<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 642</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210309">March 9, 2021</action-date><action-desc><sponsor name-id="S354">Ms. Baldwin</sponsor> (for herself, <cosponsor name-id="S309">Mr. Casey</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, <cosponsor name-id="S369">Mr. Markey</cosponsor>, <cosponsor name-id="S322">Mr. Merkley</cosponsor>, <cosponsor name-id="S386">Ms. Duckworth</cosponsor>, and <cosponsor name-id="S388">Ms. Hassan</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To protect the rights of passengers with disabilities in air transportation, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id4DC3AE4C6D004A6B98C942C67A15D3DA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Air Carrier Access Amendments Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="id026683E2A21F44FA9BB689B4DB0F2C92"><enum>2.</enum><header>Findings; sense of Congress</header><subsection id="id602E65ECC5E84136BD976C41BAB3E989"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress makes the following findings:</text><paragraph id="idE8451166F46A4FF08748724B671095CE"><enum>(1)</enum><text display-inline="yes-display-inline">In 1986, President Ronald Reagan signed the Air Carrier Access Act of 1986 (<external-xref legal-doc="public-law" parsable-cite="pl/99/435">Public Law 99–435</external-xref>; 100 Stat. 1080), adding a provision now codified in section 41705 of title 49, United States Code (in this section referred to as the <quote>ACAA</quote>), prohibiting disability-based discrimination in air transportation.</text></paragraph><paragraph id="id63F4EC5A6ECA47DEA819D79FB5B9ACBA"><enum>(2)</enum><text display-inline="yes-display-inline">Despite the effort, individuals, including veterans, with disabilities continue to experience significant barriers to and with traveling in air transportation, such as—</text><subparagraph id="id63BD5DC9B00D49DEBC3C2CBA9C813779"><enum>(A)</enum><text>damaged assistive devices;</text></subparagraph><subparagraph id="idC1FB5E0127754BE9895D814C7B54BA71"><enum>(B)</enum><text>inaccessible aircraft, lavatories, and communication media;</text></subparagraph><subparagraph id="id23F0F20B94194AFD9832F089F10F2B25"><enum>(C)</enum><text>delayed assistance;</text></subparagraph><subparagraph id="id3DB5ED0955F249688C1B4D6101CD3819"><enum>(D)</enum><text>treatment of service animals;</text></subparagraph><subparagraph id="idB404F32CAB48407B8930A495AA5CE47B"><enum>(E)</enum><text>inadequate disability cultural competency; and</text></subparagraph><subparagraph id="id971A20EEA9E04418B78E456D289822FF"><enum>(F)</enum><text>a lack of suitable seating accommodations.</text></subparagraph></paragraph></subsection><subsection id="idFFF5FD8AAD6A41E5AAA2E1C618748711"><enum>(b)</enum><header>Sense of Congress</header><text>The following is the sense of Congress:</text><paragraph commented="no" id="ide81198d2d70b4f04923c4cf926ffbf7c"><enum>(1)</enum><text>Access for individuals with disabilities in air transportation must move into the 21st century. Otherwise, individuals with disabilities will be left behind and unable to compete in today’s job market or enjoy the opportunities available to other citizens of the United States.</text></paragraph><paragraph commented="no" id="idec088e2b032a45559399cc41d86f0275"><enum>(2)</enum><text>Aircraft must be designed to accommodate individuals with disabilities and air carriers must acquire aircraft that meet broad accessibility standards.</text></paragraph><paragraph commented="no" id="id2E9BD330C26B47F7B2B04DA2914EC225"><enum>(3)</enum><text>The ACAA must be updated to improve access to air transportation for individuals with disabilities. Legislation is necessary for the modernization of standards and requirements that will strengthen accessibility in air transportation, including the accessibility of aircraft.</text></paragraph><paragraph commented="no" id="id5f7136dadadd4407beea11a2dbbf2a77"><enum>(4)</enum><text>The Department of Transportation and the Architectural and Transportation Barriers Compliance Board (in this section referred to as the <quote>Access Board</quote>) must promulgate regulations to ensure that all passengers with disabilities receive—</text><subparagraph commented="no" id="id5F8626C560EA4FE8B233B3132F74BBFD"><enum>(A)</enum><text>prompt and effective boarding, deplaning, and connections between flights;</text></subparagraph><subparagraph commented="no" id="idB04D3F418B324C44AEB31A089916AF24"><enum>(B)</enum><text>accommodations, including nonstandard accommodations, that safely facilitate air travel; and</text></subparagraph><subparagraph commented="no" id="id3240716499264A77A1528088818FDDBD"><enum>(C)</enum><text>better access to airport facilities, including the provision of visually and tactilely accessible announcements and full and equal access to aural communications. </text></subparagraph></paragraph><paragraph id="idddc51ee2a11f4fc89edcdbba3761cf41"><enum>(5)</enum><text>Legislation is necessary to ensure that individuals with disabilities have adequate remedies available when air carriers violate the ACAA (including regulations prescribed under the ACAA).