which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend SAFETEA–LU to improve the Intelligent Transportation System Program Advisory Committee, to require information and resources for the development of local smart communities, to help establish a 21st century transportation workforce, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Smart Transportation Advancement and Transition Act</short-title></quote> or the <quote><short-title>STAT Act</short-title></quote>.</text></section><section id="id489493033C1240109F273F46B7883B55"><enum>2.</enum><header>Intelligent Transportation System Program Advisory Committee</header><text display-inline="no-display-inline">Section 5305 of SAFETEA–LU (<external-xref legal-doc="usc" parsable-cite="usc/23/512">23 U.S.C. 512</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>) is amended by striking subsection (h) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id16523c01bf6a4df29531d4df06d28232"><subsection commented="no" id="idf736af82563643609008f71dd5d63b27"><enum>(h)</enum><header>Advisory committee</header><paragraph commented="no" id="id0b631ac8f8964d89962a2475fc1d4a9f"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish an advisory committee (referred to in this subsection as the <quote>Committee</quote>) to advise the Secretary in carrying out this subtitle.</text></paragraph><paragraph commented="no" id="idd43cc2591dec4942993d35c83999d96a"><enum>(2)</enum><header>Membership</header><subparagraph commented="no" id="id54CA52C128134D9CA8933ECABA578659"><enum>(A)</enum><header>In general</header><text>The Committee shall—</text><clause commented="no" id="id035AEB8FBBB2497A96DDCBB1313336CD"><enum>(i)</enum><text>be composed of not more than 25 members;</text></clause><clause commented="no" id="id3405D63AD5F64130B63A8A4CF1095B21"><enum>(ii)</enum><text>be balanced between metropolitan and rural interests; and</text></clause><clause commented="no" id="id27A3316A9D6A40BF912B51AB036A7FC5"><enum>(iii)</enum><text>include, at a minimum—</text><subclause commented="no" id="id9230171bcd1d412ca7eb3059cd1bbb8e"><enum>(I)</enum><text>a representative of a State department of transportation;</text></subclause><subclause commented="no" id="ida0dfd60a7e2a471b8c00a4e714ce3d47"><enum>(II)</enum><text>a representative of a local department of transportation (other than a metropolitan planning organization);</text></subclause><subclause commented="no" id="id12415bb0c43a45b488e6b04ff366d828"><enum>(III)</enum><text>a representative of a State, local, or regional transit agency;</text></subclause><subclause commented="no" id="id7a06ecd8a21642afadecf333675e2bde"><enum>(IV)</enum><text>a representative of a metropolitan planning organization;</text></subclause><subclause commented="no" id="id552E7764815B414188243F4389E02F5B"><enum>(V)</enum><text>a representative of a national transit association;</text></subclause><subclause commented="no" id="id80958999E83A4A8A809CE457859AA3A2"><enum>(VI)</enum><text>a representative of a national, State, or local transportation agency or association;</text></subclause><subclause commented="no" id="id4be31a5a214d4aa9a3bd9ec6b4734db9"><enum>(VII)</enum><text>a private sector user of intelligent transportation system technologies, including emerging vehicle technologies;</text></subclause><subclause commented="no" id="idBD56F7DD93ED4AEA8B9D595FCE81C493"><enum>(VIII)</enum><text>a private sector developer of intelligent transportation system technologies, including emerging vehicle technologies;</text></subclause><subclause commented="no" id="id08303d989e9b4600a49a040d50bf9b7a"><enum>(IX)</enum><text>an academic researcher—</text><item commented="no" id="idA48B0D851CB64222BE7D7DF11ECD6B05"><enum>(aa)</enum><text>with expertise in computer science or another information science field related to intelligent transportation systems; and </text></item><item commented="no" id="id70248CE78CE1435F8BE4648FEA0FE0F6"><enum>(bb)</enum><text>who is not an expert on transportation issues;</text></item></subclause><subclause commented="no" id="id92e3601099b047c9bcad7cece6dd1085"><enum>(X)</enum><text>an academic researcher in civil engineering