which was read twice and referred to the <committee-name committee-id="SSFR00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Foreign Relations</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>June 24, 2021</action-date><action-desc>Reported by <sponsor name-id="S306">Mr. Menendez</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To ensure that goods made with forced labor in the Xinjiang Uyghur Autonomous Region of the People’s Republic of China do not enter the United States market, and for other purposes.</official-title></form><legis-body><section id="HDDBBC88091D440018E490BD873023A37" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Uyghur Forced Labor Prevention Act</short-title></quote>.</text></section><section id="H8213359953D8437BBF9904013B415588" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H27237B572A7F4A8FBB934EB60D5661EB"><enum>(1)</enum><text display-inline="yes-display-inline">In the Xinjiang Uyghur Autonomous Region of the People's Republic of China, the Government of the People’s Republic of China has, since April 2017, arbitrarily detained more than 1,000,000 Uyghurs, Kazakhs, Kyrgyz, and members of other persecuted groups in a system of extrajudicial mass internment camps, and has subjected detainees to forced labor, torture, political indoctrination, and other severe human rights abuses.</text></paragraph><paragraph id="HBAA86B61373A4C18A816DC13802916DB"><enum>(2)</enum><text display-inline="yes-display-inline">Forced labor, a severe form of human trafficking, exists within the Xinjiang Uyghur Autonomous Region’s system of mass internment camps, and throughout the region, and is confirmed by the testimony of former camp detainees, satellite imagery, and official leaked documents from the Government of the People’s Republic of China as part of a targeted campaign of repression of Muslim ethnic minorities.</text></paragraph><paragraph id="H926070DF749841839267AF87ACDBB690"><enum>(3)</enum><text display-inline="yes-display-inline">In addition to reports from researchers and civil society groups documenting evidence that many factories and other suppliers in the Xinjiang Uyghur Autonomous Region are exploiting forced labor, on July 22, 2020, the Bureau of Industry and Security of the Department of Commerce added 11 entities to the Entity List set forth in Supplement No. 4 to part 744 of title 15, Code of Federal Regulations, after determining the entities had been <quote>implicated in human rights violations and abuses in the implementation of China’s campaign of repression, mass arbitrary detention, forced labor and high-technology surveillance against Uyghurs, Kazakhs, and members of other persecuted groups in the Xinjiang Uyghur Autonomous Region</quote>. </text></paragraph><paragraph id="id285e9897c39c42d89f34c67cfd06bafc"><enum>(4)</enum><text>The Government of the People’s Republic of China interferes with audits and traditional due diligence efforts to vet goods and supply chains in the Xinjiang Uyghur Autonomous Region to hinder identifying goods made in whole or part with forced labor, including by intimidating potential witnesses and concealing relevant information.</text></paragraph><paragraph id="id022dec2f7ea2420fa99778f0e397a7a8"><enum>(5)</enum><text>Reports cited by the Department of Labor estimate that hundreds of thousands of ex-detainees who are Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups in the People’s Republic of China may be working in conditions of forced labor following detention in re-education camps. Moreover, nongovernmental organizations estimate that more than 80,000 Uyghurs were transferred out of the Xinjiang Uyghur Autonomous Region to work in factories across the People’s Republic of China between 2017 and 2019, and some of them were sent directly from detention camps.</text></paragraph><paragraph id="id1d6757c096524de286b5763ad190892e"><enum>(6)</enum><text>The Department of State’s June 2020 Trafficking in Persons Report found, <quote>Authorities offer subsidies incentivizing Chinese companies to open factories in close proximity to the internment camps and to receive transferred detainees at satellite manufacturing sites in other provinces. Local governments receive additional funds for each inmate forced to work in these sites at a fraction of minimum wage or without any compensation. The government has transported tens of thousands of these individuals to other areas within Xinjiang and to other provinces for forced labor under the guise of poverty alleviation and industrial aid programs.</quote>.</text></paragraph><paragraph id="idf064460fc348444eaf32743cbf9c1380"><enum>(7)</enum><text>U.S. Customs and Border Protection has issued 11 withhold release orders on goods suspected to be produced with prison or forced labor in the Xinjiang Uyghur Autonomous Region. Goods subject to the withhold release orders include all cotton, cotton products, tomatoes, and tomato products, as well as certain garments, hair products, apparel, computer parts, and other goods.</text></paragraph><paragraph id="id8ae311695d764eb5b31f356a69d57cff"><enum>(8)</enum><text>In its 2019 annual report, the Congressional-Executive Commission on China found that goods reportedly produced with forced labor by current and former mass internment camp detainees included textiles, electronics, food products, shoes, tea, and handicrafts.</text></paragraph><paragraph id="idf35121c7273c494b8d37c24689d75914" commented="no"><enum>(9)</enum><text>Under section 1091(a) of title 18, United States Code, a person commits genocide if the person “whether in time of peace or in time of war and with the specific intent to destroy, in whole or in substantial part, a national, ethnic, racial, or religious group as such—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0EF9708A71CA417F887880E3AF219127" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><paragraph id="idF75B4E1D40424A9ABEC5EC0488259224" commented="no" indent="down1"><enum>(1)</enum><text>kills members of that group;</text></paragraph><paragraph id="idedf1d7884e744da586d998ee7637ec92" commented="no" indent="down1"><enum>(2)</enum><text>causes serious bodily injury to members of that group;</text></paragraph><paragraph id="idca837dd8c6dd4d82949cdab3d52f2b6d" commented="no" indent="down1"><enum>(3)</enum><text>causes the permanent impairment of the mental faculties of members of the group through drugs, torture, or similar techniques;</text></paragraph><paragraph id="id7cc8897afb36492985a862773ece4228" commented="no" indent="down1"><enum>(4)</enum><text>subjects the group to conditions of life that are intended to cause the physical destruction of the group in whole or in part;</text></paragraph><paragraph id="id005e56ce7e2540f390d16ec5f4272207" commented="no" indent="down1"><enum>(5)</enum><text>imposes measures intended to prevent births within the group; or</text></paragraph><paragraph id="id3f1abe33a6a544feac8f280d402d3f33" commented="no" indent="down1"><enum>(6)</enum><text>transfers by force children of the group to another group.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id5b507b63673d433aaa51de6dbe2d9ea7"><enum>(10)</enum><text>As a direct result of the campaign of targeted and coercive population control of the Government of the People’s Republic of China’s against Uyghurs, the birthrate of the Uyghur population in the Xinjiang Uyghur Autonomous Region plummeted by 24 percent from 2017 to 2018, with birthrates in the Uyghur majority regions of Hotan and Kashgar decreasing by more than 60 percent from 2015 to 2018.</text></paragraph><paragraph id="idd20675682e7c41278a9a5eb4e77ed28d"><enum>(11)</enum><text>The policies of the Government of the People’s Republic of China are in contravention of its human rights commitments and obligations, including under—</text><subparagraph id="id0258eb9eba8747458f680aa78e04fa7d"><enum>(A)</enum><text>the Universal Declaration of Human Rights;</text></subparagraph><subparagraph id="idd045f069a880484188050ec76c23b80d"><enum>(B)</enum><text>the International Covenant on Civil and Political Rights, which the People’s Republic of China has signed but not yet ratified; and</text></subparagraph><subparagraph id="id5fd5e38b57a446b797d08540adc27dbf"><enum>(C)</enum><text>the United Nations Protocol to Prevent, Suppress and Punish Trafficking in Persons Especially Women and Children (commonly known as the <quote>Palermo Protocol</quote>), to which the People’s Republic of China has been a state party since February 2010. </text></subparagraph></paragraph></section><section id="HD5B94F8CFA0948CC87124F3DE1C13158" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text><paragraph id="idb03385dd57bf4ad6815cb79e2f9c9fad"><enum>(1)</enum><text>to strengthen the prohibition against the importation of goods made with forced labor, including by ensuring that the Government of the People’s Republic of China does not undermine the effective enforcement of section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>), which prohibits the importation of <quote>[a]ll goods, wares, articles, and merchandise mined, produced or manufactured wholly or in part in any foreign country by … forced labor</quote>;</text></paragraph><paragraph