</text></paragraph><paragraph id="id836335e400414e69a579e5c8df4756e5"><enum>(6)</enum><text>Unlike other civil rights statutes, the ACAA does not contain a private right of action, which is critical to the enforcement of civil rights statutes. Legislation is necessary to correct this anomaly.</text></paragraph></subsection></section><section id="id2C68C3D97F334AB68BE6FF7864C567EE"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idC36586265E0C42D5981B8E05B9E01C13"><enum>(1)</enum><header>Access Board</header><text>The term <term>Access Board</term> means the Architectural and Transportation Barriers Compliance Board.</text></paragraph><paragraph id="id9DB0EA77862944D594573E3455E616BE"><enum>(2)</enum><header>Air carrier</header><text>The term <term>air carrier</term> means an air carrier or foreign air carrier (as those terms are defined in section 40102 of title 49, United States Code).</text></paragraph><paragraph id="idA2202EA9CC4E42B1B195EA113B981AF1"><enum>(3)</enum><header>Disability</header><text>The term <term>disability</term> has the meaning given that term in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>), including the meaning under that section as amended by the ADA Amendments Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/325">Public Law 110–325</external-xref>; 122 Stat. 3553).</text></paragraph><paragraph id="idA8AC60BCA7A44CF58041791F44254B16"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph></section><section id="id75c3070ed9404deca3eab5a25a2fd821"><enum>4.</enum><header>Improving access to air transportation for individuals with disabilities</header><subsection id="idE89D9B4A0EB241F79F350A8E10180D5D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 41705 of title 49, United States Code, is amended to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="id6634D1D7BDDF4CBEB37DA625D835E600"><section id="id08BE51F2A85B47F9BE5BA3259852D69D"><enum>41705.</enum><header>Accessibility of air transportation for individuals with disabilities</header><subsection id="id6dfe30db48cc409c9cf667779ea4efec"><enum>(a)</enum><header>In general</header><text>In providing air transportation, an air carrier may not discriminate against an individual on the basis of a disability, including by taking any of the actions prohibited under subsection (b) or not taking any of the actions required by subsection (c).</text></subsection><subsection id="idBD2751ED198D4BAB83B34DA5D1A9EBD1"><enum>(b)</enum><header>Prohibited actions</header><paragraph id="idD9EAB94669734D5988208EA32D5B4BD0"><enum>(1)</enum><header>In general</header><text>An air carrier may not—</text><subparagraph commented="no" id="id88dba669ca4a490880df707a759d55cc"><enum>(A)</enum><text>directly or through a contractual, licensing, or other arrangement, discriminate in the full and equal enjoyment (within the meaning of that term under section 302(a) of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12182">42 U.S.C. 12182(a)</external-xref>)) of air transportation;</text></subparagraph><subparagraph id="id22536F76E91E44A6B09345B3DF00CC78"><enum>(B)</enum><text>deny the opportunity of an individual or a class of individuals, on the basis of a disability or disabilities of the individual or class, to participate in or benefit from the goods, services, facilities, advantages, accommodations, or other opportunities provided by the air carrier;</text></subparagraph><subparagraph id="id5e7d5819b0a44d4eb9fed660983f9eba"><enum>(C)</enum><text>afford an individual or a class of individuals, on the basis of a disability or disabilities of the individual or class, with the opportunity to participate in or benefit from a good, service, facility, advantage, accommodation, or other opportunity that is not equal to a good, service, facility, advantage, accommodation, or other opportunity afforded to other individuals;</text></subparagraph><subparagraph id="id5a9b02f1b630469bb9ae355b684aa22b"><enum>(D)</enum><text>subject to paragraph (2), provide an individual or a class of individuals, on the basis of a disability or disabilities of the individual or class, with a good, service, facility, privilege, advantage, accommodation, or other opportunity that is different or separate from a good, service, facility, privilege, advantage, accommodation, or other opportunity provided to other individuals;</text></subparagraph><subparagraph