or a civil engineering practitioner;</text></subclause><subclause commented="no" id="idcb79ab1ff8564a649f757359a5fe7640"><enum>(XI)</enum><text>an academic researcher who is a social scientist with expertise in transportation issues;</text></subclause><subclause commented="no" id="id14B2AEA9A8C3491D866B13AB1EFD2543"><enum>(XII)</enum><text>an academic researcher with expertise in labor issues, including—</text><item commented="no" id="id5A5585A40F5042FD9960353649B25B0A"><enum>(aa)</enum><text>disruptions due to technology; and</text></item><item commented="no" id="id5A2C98A9474D4B6398D36EBE0DD64959"><enum>(bb)</enum><text>opportunities and barriers related to transportation and the incorporation of emerging technology;</text></item></subclause><subclause commented="no" id="ida2c336ee39d14534bf39d4bb9277e7b4"><enum>(XIII)</enum><text>a representative of a nonprofit group representing the intelligent transportation system industry;</text></subclause><subclause commented="no" id="id9fd688d54a4642408d1c10d1e51f68ca"><enum>(XIV)</enum><text>a representative of a public interest group concerned with safety, including bicycle and pedestrian interests;</text></subclause><subclause commented="no" id="idC78D68F118DD4DE29E6DEA99C985A6D8"><enum>(XV)</enum><text>a representative of a labor organization;</text></subclause><subclause commented="no" id="idFCBD6B2F30A7410E8C2B5ABD30E52346"><enum>(XVI)</enum><text>a representative of a mobility-providing entity, including for seniors and people with disabilities;</text></subclause><subclause commented="no" id="id64ECFD85BF594EC39171F943B27E3020"><enum>(XVII)</enum><text>an expert in traffic management;</text></subclause><subclause commented="no" id="idce82711e2460483c876a3c05db1c8d51"><enum>(XVIII)</enum><text>a representative of a public interest group concerned with the impact of the transportation system on land use and residential patterns, including housing availability; </text></subclause><subclause commented="no" id="ideca5ba08b06c4bdfaaeed74060f02824"><enum>(XIX)</enum><text>members with expertise in planning, safety, and operations;</text></subclause><subclause commented="no" id="id2C6766115D1642589F640A524AB547FD"><enum>(XX)</enum><text>a member with expertise in law enforcement; and</text></subclause><subclause commented="no" id="idD37D15B8B3724356A4A55329D01F9082"><enum>(XXI)</enum><text>a member with expertise in cybersecurity.</text></subclause></clause></subparagraph><subparagraph commented="no" id="id6BE98880CEE544AE9FBD6FF3FD1DF079"><enum>(B)</enum><header>Term</header><clause commented="no" id="id99CF1D4D12A54F6E89032F0351919367"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the term of a member of the Committee shall be 3 years.</text></clause><clause commented="no" id="id33F3B6444DAF42A1A376060F8FE9BB93"><enum>(ii)</enum><header>Staggered terms</header><subclause commented="no" id="id678E9BC1D6704076AA77AEFF888AC7BD"><enum>(I)</enum><header>In general</header><text>Of the members first appointed to the Committee—</text><item commented="no" id="idDC7D5135813D4B82A43D57CFF1D8886D"><enum>(aa)</enum><text><fraction>1/3</fraction> shall be appointed for a term of 1 year;</text></item><item commented="no" id="id427DD49A7DDF4833BC727D4E135D80C2"><enum>(bb)</enum><text><fraction>1/3</fraction> shall be appointed for a term of 2 years; and</text></item><item commented="no" id="idD54BB7881AA2494881545D0CFE4EC512"><enum>(cc)</enum><text><fraction>1/3</fraction> shall be appointed for a term of 3 years.</text></item></subclause><subclause commented="no" id="idE05FE863D858462F9C763B152ECABAB7"><enum>(II)</enum><header>Timing</header><text>The terms described in subclause (I) shall not begin until the last member of the members referred to in that subclause is appointed. </text></subclause></clause><clause commented="no" id="idE6C280F175694E58B1586A0F934B6375"><enum>(iii)</enum><header>Renewal</header><text>On expiration of the term of a member of the Committee, the member—</text><subclause commented="no" id="id95C0B8602DF64F599356DBB8BA6EFFE6"><enum>(I)</enum><text>may be reappointed; and</text></subclause><subclause commented="no" id="id550E893D2ADE460B942B0176FAE16038"><enum>(II)</enum><text>if the member is not reappointed under subclause (I), may serve until a new member is appointed.