which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>December 17, 2021</action-date><action-desc>Reported by <sponsor name-id="S275">Ms. Cantwell</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Inter-Agency Task Force on Harmful Algal Blooms and Hypoxia to develop a plan for reducing, mitigating, and controlling harmful algal blooms and hypoxia in South Florida, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>South Florida Clean Coastal Waters Act of 2021</short-title></quote>.</text></section><section id="id6250c04c75ba4773b428f713efd7539f"><enum>2.</enum><header>South Florida harmful algal blooms and hypoxia assessment and action plan</header><subsection id="id6E6FDCCDBB6C450AB90C852B59341C81"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Harmful Algal Bloom and Hypoxia Research and Control Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/383">Public Law 105–383</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/33/4001">33 U.S.C. 4001 et seq.</external-xref>) is amended—</text><paragraph id="idC795CC191E0743B8B9CE278FD9B95A68"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating sections 605 through 609 as sections 606 through 610, respectively; and</text></paragraph><paragraph id="idC1DE3E63050D4ED29B1F3BD25C6FE485"><enum>(2)</enum><text>by inserting after section 604 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id05a853d7d18647ea9869698459da8a68"><section id="idce3b9cbed2614b32b0eb70c772b1e022"><enum>605.</enum><header>South Florida harmful algal blooms and hypoxia</header><subsection commented="no" display-inline="no-display-inline" id="id4CFBE54E7F20417181438A88D83CE206"><enum>(a)</enum><header display-inline="yes-display-inline">South Florida</header><text display-inline="yes-display-inline">In this section, the term <term>South Florida</term> means—</text><paragraph commented="no" display-inline="no-display-inline" id="id1BF490A63F7A46CEA969A171AF4F78D9"><enum>(1)</enum><text display-inline="yes-display-inline">all lands and waters within the administrative boundaries of the South Florida Water Management District; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3C0004E25CBA4281884260A6F3160ECD"><enum>(2)</enum><text display-inline="yes-display-inline">regional coastal waters, including Biscayne Bay, the Caloosahatchee Estuary, Florida Bay, Indian River Lagoon, and St. Lucie River Estuary; and</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idF17DA52C97924159A2666C327E16D076"><enum>(3)</enum><text>the Florida Reef Tract.</text></paragraph></subsection><subsection id="id4559dd759b534844995f0deae8a05d7e"><enum>(b)</enum><header>Integrated assessment</header><paragraph id="id4DF4CC27FE2C40D6BC5AA59F6C178CCF"><enum>(1)</enum><header>Interim integrated assessment</header><text>Not later than 540 days after the date of enactment of the <short-title>South Florida Clean Coastal Waters Act of 2021</short-title>, the Task Force, in accordance with the authority under section 603, shall complete and submit to Congress and the President an interim integrated assessment. </text></paragraph><paragraph id="id22A3B70FA6D34F83885FD058AED38C10"><enum>(2)</enum><header>Finalized integrated assessment</header><text>Not later than 3 years after the date of enactment of the <short-title>South Florida Clean Coastal Waters Act of 2021</short-title>, the Task Force shall finalize, and submit to Congress and the President, the interim integrated assessment required by paragraph (1).</text></paragraph><paragraph id="idB85478B14DFA48B78502EC0856D327B2"><enum>(3)</enum><header>Contents of integrated assessment</header><text>The integrated assessment required by paragraphs (1) and (2) shall examine the causes, consequences, and potential approaches to reduce harmful algal blooms and hypoxia in South Florida, and the status of, and gaps within, current harmful algal bloom and hypoxia research, monitoring, management, prevention, response, and control activities that directly affect the region by—</text><subparagraph id="id4b1220b3ae51484e9e34a1a2996c2078"><enum>(A)</enum><text>Federal agencies;</text></subparagraph><subparagraph id="idfd5e6eaa8cb54527ad660b1844d917c9"><enum>(B)</enum><text>State agencies;</text></subparagraph><subparagraph id="ida4622f5cda024fde91f875f4245e1503"><enum>(C)</enum><text>regional research consortia;</text></subparagraph><subparagraph id="id53621465ca384719861991dee1faaf73"><enum>(D)</enum><text>academia;</text></subparagraph><subparagraph id="id51c1370fd05340248eb4b3d8d890eb42"><enum>(E)</enum><text>private industry;</text></subparagraph><subparagraph id="id7b053bde7287492eb0eb08df8e0f2de6"><enum>(F)</enum><text>nongovernmental organizations; and </text></subparagraph><subparagraph id="idA4A0DE98EF864941BDD30A8D8E5B22E8"><enum>(G)</enum><text>Indian tribes (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)).