id="id250f76c850b4471c843137d8007c106f"><enum>(E)</enum><text>deny any goods, services, facilities, privileges, advantages, accommodations, or other opportunities to an individual because of the known disability of another individual with whom the individual is known to have a relationship or association;</text></subparagraph><subparagraph id="id76D939CA5C4B46809C0BCA921F9E3FEB"><enum>(F)</enum><text>impose or apply eligibility criteria that screen out or have the effect of screening out individuals with disabilities or a class of individuals with disabilities from fully enjoying any good, service, facility, privilege, advantage, accommodation, or other opportunity provided by the air carrier, unless the air carrier can demonstrate that such criteria are necessary for the provision of the good, service, facility, privilege, advantage, accommodation, or other opportunity;</text></subparagraph><subparagraph id="id9EBA808C709047EBBF0FB409EFE9C576"><enum>(G)</enum><text>directly or through a contractual, licensing, or other arrangement, use standards or criteria or methods of administration—</text><clause id="id4115f36fff8942d881886b53b31c52e8"><enum>(i)</enum><text>that have the effect of discriminating on the basis of disability; or</text></clause><clause commented="no" id="id2548bff2bd924710b2a57ed9d8f2e108"><enum>(ii)</enum><text>that perpetuate the discrimination of others who are subject to common administrative control;</text></clause></subparagraph><subparagraph id="id77cd719973e14d0e88e6c9ddd66e22a5"><enum>(H)</enum><text>purchase or lease an aircraft that does not comply with this section and regulations prescribed under this section; or</text></subparagraph><subparagraph id="id17f53d86b56e465ebd9f91f21b2c8700"><enum>(I)</enum><text>refurbish an aircraft cabin in an aircraft manufactured before the date of the enactment of the <short-title>Air Carrier Access Amendments Act of 2021</short-title>, or purchase or lease such an aircraft, unless the aircraft, to the maximum extent feasible, is made readily accessible to and usable by individuals with disabilities, including individuals who use wheelchairs, in accordance with this section and upon issuance of regulations prescribed under this section.</text></subparagraph></paragraph><paragraph id="idA487997C432F486F856DA4B211D1435E"><enum>(2)</enum><header>Exception</header><subparagraph id="id4ACA62BC84334D058ADD1AD1908274F2"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), an air carrier may provide an individual or a class of individuals, on the basis of a disability or disabilities of the individual or class, with a good, service, facility, privilege, advantage, accommodation, or other opportunity that is different or separate from the good, service, facility, privilege, advantage, accommodation, or other opportunity provided to other individuals if doing so is necessary to provide the individual or class of individuals with a good, service, facility, privilege, advantage, accommodation, or other opportunity that is as effective as the good, service, facility, privilege, advantage, accommodation, or other opportunity provided to other individuals.</text></subparagraph><subparagraph commented="no" id="id266FB100678146CBA23A1EDDD4DE4055"><enum>(B)</enum><header>Acceptance</header><text>An individual or a class of individuals shall retain the authority to decide whether to accept or refuse a good, service, facility, privilege, advantage, accommodation, or other opportunity referred to in subparagraph (A).</text></subparagraph><subparagraph commented="no" id="id92596722E21F4E82A9CDACE858AF750D"><enum>(C)</enum><header>Selection of goods, etc., provided to others</header><text>If, in accordance with subparagraph (A), an air carrier provides to an individual or a class of individuals a good, service, facility, privilege, advantage, accommodation, or other opportunity that is different or separate from the good, service, facility, privilege, advantage, accommodation, or other opportunity provided to other individuals, the air carrier may not deny to an individual with a disability the opportunity to participate in the good, service, facility, privilege, advantage, accommodation, or other opportunity provided to such other individuals.