><text>The term <term>CBP detention facility</term> means any facility used by U.S. Customs and Border Protection to detain noncitizens. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFB2B089C2F1A41FF8DD597DFA97CF362"><enum>(2)</enum><header>CDC director</header><text>The term <term>CDC Director</term> means the Director of the Centers for Disease Control and Prevention. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id46E54169C37D4B63A3DB6BC8060A652A"><enum>(3)</enum><header>Contract detention facility</header><text>The term <term>contract detention facility</term> means any facility used for the detention of noncitizens that is operated by a government agency or a private entity that has contracted with U.S. Immigration and Customs Enforcement, U.S. Customs and Border Protection, or the Office of Refugee Resettlement to provide such detention services, including service processing centers, juvenile detention facilities, family residential centers, facilities holding noncitizens awaiting removal, holding facilities, and similar facilities operating under an intergovernmental service agreement with any of such Federal agencies, including intergovernmental agreements with the United States Marshals Service.</text></paragraph><paragraph id="id13dc4d6aeb044c68a5eca338e8c2c7ec"><enum>(4)</enum><header>COVID–<enum-in-header>19</enum-in-header></header><text>The term <term>COVID–19</term> means the 2019 novel coronavirus disease caused by the SARS–CoV–2 virus.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4413787D13C24A168EEE611FB038317B"><enum>(5)</enum><header>COVID–19 diagnostic test</header><text>The term <term>COVID–19 diagnostic test</term> means a test—</text><subparagraph commented="no" display-inline="no-display-inline" id="id874BB81767DB4698BBCC07D3A3ED5DE4"><enum>(A)</enum><text>that is an in vitro diagnostic product (as defined in section 809.3 of title 21, Code of Federal Regulations) for the detection of SARS–CoV–2; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE6A6842C0A464E54B60113FD0E0FBCC1"><enum>(B)</enum><text>the administration of which— </text><clause id="id6bb44d2bb087487e83868c085cf0f8fd"><enum>(i)</enum><text>is approved, cleared, or authorized under section 510(k), 513, 515, or 564 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360">21 U.S.C. 360(k)</external-xref>, 360c, 360e, 360bbb–3);</text></clause><clause id="id2c8a09c23a3e4e0ba81f3efc71a18160"><enum>(ii)</enum><text>the developer has requested, or intends to request, emergency use authorization under section 564 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360bbb-3">21 U.S.C. 360bbb–3</external-xref>), unless and until the emergency use authorization request under such section 564 has been denied or the developer of such test does not submit a request under such section within a reasonable timeframe;</text></clause><clause id="idb9f72c3f8d454f229f73a770b23c7542"><enum>(iii)</enum><text>is developed in and authorized by a State that has notified the Secretary of Health and Human Services of its intention to review tests intended to diagnose COVID–19; or</text></clause><clause id="id67d19b614e0b4e388767eaad03fde9e8"><enum>(iv)</enum><text>is another test that the Secretary determines appropriate in guidance. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc530cb84d37f4b0ca63bbbcadb04caed"><enum>(6)</enum><header>COVID–19 emergency data collection period</header><text>The term <term>COVID–19 emergency data collection period</term> means the period beginning on the date of enactment of this Act and ending on the date that is 1 year after the date on which the public health emergency declaration under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>), with respect to COVID–19, terminates. </text></paragraph><paragraph id="idb83581e64c27485c835d13d0e9b8c65e"><enum>(7)</enum><header>COVID–19 risk factors</header><text>The term <term>COVID–19 risk factors</term> includes advanced age, underlying conditions, and other factors identified by the Centers for Disease Control and Prevention.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4DEA14C1B53244E1A975AF13DF56CB64"><enum>(8)</enum><header>Facility staff</header><text>The term <term>facility staff</term> includes all individuals who work in a detention facility, including any individual who regularly reports for work within the detention facility, regardless of the actual employer of such individual.