id="id1b33cb3ebede40cbaaa61aa3ee9d6e2a"><enum>(2)</enum><text>to lead the international community in ending forced labor practices wherever such practices occur through all means available to the United States Government, including by stopping the importation of any goods made with forced labor, including those goods mined, produced, or manufactured in the Xinjiang Uyghur Autonomous Region;</text></paragraph><paragraph id="id8764fe8805ce47579ad906d3f51aac61"><enum>(3)</enum><text>to actively work to prevent, publicly denounce, and end human trafficking, including with respect to forced labor, whether sponsored by the government of a foreign country or not, and to restore the lives of those affected by human trafficking, a modern form of slavery; </text></paragraph><paragraph id="id6e4f7ad51a1548fd80beb9a2c6923261"><enum>(4)</enum><text>to regard the prevention of atrocities as a priority in the national interests of the United States; and</text></paragraph><paragraph id="id22d16001060445d8be48d2e2091bee15"><enum>(5)</enum><text>to address gross violations of human rights in the Xinjiang Uyghur Autonomous Region—</text><subparagraph id="id557902E2292A40E98BF4EECBAB1A7E38"><enum>(A)</enum><text>through bilateral diplomatic channels and multilateral institutions in which both the United States and the People’s Republic of China are members; and </text></subparagraph><subparagraph id="idCEBD6956FA8D43FB8F0C9E0E3B6EDC01"><enum>(B)</enum><text>using all the authorities available to the United States Government, including visa and financial sanctions, export restrictions, and import controls. </text></subparagraph></paragraph></section><section id="HEC157D7C5C5A465BA38C102FAB893A92" commented="no" display-inline="no-display-inline" section-type="subsequent-section" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>4.</enum><header>Strategy to enforce prohibition on importation of goods made through forced labor in the Xinjiang Uyghur Autonomous Region</header><subsection id="id6b45109c35dd4bb3b270e6e5fa2013e9"><enum>(a)</enum><header>Public comment</header><paragraph id="idef0ebf941114431698f11322e452b2c7"><enum>(1)</enum><header>In general</header><text>Not later than 45 days after the date of the enactment of this Act, the Secretary of Homeland Security, in consultation with the United States Trade Representative, the Secretary of State, and the Secretary of Labor, shall publish in the Federal Register a notice soliciting public comments on how best to ensure that goods made with forced labor in the People’s Republic of China, including by Uyghurs, Kazakhs, Kyrgyz, and members of other persecuted groups in the Xinjiang Uyghur Autonomous Region of the People's Republic of China, are not imported into the United States.</text></paragraph><paragraph id="id4be208480047460a89ac73fae11e8af6"><enum>(2)</enum><header>Period for comment</header><text>The Secretary of Homeland Security shall provide the public with not less than 60 days to submit comments in response to the notice required by paragraph (1).</text></paragraph></subsection><subsection id="id979d9fd7d5514573814dce23b6ddebe7"><enum>(b)</enum><header>Public hearing</header><paragraph id="idA73CF7B2BC4A4E5B8A7A13C2ED272F35"><enum>(1)</enum><header>In general</header><text>Not later than 45 days after the close of the period to submit comments under subsection (a)(2), the Secretary of Homeland Security, the Secretary of Labor, the United States Trade Representative, and the Secretary of State shall jointly conduct a public hearing inviting witnesses to testify with respect to the use of forced labor in the People’s Republic of China and potential measures, including the measures described in paragraph (2), to prevent the importation of goods made with forced labor into the United States from the People’s Republic of China.</text></paragraph><paragraph id="id5FAD2094CAE94798A72E5FA92E8D5212"><enum>(2)</enum><header>Measures described</header><text>The measures described in this paragraph are—</text><subparagraph id="id4B8C2B67166B4BAC8DA7E32306022DBE"><enum>(A)</enum><text>measures that can be taken to trace goods or to prevent goods from leaving the People’s Republic of China; and </text></subparagraph><subparagraph id="id102A8EB89FE942B2A51135ADD7C5C4A6"><enum>(B)</enum><text>other measures for ensuring that goods made with forced labor do not enter the United States.</text></subparagraph></paragraph></subsection><subsection id="ide204e6579b56406a91f5673af954749b"><enum>(c)</enum><header>Development of strategy</header><text>After receiving public comments under subsection (a) and holding the hearing required by subsection (b), the Secretary of Homeland Security, in consultation with the Secretary of Labor, the United States Trade Representative, the Secretary of State, and the Director of National Intelligence, shall develop a strategy for preventing the importation into the United States of goods made with forced labor in the Xinjiang Uyghur Autonomous Region.</text></subsection><subsection id="idff4cacf6438b4e39a64792758952428d"><enum>(d)</enum><header>Elements</header><text>The strategy developed under subsection (c) shall include the following:</text><paragraph id="id91fa719318de474fa9eae9803b6a0bde"><enum>(1)</enum><text>A comprehensive assessment of the risk of the possibility of importing goods made with forced labor from the People’s Republic of China, including from the Xinjiang Uyghur Autonomous Region or made by Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups in any other part of the People’s Republic of China, that identifies, to the extent feasible—</text><subparagraph id="id1310ca756895497bb8aafc6fe952b8c2" commented="no"><enum>(A)</enum><text>threats, including through the potential involvement in supply chains of entities that may use forced labor, that could lead to the importation of goods made with forced labor into the United States; and</text></subparagraph><subparagraph id="id95ed194dc1134e3cbd9942e72c26c607" commented="no"><enum>(B)</enum><text>what procedures can be implemented or improved to reduce such threats.</text></subparagraph></paragraph><paragraph id="id1b85db082d3641e98f3a544bb62bd4fa"><enum>(2)</enum><text>A comprehensive description and evaluation—</text><subparagraph id="id3745A580924D48EFA5DD265896F65E3F"><enum>(A)</enum><text>of <quote>pairing assistance</quote> and <quote>poverty alleviation</quote> programs that include the forced labor of Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups outside of the Xinjiang Uyghur Autonomous Region or similar programs of the People’s Republic of China in which work or services are extracted from Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups through the threat of penalty or for which the Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups have not offered themselves voluntarily; and</text></subparagraph><subparagraph id="id800de0f780c64d35aaa7b2d4028d8ab2"><enum>(B)</enum><text>that includes—</text><clause id="id42898FF57F474B4BA03990AED7FD369E" commented="no"><enum>(i)</enum><text>a list of entities working with the government of the Xinjiang Uyghur Autonomous Region to move forced labor or Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups out of the Xinjiang Uyghur Autonomous Region; and</text></clause><clause id="id669C70A4C8324EECAA33BBE8F5D0780A"><enum>(ii)</enum><text>a list of goods made with such labor for importation to the United States.</text></clause></subparagraph></paragraph><paragraph id="id5c06a75e53e34a5ea6cc047709f323dc"><enum>(3)</enum><text>Recommendations for efforts, initiatives, and tools and technologies to be adopted to ensure that U.S. Customs and Border Protection can accurately identify and trace goods made in the Xinjiang Uyghur Autonomous Region entering at any of the ports of the United States.</text></paragraph><paragraph id="idbbcf0e37630c4e738b312fcefa109e6d"><enum>(4)</enum><text>A description of how U.S. Customs and Border Protection plans to enhance its use of legal authorities and other tools to ensure that no goods are entered at any of the ports of the United States in violation of section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>), including through the initiation of pilot programs to test the viability of technologies to assist in the examination of such goods.</text></paragraph><paragraph id="id9f3b20918d7e4589aaf4f605bc547252"><enum>(5)</enum><text>Guidance to importers with respect to—</text><subparagraph id="id86A795D20166409CB2118B438B5BE21A"><enum>(A)</enum><text>best practices or effective due diligence measures to ensure that such importers do not import any goods made with forced labor from the Xinjiang Uyghur Autonomous Region; and</text></subparagraph><subparagraph id="ide2eb5be7a7074995aa0a78efd80fb22a"><enum>(B)</enum><text>the type, nature, and extent of evidence that demonstrates that imported goods detained or seized pursuant to section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>) were not made with forced labor.