</text></subparagraph></paragraph></subsection><subsection id="idc4b9b41b424a4a10a0b783608ea427c7"><enum>(c)</enum><header>Action plan</header><paragraph id="id6b8e6820b9f446bc806762f797af3a98"><enum>(1)</enum><header>In general</header><text>Not later than 3 years and 180 days after the date of the enactment of the <short-title>South Florida Clean Coastal Waters Act of 2021</short-title>, the Task Force shall develop and submit to Congress a plan, based on the integrated assessment under subsection (b), for reducing, mitigating, and controlling harmful algal blooms and hypoxia in South Florida.</text></paragraph><paragraph id="id1e5b7de7b4b04029828b9b5b8c67a835"><enum>(2)</enum><header>Contents</header><text>The plan submitted under paragraph (1) shall—</text><subparagraph id="id6a820083c847457c8d234cb61fb01b3b"><enum>(A)</enum><text>address the monitoring needs identified in the integrated assessment under subsection (b);</text></subparagraph><subparagraph id="id02b94d779afc43048b95f091a52eb701"><enum>(B)</enum><text>develop a timeline and budgetary requirements for deployment of future assets;</text></subparagraph><subparagraph id="idab24f6da91c348069753e68ecadb129e"><enum>(C)</enum><text>identify requirements for the development and verification of South Florida harmful algal bloom and hypoxia models, including—</text><clause id="id1471fadf85cb40a9a8018b07a7cc3a72"><enum>(i)</enum><text>all assumptions built into the models; and</text></clause><clause id="id4b2d61541fa84dfa99830ebd1c25a3ed"><enum>(ii)</enum><text>data quality methods used to ensure the best available data are utilized; and</text></clause></subparagraph><subparagraph id="idc53ec8bc1435446a8d430465a5204f21"><enum>(D)</enum><text>propose a plan to implement a remote monitoring network and early warning system for alerting local communities in the region to harmful algal bloom risks that may impact human health.</text></subparagraph></paragraph><paragraph id="id9ef140c0d30d491e8ea40e33b0b04484"><enum>(3)</enum><header>Requirements</header><text>In developing the action plan, the Task Force shall—</text><subparagraph id="id6d71cae803fd446684a35dd0fb41aa0c"><enum>(A)</enum><text>consult with the State of Florida, and affected local and tribal governments;</text></subparagraph><subparagraph id="id7cc0203b1b594c13aa675833b065d2e3"><enum>(B)</enum><text>consult with representatives from regional academic, agricultural, industry, and other stakeholder groups;</text></subparagraph><subparagraph id="id4d7a0b7cb31d4a80ba1cceb0f4abd6fe"><enum>(C)</enum><text>ensure that the plan complements and does not duplicate activities conducted by other Federal or State agencies, including the South Florida Ecosystem Restoration Task Force;</text></subparagraph><subparagraph id="ide27fb3b7ce624177a644716042ba61aa"><enum>(D)</enum><text>identify critical research for reducing, mitigating, and controlling harmful algal bloom events and their effects;</text></subparagraph><subparagraph id="id3f41e44bbab04c1cb4c841ff6bcc441f"><enum>(E)</enum><text>evaluate cost-effective, incentive-based partnership approaches;</text></subparagraph><subparagraph id="id09058213d1104509979fe20b0a3905fd"><enum>(F)</enum><text>ensure that the plan is technically sound and cost-effective;</text></subparagraph><subparagraph id="ide626e124526342f388eb27e6af9f9df0"><enum>(G)</enum><text>utilize existing research, assessments, reports, and program activities;</text></subparagraph><subparagraph id="idc9de63c098224000b45593071d04179a"><enum>(H)</enum><text>publish a summary of the proposed plan in the Federal Register at least 180 days prior to submitting the completed plan to Congress; and</text></subparagraph><subparagraph id="id1e3ccf4dba8944d28dff706e666eb2a4"><enum>(I)</enum><text>after submitting the completed plan to Congress, provide biennial progress reports on the activities toward achieving the objectives of the plan.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id8124CDFCD71347BC9EAE9BFDA5153575"><enum>(b)</enum><header>Clerical amendment and correction</header><text>The table of contents in section 2 of the Coast Guard Authorization Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/383">Public Law 105–383</external-xref>) is amended by striking the items relating to title VI and inserting the following new items:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id59D035AF0814400C8831A7194E7D4AD2"><toc><toc-entry bold="off" level="title">Title VI—Harmful Algal Blooms and Hypoxia</toc-entry><toc-entry bold="off" level="section">Sec. 601.