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0E268DE9590345CEA677488CC92C6DCD"><enum>(9)</enum><header>ICE detention facility</header><text>The term <term>ICE detention facility</term> means any facility used by U.S. Immigration and Customs Enforcement to detain or process noncitizens, including service processing centers and hold rooms.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1E2079F1CDF541148863FC65E3960E0F"><enum>(10)</enum><header>ORR contracted facility or program</header><text>The term <term>ORR contracted facility or program</term> means any facility or program in which unaccompanied noncitizen children are in the care and custody of the Department of Health and Human Services.</text></paragraph><paragraph id="idBE54C4C2B99A48A391F2301BDD4B872F"><enum>(11)</enum><header>Public health emergency</header><text>The term <term>public health emergency</term> means—</text><subparagraph id="id61274B46F0374F55946AE6E822DE1586"><enum>(A)</enum><text>a national emergency involving Federal primary responsibility determined to exist by the President under section 501(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191(b)</external-xref>) with respect to a communicable disease; </text></subparagraph><subparagraph id="idB9E25C1E7B64447E9E2F77AA94C14051"><enum>(B)</enum><text>a national emergency declared by the President under sections 201 and 301 of the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1621">50 U.S.C. 1621</external-xref> and 1631) with respect to a communicable disease;</text></subparagraph><subparagraph id="idD0EEAA1E103D461C8D95BFF4E816509A"><enum>(C)</enum><text>a national public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>); or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9D5E40FA9A45434DB0B31528AB22B6BB"><enum>(D)</enum><text>a global pandemic declared by the World Health Organization. </text></subparagraph></paragraph></section><section id="id80002768831248b88f591222b9c10f1c"><enum>3.</enum><header>COVID–19 data collection requirements</header><subsection id="idB5D3298FB0BB4BC0A8A34AD914A2F8CB"><enum>(a)</enum><header>Federal detention facilities</header><text display-inline="yes-display-inline">The Director of U.S. Immigration and Customs Enforcement, the Commissioner of U.S. Customs and Border Protection, the Director of the Office of Refugee Resettlement, and any senior official acting in, or performing the duties of, any such position shall, during the COVID–19 emergency data collection period—</text><paragraph id="id6F4A65A244274515B036386486E82B23"><enum>(1)</enum><text display-inline="yes-display-inline">post daily updates on the public website of the applicable agency containing the information described in section 5 with respect to staff working at ICE detention facilities, CBP detention facilities, or ORR contracted facilities or programs, respectively, and noncitizens detained at such facilities or served by such programs; </text></paragraph><paragraph id="id233A02548F174C0A865F87B142EE646A"><enum>(2)</enum><text display-inline="yes-display-inline">archive, on a weekly basis, the data described in paragraph (1) so that it remains publicly accessible and in a machine readable format; and</text></paragraph><paragraph id="id4D4387885FEE43CE8A9BD1129BBD88D8"><enum>(3)</enum><text>beginning not later than the earlier of the date that is 14 days after the date on which the CDC Director publishes the guidance required under section 4(a) or 45 days after the date of the enactment of this Act, submit weekly reports to the CDC Director containing the information described in section 5.</text></paragraph></subsection><subsection id="ida15154d07d4e46028ff1d5ba81d0ff05"><enum>(b)</enum><header>Contract detention facilities</header><paragraph id="idfd14d3142b464384b5ee78c426f8aa90"><enum>(1)</enum><header>In general</header><text>Beginning not later than the earlier of the date that is 14 days after the date on which the CDC Director publishes the guidance required under section 4(a) or 45 days after the date of the enactment of this Act, the head of each contract detention facility shall—</text><subparagraph id="id412741BC6B2E48B691BE269ED8CA9027"><enum>(A)</enum><text>submit weekly reports to the Federal agency with which the facility is under contract and the public health authority of the State in which the facility is located containing the data described in section 5 with respect to staff working at such facility and noncitizens detained at such facility;</text></subparagraph><subparagraph