<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 640</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210309">March 9, 2021</action-date><action-desc><sponsor name-id="S311">Ms. Klobuchar</sponsor> (for herself and <cosponsor name-id="S252">Ms. Collins</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSRA00">Committee on Rules and Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide grants to support continuing education in election administration or cybersecurity for election officials and employees.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Invest in Our Democracy Act of 2021</short-title></quote>.</text></section><section id="id8A1CF7B3F19A4234A5C5CA576CB084AF"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id20eb41a16009457a99aeb84f9753f295"><enum>(1)</enum><text>free and fair elections are central to our democracy;</text></paragraph><paragraph id="ide748890760944f69841df72088aea969"><enum>(2)</enum><text>protecting our elections from foreign adversaries is a national security priority;</text></paragraph><paragraph id="id7ebbdd4bccda43049e98e36c82f4ada0"><enum>(3)</enum><text>the States conduct elections and it is important to maintain State leadership in election administration;</text></paragraph><paragraph id="iddc14023ec3e0429bbf733f1909e73122"><enum>(4)</enum><text>the States deserve Federal support to secure our elections from interference by foreign nations; and</text></paragraph><paragraph id="idbd957e1c53624e95986cafe26bdee238"><enum>(5)</enum><text>election security in the United States will benefit from continued education and investment in the individuals that administer our elections.</text></paragraph></section><section id="idB8443E41342F403FB8B11188C002BD44"><enum>3.</enum><header>Supporting continuing education for election officials and employees</header><subsection id="id0A34146965344078835F9C1A90BC32FD"><enum>(a)</enum><header>Program authority and method of distribution</header><text>The Election Assistance Commission (in this section referred to as the <quote>Commission</quote>) shall establish a program under which the Commission pays to each eligible institution such sums as may be necessary to pay to each eligible certificate program enrollee (as defined in subsection (b)) for each academic year during which that enrollee is enrolled in an accredited certificate program in election administration or cybersecurity in the amount for which that enrollee is eligible, as determined pursuant to subsection (c). Not less than 85 percent of such sums shall be advanced to eligible institutions prior to the start of each payment period and shall be based upon an amount requested by the institution as needed to pay eligible certificate program enrollees until such time as the Commission determines an alternative payment system that provides payments to institutions in an accurate and timely manner, except that this sentence shall not be construed to limit the authority of the Commission to place an institution on a reimbursement system of payment.</text></subsection><subsection id="id047DB9BF145D40BB9CDA417FE13A8431"><enum>(b)</enum><header>Eligible certificate program enrollee</header><text>In this section, the term <term>eligible certificate program enrollee</term> means an individual who—</text><paragraph id="id5174CF6A858044998A56C593D6C9DCCA"><enum>(1)</enum><text>is a State or local election official, an employee of a State or local election official, or an employee of the Commission;</text></paragraph><paragraph id="idB2251802237846C4B15B301E3F8F241D"><enum>(2)</enum><text>certifies to the Commission their enrollment in an accredited certificate program in election administration or cybersecurity; and</text></paragraph><paragraph id="id280F0E9C93BC480993BA789EC5E76575"><enum>(3)</enum><text>submits to the Commission—</text><subparagraph id="id1214CD2D8CBB4547BB05DB6A5C82D50B"><enum>(A)</enum><text>a receipt or other verification determined appropriate by the Commission of the tuition amount for such certificate program; and</text></subparagraph><subparagraph id="id0CB8E3D39C484FC39104B1D1CE98EFC5"><enum>(B)</enum><text>an application at such time, in such manner, and containing such information as the Commission may require.</text></subparagraph></paragraph></subsection><subsection id="id6DBEE24B991F4861AF5B3C6F431DD91E"><enum>(c)</enum><header>Amount of grants</header><text>The amount of a grant for an eligible certificate program enrollee under this section for a year shall be an amount equal to 75 percent of the tuition amount for the accredited certificate program in election administration or cybersecurity for the year.</text></subsection><subsection id="id8BCFCA935A1E44DBB47156690C724AB0"><enum>(d)</enum><header>Additional definitions</header><text>In this section:</text><paragraph id="id0C5A21E8723F4C58A181E2160CECBE21"><enum>(1)</enum><header>Accredited certificate program in election administration or cybersecurity</header><text>The term <term>accredited certificate program in election administration or cybersecurity</term> means a program in election administration or cybersecurity that leads to a certificate, or other nondegree recognized credential, at an eligible institution.</text></paragraph><paragraph id="idBE0A53E1D8784F38995611EFEEAA5100"><enum>(2)</enum><header>Eligible institution</header><text>The term <term>eligible institution</term> means an institution of higher education (as defined under section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) that—</text><subparagraph id="id31D972BE28AA4EA3A9A6A0759AFB11AD"><enum>(A)</enum><text>offers an accredited certificate program in election administration or cybersecurity; and</text></subparagraph><subparagraph id="idB76DCDB0AD4A48A6AAAED349ACE8DB20"><enum>(B)</enum><text>elects to participate in the program established under this section.</text></subparagraph></paragraph></subsection><subsection id="id743264A80F184B1DBEF121D5E4BF0129"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section—</text><paragraph id="id6F39450FBD284914AA168698663BFDE3"><enum>(1)</enum><text>$1,000,000 for fiscal year 2023; and</text></paragraph><paragraph id="id3799D078F5B04977B96473033C5F77D6"><enum>(2)</enum><text>such sums as may be necessary for each of fiscal years 2024 through 2030.</text></paragraph></subsection></section></legis-body></bill>
