which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Natural Gas Act to require the Federal Energy Regulatory Commission to consider certain factors in issuing certificates of public convenience and necessity under that Act, to modify the requirements for the right to exercise eminent domain in construction of pipelines under that Act, to provide that the right of eminent domain may not be exercised under that Act for projects for the exportation of natural gas, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Landowner Fairness Act</short-title></quote>.</text></section><section id="id7115EA381773408292375722825733C9"><enum>2.</enum><header>No presumption of public interest</header><text display-inline="no-display-inline">Section 3 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717b">15 U.S.C. 717b</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id825650F3E3B54EBAB0B7C249E757E91C"><subsection id="id335F243BFA184F4D9B00EDBE19996D67"><enum>(g)</enum><header>No presumption of public interest</header><text>In determining whether a proposed exportation of natural gas is consistent with the public interest under subsection (a), the Commission, and any other Federal agency that may be involved in the determination, shall not make a presumption that the exportation is consistent with the public interest.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id61bc90b6c6f043789495e1b69a4580a2"><enum>3.</enum><header>Balancing considerations of public necessity</header><text display-inline="no-display-inline">Section 7(e) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f(e)</external-xref>) is amended—</text><paragraph id="idE67E47002AD1454897A3FE31D55DBC21"><enum>(1)</enum><text>in the second sentence, by striking <quote>The Commission</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id32A36C513D014EDA85EC6239C8BD23D7"><paragraph id="id3F208C7C301C4D34987C5632DBE95DE6"><enum>(2)</enum><header>Terms and conditions</header><text>The Commission</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id8A080A5AF5D64CA2BD45DA6FAC3D71E0"><enum>(2)</enum><text>by striking <quote>(e) Except</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCDB0DDC445BE4C42960F6438E4F2763C"><subsection id="id18A818C642EE4E4882FA7DB7AC864889"><enum>(e)</enum><header>Procedure</header><paragraph id="id4A5AEF31E13D46C5AABE0E03CA7214CE"><enum>(1)</enum><header>In general</header><text>Except</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id2203F1908514448EBA9797864110594F"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id523BE67DA45B47769DB9603478F54AE1"><paragraph id="idB3636D878FE44906B81E44220348EB19"><enum>(3)</enum><header>Factors for consideration</header><text display-inline="yes-display-inline">In determining whether a proposed project is or will be required by the present or future public convenience and necessity under paragraph (1), the Commission shall make findings of fact, based on the evidence in the record before the Commission, regarding, at a minimum— </text><subparagraph id="idD2CDE57E78034E0BBE7AD39106AB294C"><enum>(A)</enum><text display-inline="yes-display-inline">the private property rights of any impacted landowners, including viable alternatives to eminent domain proceedings;</text></subparagraph><subparagraph id="idA2D16740555F4012884CF5EC15108C43"><enum>(B)</enum><text display-inline="yes-display-inline">whether the benefits of the project accrue substantially to the public at large, rather than to the applicant or a limited private interest; </text></subparagraph><subparagraph id="idF51184E8282440298314F8348DB2633E"><enum>(C)</enum><text display-inline="yes-display-inline">the practicability of alternatives and substitutes to the project, including whether there exists available capacity of—</text><clause id="id0DF6C911AD634D84AAB6797579E434A5"><enum>(i)</enum><text display-inline="yes-display-inline">natural gas in a similar project; or </text></clause><clause id="id700D38289ACE4FC19D1AD7A2134BEE01"><enum>(ii)</enum><text display-inline="yes-display-inline">a substitute to natural gas;</text></clause></subparagraph><subparagraph id="id84CDD19D747848549CD3F5238DB350F9"><enum>(D)</enum><text display-inline="yes-display-inline">any wildlife and ecological impacts of the project, including impacts recognized in the States and local jurisdictions in which the project is proposed to be located; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id86EAF4CEB60A4590B1C89B3302689057"><enum>(E)</enum><text display-inline="yes-display-inline">the net noxious chemical and greenhouse gas emissions that the project would emit or offset during the course of the construction and service life of the project; and</text></subparagraph><subparagraph id="idad1b50b7d2dc4348a98a536e2b9878ed"><enum>(F)</enum><text>the extent to which the project increases environmental and health burdens to low-income communities and communities of color. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idedc732db342049b4ae9ae609cb488b2d"><enum>4.</enum><header>Notice to landowners</header><subsection id="idAFCF271E58974584A59652FED06F4E42"><enum>(a)</enum><header>Initial notice to affected landowners</header><text display-inline="yes-display-inline">Section 7(d) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f(d)</external-xref>) is amended—</text><paragraph id="idA7505BE78AF248CA98957952B93607BA"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(d) Application for certificates</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD1FF20066EBF4146BB49A0A7C30C33A2"><subsection id="id8AA4426BAB2E42A99F471DA85238E0BE"><enum>(d)</enum><header>Applications</header><paragraph id="idB3E18346C9704F4786A9B393627FE313"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An application for a certificate of public convenience and necessity under this section</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id65ABC5F322BC45B1B485038199C5DFAF"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFA6BECE4B89E4751A5D1AF6A6B130A5F"><paragraph id="idA1BFAB77B6504E6F87BAB44C7E954338"><enum>(2)</enum><header>Requirements for notice</header><subparagraph id="idD36D02EE5A604C5A823AA0D20C62E0FC"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Before serving a notice described in paragraph (1), the applicant shall submit the notice to the Commission for review and approval.</text></subparagraph><subparagraph id="idBC88F3BC5C2940A08FBD49876D060E01"><enum>(B)</enum><header>Approval</header><text display-inline="yes-display-inline">The Commission shall only approve a notice under subparagraph (A) if the notice satisfies all applicable requirements of this section.</text></subparagraph><subparagraph id="id271313514D8349F89860E0FFDB098994"><enum>(C)</enum><header>Instructions for motions to intervene</header><text display-inline="yes-display-inline">A notice described in paragraph (1) shall include complete instructions regarding the method by which a notice recipient can move to intervene, through electronic or paper filing, in the application process, including—</text><clause id="idad38c35d70a140f3a66092efecdd98e6"><enum>(i)</enum><text>a clear statement of the required contents of such a motion to intervene;</text></clause><clause id="idc5ae9fabcec941a8901e81e345c6fbdd"><enum>(ii)</enum><text>a separate, bolded section informing notice recipients that the notice recipients must intervene in the application process to preserve the right to judicial review; and</text></clause><clause id="id9d3c53becf01401486fed9ec0dd3ebe5"><enum>(iii)</enum><text>the deadline for moving to intervene, which shall be not later than the date that is 60 days after the date on which the notice recipient is confirmed to have received the notice.</text></clause></subparagraph><subparagraph id="id963218C2578743F69079BFE3EAA4E954"><enum>(D)</enum><header>Requirement</header><text>The applicant shall submit to the Commission, together with the notice under subparagraph (A), a list of all persons to whom the applicant is required to serve the notice, including—</text><clause id="id890386E6AEBC4B7395A86E4929AE70DF"><enum>(i)</enum><text>the address of each such person; and </text></clause><clause id="id69F23AB41CB14BF6B1EA28F5C89D1BC5"><enum>(ii)</enum><text>after receipt of the notice by each such person, confirmation of receipt of the notice. </text></clause></subparagraph><subparagraph id="id4871CAC15411402AAC4E990C55B8AE2B"><enum>(E)</enum><header>Disclosure</header><text>On request by any person, not later than 15 days after the date of receipt of the request, the Commission shall disclose to that person the list submitted under subparagraph (D).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id007c36b9702544238aa4a2b5725119dd"><enum>(b)</enum><header>Subsequent notice to affected landowners</header><text>Section 7(e) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f(e)</external-xref>) (as amended by section 3) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0BE293E3907E46688A469AE29B6F4C02"><paragraph id="id3B13CB3474E94EAFBC40543F47430DD0"><enum>(4)</enum><header>Rehearing notice requirement</header><subparagraph id="id93D3BD69CC384CABB2472512FE359EE0"><enum>(A)</enum><header>In general</header><text>Not later than 15 days after the date on which a certificate of public convenience and necessity is issued under paragraph (1), the holder of the certificate of