id="id81D4ED4878C843B19B8148C950E1550E"><enum>(B)</enum><text>post weekly updates containing the data described in subparagraph (A) on the public website of the facility, if the facility has a public website, in a machine readable format, and archive prior updates so that they remain publicly accessible; and</text></subparagraph><subparagraph id="id74BD1475F17944A49E07C1F910B27FF7"><enum>(C)</enum><text>submit weekly reports containing the data referred to in subparagraph (A) to—</text><clause id="id5F92F005E3FE477B8B5EECDB508D3970"><enum>(i)</enum><text>the Immigration Detention Ombudsman designated pursuant to section 405 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/205">6 U.S.C. 205</external-xref>); and</text></clause><clause id="id0C3E64FC646041EDB6A979E52AE68A72"><enum>(ii)</enum><text>the Office for Civil Rights and Civil Liberties of the Department of Homeland Security.</text></clause></subparagraph></paragraph><paragraph id="id3CE839C3640D46EAA37550E1F48C3C49"><enum>(2)</enum><header>Submission of information to the CDC</header><text>Not later than 24 hours after a Federal agency receives the data described in paragraph (1), the head of such agency shall—</text><subparagraph id="idB79FF13612A74F7EBA028BCA6B8D15C8"><enum>(A)</enum><text>submit such data to the CDC Director; and</text></subparagraph><subparagraph id="idDF1D0DA6B43048729668DC1AC72C2646"><enum>(B)</enum><text>post such data to the public website of the agency, disaggregated by individual contract detention facility, which shall be archived weekly and shall remain publicly accessible in a machine readable format.</text></subparagraph></paragraph></subsection><subsection id="id745f26f2e1894ea08c32315eb38eea57"><enum>(c)</enum><header>Use of existing appropriations</header><paragraph id="idE816154D8923402BB02D72E5AE564DD6"><enum>(1)</enum><header>Department of health and human services</header><text>The Department of Health and Human Services shall use amounts otherwise appropriated for the Office of Refugee Resettlement to carry out its responsibilities under this section.</text></paragraph><paragraph id="id8B15B078B4624548BD1733DF1651D6E5"><enum>(2)</enum><header>U.S. immigration and customs enforcement</header><text>U.S. Immigration and Customs Enforcement shall use amounts otherwise appropriated to the Custody Operations Account to carry out its responsibilities under this section.</text></paragraph><paragraph id="id30A9A91B7DB944429E7F064229FE57BB"><enum>(3)</enum><header>U.S. customs and border protection</header><text>U.S. Customs and Border Protection shall use amounts otherwise appropriated to the Procurement, Construction, and Improvements Account to carry out its responsibilities under this section. </text></paragraph></subsection></section><section id="idD06F8E7F2AE444ABB693AAE1D5640E67"><enum>4.</enum><header>CDC Reports</header><subsection id="idA8874E0E6D3B46059B126B38CD21B29F"><enum>(a)</enum><header>Guidance</header><text>Not later than 30 days after the date of enactment of this Act, the CDC Director shall issue guidance for immigration detention facilities regarding—</text><paragraph id="id77fd055de66242dda1f71ba8ad973b50"><enum>(1)</enum><text>the categories of data required to be reported under this Act; and</text></paragraph><paragraph id="id24da2065ba0f491fbf0a54c5ca767cc8"><enum>(2)</enum><text>how the CDC Director will determine whether a Federal or State agency is in compliance with the requirements under this Act.</text></paragraph></subsection><subsection id="id594316639472414EBF7F4C5D8B8173C9"><enum>(b)</enum><header>Publication on website</header><paragraph id="id9128A419A7294699856A5038CC2B8452"><enum>(1)</enum><header>In general</header><text>Not later than 7 days after data is reported to the Centers for Disease Control and Prevention pursuant to section 3, the CDC Director shall make such data available to the public on the website of the Centers for Disease Control and Prevention, including all data reported by U.S. Immigration and Customs Enforcement, U.S. Customs and Border Protection, and the Office of Refugee Resettlement.</text></paragraph><paragraph id="idA4A863AD89A545B3BFEAB697257DB9A3"><enum>(2)</enum><header>Weekly archival</header><text>The data referred to in paragraph (1) shall be archived weekly and shall remain publicly accessible in a machine readable format.