</text></subparagraph></paragraph></subsection><subsection id="idB2B382331A074867B3802498E6FA75B5"><enum>(c)</enum><header>Required actions</header><text>An air carrier shall—</text><paragraph id="id6ff11f41b76f40709695da32e66f5d37"><enum>(1)</enum><text>afford goods, services, facilities, privileges, advantages, accommodations, and other opportunities to an individual with a disability in the most integrated setting appropriate to the needs of the individual;</text></paragraph><paragraph id="id2aff5bfd3e904cc2aab2571ab43febbd"><enum>(2)</enum><text>make reasonable modifications in policies, practices, or procedures, when such modifications are necessary to afford goods, services, facilities, privileges, advantages, accommodations, or other opportunities to individuals with disabilities, unless the air carrier can demonstrate that making such modifications would fundamentally alter the nature of the goods, services, facilities, privileges, advantages, accommodations, or other opportunities;</text></paragraph><paragraph id="id46261f3393ed4ee0a87990cfe78bc1a9"><enum>(3)</enum><text>take such measures as may be necessary to ensure that no individual with a disability is excluded, denied services, segregated, or otherwise treated differently from other individuals because of the absence of auxiliary aids or services, unless the air carrier can demonstrate that taking such measures would—</text><subparagraph id="idA1FFF82D213C44FBA124A7D2EC4E0E89"><enum>(A)</enum><text>fundamentally alter the nature of a good, service, facility, privilege, advantage, accommodation, or other opportunity being offered; or</text></subparagraph><subparagraph id="id73ACB7DCC1DB486F912C43BB17D540BD"><enum>(B)</enum><text>result in an undue burden to the air carrier; and</text></subparagraph></paragraph><paragraph id="id33e127c787d8497cbb051bac86c6d559"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id45AC3AE161E745B48912586A4E5F53FC"><enum>(A)</enum><text>remove architectural barriers to equal access by individuals with disabilities to goods, services, facilities, privileges, advantages, accommodations, or other opportunities provided by the air carrier, and communication barriers to such access that are structural in nature, in facilities of the air carrier (whether owned or leased by the air carrier) that were constructed before or altered after the date of the enactment of the <short-title>Air Carrier Access Amendments Act of 2021</short-title>, and remove physical and communication barriers to such access in aircraft manufactured before such date of enactment and used by an air carrier for transporting individuals, if the removal of such barriers is readily achievable; or</text></subparagraph><subparagraph id="idF8679BE65EC14A7783AD7AFF9F3A96D0" indent="up1"><enum>(B)</enum><text>if the air carrier can demonstrate that the removal of a barrier described in subparagraph (A) is not readily achievable, make such goods, services, facilities, privileges, advantages, accommodations, or other opportunities available through alternative methods that are readily achievable.</text></subparagraph></paragraph></subsection><subsection id="id77600f5c42d642409e9e4404de4f1edd"><enum>(d)</enum><header>Complaints</header><paragraph id="ide8e74b46a0ef4dccb5a8a103e19f3891"><enum>(1)</enum><header>In general</header><text>The Secretary of Transportation shall ensure that individuals with disabilities traveling in air transportation are able—</text><subparagraph id="id5A870B8DDC8340E7B95295AB711B1C82"><enum>(A)</enum><text>to file complaints with the Department of Transportation in response to disability-related discrimination prohibited under this section or regulations prescribed under this section; and</text></subparagraph><subparagraph id="id6AB4F06BB4644CD89D9BBECED96B7F4D"><enum>(B)</enum><text>to receive assistance from the Department through a toll-free hotline telephone number or comparable electronic means of communication.</text></subparagraph></paragraph><paragraph id="id5a636433784e4c40b699df0c272fb345"><enum>(2)</enum><header>Notice to passengers with disabilities</header><text>Each air carrier shall include on its publicly available Internet website, any related mobile device application, and online service—</text><subparagraph id="id81a8213dd31b4583bc56ce193efbf6b3"><enum>(A)</enum><text>the hotline telephone number established under section 42302 or the telephone number for the Aviation Consumer Protection Division of the Department of Transportation and the Department’s disability assistance hotline telephone number or a comparable electronic means of communication;</text></subparagraph><subparagraph id="idb0e4d872b4534308af118da2acacc111"><enum>(B)</enum><text>notice that a consumer can file a disability-related complaint with the Aviation Consumer Protection Division;</text></subparagraph><subparagraph id="id85bfe35b75564319abee05608d506186"><enum>(C)</enum><text>an active link to the Internet website of the Aviation Consumer Protection Division for a consumer to file a disability-related complaint; and</text></subparagraph><subparagraph id="id0184c84320ca4683b02f2487574dc040"><enum>(D)</enum><text>notice that the consumer can file a disability-related complaint with the air carrier and the process and any timelines for filing such a complaint.