<section id="HB8A05E96EC7843A0809F4F86FBE95A19" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Cybersecurity Preparedness Consortium Act of 2021</short-title></quote>.</text></section> <section id="H3ACA2EBC3EA24E478384559E818EDEF9"><enum>2.</enum><header>National cybersecurity preparedness consortium</header> <subsection id="H1DDD7B58A7B84EA1B61F20C47F0CC597"><enum>(a)</enum><header>In general</header><text>The Secretary may work with one or more consortia to support efforts to address cybersecurity risks and incidents.</text></subsection>
<subsection id="H132ADA2E993148DBAE9169F4811E3A13"><enum>(b)</enum><header>Assistance to DHS</header><text>The Secretary may work with one or more consortia to carry out the Secretary’s responsibility pursuant to section 2202(e)(1)(P) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/652">6 U.S.C. 652(e)(1)(P)</external-xref>) to—</text> <paragraph id="H4B2A4F6559F24EC190CF86DDE342F862"><enum>(1)</enum><text>provide training and education to State, Tribal, and local first responders and officials specifically for preparing for and responding to cybersecurity risks and incidents, in accordance with applicable law;</text></paragraph>
<paragraph id="H6A44CD891661487D832200EA1E1503B8"><enum>(2)</enum><text>develop and update a curriculum utilizing existing training and educational programs and models in accordance with section 2209 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/659">6 U.S.C. 659</external-xref>), for State, Tribal, and local first responders and officials, related to cybersecurity risks and incidents;</text></paragraph> <paragraph id="H10A76893AEC343968040BA7A3522460E"><enum>(3)</enum><text>provide technical assistance services, training, and educational programs to build and sustain capabilities in support of preparedness for and response to cybersecurity risks and incidents, including threats of acts of terrorism, in accordance with such section 2209;</text></paragraph>
<paragraph id="H1F4D12867BAA467A814BDC997295B7EB"><enum>(4)</enum><text>conduct cross-sector cybersecurity training, education, and simulation exercises for entities, including State and local governments and Tribal organizations, critical infrastructure owners and operators, and private industry, to encourage community-wide coordination in defending against and responding to cybersecurity risks and incidents, in accordance with section 2210(c) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/660">6 U.S.C. 660(c)</external-xref>);</text></paragraph> <paragraph id="H15DF024B169C4C41A7FEB06F7AA25C4A"><enum>(5)</enum><text>help States, Tribal organizations, and communities develop cybersecurity information sharing programs, in accordance with section 2209 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/659">6 U.S.C. 659</external-xref>), for the dissemination of homeland security information related to cybersecurity risks and incidents;</text></paragraph>
<paragraph id="H7068AE5051264297A29CB9CDE891DF23"><enum>(6)</enum><text>help incorporate cybersecurity risk and incident prevention and response into existing State, Tribal, and local emergency plans, including continuity of operations plans; and</text></paragraph> <paragraph id="H4E031A365ADD4AF7A2F4CCA18916D4CC"><enum>(7)</enum><text>assist State governments and Tribal organizations in developing cybersecurity plans.</text></paragraph></subsection>
<subsection id="HF2C4DCD6E9E942798F32E90116317D5C"><enum>(c)</enum><header>Considerations regarding selection of a consortium</header><text>In selecting a consortium with which to work under this Act, the Secretary shall take into consideration the following:</text> <paragraph id="HE7E7B5E93B3F4F57970FC1ED8724BA7A"><enum>(1)</enum><text>Prior experience conducting cybersecurity training, education, and exercises for State and local entities.</text></paragraph>
<paragraph id="H4E3CEEEB64E448C09231341BA4575583"><enum>(2)</enum><text>Geographic diversity of the members of any such consortium so as to maximize coverage of the different regions of the United States.</text></paragraph> <paragraph id="HC8062D3D0D494098B00D76F6973A1721"><enum>(3)</enum><text>The participation in such consortium of one or more historically Black colleges and universities, Hispanic-serving institutions, Tribal Colleges and Universities, other minority-serving institutions, and community colleges that participate in the National Centers of Excellence in Cybersecurity program, as carried out by the Department of Homeland Security.</text></paragraph></subsection>