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id543189E536CE42BAA3DF3B7D84D89975"><enum>(c)</enum><header>Reports to Congress</header><text>Not later than 60 days after the date of the enactment of this Act, and monthly thereafter during the COVID–19 emergency data collection period, the CDC Director shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions of the Senate</committee-name>, the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name> that—</text><paragraph commented="no" display-inline="no-display-inline" id="id17A16DD0F38242E89194653B106BE7F4"><enum>(1)</enum><text>summarizes the information submitted by U.S. Immigration and Customs Enforcement, U.S. Customs and Border Protection, the Office of Refugee Resettlement, and State public health authorities pursuant to section 3; and</text></paragraph><paragraph id="iddeb2231993d54df6bc44ebc80f132d1b"><enum>(2)</enum><text>analyzes the trends and patterns of the disease outbreak and the care provided in immigration detention facilities and contracted facilities.</text></paragraph></subsection></section><section id="id48524d63d4ba4aeda447c0e74d543950"><enum>5.</enum><header>COVID–19 data</header><subsection id="id92fb5e0d4ad4407786d66bbd22e946a6"><enum>(a)</enum><header>In general</header><text>The data described in this section is the following data with respect to each ICE, CBP, ORR, and contract detention facility:</text><paragraph id="id5ebf40879cd0479d9a20f784746148e7"><enum>(1)</enum><header>Testing numbers</header><text>Data related to COVID–19 diagnostic testing by such facilities, including cumulative and new (since the previous weekly report) counts of—</text><subparagraph id="id05fab0152775445faa03ca4c236d2b9c"><enum>(A)</enum><text>the number of detained noncitizens tested for COVID–19, including the dates on which such tests were administered, disaggregated by—</text><clause id="id0504C4BF8B6E4BF0BC2CDE70D5E50AF7"><enum>(i)</enum><text>first-time COVID–19 diagnostic tests and retests; and</text></clause><clause id="id1944260C3CA14DD796F7363DC35151FA"><enum>(ii)</enum><text>symptomatic and asymptomatic;</text></clause></subparagraph><subparagraph id="ideced7645ee954a13afb87ab842858127"><enum>(B)</enum><text>the number of detained noncitizens who have requested COVID–19 testing, including the number of such requests that were denied and the reasons for such denials;</text></subparagraph><subparagraph id="idE6A9F4538B1843629B6FA856832D33C2"><enum>(C)</enum><text>the number of facility staff tested for COVID–19, disaggregated by first-time COVID–19 diagnostic tests and retests; and</text></subparagraph><subparagraph id="ida7e008e2360849478a79fb6d8cd71a75"><enum>(D)</enum><text>the COVID–19 diagnostic test developer and test name for each COVID–19 diagnostic test conducted.</text></subparagraph></paragraph><paragraph id="id78fbc277594f48f5b02b501df7b2db6f"><enum>(2)</enum><header>Test results</header><text>Data related to COVID–19 diagnostic testing outcomes, including cumulative and new (since the previous weekly report) counts of—</text><subparagraph id="id251d7eb6b6c040bf8de64c48804e09b8"><enum>(A)</enum><text>the number of confirmed active cases of COVID–19 among detained noncitizens, disaggregated by—</text><clause id="idF212157E629C46928AF9035906C3F385"><enum>(i)</enum><text>first-time COVID–19 diagnostic tests and retests; and</text></clause><clause id="idCFB5CC8CFC9A4B8AB4F85C01289B1CB5"><enum>(ii)</enum><text>the COVID–19 diagnostic test developer and test name for each COVID–19 diagnostic test used to confirm each active case;</text></clause></subparagraph><subparagraph id="id648ed362c0cc40cda4c1bd97d359922d"><enum>(B)</enum><text>the number of confirmed negative cases of COVID–19 among detained noncitizens, disaggregated by—</text><clause id="id5444AE18416D44138C37FEA78283F837"><enum>(i)</enum><text>first-time COVID–19 diagnostic tests and retests; and</text></clause><clause id="idB5BDBBF186CC40B89A271A892962AF07"><enum>(ii)</enum><text>the COVID–19 diagnostic test developer and test name for each COVID–19 diagnostic test used to confirm each negative case; </text></clause></subparagraph><subparagraph id="id79268ca9ca4e484993f279c641277dde"><enum>(C)</enum><text>the number of confirmed active cases of COVID–19 among detention facility staff, disaggregated by—</text><clause id="id4B8CA9B6C3F34B2EB64EAE82BB32702B"><enum>(i)</enum><text>first-time COVID–19 diagnostic tests and retests; and</text></clause><clause id="id17E576977DC841FFB6EF885370166F9B"><enum>(ii)</enum><text>the COVID–19 diagnostic test developer and test name for each COVID–19 diagnostic test used to confirm each active