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="ida8197190b1ca4fd2b5db894c1a43b8e9"><enum>(3)</enum><header>Duties</header><text>The Committee shall, at a minimum—</text><subparagraph commented="no" id="id9fe28e329cbc4e42bf6efc58456921d9"><enum>(A)</enum><text>provide input into the development of the intelligent transportation system aspects of the 5-year strategic plan under section 6503 of title 49, United States Code;</text></subparagraph><subparagraph commented="no" id="ide3b440149bc44fd4bdd04ec75d125b44"><enum>(B)</enum><text>annually review areas of intelligent transportation systems programs and research being considered for funding by the Department, to determine—</text><clause commented="no" id="id7654a15249ae4cd8823eae1f21e2ed77"><enum>(i)</enum><text>whether those areas of research are likely to advance the state of the practice or state of the art in intelligent transportation systems;</text></clause><clause commented="no" id="idecb32075cb1d432b9ca24724b284d558"><enum>(ii)</enum><text>whether intelligent transportation system technologies are likely to be deployed by users, and if not, to determine the barriers to deployment;</text></clause><clause commented="no" id="idd1d4e4473b1e41e9bab2ad1a361f1f7b"><enum>(iii)</enum><text>the appropriate roles for government and the private sector in investing in the research and technologies being considered;</text></clause><clause commented="no" id="id95926E61EBC34C3BB5D4193D35057F6F"><enum>(iv)</enum><text>how Federal resources, especially resources provided by the Department, are being utilized to advance intelligent transportation systems; and</text></clause><clause commented="no" id="id4CC41057C89D4D4D89B9703F46C898EC"><enum>(v)</enum><text>how the Department is engaging and supporting local communities in the adoption and integration of intelligent transportation systems across all modes;</text></clause></subparagraph><subparagraph commented="no" id="idB002488B4D994F3CA739908BC037989B"><enum>(C)</enum><text>help develop and revise the resource guide described in section 4(b) of the <short-title>Smart Transportation Advancement and Transition Act</short-title>; and</text></subparagraph><subparagraph commented="no" id="idD922F7F3A56848F28801309D69A5CA14"><enum>(D)</enum><text>through the appropriate office of the Department, help respond to requests for assistance, advice, or consultation from States and local communities as a result of the resource guide described in section 4(b) of the <short-title>Smart Transportation Advancement and Transition Act</short-title>.</text></subparagraph></paragraph><paragraph commented="no" id="idADF483E7F2304B2998AB265EE8256E51"><enum>(4)</enum><header>Meetings</header><text>The Committee—</text><subparagraph commented="no" id="id7ED3C1E63A034983B459276D664C83E3"><enum>(A)</enum><text>shall convene not less frequently than twice each year; and</text></subparagraph><subparagraph commented="no" id="id9959B9B7601B46FE9FFF92CC24BFC03E"><enum>(B)</enum><text>may convene with the use of remote video conference technology.</text></subparagraph></paragraph><paragraph commented="no" id="idB771E787EF4F46D3B9AC565CB3F43EA9"><enum>(5)</enum><header>Assistance</header><text>The Secretary may provide to the Committee personnel or expertise from the Department to assist the Committee in carrying out the duties of the Committee. </text></paragraph><paragraph commented="no" id="id0DDDEF1BBD6C4A9C8B6A36E6A9385BE8"><enum>(6)</enum><header>Report</header><text>Not later than February 1 of each year beginning after the date of enactment of the <short-title>Smart Transportation Advancement and Transition Act</short-title>, the Secretary shall submit to the Committees on Appropriations, Commerce, Science, and Transportation, and Environment and Public Works of the Senate and the Committees on Appropriations and Transportation and Infrastructure of the House of Representatives a report that includes—</text><subparagraph commented="no" id="id110af8a570144d7cb5a82987877f5555"><enum>(A)</enum><text>the recommendations made by the Committee during the preceding calendar year;</text></subparagraph><subparagraph commented="no" id="id90af87ca4893461e96c3b259a466d5e9"><enum>(B)</enum><text>an explanation of how the Secretary has implemented those recommendations; and</text></subparagraph><subparagraph commented="no" id="idc68f7d4cb8b1475c8518016a7f1ff059"><enum>(C)</enum><text>for any recommendation not implemented, an explanation of the reasons for not implementing the recommendation.