public convenience and necessity shall serve to all persons that received notice under subsection (d) an actual notice of the decision of the Commission to issue the certificate of public convenience and necessity. </text></subparagraph><subparagraph id="id2F92B7B03D914C59B2CCE4A6DB937CD9"><enum>(B)</enum><header>Contents</header><text>A notice under subparagraph (A) shall include complete instructions regarding the method by which a notice recipient can petition for a rehearing of the decision of the Commission to issue the certificate of public convenience and necessity, including—</text><clause id="idb7a26f6a56f14414bd2e7b9a5fdcbcbd"><enum>(i)</enum><text>the required contents of a petition for rehearing;</text></clause><clause commented="no" id="id7CC78B736737429DA8556DF578727507"><enum>(ii)</enum><text>a separate, bolded section informing notice recipients that the notice recipients must petition for a rehearing on an issue covered by the certificate to preserve the right to judicial review on that issue; and</text></clause><clause id="id833a04fa898c40118c6e6b1183fa6496"><enum>(iii)</enum><text>information regarding the requirements for rehearing and judicial review under subsections (a) and (b) of section 19 that apply to the petition for rehearing, including a specific reference to any relevant deadlines applicable to the petition.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id01b8a5153bcb42f5890891a5c2591c73"><enum>5.</enum><header>Requirements for exercise of eminent domain</header><subsection id="id12BBFDC0D9B245E89ADA6E254744167F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7(h) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f(h)</external-xref>) is amended—</text><paragraph id="idB5E946897771441B86BEE4B28403E919"><enum>(1)</enum><text>in the second sentence—</text><subparagraph id="id0A03A7F622194AB98311A3147797650E"><enum>(A)</enum><text>by striking <quote>where the property is situated: <italic>Provided, </italic>That the</quote> and inserting <quote>in which the property is situated, subject to the condition that the</quote>; and</text></subparagraph><subparagraph id="id11A9AA8E3C4D4AEE8E9BD85B133F8606"><enum>(B)</enum><text>by striking <quote>The practice</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA6F71F90F3D5402A95C74A9DF910211D"><paragraph id="id3B516244DF5748F69D7493AAD84EFA11"><enum>(2)</enum><header>Practice and procedure</header><text>The practice</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idEB860CE624F04CECB6958899C88D871E"><enum>(2)</enum><text>by striking <quote>(h) When any holder</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4EC0CF7E603A44759E35F94EC6482255"><subsection id="id659EB85BAC7C45D4BE07647BE01162BD"><enum>(h)</enum><header>Eminent domain</header><paragraph id="idC334D801F05A4C1AACC312AFE71F4A1E"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (4), in any case in which a holder</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id8839098C05ED41AC820588C3457C5AD3"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8FEC7D2572764515834CCFE0A9F045E5"><paragraph id="id63c3a3cfecec45ca94bfbabb19cce13a"><enum>(3)</enum><header>Requirements</header><subparagraph id="idD242084E6B1C45E88B40B502417F10E2"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), a holder of a certificate of public convenience and necessity may not exercise the right of eminent domain for a project under this subsection until the latest of, as applicable—</text><clause id="id720FDA8D368F4DAF8954FC6979BC893D"><enum>(i)</enum><text>the date on which the holder has received all required certifications and authorizations for the project from any Federal agencies (other than the Commission) or State administrative agencies acting pursuant to Federal law; </text></clause><clause commented="no" display-inline="no-display-inline" id="id3C63124EF00B42E9A115BD6EFF9F1A09"><enum>(ii)</enum><text display-inline="yes-display-inline">the date on which the applicant serves each notice in accordance with subsection (e)(4); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idEBF96DF58ED84D6C9DF2D62E6F54DF78"><enum>(iii)</enum><text>the date on which each timely motion to intervene relating to the certificate under subsection (d)(2)(C) has been acted on by the Commission.