</text></subparagraph></paragraph><paragraph id="id246325d8601343b99fcff6772337e5c3"><enum>(3)</enum><header>Investigation of complaints</header><subparagraph id="idc6d507ee349b4d5b9794f9f7009410a8"><enum>(A)</enum><header>In general</header><text>The Secretary shall—</text><clause id="idB30593946CC545DEAC8BB2705CCF7CE6"><enum>(i)</enum><text>investigate each complaint of a violation of this section or a regulation prescribed under this section;</text></clause><clause id="idAC2D30B28C6347E48DF3BCD32B33DFE0"><enum>(ii)</enum><text>provide, in writing, to the individual that filed the complaint and the air carrier alleged to have violated this section or a regulation prescribed under this section, the determination of the Secretary with respect to—</text><subclause id="id5F989D94FCA340CEB38E24B0DE0073F6"><enum>(I)</enum><text>whether the air carrier violated this section or a regulation prescribed under this section;</text></subclause><subclause id="idDA69028869234AC78D0CB2E7CB59682E"><enum>(II)</enum><text>the facts underlying the complaint; and</text></subclause><subclause id="id48083C6B03794D459A8D786B7095BE1E"><enum>(III)</enum><text>any action the Secretary is taking in response to the complaint; and</text></subclause></clause><clause id="id5ee75e1fb69649fbaa34eb068f409d9b"><enum>(iii)</enum><text>assess civil penalties under section 46301 for each violation of this section (with each individual act of discrimination prohibited under subsection (a), (b), or (c) considered a separate violation of this section).</text></clause></subparagraph><subparagraph id="id77eb36cf68e44e4e857491f8b936c8d5"><enum>(B)</enum><header>Referral</header><text>If the Secretary has reasonable cause to believe that any air carrier or group of air carriers is engaged in a pattern or practice of discrimination under this section, or any person or group of persons has been discriminated against under this section and such discrimination raises an issue of general public importance, the Secretary shall, after the assessment of civil penalties, refer the matter to the Attorney General for further action.</text></subparagraph><subparagraph id="idf3846d4b8bb94497aecf183c742b1f90"><enum>(C)</enum><header>Publication of data</header><text>The Secretary shall publish disability-related complaint data in a manner comparable to other aviation consumer complaint data.</text></subparagraph><subparagraph id="id3ace30f3b6a94b13a9049012b5b3d644"><enum>(D)</enum><header>Review and report</header><text>The Secretary shall regularly review all complaints received by air carriers alleging discrimination on the basis of disability and shall report annually to Congress on the disposition of such complaints.</text></subparagraph></paragraph></subsection><subsection id="id7a6cfc59b106489cb89162ec4a789a41"><enum>(e)</enum><header>Civil action</header><paragraph id="id4378C57F80544215AA6D96B6BFB5213C"><enum>(1)</enum><header>Aggrieved persons</header><subparagraph id="id8855054c4bea4971b0b10d5f07c22796"><enum>(A)</enum><header>In general</header><text>Any person aggrieved by the violation by an air carrier of this section or a regulation prescribed under this section may, during the 2-year period beginning on the date of the violation, bring a civil action in an appropriate district court of the United States.</text></subparagraph><subparagraph id="id52e38ca3304942e8ba6de1a9b4560c77"><enum>(B)</enum><header>Available relief</header><text>If a court finds in favor of the plaintiff in a civil action brought under subparagraph (A), the court may award to the plaintiff equitable and legal relief, including compensatory and punitive damages, and shall, in addition to any such relief, award reasonable attorney’s fees, reasonable expert fees, and cost of the action to the plaintiff.</text></subparagraph><subparagraph id="id1a857d0c109b470a997b7efe871e3215"><enum>(C)</enum><header>Exhaustion of administrative remedies</header><text>Any person aggrieved by the violation by an air carrier of this section or a regulation prescribed under this section shall not be required to exhaust administrative remedies before bringing a civil action under subparagraph (A).</text></subparagraph><subparagraph id="id1e8f6bb39b5c4bd0acd773498d413114"><enum>(D)</enum><header>Rule of construction</header><text>Nothing in this paragraph shall be construed to invalidate or limit other Federal or State laws affording to people with disabilities greater legal rights or protections than those granted by this section.</text></subparagraph></paragraph><paragraph id="id89f415c12de4457ba7a22c37d4266fe2"><enum>(2)</enum><header>Enforcement by Attorney General</header><subparagraph id="id787a333f2106478092cd018214e1565f"><enum>(A)</enum><header>In general</header><text>The Attorney General may bring a civil action on behalf of persons aggrieved by the violation by an air carrier of this section or a regulation prescribed under this section in any appropriate district court of the United States.