</text></subparagraph></paragraph><paragraph commented="no" id="id149FC8FEE9E84F22BA8A1BF562EF9426"><enum>(7)</enum><header>Applicability of Federal Advisory Committee Act</header><text>The Committee shall be subject to the Federal Advisory Committee Act (5 U.S.C. App.).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id96A9AE102117415699F69E86E4DB3787"><enum>3.</enum><header>Report on local engagement</header><text display-inline="no-display-inline">Not later than 150 days after the date of enactment of this Act, and annually thereafter, the Secretary of Transportation, in coordination with the advisory committee established under section 5305(h) of SAFETEA–LU (<external-xref legal-doc="usc" parsable-cite="usc/23/512">23 U.S.C. 512</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>), shall submit to the Committees on Appropriations, Commerce, Science, and Transportation, and Environment and Public Works of the Senate and the Committees on Appropriations and Transportation and Infrastructure of the House of Representatives a report on efforts by the Department of Transportation to engage with local communities, metropolitan planning organizations, regional transportation commissions, and multijurisdictional groups, including in rural areas, on advancing data and intelligent transportation systems technologies and other smart cities solutions.</text></section><section id="id2DDBDFCF85374268AE79476E542915DF"><enum>4.</enum><header>Smart community resource guide</header><subsection id="id96A5266F66064778A168E8A0FA20E295"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="id4B38954D39864536A3D335C3E41BB243"><enum>(1)</enum><header>Advisory committee</header><text>The term <term>advisory committee</term> means the advisory committee established under section 5305(h) of SAFETEA–LU (<external-xref legal-doc="usc" parsable-cite="usc/23/512">23 U.S.C. 512</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>).</text></paragraph><paragraph id="idC3D4235CA2954BA8AF57D8787172EF7F"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph id="idD72626F2D75C4125A9A882850E574099"><enum>(3)</enum><header>Smart community</header><text>The term <term>smart community</term> means a community that uses innovative technologies, data, analytics, and other means to improve the community and address local challenges. </text></paragraph><paragraph id="idFCE8A8ED6AD84C6F9CDBE250E3758309"><enum>(4)</enum><header>Smart community resource guide</header><text>The term <term>smart community resource guide</term> means the resource guide created, published, and maintained under subsection (b).</text></paragraph></subsection><subsection id="idB76235A9EDF242E69C16ED07654AE0DE"><enum>(b)</enum><header>Resource guide</header><text>The Secretary, in consultation with the advisory committee, shall create, publish, and maintain a resource guide that is designed to assist States and local communities in developing and implementing intelligent transportation technology or smart community transportation programs. </text></subsection><subsection id="idD9736EFA0499432B918A0023E78E5EE6"><enum>(c)</enum><header>Inclusions</header><text>The smart community resource guide may include—</text><paragraph id="id8C0ADA34160947E6AEAFD5FD15AD36B7"><enum>(1)</enum><text>a compilation of existing related Federal and non-Federal programs that are available to States and local communities in developing and implementing smart community transportation programs, including technical assistance, education, training, research and development, analysis, and funding;</text></paragraph><paragraph id="idE7998EFED9D94810ACE7AB0450514754"><enum>(2)</enum><text>available