</text></subparagraph></paragraph></subsection><subsection id="idb6137472d43d46aebb70d8b9362d16f4"><enum>(e)</enum><header>Submission of strategy</header><text>Not later than 270 days after the date of the enactment of this Act, and annually thereafter, the Secretary of Homeland Security, in consultation with the Secretary of Labor, the United States Trade Representative, and the Secretary of State, shall submit to the appropriate congressional committees a report that—</text><paragraph id="ide238ede2f8e64e4c88c2a98b84ad17b1"><enum>(1)</enum><text>in the case of the first such report, sets forth the strategy developed under subsection (c); and</text></paragraph><paragraph id="id4e9103e65eef46d68dd8dde232cee843"><enum>(2)</enum><text>in the case of any subsequent such report, sets forth any updates to the strategy.</text></paragraph></subsection><subsection id="idc9be7ee523654f90a05e36b9fadf8077" commented="no"><enum>(f)</enum><header>Form of report</header><text>Each report required by subsection (e) shall be submitted in unclassified form, but may include a classified annex, if necessary.</text></subsection><subsection commented="no" id="idB021497459564FC0826B9A0448DFB4B3"><enum>(g)</enum><header>Public availability</header><text>The unclassified portion of each report required by subsection (e) shall be made available to the public.</text></subsection></section><section id="H47587A5F119341778095DA1450B49547" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>5.</enum><header>Rebuttable presumption that import prohibition applies to goods produced in the Xinjiang Uyghur Autonomous Region</header><subsection id="id41b3cb0127cf4e97b64e427aeb2ab542" commented="no"><enum>(a)</enum><header>In general</header><text>The Commissioner of U.S. Customs and Border Protection shall, except as provided by subsection (b), apply a presumption that, with respect to any significant goods, wares, articles, and merchandise mined, produced, or manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region of the People’s Republic of China or produced by entities on a list required by section 4(d)(2)(B)(i)—</text><paragraph commented="no" id="id4E41A48370E94C8D9BFF6DA3EDF1C8CD"><enum>(1)</enum><text>the importation of such goods, wares, articles, and merchandise is prohibited under section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>); and </text></paragraph><paragraph commented="no" id="idDBBBFA2A5C2348F98A703CBE38A7AF78"><enum>(2)</enum><text>such goods, wares, articles, and merchandise are not entitled to entry at any of the ports of the United States.</text></paragraph></subsection><subsection id="id55ddf4ce390f4c8dacf613457121b8f9"><enum>(b)</enum><header>Exceptions</header><text>The Commissioner shall apply the presumption under subsection (a) unless the Commissioner determines that—</text><paragraph id="id21102cdd321e43d58e1d2d869ceb8690"><enum>(1)</enum><text>the importer of record has—</text><subparagraph id="idB7475C41796248F9AD86A16599D5F592"><enum>(A)</enum><text>fully complied with the guidance described in section 4(d)(5) and any regulations issued to implement that guidance; and</text></subparagraph><subparagraph id="id40497398e3ee4cb385d3d2a8249f8f11"><enum>(B)</enum><text>completely and substantively responded to all inquiries for information submitted by the Commissioner to ascertain whether the goods were manufactured through forced labor;</text></subparagraph></paragraph><paragraph id="idf7d73a0524e04904acd959dba0f5405d"><enum>(2)</enum><text>the good was not produced wholly or in part by forced labor; or</text></paragraph><paragraph id="idc11fd251229e4d0aa5e938b92e3dcc8f"><enum>(3)</enum><text>the President certifies that the Government of the People’s Republic of China is not impeding in any way attempts to investigate abuses of Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups or to address any other instances of forced labor in the People’s Republic of China.</text></paragraph></subsection><subsection id="id4e4e9aa7bbfb4ffa9319469eb05e974e"><enum>(c)</enum><header>Regulations</header><text>The Commissioner may prescribe regulations—</text><paragraph id="idF9915595363D47FC83D9F2ECA67AD5C0"><enum>(1)</enum><text>to implement paragraphs (1) and (2) of subsection (b); or </text></paragraph><paragraph id="id6ECC5286E4BB4B25888A77EA8F9FDE88"><enum>(2)</enum><text>to amend any other regulations relating to withhold release orders in order to implement this section.</text></paragraph></subsection><subsection id="id15237860A45640719916C3AB5A3AE8C0" commented="no"><enum>(d)</enum><header>Effective date</header><text>This section takes effect on the date that is 300 days after the date of the enactment of this Act.</text></subsection></section><section id="idb9969aad5f204973a4f55ebf1fa537c3" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>6.</enum><header>Determination relating to atrocities and genocide in the Xinjiang Uyghur Autonomous Region</header><subsection id="id1627401f602b41aaa2a37d3072f50233"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State shall submit to the appropriate congressional committees a report setting forth the formal determination of the Secretary with respect to whether—</text><paragraph id="id02b05cd85f1941c6998abec99702cd3a"><enum>(1)</enum><text>the human rights abuses committed by the Government of the People’s Republic of China against Uyghurs, Kazakhs, Kyrgyz, and members of other persecuted groups in the Xinjiang Uyghur Autonomous Region of the People’s Republic of China constitute genocide within the meaning of section 1091(a) of title 18, United States Code; and</text></paragraph><paragraph id="id836d49adcd9244d7bd8e1ccd79d25921"><enum>(2)</enum><text>the actions taken by the Government of the People’s Republic of China in support of the use of forced labor against Uyghurs, Kazakhs, Kyrgyz, and members of other persecuted groups in the Xinjiang Uyghur Autonomous Region constitute an atrocity within the meaning of the term <term>atrocities</term> as defined in section 6 of the Elie Wiesel Genocide and Atrocities Prevention Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/441">Public Law 115–441</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note).</text></paragraph></subsection><subsection id="idbb7995fb4bcb4289b607cce272d8fb8e"><enum>(b)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in unclassified form, but may include a classified annex, if necessary.</text></subsection><subsection id="id05b21188ecd349bfb73b352e8216666b"><enum>(c)</enum><header>Public availability</header><text>The unclassified portion of each report required by subsection (a) shall be made available to the public. </text></subsection></section><section id="HBEA4FC604D804B518ECA96519DFC2E1E" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>7.</enum><header>Diplomatic strategy to address forced labor in the Xinjiang Uyghur Autonomous Region</header><subsection id="H0CBD6A22CB954732970E924B18B4FB0A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of State, in coordination with the heads of other appropriate Federal agencies, shall submit to the appropriate congressional committees a report that includes a United States strategy to promote initiatives to enhance international awareness of and to address forced labor in the Xinjiang Uyghur Autonomous Region of the People's Republic of China.</text></subsection><subsection id="HA8CC4ED935A448809697CCA0486ADA03"><enum>(b)</enum><header>Matters To be included</header><text>The Secretary shall include in the report required by subsection (a) the following:</text><paragraph id="H7A4D394A59B54D4F9AEF0F72F3D91356"><enum>(1)</enum><text>A plan to enhance bilateral and multilateral coordination, including sustained engagement with the governments of countries that are partners and allies of the United States, to end the use of Uyghurs, Kazakhs, Kyrgyz, and members of other persecuted groups in the Xinjiang Uyghur Autonomous Region for forced labor. </text></paragraph><paragraph id="HAD84BD8B827A4FFEAFB844042E78FF49"><enum>(2)</enum><text display-inline="yes-display-inline">A description of public affairs, public diplomacy, and counter-messaging efforts to promote awareness of the human rights situation, including with respect to forced labor, in the Xinjiang Uyghur Autonomous Region.</text></paragraph><paragraph id="id5e7a71022b974542aabcca9262ed7285"><enum>(3)</enum><text>A plan—</text><subparagraph id="idB8AB3182DAF740858DCCF0A5070A473F"><enum>(A)</enum><text> to coordinate and collaborate with appropriate nongovernmental organizations and private sector entities to raise awareness about goods made with forced labor in the Xinjiang Uyghur Autonomous Region; and </text></subparagraph><subparagraph id="idDE66B6106A4E4294A5B58CDC520FCFE9"><enum>(B)</enum><text>to provide humanitarian assistance, including with respect to resettlement and advocacy for imprisoned family members, to Uyghurs, Kazakhs, Kyrgyz, and members of other persecuted groups, including members of such groups formerly detained in mass internment camps in the Xinjiang Uyghur Autonomous Region.