case; </text></clause></subparagraph><subparagraph id="ida3259482f4514095a26e6cf4b760559a"><enum>(D)</enum><text>the number of confirmed negative cases of COVID–19 among detention facility staff, disaggregated by—</text><clause id="id225D71ED2433442EA8C3BB326CE6F15F"><enum>(i)</enum><text>first-time COVID–19 diagnostic tests and retests; and</text></clause><clause id="idA34BCA8481C74101B6EC59FF81054402"><enum>(ii)</enum><text>the COVID–19 diagnostic test developer and test name for each COVID–19 diagnostic test used to confirm each negative case; </text></clause></subparagraph><subparagraph id="idcff0995de07349969401413aacb13494"><enum>(E)</enum><text>the number of COVID–19 diagnostic tests pending results, disaggregated by detained noncitizens and detention facility staff;</text></subparagraph><subparagraph id="idf57182a7978a4ac6875d088b98383aa3"><enum>(F)</enum><text>the average time between testing a detained person for COVID–19 and receiving the results of the COVID–19 diagnostic test; and</text></subparagraph><subparagraph id="id1a2469bcf7bd4ff09cdf0b273887298b"><enum>(G)</enum><text>the average time between testing a detention facility employee for COVID–19 and receiving the results of the COVID–19 diagnostic test.</text></subparagraph></paragraph><paragraph id="idce6f3ae59d774079bad337b155dbc67f"><enum>(3)</enum><header>Case outcomes</header><text>COVID–19 case outcomes, including cumulative and new (since the previous report) counts of—</text><subparagraph id="id1b7c7fd7bb764a999be3fc0f1f670f37"><enum>(A)</enum><text>the number of detained noncitizens hospitalized for a case of COVID–19, including the locations of the hospitals at which the noncitizens are receiving treatment;</text></subparagraph><subparagraph id="id21b7ad58622647bea7a5515582edd100"><enum>(B)</enum><text>the number of detained noncitizens who have recovered from COVID–19;</text></subparagraph><subparagraph id="id8de13a6d62634f279e4703e44178d991"><enum>(C)</enum><text>the number of detained noncitizens currently in quarantine and the number of detained noncitizens in medical isolation for infection with or exposure to COVID–19; and </text></clause><clause id="idB1C6F7C3C8464D30869BDAEA4C1E6B2E"><enum>(ii)</enum><text>any changes or updates made to the policies;</text></clause></subparagraph><subparagraph id="id1186fa8e9e4b4da1926443ea5a309b10"><enum>(B)</enum><text>the total number of COVID–19 vaccine doses that the facility has received up to the date of the report, disaggregated by the types of COVID–19 vaccine the facility has received; </text></subparagraph><subparagraph id="ided217f8a6b8a4484af61bc297e653923"><enum>(C)</enum><text>the number of COVID–19 vaccine doses that the facility has in inventory as of the date of the report, disaggregated by the types of COVID–19 vaccine the facility has in inventory; </text></subparagraph><subparagraph id="ide44b1a76f90e4b20aa92f2309db9ce96"><enum>(D)</enum><text>the total number and percentage of detained noncitizens—</text><clause id="id6189d5b56fdc4c4cbe829c2fb8bdbf13"><enum>(i)</enum><text>who have been offered a COVID–19 vaccine, disaggregated by the types of COVID–19 vaccine offered at each facility; </text></clause><clause id="id0f6f99f0a26644b88a45d336c47aeda0"><enum>(ii)</enum><text>who received a first dose of the COVID–19 vaccine during the week immediately preceding the date of the report, disaggregated by the types of COVID–19 vaccine administered at each facility; and </text></subparagraph><subparagraph id="id2e58d8d934654583945170477d548cf1"><enum>(G)</enum><text>the number of transferees who were fully vaccinated before being transferred, either because the person received a second dose of the COVID–19 vaccine or because the COVID–19 vaccine the person received required only 1 dose, disaggregated by the type of COVID–19 vaccine administered. </text></subparagraph></paragraph><paragraph id="id659EDAF8B73D4D4297A6A827C779F8CB"><enum>(8)</enum><header>Released noncitizens</header><text>Data related to the COVID–19 testing, results, and case outcomes (at the time of release) of noncitizens who were released from detention, and juvenile noncitizens who were released from the custody of the Department of Health and Human Services, during the reporting period, disaggregated by the type of release, and including—</text><subparagraph id="idCB409A8B65CE42EA84E86F4D2AED49B5"><enum>(A)</enum><text>individuals released to alternatives to detention programs as a result of the COVID–19 public health