</text></subparagraph><subparagraph id="id4217a881bd75415a90c7669c63b4dc31"><enum>(B)</enum><header>Authority of court</header><text>In a civil action under subparagraph (A), the court may—</text><clause id="id9c6a618b7fcb426ebf5e82725d704fe8"><enum>(i)</enum><text>grant any equitable relief that the court considers to be appropriate;</text></clause><clause id="id4993eb2dedd8455a8322d1cb86c9faa5"><enum>(ii)</enum><text>award such other relief as the court considers to be appropriate, including monetary damages to persons aggrieved by the violation by an air carrier of this section or a regulation prescribed under this section, when requested by the Attorney General; and</text></clause><clause id="idc27c1d65169a42db8c18ab8719014acc"><enum>(iii)</enum><text>assess a civil penalty against the air carrier.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="id1c59602f1a854c1ab9838203feb71b1f"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this subchapter shall require an air carrier to permit an individual to participate in or benefit from goods, services, facilities, privileges, advantages, accommodations, or other opportunities if the individual poses a significant risk to the health or safety of others that cannot be eliminated by a modification of policies, practices, or procedures or by the provision of auxiliary aids or services.</text></subsection><subsection id="idC0C691C729E44AA6979BC10580A42F17"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id9DFFD568633B4E5E9F24344DE9D3B1CD"><enum>(1)</enum><header>Access Board</header><text>The term <term>Access Board</term> means the Architectural and Transportation Barriers Compliance Board.</text></paragraph><paragraph id="id3717D9AFA8D24E94A56A09BA4596153D"><enum>(2)</enum><header>Air carrier</header><text>The term <term>air carrier</term> means an air carrier or, subject to section 40105(b), a foreign air carrier.</text></paragraph><paragraph id="id03964F0AF6E5471396227C39D97FDFE7"><enum>(3)</enum><header>Disability</header><text>The term <term>disability</term> has the meaning given that term in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>), including the meaning under that section as amended by the ADA Amendments of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/325">Public Law 110–325</external-xref>; 122 Stat. 3553).</text></paragraph><paragraph commented="no" id="id20a2ed712a8b40a286821eab4c3982f3"><enum>(4)</enum><header>Readily achievable</header><text>The term <term>readily achievable</term> means easily accomplishable and able to be carried out without much difficulty or expense. In determining whether an action is readily achievable, factors to be considered include—</text><subparagraph commented="no" id="id97f516d2e2dd409190ae5264a48f4905"><enum>(A)</enum><text>the nature and cost of the action needed; and</text></subparagraph><subparagraph commented="no" id="ide7710716dd6a470cb28418c016b20331"><enum>(B)</enum><text>the overall financial resources of the air carrier.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ida9805ce2821046ac83621b27476e3789"><enum>(b)</enum><header>Technical assistance</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall ensure the availability and provision of appropriate technical assistance manuals to individuals and entities with rights or responsibilities under section 41705 of title 49, United States Code, as amended by subsection (c).</text></subsection><subsection id="id013C2344A0D84AA094028A5669B5E42D"><enum>(c)</enum><header>Clerical amendment</header><text>The chapter analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States Code, is amended by striking the item relating to section 41705 and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC3D366A0726B457CB63EEF0F4633E5D4"><toc><toc-entry bold="off" level="section">41705. Accessibility of air transportation for individuals with disabilities.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id2CEF5067FF4742BFBFFE6D13D41A2EE5"><enum>5.</enum><header>Standards</header><subsection id="iddf74324f1e9a4efe8cfcd036f4e12690"><enum>(a)</enum><header>Aircraft with new or amended type certificates</header><paragraph id="idfd402789688143c987ee67a9f7a16977"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of the enactment of this Act, the Access Board shall, in consultation with the Secretary, prescribe regulations setting forth the minimum standards to ensure that aircraft with type certificates under part 21 of title 14, Code of Federal Regulations, issued or amended after the date the regulations are issued, and related boarding and deplaning equipment, are accessible, in terms of design for, transportation of, and communication to, individuals with disabilities, including individuals who use wheelchairs.