</text></subparagraph></paragraph></subsection><subsection id="ida8dafa2a4e714035bbc07852a71623e5"><enum>(c)</enum><header>Additional matters To be included</header><text>The Secretary shall include in the report required by subsection (a), based on consultations with the Secretary of Commerce, the Secretary of Homeland Security, and the Secretary of the Treasury, the following:</text><paragraph id="id607f07ba65a54a57bb52493ade761d5e" commented="no"><enum>(1)</enum><text>To the extent practicable, a list of—</text><subparagraph id="ide88016d4b8d54f46ab6bdbead1300810" commented="no"><enum>(A)</enum><text>entities in the People’s Republic of China or affiliates of such entities that use or benefit from forced labor in the Xinjiang Uyghur Autonomous Region; and</text></subparagraph><subparagraph id="idd71e5f6c4c774d3b91fa3ee32c9a49f8" commented="no"><enum>(B)</enum><text>foreign persons that act as agents of the entities or affiliates described in subparagraph (A) to import goods into the United States.</text></subparagraph></paragraph><paragraph id="id78e45778202c416b8770d4d678d848c4"><enum>(2)</enum><text>A plan for working with private sector entities seeking to conduct supply chain due diligence to prevent the importation of goods made with forced labor into the United States.</text></paragraph><paragraph id="id7de55ccd298b401d988005ba7230cfac"><enum>(3)</enum><text>A description of actions taken by the United States Government to address forced labor in the Xinjiang Uyghur Autonomous Region under existing authorities, including—</text><subparagraph id="id4b41016e87a9435cbaf9c3acb411271c"><enum>(A)</enum><text>the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7101">22 U.S.C. 7101 et seq.</external-xref>);</text></subparagraph><subparagraph id="idd0200774a49d406ab173f9506ae56cfe"><enum>(B)</enum><text>the Elie Wiesel Genocide and Atrocities Prevention Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/441">Public Law 115–441</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note); and</text></subparagraph><subparagraph id="id0c5ffbc59d2e4873bc0a1fc526f01999"><enum>(C)</enum><text>the Global Magnitsky Human Rights Accountability Act (subtitle F of title XII of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note).</text></subparagraph></paragraph></subsection><subsection id="id42a74fa39c9d41c18e67f05c9772233b"><enum>(d)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in unclassified form, but may include a classified annex, if necessary.</text></subsection></section><section id="H1D1AFE54EB32443CA2D01AF0F6063090" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>8.</enum><header>Imposition of sanctions relating to forced labor in the Xinjiang Uyghur Autonomous Region</header><subsection id="id5F3AC74057F24981A4084B8CD1BC0E68"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 6(a)(1) of the Uyghur Human Rights Policy Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/145">Public Law 116–145</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/6901">22 U.S.C. 6901</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id57d3d3896d72444dbe501880e7e4f4f3" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><subparagraph id="id4298cb6487374cd38775699e4984b903"><enum>(F)</enum><text>Serious human rights abuses in connection with forced labor.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idB1B26FA992834C2DB6DAF47D06CA2E42"><enum>(b)</enum><header>Effective date; applicability</header><text>The amendment made by subsection (a)—</text><paragraph id="idFCD3FFCEFD4847E593E43E721CE818E0"><enum>(1)</enum><text>takes effect on the date of the enactment of this Act; and</text></paragraph><paragraph id="id43C88B6A0A5549778E1F7F19F60036D3"><enum>(2)</enum><text>applies with respect to the first report required by section 6(a)(1) of the Uyghur Human Rights Policy Act of 2020 submitted after such date of enactment.</text></paragraph></subsection><subsection id="idE0CDAA9A1F0747C1B1156529E1681523"><enum>(c)</enum><header>Transition rule</header><paragraph id="id303AA55A27E0498C9E0A39B6D6395CC8"><enum>(1)</enum><header>Interim report</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall submit to the committees specified in section 6(a)(1) of the Uyghur Human Rights Policy Act of 2020 a report that identifies each foreign person, including any official of the Government of the People's Republic of China, that the President determines is responsible for serious human rights abuses in connection with forced labor with respect to Uyghurs, Kazakhs, Kyrgyz, or members of other Muslim minority groups, or other persons in the Xinjiang Uyghur Autonomous Region.</text></paragraph><paragraph id="id017A404E2DC8431BB853CFDBEA2A94BC"><enum>(2)</enum><header>Imposition of sanctions</header><text>The President shall impose sanctions under subsection (c) of section 6 of the Uyghur Human Rights Policy Act of 2020 with respect to each foreign person identified in the report required by paragraph (1), subject to the provisions of subsections (d), (e), (f), and (g) of that section.</text></paragraph></subsection></section><section id="idBDAC1EC9FC794A9D92FB1C17A3A2636F" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>9.</enum><header>Sunset</header><text display-inline="no-display-inline">Sections 4, 5, and 7 shall cease to have effect on the earlier of—</text><paragraph id="iddced11d088f043ffbc52516307d232b2"><enum>(1)</enum><text>the date that is 8 years after the date of the enactment of this Act; or</text></paragraph><paragraph id="id7fa65fd1ea464e7fbe256ecac7746fac"><enum>(2)</enum><text>the date on which the President submits to the appropriate congressional committees a determination that the Government of the People’s Republic of China has ended mass internment, forced labor, and any other gross violations of human rights experienced by Uyghurs, Kazakhs, Kyrgyz, and members of other persecuted groups in the Xinjiang Uyghur Autonomous Region. </text></paragraph></section><section id="H929992826FE44FFA875BC5ACD820F972" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>10.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HB01B14605DEF419CA030290790658B17"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="HC65C4F8048394A98884961C44E95C5BF"><enum>(A)</enum><text>the Committee on Foreign Affairs, the Committee on Financial Services, the Committee on Ways and Means, and the Committee on Homeland Security of the House of Representatives; and</text></subparagraph><subparagraph id="HF4A54F647D8C4A75852393FF5AC8E1DC"><enum>(B)</enum><text>the Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, the Committee on Finance, and the Committee on Homeland Security and Governmental Affairs of the Senate.</text></subparagraph></paragraph><paragraph id="HE321A90061F24EFCA9568BD610068DF3"><enum>(2)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means a person that is not a United States person. </text></paragraph><paragraph id="H202432285177405A8E89D913310AF039"><enum>(3)</enum><header>Person</header><text>The term <term>person</term> means an individual or entity.</text></paragraph><paragraph id="HEC15BEEDE8BD4B3383D62B00B25D95C8"><enum>(4)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text><subparagraph id="HA0DDFF95F19F41E7A425347D64CF467E"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or </text></subparagraph><subparagraph id="H02725761322F455F9CEC87875C7EB83F"><enum>(B)</enum><text display-inline="yes-display-inline">an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity.</text></subparagraph></paragraph></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id89667762-eb66-4542-aa34-779eb3e39394" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Uyghur Forced Labor Prevention Act</short-title></quote>.</text></section><section id="id21021460-5e14-4b56-9900-c9fbd89167f5" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id563ddc53-0e20-4a46-8a61-61e523bbc350"><enum>(1)</enum><text display-inline="yes-display-inline">In the Xinjiang Uyghur Autonomous Region of the People's Republic of China, the Government of the People’s Republic of China has, since April 2017, arbitrarily detained more than 1,000,000 Uyghurs, Kazakhs, Kyrgyz, Tibetans, and members of other persecuted groups in a system of extrajudicial mass internment camps, and has subjected detainees to forced labor, torture, political indoctrination, and other severe human rights abuses.</text></paragraph><paragraph id="id726a3af8-a2bb-4772-b89f-ffa4282731c7"><enum>(2)</enum><text display-inline="yes-display-inline">Forced labor, a severe form of human trafficking, exists within the Xinjiang Uyghur Autonomous Region’s system of mass internment camps, and throughout the region, and is confirmed by the testimony of former camp detainees, satellite imagery, and official leaked documents from the Government of the People’s Republic of China as part of a targeted campaign of repression of Muslim ethnic minorities.