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD4B33EA61C7F4099BAC48C9D09FCBFA7"><enum>(B)</enum><header>Effect of vacated or rescinded certification or authorization</header><text>If a certification or authorization for a project from any Federal agency (other than the Commission) or State administrative agency acting pursuant to Federal law is rescinded or vacated—</text><clause commented="no" display-inline="no-display-inline" id="id40A7DD1135BD42C6B39A0CBF7DC40C60"><enum>(i)</enum><text>the holder of a certificate of public convenience and necessity for the project may not exercise the right of eminent domain for the project under this subsection; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id36C30AD951A54099ADDDEF1CCC2D1E00"><enum>(ii)</enum><text>if land has already been acquired by the exercise of the right of eminent domain under this subsection, construction of the project on that land shall be prohibited.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="iddd89314859ea4c209e208b2aac831f90"><enum>(b)</enum><header>Limitation on use of eminent domain for exports</header><text display-inline="yes-display-inline">Section 7(h) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f(h)</external-xref>) (as amended by subsection (a)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1ef8e6e56f06465db5c2581dc91da074"><paragraph id="ida4a30a3d05e84cf281420528b1583658"><enum>(4)</enum><header>Limitation on use of eminent domain for exports</header><text>A holder of a certificate of public convenience and necessity may not exercise the right of eminent domain under this subsection if the project covered by the certificate is a project to be constructed substantially for the purpose of transporting natural gas to an LNG terminal for export from the United States to a foreign country.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="ided0c5ca9a55c4e89b3a7edc4f6be4dda"><enum>6.</enum><header>Requirement to execute project only for certain purposes</header><text display-inline="no-display-inline">Section 7 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5914F407C80C4E07838492F44B1B89C5"><subsection id="idC6E4453C31A74980A1E9DCE0A3007195"><enum>(i)</enum><header>Requirement To execute project only for certain purposes</header><text display-inline="yes-display-inline">The holder of a certificate of public convenience and necessity shall execute the project covered by the certificate only for the purposes that were—</text><paragraph id="id98581BBC089548869F88B63E2D4AA2BF"><enum>(1)</enum><text display-inline="yes-display-inline">expressly described in the application for the certificate; and</text></paragraph><paragraph id="idAC0A91E1CB1542B5BCC1EFD0DCE8188E"><enum>(2)</enum><text display-inline="yes-display-inline">communicated to—</text><subparagraph id="idFF655CE90B164579B88C70ACC19AC78F"><enum>(A)</enum><text display-inline="yes-display-inline">the Commission;</text></subparagraph><subparagraph id="id954C2B0E369546A1A95D26B57186C98A"><enum>(B)</enum><text display-inline="yes-display-inline">the persons that received a notice of the application for the certificate under subsection (d); and</text></subparagraph><subparagraph id="id27B103CAA04F483EB61C09B6AA990F11"><enum>(C)</enum><text display-inline="yes-display-inline">the public.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idC9F54C7033184C43BD1D9FEE5AF8C519"><enum>7.</enum><header>Conditions under which certificate of public convenience and necessity may be rescinded</header><text display-inline="no-display-inline">Section 7 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f</external-xref>) (as amended by section 6) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBF372AC6917A41719E6BB0BCC8CE8843"><subsection id="idF064AAAC2D6D49AD8DDA552814D99A82"><enum>(j)</enum><header>Conditions under which certificate may be rescinded</header><paragraph id="id35E3E3F08ED84830A08D2E48110DA784"><enum>(1)</enum><header>In general</header><text>A certificate of public convenience and necessity shall be rescinded on a determination by the Commission, or on a determination after a rehearing, that— </text><subparagraph id="id3791D06B57A74E36ADE85ACDA8132D89"><enum>(A)</enum><text>the scope of the project covered by the certificate has changed materially;</text></subparagraph><subparagraph id="id7D6096A1F69948A8B430CAC63BC358C1"><enum>(B)</enum><text>the rationale of public convenience and necessity by which the Commission issued the certificate has changed; or</text></subparagraph><subparagraph id="id1c08f742dc834d5bb2f2cbd985d9458f"><enum>(C)</enum><text>the applicant has failed to begin substantial construction on the project covered by the certificate, such that the observed delay is not consistent with a prior finding of public convenience and necessity.</text></subparagraph></paragraph><paragraph id="id53F4377D78134ABEA64A46C1657A27F3"><enum>(2)</enum><header>Failure to initiate substantial construction</header><text>If the holder of a certificate of public convenience and necessity fails to initiate substantial construction of the project covered by the certificate by the date specified by the certificate, the certificate shall be rescinded on that date.