<subsection id="H0F3F593A682A457B987E13FE1FED5D4A"><enum>(d)</enum><header>Metrics</header><text>If the Secretary works with a consortium under subsection (a), the Secretary shall measure the effectiveness of the activities undertaken by the consortium under this Act.</text></subsection> <subsection id="HE74C41C9C5A04BBBA0355055A9B955C1"><enum>(e)</enum><header>Outreach</header><text>The Secretary shall conduct outreach to universities and colleges, including, in particular, outreach to historically Black colleges and universities, Hispanic-serving institutions, Tribal Colleges and Universities, other minority-serving institutions, and community colleges, regarding opportunities to support efforts to address cybersecurity risks and incidents, by working with the Secretary under subsection (a).</text></subsection>
<subsection id="H190F323B62B54799B378B56F96619A04"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to authorize a consortium to control or direct any law enforcement agency in the exercise of the duties of the law enforcement agency.</text></subsection> <subsection id="HCC5A9C2E0F7B4FDB85BD2E8B651E55A1"><enum>(g)</enum><header>Definitions</header><text>In this section—</text>
<paragraph id="HBF98EE6526244DD4B25BE20115FC3BAF"><enum>(1)</enum><text>the term <quote>community college</quote> has the meaning given the term <quote>junior or community college</quote> in section 312 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1058">20 U.S.C. 1058</external-xref>);</text></paragraph> <paragraph id="H483CE57BC23F4149A8D0FD2C09EB06A4"><enum>(2)</enum><text>the term <quote>consortium</quote> means a group primarily composed of nonprofit entities, including academic institutions, that develop, update, and deliver cybersecurity training and education in support of homeland security;</text></paragraph>
<paragraph id="H48E53EE10E7143AA823E06B4CA03ACCE"><enum>(3)</enum><text>the terms <quote>cybersecurity risk</quote> and <quote>incident</quote> have the meanings given those terms in section 2209(a) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/659">6 U.S.C. 659(a)</external-xref>);</text></paragraph> <paragraph id="H5D4C9CB1312F47259F0B5F5A26C7E106"><enum>(4)</enum><text>the term <quote>Department</quote> means the Department of Homeland Security;</text></paragraph>
<paragraph id="HC2EF19BEFE81406098E4E88C8865AB1B"><enum>(5)</enum><text>the term <quote>Hispanic-serving institution</quote> has the meaning given the term in section 502 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1101a">20 U.S.C. 1101a</external-xref>);</text></paragraph> <paragraph id="H4A719E9E4F6E4FDC972DC9EEC1ABD776"><enum>(6)</enum><text>the term <quote>historically Black college and university</quote> has the meaning given the term <quote>part B institution</quote> in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>);</text></paragraph>
<paragraph id="H03AA5A8BE49E40148F03F782F112EBE1"><enum>(7)</enum><text>the term <quote>minority-serving institution</quote> means an institution of higher education described in section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>);</text></paragraph> <paragraph id="H28C854C9D06E484782493D809B1A4D31"><enum>(8)</enum><text>the term <quote>Secretary</quote> means the Secretary of Homeland Security;</text></paragraph>
<paragraph id="H17E2C02524534664BF3C432F67940550"><enum>(9)</enum><text>The term <quote>State</quote> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any possession of the United States;</text></paragraph> <paragraph id="H023B832427FA47A8B0AB99C34DAAF3EF"><enum>(10)</enum><text>the term <quote>Tribal Colleges and Universities</quote> has the meaning given the term in section 316 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>); and</text></paragraph>
<paragraph id="H145E41C49A5A417AADF0713D90203A4F"><enum>(11)</enum><text>the term <quote>Tribal organization</quote> has the meaning given the term in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>).</text></paragraph></subsection></section> </legis-body> </amendment-block> </amendment></engrossed-amendment-body><attestation><attestation-group><attestor display="no">Lorraine Miller</attestor><role>Clerk.</role></attestation-group></attestation><endorsement></endorsement></amendment-doc>