</text></paragraph><paragraph id="id2dc3dd36-ab0c-4752-81f2-74e2487cbb5b"><enum>(3)</enum><text display-inline="yes-display-inline">Researchers and civil society groups have issued reports documenting evidence that many factories and other suppliers in the Xinjiang Uyghur Autonomous Region are exploiting forced labor, on July 22, 2020, the Bureau of Industry and Security of the Department of Commerce added 11 entities to the Entity List set forth in Supplement No. 4 to part 744 of title 15, Code of Federal Regulations, after determining the entities had been <quote>implicated in human rights violations and abuses in the implementation of China’s campaign of repression, mass arbitrary detention, forced labor and high-technology surveillance against Uyghurs, Kazakhs, Kyrgyz, Tibetans, and members of other persecuted groups in the Xinjiang Uyghur Autonomous Region</quote>. </text></paragraph><paragraph id="idf1fe44ba04fe4a1fadf3d8e27eb848a5"><enum>(4)</enum><text>Since October 2019, the Bureau of Industry and Security of the Department of Commerce has added a total of 48 entities of the Government of the People's Republic of China to the Entity List set forth in Supplement No. 4 to part 744 of title 15, Code of Federal Regulations, in connection with their implication in human rights abuses in the implementation of China’s campaign of repression, mass arbitrary detention, forced labor, and high-technology surveillance against Uyghurs, Kazakhs, and other members of Muslim minority groups in the Xinjiang Uyghur Autonomous Region. As a consequence of their addition to the Entity List, comprehensive restrictions apply to the export, reexport, and in-country transfer of most United States-origin items to those 48 entities. Audits and traditional due diligence efforts to vet goods and supply chains in the Xinjiang Uyghur Autonomous Region are unreliable for identifying the absence of forced labor in the production of goods because of interference by the Government of the People’s Republic of China, including through intimidation of potential witnesses and concealment of relevant information. </text></paragraph><paragraph id="id0e270705-b2ac-4313-9503-f3f2f557dc05"><enum>(5)</enum><text>Reports cited by the Department of Labor estimate that hundreds of thousands of ex-detainees who are Uyghurs, Kazakhs, Kyrgyz, Tibetans, or members of other persecuted groups in the People’s Republic of China may be working in conditions of forced labor following detention in re-education camps. Moreover, nongovernmental organizations estimate that more than 80,000 Uyghurs were transferred out of the Xinjiang Uyghur Autonomous Region to work in factories across the People’s Republic of China between 2017 and 2019, and some of them were sent directly from detention camps.</text></paragraph><paragraph id="id476e626f-acdb-4f87-be5d-3450aa2f025a"><enum>(6)</enum><text>The Department of State’s June 2020 Trafficking in Persons Report found, <quote>Authorities offer subsidies incentivizing Chinese companies to open factories in close proximity to the internment camps and to receive transferred detainees at satellite manufacturing sites in other provinces. Local governments receive additional funds for each inmate forced to work in these sites at a fraction of minimum wage or without any compensation. The government has transported tens of thousands of these individuals to other areas within Xinjiang and to other provinces for forced labor under the guise of poverty alleviation and industrial aid programs.</quote>.</text></paragraph><paragraph id="idd88bcd19-b05c-4913-bac2-3e954adbeae7"><enum>(7)</enum><text>U.S. Customs and Border Protection has issued 11 withhold release orders on goods suspected to be produced with forced labor in the Xinjiang Uyghur Autonomous Region. Goods subject to the withhold release orders include all cotton, cotton products, tomatoes, and tomato products, as well as certain garments, hair products, apparel, computer parts, and other goods.</text></paragraph><paragraph id="idecb3482b-0781-49ea-ba9d-fb88e4c3d8d0"><enum>(8)</enum><text>In its 2019 annual report, the Congressional-Executive Commission on China found that goods reportedly produced with forced labor by current and former mass internment camp detainees included textiles, electronics, food products, shoes, tea, and handicrafts.</text></paragraph><paragraph id="id54818018-30f1-43b1-a501-e64f5c595b43" commented="no"><enum>(9)</enum><text>Under section 1091(a) of title 18, United States Code, a person commits genocide if the person “whether in time of peace or in time of war and with the specific intent to destroy, in whole or in substantial part, a national, ethnic, racial, or religious group as such—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idba33e7b0-27b9-4abc-89de-c5f859e92acd" changed="added" reported-display-style="italic" committee-id="SSFR00"><paragraph id="id5f152910-b501-4a50-a699-96239f26a108" commented="no" indent="down1"><enum>(1)</enum><text>kills members of that group;</text></paragraph><paragraph id="id00cedb7e-f7e7-4304-a6a1-216a4133b156" commented="no" indent="down1"><enum>(2)</enum><text>causes serious bodily injury to members of that group;</text></paragraph><paragraph id="id3aa240eb-034c-479a-ae6a-4010cb136a7b" commented="no" indent="down1"><enum>(3)</enum><text>causes the permanent impairment of the mental faculties of members of the group through drugs, torture, or similar techniques;</text></paragraph><paragraph id="id5a1aa733-adf1-470b-8b8a-e94f8e84f041" commented="no" indent="down1"><enum>(4)</enum><text>subjects the group to conditions of life that are intended to cause the physical destruction of the group in whole or in part;</text></paragraph><paragraph id="ida7c6d45e-3f27-4028-84d0-21777e996b6f" commented="no" indent="down1"><enum>(5)</enum><text>imposes measures intended to prevent births within the group; or</text></paragraph><paragraph id="id633921bb-cf2f-4b4a-a46b-e0daae80e0d2" commented="no" indent="down1"><enum>(6)</enum><text>transfers by force children of the group to another group.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id77809fd5-209c-4162-bcec-350dfc7121c5"><enum>(10)</enum><text>As a direct result of the campaign of targeted and coercive population control of the Government of the People’s Republic of China’s against Uyghurs, the birthrate of the Uyghur population in the Xinjiang Uyghur Autonomous Region plummeted by 24 percent from 2017 to 2018, with birthrates in the Uyghur majority regions of Hotan and Kashgar decreasing by more than 60 percent from 2015 to 2018.</text></paragraph><paragraph id="id6eeb351a-41f6-415d-a654-1fe13fdbaf07"><enum>(11)</enum><text>The policies of the Government of the People’s Republic of China are in contravention of its human rights commitments and obligations, including under—</text><subparagraph id="id78b95cdf-7876-4f89-a151-707d9722a626"><enum>(A)</enum><text>the Universal Declaration of Human Rights;</text></subparagraph><subparagraph id="id5b9df3d9-a487-4d9a-b5c4-66f33f7c6cba"><enum>(B)</enum><text>the International Covenant on Civil and Political Rights, which the People’s Republic of China has signed but not yet ratified; and</text></subparagraph><subparagraph id="id1a69e34b-bbe1-4a08-be7f-a25d29d9e4b6"><enum>(C)</enum><text>the United Nations Protocol to Prevent, Suppress and Punish Trafficking in Persons Especially Women and Children (commonly known as the <quote>Palermo Protocol</quote>), to which the People’s Republic of China has been a state party since February 2010. </text></subparagraph></paragraph></section><section id="ida68e15c7-7dc2-419d-b324-867cd4282373" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text><paragraph id="id18b83256-fbd3-4def-9bb4-cc54ec728296"><enum>(1)</enum><text>to strengthen the prohibition against the importation of goods made with forced labor, including by ensuring that the Government of the People’s Republic of China does not undermine the effective enforcement of section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>), which prohibits the importation of all <quote>goods, wares, articles, and merchandise mined, produced or manufactured wholly or in part in any foreign country by … forced labor</quote>;</text></paragraph><paragraph id="id4fc06128-d4b2-40e6-91c7-4b21e8576643"><enum>(2)</enum><text>to lead the international community in ending forced labor practices wherever such practices occur through all means available to the United States Government, including by stopping the importation of any goods made with forced labor, including those goods mined, produced, or manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region;</text></paragraph><paragraph id="id7d1f139c-2f61-4f76-8734-adc2c9b3609b"><enum>(3)</enum><text>to actively work to prevent, publicly denounce, and end human trafficking, including with respect to forced labor, whether sponsored by the government of a foreign country or not, and to restore the lives of those affected by human trafficking, a modern form of slavery; </text></paragraph><paragraph id="id6702684c-c0b7-4ed7-869b-b4bf3a0feced"><enum>(4)</enum><text>to regard the prevention of atrocities as a priority in the national interests of the United States; and</text></paragraph><paragraph id="idd101a4b1-ed67-4954-ba0c-9ad1c4ec02fe"><enum>(5)</enum><text>to address gross violations of human rights in the Xinjiang Uyghur Autonomous Region—</text><subparagraph id="idf92e68f2-5e9a-4eeb-b145-7b95b5c7599c"><enum>(A)</enum><text>through bilateral diplomatic channels and multilateral institutions in which both the United States and the People’s Republic of China are members; and </text></subparagraph><subparagraph id="id23401960-54f5-407c-8c13-cdabbc2504af"><enum>(B)</enum><text>using all the authorities available to the United States Government, including visa and financial sanctions, export restrictions, and import controls. </text></subparagraph></paragraph></section><section id="id450d67fd-6bba-4680-84fc-83fd6096595c" commented="no" display-inline="no-display-inline" section-type="subsequent-section" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>4.