examples of States and local communities engaging private sector entities to carry out smart community transportation solutions, including public-private partnership models that could be used to leverage private sector funding to solve local challenges; </text></paragraph><paragraph id="id324BCDBB80B140DDA0D892B888633B57"><enum>(3)</enum><text>available examples of proven methods for States and local communities to facilitate the integration of smart community transportation technologies with, or within, new and existing infrastructure and systems;</text></paragraph><paragraph id="id30F79AC6D8A544A1932C5E330D08D6ED"><enum>(4)</enum><text>best practices and lessons learned from smart community transportation demonstration projects, including information on return on investment and performance, to help other States and local communities to decide how to begin the integration of smart community transportation technologies; and</text></paragraph><paragraph id="idA3EC3119923543098BE21F6570CCFC3B"><enum>(5)</enum><text>other topics—</text><subparagraph id="id0179758F3BCB4C828E45E2383F9AE896"><enum>(A)</enum><text>as requested by industry entities, States, or local governments; or</text></subparagraph><subparagraph id="idBF424762E8444BF18CC9857151CE08C7"><enum>(B)</enum><text>as determined to be necessary by the Secretary and the advisory committee.</text></subparagraph></paragraph></subsection><subsection id="id9CB105BD52044CA6817A1D185C483D85"><enum>(d)</enum><header>Use of existing guides</header><text>In creating, publishing, and maintaining the smart community resource guide, the Secretary shall consider existing Federal, State, and local community information, guides, and other resources that relate to smart community transportation goals, activities, and best practices—</text><paragraph id="id802CEC7A0B40457CB864116A9E75591A"><enum>(1)</enum><text>to prevent duplication of efforts by the Federal Government; </text></paragraph><paragraph id="id36F0874ED6F44C57867448573CA04BB5"><enum>(2)</enum><text>to improve local accessibility to Federal programs; and</text></paragraph><paragraph id="id8329F33FEA454234920B6B58582C09BF"><enum>(3)</enum><text>to leverage existing, complementary efforts.</text></paragraph></subsection><subsection id="id753868F3BBB3462EB33EACF977F2E85D"><enum>(e)</enum><header>Outreach</header><text>The Secretary, with input from the advisory committee at the determination of the Secretary, shall conduct outreach to States, counties, local communities, and other relevant entities—</text><paragraph id="id5DBF8A18DA1A47C79A8C99A851258EDF"><enum>(1)</enum><text>to provide interested stakeholders with the smart community resource guide, including through publication of the guide on the internet;</text></paragraph><paragraph id="idD4FFC15E8C6940E58A99BEDB792483FC"><enum>(2)</enum><text>to promote the consideration of smart community transportation technologies;</text></paragraph><paragraph id="idFA76B646BF994A22B4420EC673986FA5"><enum>(3)</enum><text>to encourage States and local governments to contribute smart community transportation program and activity information to the smart community resource guide;</text></paragraph><paragraph id="idBCD391137E084A0594BE02D906387A69"><enum>(4)</enum><text>to identify—</text><subparagraph id="id204414BE759B4EFF934D5B3DD560AAC0"><enum>(A)</enum><text>barriers to the adoption of smart community transportation technologies; and</text></subparagraph><subparagraph id="idFCE32BA25BD045C28AF5A8B5CA34E2BD"><enum>(B)</enum><text>any research, development, and other assistance that is needed that could be included in the smart community resource guide; and</text></subparagraph></paragraph><paragraph id="id8DCF8AEE332A45008FAE9925B28BB816"><enum>(5)</enum><text>for other purposes, as identified by the Secretary or the advisory committee.</text></paragraph></subsection><subsection id="id1F8B9B0E1C814BA68C3CB2AA345F2945"><enum>(f)</enum><header>Revision</header><text>The Secretary and the advisory committee shall issue a revised smart community resource guide not less frequently than once every 3 years. </text></subsection></section></legis-body></bill>