emergency;</text></subparagraph><subparagraph id="idD1EEDC530FB84AD4907524707641444A"><enum>(B)</enum><text>any recent positive COVID–19 tests and referrals to external medical care;</text></subparagraph><subparagraph id="id845cc5b5bb5043c1873f91e10623ec4a"><enum>(C)</enum><text>the number of noncitizens released who received a first dose of the COVID–19 vaccine before being released, disaggregated by the type of COVID–19 vaccine administered; and</text></subparagraph><subparagraph id="id2f82d4439c5e421ab1250ff078b78c10"><enum>(D)</enum><text>the number of noncitizens who were fully vaccinated before being released, either because the person received a second dose of the COVID–19 vaccine or because the COVID–19 vaccine the person received required only 1 dose, disaggregated by the type of COVID–19 vaccine administered. </text></subparagraph></paragraph><paragraph id="id72B3FFA75EC746F297266D23D76D135A"><enum>(9)</enum><header>Removed noncitizens</header><text>Data related to the COVID–19 testing, results, and case outcomes (at the time of removal or expulsion) of noncitizens who were deported from an ICE, CBP, ORR, or contract detention facility during the reporting period, including—</text><subparagraph id="idE3136E360F5F4419BE12B58C7BBAA3F4"><enum>(A)</enum><text>any recent positive COVID–19 tests and referrals to external medical care;</text></subparagraph><subparagraph id="id65361be35999457990f73f05752cd69b"><enum>(B)</enum><text>the number of noncitizens removed or expelled from the United States;</text></subparagraph><subparagraph id="id64378731ebf441bdb413bc2971295077"><enum>(C)</enum><text>the number of such noncitizens who were tested and received a result before their removal or expulsion;</text></subparagraph><subparagraph id="idcbf499bb001244a2925ec001d56e164d"><enum>(D)</enum><text>the number of such noncitizens who were not tested or did not receive a result before their removal or expulsion;</text></subparagraph><subparagraph id="id664d474c3b604ff091ec2783a3f650fc"><enum>(E)</enum><text>the number of such noncitizens who received a first dose of the COVID–19 vaccine before their removal, disaggregated by the type of COVID–19 vaccine administered;</text></subparagraph><subparagraph id="id54530c0c16a0453284fe8c715236961f"><enum>(F)</enum><text>the number of such noncitizens who were fully vaccinated before their removal, either because the person received a second dose of the COVID–19 vaccine or because the COVID–19 vaccine the person received required only 1 dose, disaggregated by the type of COVID–19 vaccine administered; and</text></subparagraph><subparagraph id="id5A6A020A7327483084C130EB3E0BC716"><enum>(G)</enum><text>the countries to which noncitizens are removed or expelled from the United States. </text></subparagraph></paragraph><paragraph id="id5e29405ac7064403a9db58eb48259888"><enum>(10)</enum><header>Book-ins</header><text>Data related to facility book-ins, including cumulative and new (since the previous report) counts of—</text><subparagraph id="idf9cca6cb2e254ba181bba13a9ddda495"><enum>(A)</enum><text>the number of noncitizens booked into each facility, disaggregated by—</text><clause id="id6ef7fa2f7c3c4276a133c8be794ef238"><enum>(i)</enum><text>initial and total book-ins (including transfers);</text></clause><clause id="idcb1491cae2e34e81a9638a092a970c01"><enum>(ii)</enum><text>arresting agency;</text></clause><clause id="id2a5207bc1d1e4831aa9d2f7ed736a5ae"><enum>(iii)</enum><text>initial book-ins from ORR custody (if applicable); and</text></clause><clause id="id16bb8ca0d8e74b3e9c33400e21797b9e"><enum>(iv)</enum><text>initial book-ins from other Federal, State, or local government agencies, including the United States Marshals Service and the Bureau of Prisons.</text></clause></subparagraph></paragraph><paragraph id="id21729e94051545ca9675459ac2997a26"><enum>(11)</enum><header>Facility staff</header><text>The total number of facility staff during the current reporting period.</text></paragraph></subsection><subsection id="ideea354a8c5ef450cb8a5795e8df306b7"><enum>(b)</enum><header>Disaggregation of data</header><paragraph id="idC9835632D545407EAE8A4E4338FF26C0"><enum>(1)</enum><header>In general</header><text>The data described in subsection (a) shall be disaggregated by sex, sexual orientation, gender identity, age, race, ethnicity, disability, language spoken, last known place of residence, location at which the individual is being detained, nationality, and statutory authority for detention.