</enum><header>Strategy to enforce prohibition on importation of goods made through forced labor in the Xinjiang Uyghur Autonomous Region</header><subsection id="id98728ea7-c61a-459a-8532-d483b446fec1"><enum>(a)</enum><header>Public comment</header><paragraph id="ida5d57443-fac9-4d45-b4ac-8ca0c4b59a17"><enum>(1)</enum><header>In general</header><text>Not later than 45 days after the date of the enactment of this Act, the Secretary of the Treasury and the Secretary of Homeland Security shall jointly, and in consultation with the United States Trade Representative, the Secretary of State, and the Secretary of Labor, publish in the Federal Register a notice soliciting public comments on how best to ensure that goods mined, produced, or manufactured wholly or in part with forced labor in the People’s Republic of China, including by Uyghurs, Kazakhs, Kyrgyz, Tibetans, and members of other persecuted groups in the People's Republic of China, and especially in the Xinjiang Uyghur Autonomous Region, are not imported into the United States.</text></paragraph><paragraph id="idee99cff1-cadd-4756-8a74-89181514f9e7"><enum>(2)</enum><header>Period for comment</header><text>The Secretary of the Treasury and the Secretary of Homeland Security shall provide the public with not less than 60 days to submit comments in response to the notice required by paragraph (1).</text></paragraph></subsection><subsection id="idc55aa142-0442-4fe7-bc47-f0553e98be70"><enum>(b)</enum><header>Public hearing</header><paragraph id="id99fb2cc3-f146-4422-ae77-f750a0cbd4ce"><enum>(1)</enum><header>In general</header><text>Not later than 45 days after the close of the period to submit comments under subsection (a)(2), the Secretary of the Treasury, the Secretary of Homeland Security, the Secretary of Labor, the United States Trade Representative, and the Secretary of State shall jointly conduct a public hearing inviting witnesses to testify with respect to the use of forced labor in the People’s Republic of China and potential measures, including the measures described in paragraph (2), to prevent the importation of goods mined, produced, or manufactured wholly or in part with forced labor in the People's Republic of China into the United States.</text></paragraph><paragraph id="idb3045a96-66c3-4eb8-8384-7f9476660b8a"><enum>(2)</enum><header>Measures described</header><text>The measures described in this paragraph are—</text><subparagraph id="id7aa3a03f-2e2a-431e-bf57-5cbb721a12fb"><enum>(A)</enum><text>measures that can be taken to trace the origin of goods, offer greater supply chain transparency, and identify third country supply chain routes for goods mined, produced, or manufactured wholly or in part with forced labor in the People’s Republic of China; and </text></subparagraph><subparagraph id="id1c3c27e4-d677-4cbd-883f-6f3b15b1a391"><enum>(B)</enum><text>other measures for ensuring that goods mined, produced, or manufactured wholly or in part with forced labor do not enter the United States.</text></subparagraph></paragraph></subsection><subsection id="id7058506d-da10-4af8-95ab-8972b48148a9"><enum>(c)</enum><header>Development of strategy</header><text>After receiving public comments under subsection (a) and holding the hearing required by subsection (b), the Secretary of the Treasury and the Secretary of Homeland Security shall jointly, and in consultation with the Secretary of Labor, the United States Trade Representative, the Secretary of State, and the Director of National Intelligence, develop a strategy for preventing the importation into the United States of goods mined, produced, or manufactured wholly or in part with forced labor in the People’s Republic of China.</text></subsection><subsection id="id0d3c42f2-ee26-4c0f-991d-585a3f72ed56"><enum>(d)</enum><header>Elements</header><text>The strategy developed under subsection (c) shall include the following:</text><paragraph id="id9b8b7cf8-6dfc-496f-8e5c-2e2c3c791e0a"><enum>(1)</enum><text>A comprehensive assessment of the risk of importing goods mined, produced, or manufactured wholly or in part with forced labor in the People’s Republic of China, including from the Xinjiang Uyghur Autonomous Region or made by Uyghurs, Kazakhs, Kyrgyz, Tibetans, or members of other persecuted groups in any other part of the People’s Republic of China, that identifies, to the extent feasible—</text><subparagraph id="idf7e1ae18af1f466ab2236aa8a137b432"><enum>(A)</enum><text>threats, including through the potential involvement in supply chains of entities that may use forced labor, that could lead to the importation into the United States from the People’s Republic of China, including through third countries, of goods mined, produced, or manufactured wholly or in part with forced labor; and </text></subparagraph><subparagraph id="idf2932102-408a-4951-8904-35eb3a975ea0" commented="no"><enum>(B)</enum><text>what procedures can be implemented or improved to reduce such threats.</text></subparagraph></paragraph><paragraph id="idae1073a0-9f98-46b3-a625-1782866640f7"><enum>(2)</enum><text>A comprehensive description and evaluation—</text><subparagraph id="id81e1b645-be4b-471f-848e-de29c9ba458a"><enum>(A)</enum><text>of <quote>pairing assistance</quote> and <quote>poverty alleviation</quote> or any other government labor scheme that includes the forced labor of Uyghurs, Kazakhs, Kyrgyz, Tibetans, or members of other persecuted groups outside of the Xinjiang Uyghur Autonomous Region or similar programs of the People’s Republic of China in which work or services are extracted from Uyghurs, Kazakhs, Kyrgyz, Tibetans, or members of other persecuted groups through the threat of penalty or for which the Uyghurs, Kazakhs, Kyrgyz, Tibetans, or members of other persecuted groups have not offered themselves voluntarily; and</text></subparagraph><subparagraph id="id3e902a30-b0f4-4c8c-89f0-d7c6871fa6b5"><enum>(B)</enum><text>that includes—</text><clause id="id398e1816-bf8a-4e0b-b105-0466d7dcb2be" commented="no"><enum>(i)</enum><text>a list of entities working with the government of the Xinjiang Uyghur Autonomous Region to move forced labor or Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups out of the Xinjiang Uyghur Autonomous Region; </text></clause><clause id="id98038b9b6d024a10825b22ff1a2bde25"><enum>(ii)</enum><text>a list of products mined, produced, or manufactured wholly or in part by entities on the list required by clause (i);</text></clause><clause id="id88D81AA1528A4F0F98314953CA51D330"><enum>(iii)</enum><text>a list of entities that exported products described in clause (ii) from the People's Republic of China into the United States;</text></clause><clause id="id51f27f987a0f44de8e145f03609b913b"><enum>(iv)</enum><text>a list of facilities and entities, including the Xinjiang Production and Construction Corps, that source material from the Xinjiang Uyghur Autonomous Region or from persons working with the government of the Xinjiang Uyghur Autonomous Region or the Xinjiang Production and Construction Corps for purposes of the <quote>poverty alleviation</quote> program or the <quote>pairing-assistance</quote> program or any other government labor scheme that uses forced or involuntary labor; </text></clause><clause id="id1CDF619C3B7F4DCBBE51D5499D19C444"><enum>(v)</enum><text>a plan for identifying additional facilities and entities described in clause (iv);</text></clause><clause id="id5618B473A2E545CE86CEE568B795C8E6"><enum>(vi)</enum><text>an enforcement plan for each such entity, which may include issuing withhold release orders to support enforcement of section 5 with respect to the entity;</text></clause><clause id="idf2adb0c83f174cab889a53bfbd626576"><enum>(vii)</enum><text>a list of high-priority sectors for enforcement, which shall include cotton, tomatoes, and polysilicon; and</text></clause><clause id="idAF99B4B3D3B64ABFAF96306F418F0334"><enum>(viii)</enum><text>an enforcement plan for each such high-priority sector. </text></clause></subparagraph></paragraph><paragraph id="id76dca94c-566a-45c3-a59d-eeab95131a12"><enum>(3)</enum><text>Recommendations for efforts, initiatives, and tools and technologies to be adopted to ensure that U.S. Customs and Border Protection can accurately identify and trace goods made in the Xinjiang Uyghur Autonomous Region entering at any of the ports of the United States.</text></paragraph><paragraph id="id9bd9073c-86c3-4d04-8c76-ab3772d883a8"><enum>(4)</enum><text>A description of how U.S. Customs and Border Protection plans to enhance its use of legal authorities and other tools to ensure that no goods are entered at any of the ports of the United States in violation of section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>), including through the initiation of pilot programs to test the viability of technologies to assist in the examination of such goods.