</text></paragraph><paragraph id="id476fb5691ece4f9ab6b758566ffae83a"><enum>(2)</enum><header>Covered aircraft, equipment, and features</header><text>The standards issued under paragraph (1) shall address, at a minimum—</text><subparagraph id="idD9644832B0CA4E92BCA47A3DA4A01590"><enum>(A)</enum><text>boarding and deplaning equipment, including ensuring that there is a route accessible for individuals with disabilities;</text></subparagraph><subparagraph id="idA423FB6D81FD4FFCB99CF72BA62D472F"><enum>(B)</enum><text>seating accommodations;</text></subparagraph><subparagraph id="id41E3B6023B774405881331986A07B0B9"><enum>(C)</enum><text>lavatories;</text></subparagraph><subparagraph id="idED3C9FA5600A42D882616029BC8BEDD9"><enum>(D)</enum><text>captioning and audio description of in-flight entertainment and captioning of any other aural communication;</text></subparagraph><subparagraph id="id2AE84CFBEFD94A3FA95BF7CFC1A5E90A"><enum>(E)</enum><text>individual video displays;</text></subparagraph><subparagraph id="id2F70EEDD42BB4E838DA8F589A5A40E6F"><enum>(F)</enum><text>visually and tactilely accessible announcements;</text></subparagraph><subparagraph id="id4F1ABD162FCF4C73BC286A0564178D5E"><enum>(G)</enum><text>adequate in-cabin stowage for assistive devices; and</text></subparagraph><subparagraph id="idE7CBC67A9C2E469B9E43F1F9E1417160"><enum>(H)</enum><text>proper stowage of assistive devices in the cargo hold to prevent damage.</text></subparagraph></paragraph></subsection><subsection id="id210e3e82299c401985f45a934f3c3cea"><enum>(b)</enum><header>Aircraft with an existing type certificate</header><paragraph id="idc387a91409524d06b640a658a066cd58"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Access Board shall, in consultation with the Secretary, prescribe regulations setting forth minimum standards to ensure that barriers to the access of individuals with disabilities, including individuals who use wheelchairs, on aircraft with type certificates issued under part 21 of title 14, Code of Federal Regulations, before such date of enactment, are removed to meet basic accessibility needs of individuals with disabilities to the extent readily achievable.</text></paragraph><paragraph id="id3e6dc0f95cda41b1bb4abc571ba74f42"><enum>(2)</enum><header>Removal of barriers</header><text>The standards issued under paragraph (1) shall apply at a minimum to stowage of wheelchairs in the cargo hold, captioning and audio description of in-flight entertainment and captioning of any other aural communication, visually and tactilely accessible announcements, individual video displays, and improved access to seating and lavatories in all aircraft.</text></paragraph></subsection><subsection id="id424502190695470884b4b63c7cc3b782"><enum>(c)</enum><header>Airport facilities</header><text>Not later than 1 year after the date of the enactment of this Act, the Access Board shall, in consultation with the Secretary, issue standards under section 41705 of title 49, United States Code (commonly known as the <quote>Air Carrier Access Act</quote>), that ensure all gates (including counters), ticketing areas, and customer service desks covered under such section at airports are accessible to and usable by all individuals with disabilities, including through the provision of visually and tactilely accessible announcements and full and equal access to aural communications.</text></subsection><subsection id="idc1a6e7aebbd64b4aa99ad456080386a2"><enum>(d)</enum><header>Websites and kiosks</header><text>Not later than 1 year after the date of the enactment of this Act, the Access Board shall, in consultation with the Secretary, prescribe regulations setting forth minimum standards to ensure that individuals with disabilities are able to access kiosks and websites in a manner that is equally as effective as individuals without disabilities, with a substantially equivalent ease of use. Such standards shall be consistent with the standards set forth in the Web Content Accessibility Guidelines 2.0 Level AA of the Web Accessibility Initiative of the World Wide Web Consortium or any subsequent version.</text></subsection><subsection id="id84d13a2885cc42c183c870e7a9761d9b"><enum>(e)</enum><header>Regulations</header><text>Not later than 180 days after the Access Board issues standards under this section, the Secretary shall prescribe such regulations as are necessary to implement those standards, including the requirement to maintain accessible features of aircraft, equipment, and facilities.</text></subsection></section></legis-body></bill>