</text></paragraph><paragraph id="id8ff421901ef842e481712878e5115742"><enum>(2)</enum><header>Exclusion of individuals incarcerated for nonimmigration reasons at contract detention facilities</header><text>Data regarding individuals incarcerated at contract detention facilities for nonimmigration reasons shall be excluded from the data described in subsection (a). </text></paragraph></subsection><subsection id="id1365c291e1a44c7d841569856e87c7fa"><enum>(c)</enum><header>Detention period</header><text>The data described in subsection (a) with respect to detained noncitizens who are infected with COVID–19 shall include, to the extent practicable, the period of their detention.</text></subsection></section><section id="id59cb164df6354f1fa299f215f2428ce0"><enum>6.</enum><header>Privacy protections</header><subsection id="id1128A7A896EB46CE8DA00F42E676FEED"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any data collected, stored, received, or published under this Act—</text><paragraph id="ida7c2ea89bc0b4450bc2ae0c9e8728714"><enum>(1)</enum><text>shall be collected, stored, received, or published in a manner that protects the privacy of individuals whose information is included in such data;</text></paragraph><paragraph id="idA5A34CBA5C9743CC9256563DD0A2A4D4"><enum>(2)</enum><text>shall be de-identified or anonymized in a manner that protects the identity of all individuals whose information is included in such data; </text></paragraph><paragraph id="idbaa5796da5704b65bcbf2e03660bb76e"><enum>(3)</enum><text>shall comply with privacy protections provided under the regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1320d-2">42 U.S.C. 1320d–2</external-xref> note); and </text></paragraph><paragraph id="id6342bdf5994e444ca600e6d802c7376a"><enum>(4)</enum><text>shall be limited in use for the purpose of public health and be protected from all other internal use by any entity that collects, stores, or receives the data, including use of such data in determinations of eligibility (or continued eligibility) in health plans, and from any other inappropriate uses.</text></paragraph></subsection><subsection id="idC763399B3D104F94BB88976269CF3104"><enum>(b)</enum><header>Restriction on use of COVID–19 status in immigration proceedings</header><text>The Government may not use an noncitizen’s positive COVID–19 test, an noncitizen’s treatment for COVID–19 symptoms, or the state of the COVID–19 pandemic in the noncitizen’s country of origin as evidence against the noncitizen in any immigration proceeding, including—</text><paragraph id="id146A7437513440E3B0EB89FEA398F89B"><enum>(1)</enum><text>a proceeding to determine if the noncitizen is a public charge; and</text></paragraph><paragraph id="idE60236CCBDBC4B0484BF1EB81FB257AE"><enum>(2)</enum><text>proceedings involving asylum, withholding of removal, and protection under the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, done at New York December 10, 1984.</text></paragraph></subsection></section><section id="id31C50CF4CC374D0794681B91D0B2A9C0"><enum>7.</enum><header>COVID–19 safety protocols and practices</header><subsection id="id8A9022A290C243039D2BF73CABF65E73"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Director of U.S. Immigration and Customs Enforcement, the Commissioner of U.S. Customs and Border Protection, the Director of the Office of Refugee Resettlement, and any senior official acting in, or performing the duties of, any such position shall submit a report to the congressional committees referred to in section 4(c) that identifies, for each detention facility under the jurisdiction of the applicable agency head, including contract detention facilities, the protocols and practices for protecting detained noncitizens from exposure to the novel coronavirus (SARS–CoV–2), including—</text><paragraph id="id2AEF32867D6441F5B37E8D9E820064E1"><enum>(1)</enum><text>the health standards at the facility, including—</text><subparagraph id="id7111e81c47fa43f58a6e35b0f566c22a"><enum>(A)</enum><text>the standards for transfer to hospital or other specialized care;</text></subparagraph><subparagraph id="id8ec799d901a1422f9cc3816ef1739e5b"><enum>(B)</enum><text>the procedure for the detained person to request and obtain a COVID–19 test and associated results; and</text></subparagraph><subparagraph id="id39608c9c1fff41909d53ab59c03d6f6e"><enum>(C)</enum><text>detained noncitizens access to information about the facility’s COVID–19 plans and protocols;</text></subparagraph></paragraph><paragraph