</text></paragraph><paragraph id="id70323F6A7ABA4550BA4FA0D180AD70D0"><enum>(3)</enum><header>Reapplication</header><text>The holder of a certificate of public convenience and necessity rescinded under paragraph (1) or (2) may reapply for the certificate in accordance with the applicable requirements of this Act.</text></paragraph><paragraph id="idd5fe1e277add4f0f9b502e129e9b1c30"><enum>(4)</enum><header>Requirement</header><text>Any certificate of public convenience and necessity that is issued by the Commission shall include the condition that title in and to any property that was acquired under subsection (h)(1) by the exercise of the right of eminent domain pursuant to a certificate of public convenience and necessity that was rescinded under paragraph (1) or (2) shall immediately revert to the prior property owner.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id081D1F284ACF448DA53EAE08EC1EBC0E"><enum>8.</enum><header>Requirements for acquisition of property</header><text display-inline="no-display-inline">Section 7 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f</external-xref>) (as amended by section 7) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id54A6CDA90E264A36884B92B9BD0D96C5"><subsection id="id7DEDCFE53A5549E390DF107BF66659A8"><enum>(k)</enum><header>Requirements for acquisition of property</header><paragraph commented="no" id="id7A80678E205E4DCE872E2A95978DF43A"><enum>(1)</enum><header>Appraisal</header><subparagraph commented="no" id="id5DDA8B8B79D441FCA9888C0F61675066"><enum>(A)</enum><header>In general</header><text>A holder of a certificate of public convenience and necessity seeking to acquire property for the project covered by the certificate by just compensation or the exercise of the right of eminent domain under subsection (h)(1) shall, prior to making an offer of just compensation or exercising that right, appraise the property in accordance with—</text><clause commented="no" id="idD3EB7A121CF34B66A3B01F2B9A25D2B7"><enum>(i)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and</text></clause><clause commented="no" id="id9F06B3BAE1D54DA8892D74217C8F14FA"><enum>(ii)</enum><text>the Uniform Standards of Professional Appraisal Practice.</text></clause></subparagraph><subparagraph commented="no" id="idDEFA97C1B5E940EBBE5662D85CB4FFFD"><enum>(B)</enum><header>Opportunity to accompany appraiser during inspection</header><text>The owner of any property subject to an appraisal under subparagraph (A), or the designated representative of the owner, shall be given an opportunity to accompany the appraiser during the inspection by the appraiser of the property.</text></subparagraph></paragraph><paragraph commented="no" id="id1CFDDAF9877F4F8997C9879DE5FEE8C9"><enum>(2)</enum><header>Just compensation</header><text>A holder of a certificate of public convenience and necessity seeking to acquire property for the project covered by the certificate by just compensation shall make the offer of just compensation—</text><subparagraph commented="no" id="id5724BD55D73F47FD88E6DE4F2B8F209A"><enum>(A)</enum><text>in writing; and</text></subparagraph><subparagraph commented="no" id="id625610549360482DB8E1A1FEAD3D058D"><enum>(B)</enum><text>in an amount that—</text><clause commented="no" id="id21DFCE26FFDF448BACABFE1E6F811DC5"><enum>(i)</enum><text>is not less than the fair market value of the property, as defined by the appraiser; and </text></clause><clause commented="no" id="idD0431E1B5D2F468296D9DBA5D1D17ABB"><enum>(ii)</enum><text>includes just compensation for any damages that would result to the remaining property of the owner. </text></clause></subparagraph></paragraph><paragraph commented="no" id="idB5BD2E45C69743D68CD7EE68DBE170F5"><enum>(3)</enum><header>Surrender of property</header><text>The owner of property to be acquired by a holder of a certificate of public convenience and necessity shall not be required to surrender possession of the property before, as applicable—</text><subparagraph commented="no" id="id4F45C1A1421C45C385E714D508241FBC"><enum>(A)</enum><text>the holder pays the agreed purchase price; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3FFA0B998558442CBD16D783F2F79CEF"><enum>(B)</enum><text>if the property is acquired through a proceeding under which the holder exercised the right of eminent domain under subsection (h)(1), the owner receives the compensation awarded by the court in that proceeding.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id136edabfb55b477686c8211c59b4c96e"><enum>9.