</text></paragraph><paragraph id="id4dbbc0db-54d4-4538-bd76-7550be1726e7"><enum>(5)</enum><text>Guidance to importers with respect to—</text><subparagraph id="id9235fa560ebe4777b3de4c7c93e44930"><enum>(A)</enum><text>due diligence, effective supply chain tracing, and supply chain management measures to ensure that such importers do not import any goods mined, produced, or manufactured wholly or in part with forced labor from the People’s Republic of China, especially from the Xinjiang Uyghur Autonomous Region;</text></subparagraph><subparagraph id="idf89440a13fbe4343a371efb775f194ad"><enum>(B)</enum><text>the type, nature, and extent of evidence that demonstrates that goods originating in the People's Republic of China were not mined, produced, or manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region; and</text></subparagraph><subparagraph id="id356090faf7b04673ab9ad2f0f92872aa"><enum>(C)</enum><text>the type, nature, and extent of evidence that demonstrates that goods originating in the People's Republic of China, including goods detained or seized pursuant to section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>), were not mined, produced, or manufactured wholly or in part with forced labor.</text></subparagraph></paragraph><paragraph id="idaa9a3c112c8f446ea181b62f1ac035f3"><enum>(6)</enum><text>A plan to coordinate and collaborate with appropriate nongovernmental organizations and private sector entities to implement and update the strategy developed under subsection (c).</text></paragraph></subsection><subsection id="id4d0d943c-eea0-4646-9178-27c30a06d64d"><enum>(e)</enum><header>Submission of strategy</header><paragraph id="idA160F35AF2FB4EBEBEB92BD4A7DD1C1A"><enum>(1)</enum><header>In general</header><text>Not later than 270 days after the date of the enactment of this Act, and annually thereafter, the Secretary of Homeland Security, in consultation with the Secretary of Labor, the United States Trade Representative, and the Secretary of State, shall submit to the appropriate congressional committees a report that—</text><subparagraph id="iddcbd8ff6-3472-4372-9e95-622aa310d8e7"><enum>(A)</enum><text>in the case of the first such report, sets forth the strategy developed under subsection (c); and</text></subparagraph><subparagraph id="idec48296f-4101-4d7b-b0dc-edac3b0d5056"><enum>(B)</enum><text>in the case of any subsequent such report, sets forth any updates to the strategy.</text></subparagraph></paragraph><paragraph id="idFA15B6A8CDB3489F83B4413390FCFC7C"><enum>(2)</enum><header>Updates of certain matters</header><text>Not less frequently than annually after the submission under paragraph (1)(A) of the strategy developed under subsection (c), the Secretary shall submit to the appropriate congressional committees updates to the strategy with respect to the matters described in clauses (i) through (vi) of subsection (d)(2)(B).</text></paragraph><paragraph id="id8a612b31-fabb-4ee3-9923-78d7f944d5d3" commented="no"><enum>(3)</enum><header>Form of report</header><text>Each report required by paragraph (1) shall be submitted in unclassified form, but may include a classified annex, if necessary.</text></paragraph><paragraph commented="no" id="id246f0f90-aa5b-4b65-9022-407be3b4c5d4"><enum>(4)</enum><header>Public availability</header><text>The unclassified portion of each report required by paragraph (1) shall be made available to the public.</text></paragraph></subsection><subsection id="id30b74db9f4c4422c89259d06fb412639"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to limit the application of regulations in effect on or measures taken before the date of the enactment of this Act to prevent the importation of goods mined, produced, or manufactured wholly or in part with forced labor into the United States, including withhold release orders issued before such date of enactment. </text></subsection></section><section id="idad48dc98-0018-4d64-8777-d412155a5d2f" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>5.</enum><header>Rebuttable presumption that import prohibition applies to goods mined, produced, or manufactured in the Xinjiang Uyghur Autonomous Region or by certain entities</header><subsection id="id8a14207c-adf1-4a30-a419-9d74d6a51e46" commented="no"><enum>(a)</enum><header>In general</header><text>The Commissioner of U.S. Customs and Border Protection shall, except as provided by subsection (b), apply a presumption that, with respect to any goods, wares, articles, and merchandise mined, produced, or manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region of the People’s Republic of China or produced by an entity on a list required by clause (i), (iii), or (iv) of section 4(d)(2)(B)—</text><paragraph commented="no" id="ideb0493d3-eca8-4422-8f9b-7a39bb687dd8"><enum>(1)</enum><text>the importation of such goods, wares, articles, and merchandise is prohibited under section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>); and </text></paragraph><paragraph commented="no" id="id334790c5-19db-4df9-9153-f4ff27867400"><enum>(2)</enum><text>such goods, wares, articles, and merchandise are not entitled to entry at any of the ports of the United States.</text></paragraph></subsection><subsection id="id5515c219-a8d4-44a8-8971-a455dd2eccf1"><enum>(b)</enum><header>Exceptions</header><text>The Commissioner shall apply the presumption under subsection (a) unless the Commissioner determines that—</text><paragraph id="ideab58031-90eb-46a9-9d99-7528384894bc"><enum>(1)</enum><text>the importer of record has—</text><subparagraph id="ida1019328-a77c-4659-94dc-2c5ef39dd6fc"><enum>(A)</enum><text>fully complied with the guidance described in section 4(d)(5) and any regulations issued to implement that guidance; and</text></subparagraph><subparagraph id="id3d3f7618-97f9-4140-9efd-67fee3efe5bb"><enum>(B)</enum><text>completely and substantively responded to all inquiries for information submitted by the Commissioner to ascertain whether the goods were mined, produced, or manufactured wholly or in part with forced labor; and</text></subparagraph></paragraph><paragraph id="idb99721b330a3490b959db78e925d3ada"><enum>(2)</enum><text>the good was not mined, produced, or manufactured wholly or in part by forced labor.</text></paragraph></subsection><subsection id="ide8341ba7f58f4fa1856cd34ab37a04cb"><enum>(c)</enum><header>Report required</header><text>Not less frequently than every 180 days, the Commissioner shall submit to the appropriate congressional committees and make available to the public a report that lists all instances in which the Commissioner declined to apply the presumption under subsection (a) during the preceding 180-day period. </text></subsection><subsection id="id0876335d-460a-4176-865c-1b2ecfb1d087"><enum>(d)</enum><header>Regulations</header><text>The Commissioner may prescribe regulations—</text><paragraph id="id03ea8a74-2085-457e-8f8a-74a17fc85ea0"><enum>(1)</enum><text>to implement paragraphs (1) and (2) of subsection (b); or </text></paragraph><paragraph id="id9bd397b0-f35d-4d4a-8a27-acfaa6fbfac2"><enum>(2)</enum><text>to amend any other regulations relating to withhold release orders in order to implement this section.</text></paragraph></subsection><subsection id="id79af6f40-bfcc-41e7-b5fe-b979b21a453e" commented="no"><enum>(e)</enum><header>Effective date</header><text>This section takes effect on the date that is 300 days after the date of the enactment of this Act.</text></subsection></section><section id="id36ddbfd3-1b9e-48ba-9bcf-3ddef8c9ee34" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>6.</enum><header>Diplomatic strategy to address forced labor in the Xinjiang Uyghur Autonomous Region</header><subsection id="id4435aa63-6a6e-4237-bafd-5ee426d9d42a"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of State, in coordination with the heads of other appropriate Federal agencies, shall submit to the appropriate congressional committees a report that includes a United States strategy to promote initiatives to enhance international awareness of and to address forced labor in the Xinjiang Uyghur Autonomous Region of the People's Republic of China.</text></subsection><subsection id="id3de96bd2-726b-412b-bc83-dc395634a245"><enum>(b)</enum><header>Matters To be included</header><text>The Secretary shall include in the report required by subsection (a) the following:</text><paragraph id="id543aeeaa-4fd8-4b46-a4cc-ba58330ba488"><enum>(1)</enum><text>A plan to enhance bilateral and multilateral coordination, including sustained engagement with the governments of countries that are partners and allies of the United States, to end the use of Uyghurs, Kazakhs, Kyrgyz, Tibetans, and members of other persecuted groups in the Xinjiang Uyghur Autonomous Region for forced labor. </text></paragraph><paragraph id="id5aa53547-6ce9-41bb-b10a-30b3a2907f37"><enum>(2)</enum><text display-inline="yes-display-inline">A description of public affairs, public diplomacy, and counter-messaging efforts to promote awareness of the human rights situation, including with respect to forced labor, in the Xinjiang Uyghur Autonomous Region.