id="idCAB5778A83384020879C5F41AF088A5D"><enum>(2)</enum><text>the medical care provided to detained noncitizens, including—</text><subparagraph id="id7d58521dd2324662a9a34090a0971f7f"><enum>(A)</enum><text>the specific efforts to cohort smaller groups of detained people;</text></subparagraph><subparagraph id="id7be782ae1df64879af04e5a70909ff44"><enum>(B)</enum><text>the specific efforts to provide humane medical isolation to symptomatic people, and separately, people who have tested positive for COVID–19; and</text></subparagraph><subparagraph id="ide7e0936230fe488381268ec7c49fa26b"><enum>(C)</enum><text>the standards for clinical monitoring of symptomatic and COVID–19 positive detained persons; and</text></subparagraph></paragraph><paragraph id="idFDA5421EC4744C759E588024065129B3"><enum>(3)</enum><text>the sanitation practices at the facility, including the frequency and amount of detained noncitizens’ access to soap and masks.</text></paragraph></subsection><subsection id="id31C7A81B1824410B8CABE7DC5358DC96"><enum>(b)</enum><header>Notification of outbreak or exposure</header><text>Each detention facility shall create, share, and enforce a process for notifying anyone who has recently entered or visited such facility of any COVID–19 outbreak or exposure at such facility.</text></subsection></section><section id="id5B59EDFFF08D4F269F384DD6CB291F9F"><enum>8.</enum><header>Access to legal counsel</header><text display-inline="no-display-inline">Not later than 30 days after the date of the enactment of this Act, and monthly thereafter, the Director of U.S. Immigration and Customs Enforcement, the Commissioner of U.S. Customs and Border Protection, the Director of the Office of Refugee Resettlement, the head of each contract detention facility, and any senior official acting in, or performing the duties of, any such position shall submit a report to the congressional committees referred to in section 4(c) that identifies, for each detention facility for which he or she is responsible—</text><paragraph id="id807FB886375A4F3782B8A1901B24F927"><enum>(1)</enum><text display-inline="yes-display-inline">the efforts made to ensure that each noncitizen detained in such facility has access to legal counsel;</text></paragraph><paragraph id="id93B262CD5CF24E5C9319CE5112B6F9D3"><enum>(2)</enum><text>if any detained noncitizen does not have access to legal counsel, the changes being made to ensure universal access to legal counsel;</text></paragraph><paragraph id="ide6dc81ea0aac4949844ebbb187a2c048"><enum>(3)</enum><text>the number of telephones available to detained noncitizens;</text></paragraph><paragraph id="id3747086442924ada8cf1589de515c680"><enum>(4)</enum><text>the number of detained noncitizens who have used the free telephone call minutes available to them;</text></paragraph><paragraph id="idd1b574d43d094715823206fb252af0e5"><enum>(5)</enum><text>the number of detained noncitizens who have access to video conference technology with their legal counsel and the number of detained noncitizens who have used video conference technology to communicate with their legal counsel;</text></paragraph><paragraph id="id76b96d6587af4a46a8aeac1083f34c55"><enum>(6)</enum><text>the number of computers or internet-enabled portable electronic devices available to detained noncitizens; and</text></paragraph><paragraph id="id36fd40fd77c6456b8e87377a734f31f1"><enum>(7)</enum><text>the process for notifying the public when the facility is locked down because of an outbreak, including the accommodations made during such lockdowns to provide detained noncitizens with increased access to telephones or videoconferencing. </text></paragraph></section><section id="idBECF6708D44A448587AF466F84621236"><enum>9.</enum><header>Right of detained noncitizens to access test results</header><text display-inline="no-display-inline"> The Director of U.S. Immigration and Customs Enforcement, the Commissioner of U.S. Customs and Border Protection, the Director of the Office of Refugee Resettlement, the head of each contract detention facility, and any senior official acting in, or performing the duties of, any such position shall ensure that each detained noncitizen receives the results of, and any medical records related to, any COVID–19 diagnostic test administered to the noncitizen, in the noncitizen’s preferred language, and in a private and confidential manner, not later than 24 hours after such results become available.</text></section></legis-body></bill>