</enum><header>Appeal rights to Federal Energy Regulatory Commission</header><subsection id="id9BA91D8BD62949FC849E0740F3D63E0C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 19(a) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717r">15 U.S.C. 717r(a)</external-xref>) is amended—</text><paragraph id="id79B9F9DB69C7482C8CC1572B3121AA94"><enum>(1)</enum><text>in the first sentence, by striking <quote>(a) Any person, State, municipality, or State commission aggrieved by an order issued by the Commission in a proceeding under this act to which such person, State, municipality, or State commission is a party may apply</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7E55C458E115497589B984C4F18BFB87"><subsection id="id9A048D1213784C1F842F19DA797B306E"><enum>(a)</enum><header>Rehearing</header><paragraph id="id11C07752808D42A2AC87A86A070EDE96"><enum>(1)</enum><header>Petitions for rehearing</header><subparagraph commented="no" display-inline="no-display-inline" id="idDD176003F7E442AC83B6B763ED6A83C5"><enum>(A)</enum><header>In general</header><text>Any person, State, municipality, or State commission that is aggrieved by an order issued by the Commission in a proceeding under this Act to which the person, State, municipality, or State commission is a party may petition</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id6cc763164efb4ed088275ef19f047b02"><enum>(2)</enum><text>by striking the second sentence and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida58c0d98cace4e1a8711da029a85e26e"><subparagraph id="id11cd4f0317f84ce99f89933349d1465b"><enum>(B)</enum><header>Limitation</header><text>No proceeding to review an order of the Commission shall be brought by a person unless the person has submitted to the Commission a petition for rehearing regarding the order in accordance with this paragraph.</text></subparagraph><subparagraph id="id4a04398360044f48b4017a60d470b53f"><enum>(C)</enum><header>Contents</header><text>A petition for rehearing under this paragraph shall describe specifically the one or more grounds on which the petition is based.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id361695e83d644caf8912d3d37a5a2265"><enum>(3)</enum><text>in the third sentence, by striking <quote>Upon such application</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id36ca504bb274459f9bf0ed666085201d"><paragraph id="id30fecd43b7b84e189f2ca804ee883116"><enum>(2)</enum><header>Action by commission</header><subparagraph id="id949110b5c0404517b924fdf7e586cb49"><enum>(A)</enum><header>In general</header><text>On receipt of a petition under paragraph (1),</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id7d4ec8d9b4434550a09deaf57599a5a6"><enum>(4)</enum><text>by striking the fourth and fifth sentences and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id710E7402B4104D8DBE219320F3264DC5"><subparagraph id="id0fc92518b5d344cc90c9cd65e99be9b4"><enum>(B)</enum><header>Effect of failure to act</header><text>In any case in which the Commission fails to issue a final agency action that is reviewable under subsection (b) with respect to a petition for rehearing by the date that is 60 days after the date on which the petition is filed, the petition shall be deemed to be denied.</text></subparagraph><after-quoted-block>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idBF8D2485318A4531A05FC4E3E89DA92E"><enum>(ii)</enum><text>the holder of a certificate of public convenience and necessity issued pursuant to the order may not exercise the right of eminent domain under section 7(h). </text></clause></subparagraph></paragraph><paragraph id="id1FB881FCFDBD4EFD84D772F261876969"><enum>(3)</enum><header>Effect of denial of rehearing</header><text>If the Commission denies a petition for rehearing or fails to act on the petition for rehearing by the deadline described in subsection (a)(2)(B), the order that is the subject of the petition shall be deemed to be final for all purposes.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idFA258C6BE8B0421CB84182EECE0C9D20"><enum>(c)</enum><header>Technical amendments</header><text>Section 19(b) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717r">15 U.S.C. 717r(b)</external-xref>) is amended—</text><paragraph id="id987687995E184681924F04DD17360ECC"><enum>(1)</enum><text>by striking <quote>application</quote> each place it appears and inserting <quote>petition</quote>; and</text></paragraph><paragraph id="id93E34104E6BB4A3D8C53447300424C0D"><enum>(2)</enum><text>by striking <quote>such petition</quote> each place it appears and inserting <quote>the written petition praying that the order of the Commission be modified or set aside in whole or in part</quote>.</text></paragraph></subsection></section></legis-body></bill>