</text></paragraph><paragraph id="id5ead4acf-5f3e-4be6-97b0-0b77a4028fd2"><enum>(3)</enum><text>A plan—</text><subparagraph id="id0e898889-9077-4212-8027-235442a5fed4"><enum>(A)</enum><text> to coordinate and collaborate with appropriate nongovernmental organizations and private sector entities to raise awareness about goods mined, produced, or manufactured wholly or in part with forced labor in the Xinjiang Uyghur Autonomous Region; and </text></subparagraph><subparagraph id="iddd22baf6-c9f6-4edd-9651-9de458f5c234"><enum>(B)</enum><text>to provide humanitarian assistance, including with respect to resettlement and advocacy for imprisoned family members, to Uyghurs, Kazakhs, Kyrgyz, Tibetans, and members of other persecuted groups, including members of such groups formerly detained in mass internment camps in the Xinjiang Uyghur Autonomous Region.</text></subparagraph></paragraph></subsection><subsection id="id9b4129d2-4338-45ea-bd6c-2170d6fa0b94"><enum>(c)</enum><header>Additional matters To be included</header><text>The Secretary shall include in the report required by subsection (a), based on consultations with the Secretary of Commerce, the Secretary of Homeland Security, and the Secretary of the Treasury, the following:</text><paragraph id="id40d6b1c6-2998-45ef-889c-9f915cf77f21" commented="no"><enum>(1)</enum><text>To the extent practicable, a list of—</text><subparagraph id="idbdf524b3-6a49-4166-b431-3727d0e9cd6c" commented="no"><enum>(A)</enum><text>entities in the People’s Republic of China or affiliates of such entities that use or benefit from forced labor in the Xinjiang Uyghur Autonomous Region; and</text></subparagraph><subparagraph id="id6b300e0c-eea9-4533-8b02-3a78fa2d7947" commented="no"><enum>(B)</enum><text>foreign persons that act as agents of the entities or affiliates described in subparagraph (A) to import goods into the United States.</text></subparagraph></paragraph><paragraph id="idf995cc74-4c0d-4838-8fa6-a33fdec74aea"><enum>(2)</enum><text>A plan for working with private sector entities seeking to conduct supply chain due diligence to prevent the importation of goods mined, produced, or manufactured wholly or in part with forced labor into the United States.</text></paragraph><paragraph id="id535cc81c-1b9e-4c23-a704-7fc71dca1d0d"><enum>(3)</enum><text>A description of actions taken by the United States Government to address forced labor in the Xinjiang Uyghur Autonomous Region under existing authorities, including—</text><subparagraph id="idbb2eb052-3a73-445e-86ad-696009b943bb"><enum>(A)</enum><text>the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7101">22 U.S.C. 7101 et seq.</external-xref>);</text></subparagraph><subparagraph id="ide35efb61-e24e-484f-8f39-baff79f9e4bf"><enum>(B)</enum><text>the Elie Wiesel Genocide and Atrocities Prevention Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/441">Public Law 115–441</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note); and</text></subparagraph><subparagraph id="id41df85c1-3042-4f48-ad88-1d3bd51c51d3"><enum>(C)</enum><text>the Global Magnitsky Human Rights Accountability Act (subtitle F of title XII of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note).</text></subparagraph></paragraph></subsection><subsection id="idfdc30b5b-e00c-46dd-8a5b-9136216cf264"><enum>(d)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in unclassified form, but may include a classified annex, if necessary.</text></subsection></section><section id="id484bc2ea-12ca-4e99-ae79-ca6ae4b160ae" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>7.</enum><header>Imposition of sanctions relating to forced labor in the Xinjiang Uyghur Autonomous Region</header><subsection id="idf03edb52-3595-4c0e-9229-6bfda97879b2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 6(a)(1) of the Uyghur Human Rights Policy Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/145">Public Law 116–145</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/6901">22 U.S.C. 6901</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idae52bd59-9a0b-43a6-84bc-35285c3ef395" changed="added" reported-display-style="italic" committee-id="SSFR00"><subparagraph id="id980bb604-d32a-4c02-9cba-4cebe8d78748"><enum>(F)</enum><text>Serious human rights abuses in connection with forced labor.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idf3a19265-ea8a-4919-9d8b-1318110ad15a"><enum>(b)</enum><header>Effective date; applicability</header><text>The amendment made by subsection (a)—</text><paragraph id="id5a375783-0a85-4ee0-9d6d-b20bc398b512"><enum>(1)</enum><text>takes effect on the date of the enactment of this Act; and</text></paragraph><paragraph id="idbbef82b2-4723-406f-b55b-8032d82ca4e6"><enum>(2)</enum><text>applies with respect to the first report required by section 6(a)(1) of the Uyghur Human Rights Policy Act of 2020 submitted after such date of enactment.</text></paragraph></subsection><subsection id="id4c2f5d3d-f4fe-4c92-82ab-496baabeba9f"><enum>(c)</enum><header>Transition rule</header><paragraph id="id8ecf7ce9-2150-45d3-a535-34012f2d9ee9"><enum>(1)</enum><header>Interim report</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall submit to the committees specified in section 6(a)(1) of the Uyghur Human Rights Policy Act of 2020 a report that identifies each foreign person, including any official of the Government of the People's Republic of China, that the President determines is responsible for serious human rights abuses in connection with forced labor with respect to Uyghurs, Kazakhs, Kyrgyz, or members of other Muslim minority groups, or other persons in the Xinjiang Uyghur Autonomous Region.</text></paragraph><paragraph id="id97461c74-d48b-410c-bf0a-fe524bdaf562"><enum>(2)</enum><header>Imposition of sanctions</header><text>The President shall impose sanctions under subsection (c) of section 6 of the Uyghur Human Rights Policy Act of 2020 with respect to each foreign person identified in the report required by paragraph (1), subject to the provisions of subsections (d), (e), (f), and (g) of that section.</text></paragraph></subsection></section><section id="idcc4f6080-f0dc-411b-bb89-01d257294580" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>8.</enum><header>Sunset</header><text display-inline="no-display-inline">Sections 4, 5, and 6 shall cease to have effect on the earlier of—</text><paragraph id="idcba4f706-34c2-4703-a069-6a8f6c83e514"><enum>(1)</enum><text>the date that is 8 years after the date of the enactment of this Act; or</text></paragraph><paragraph id="id9c4ad4af-0c77-47ea-9215-dc2131df18fa"><enum>(2)</enum><text>the date on which the President submits to the appropriate congressional committees a determination that the Government of the People’s Republic of China has ended mass internment, forced labor, and any other gross violations of human rights experienced by Uyghurs, Kazakhs, Kyrgyz, Tibetans, and members of other persecuted groups in the Xinjiang Uyghur Autonomous Region. </text></paragraph></section><section id="id4f414446-bc3e-4b21-ba84-f8a59abc8c53" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>9.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="ide3f017f5-aed5-465d-9933-019f8ba38756"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="ide8d18510-67f8-445d-a3b5-1d8d2b7a09ee"><enum>(A)</enum><text>the Committee on Foreign Affairs, the Committee on Financial Services, the Committee on Ways and Means, and the Committee on Homeland Security of the House of Representatives; and</text></subparagraph><subparagraph id="id5c731b46-3406-4f44-a23e-346ec33ff944"><enum>(B)</enum><text>the Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, the Committee on Finance, and the Committee on Homeland Security and Governmental Affairs of the Senate.</text></subparagraph></paragraph><paragraph id="id1D281211B5BB46C993820912C3AB96F5"><enum>(2)</enum><header>Forced labor</header><text>The term <term>forced labor</term>—</text><subparagraph id="idD7BB20157CC6472192E19315FB7A3FD8"><enum>(A)</enum><text>has the meaning given that term in section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>); and</text></subparagraph><subparagraph id="id4EAC96607E3D464587666CDFC0958F9C"><enum>(B)</enum><text>includes convict labor and indentured labor under penal sanctions.</text></subparagraph></paragraph><paragraph id="id2d541a22-e62d-4ea6-a3b6-12629944aae1"><enum>(3)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means a person that is not a United States person. </text></paragraph><paragraph id="idf48bc102-2bd5-40df-9801-e17833488c7d"><enum>(4)</enum><header>Person</header><text>The term <term>person</term> means an individual or entity.</text></paragraph><paragraph id="idbb82684e-e380-49cf-9e18-6d45d498f6a4"><enum>(5)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text><subparagraph id="id1bbaa55e-d7c4-471b-b306-c0cb345ec01d"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or </text></subparagraph><subparagraph id="id39e6ec1b-d835-4e91-bfd1-2b491b86865f"><enum>(B)</enum><text display-inline="yes-display-inline">an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity.</text></subparagraph></paragraph></section></legis-body><endorsement><action-date>June 24, 2021</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
