which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish an Office of Emerging Markets within the Small Business Administration that will strengthen the development of small business concerns in emerging markets, including those owned by women, minorities, veterans, and those located in rural areas, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unlocking Opportunities in Emerging Markets Act of 2021</short-title></quote>.</text></section><section id="id3879C4875E8F4F80AAB75BE192FF0277"><enum>2.</enum><header>Office of Emerging Markets</header><text display-inline="no-display-inline">Section 7 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0A8E6587C346483B9C3574F6447A79E8"><subsection id="id2534A4F5D85648C9ABEEDC9DAE15774E"><enum>(o)</enum><header>Office of Emerging Markets</header><paragraph id="id652C3088AE0544738B0D90FFADA54F5E"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="id85a44b192ee9457eaa98d1b8e3a9d6aa"><enum>(A)</enum><text>the term <term>Associate Administrator</term> means the Associate Administrator of the Office of Capital Access of the Administration;</text></subparagraph><subparagraph id="idc36e2cedb2664cc099b8894d4ceaaa90"><enum>(B)</enum><text>the term <term>Director</term> means the Director of the Office of Emerging Markets;</text></subparagraph><subparagraph id="id6a802d7bd9dd4677a72aca3afa8c2e25"><enum>(C)</enum><text>the term <term>microloan program</term> means the program described in subsection (m);</text></subparagraph><subparagraph id="id8c31e1d0ac744c71806c54b535a4f4a2"><enum>(D)</enum><text>the term <term>Reservist</term> means a member of a reserve component of the Armed Forces named in section 10101 of title 10, United States Code;</text></subparagraph><subparagraph id="id1e257b7e8b02466ea35593521967de33"><enum>(E)</enum><text>the term <term>rural area</term> has the meaning given the term in subsection (m)(11);</text></subparagraph><subparagraph id="id06a3d19777a84054a4e0e2ea7d3c4b7d"><enum>(F)</enum><text>the term <term>service-connected</term> has the meaning given the term in section 101 of title 38, United States Code; and</text></subparagraph><subparagraph id="idc8b74bcfed9d459aae0acaecd5f15575"><enum>(G)</enum><text>the term <term>small business concern in an emerging market</term> means a small business concern—</text><clause id="ide79fbfa844cf410792c8c2ad6fd3062b"><enum>(i)</enum><text>that is located in—</text><subclause id="ida9efbe8e10c644689971c4ee3b2f941a"><enum>(I)</enum><text>a low-income or moderate-income area for purposes of the Community Development Block Grant Program under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301</external-xref> et seq.);</text></subclause><subclause id="id71b77393e4a847888e7be7e3dee1936a"><enum>(II)</enum><text>a HUBZone, as that term is defined in section 31(b);</text></subclause><subclause id="id501213a9f5da4341890bac022da823cc"><enum>(III)</enum><text>a community that has been designated as an empowerment zone or an enterprise community under <external-xref legal-doc="usc" parsable-cite="usc/26/1391">section 1391</external-xref> of the Internal Revenue Code of 1986;</text></subclause><subclause id="id7d551a0fb2f344af8317c1b5f46a5475"><enum>(IV)</enum><text>a community that has been designated as a Promise Zone by the Secretary of Housing and Urban Development;</text></subclause><subclause id="id7ce2e155273b4bd3bc417cb0ca661a66"><enum>(V)</enum><text>a community that has been designated as a qualified opportunity zone under <external-xref legal-doc="usc" parsable-cite="usc/26/1400Z">section 1400Z–1</external-xref> of the Internal Revenue Code of 1986; or</text></subclause><subclause id="id99735f407b034fbc98b2f5686077db74"><enum>(VI)</enum><text>a rural area;</text></subclause></clause><clause id="id8074a7bb5dbb41cc8ab8709987184afd"><enum>(ii)</enum><text>that has more than 50 percent of employees residing in a low- or moderate-income community;</text></clause><clause id="id5f3c5a8fd0834603bd63fb34ca0d9ae2"><enum>(iii)</enum><text>that is growing, newly established, or a startup, as those terms are used in subsection (m);</text></clause><clause id="ide5ff113c6d244176bddf42d82333f126"><enum>(iv)</enum><text>owned and controlled by socially and economically disadvantaged individuals, including Black Americans, Hispanic Americans, Native Americans, Asian Pacific Americans, and other minorities;</text></clause><clause id="idae01f932f1234aa586094893a7af7705"><enum>(v)</enum><text>owned and controlled by women;</text></clause><clause id="id027a9c201d19402bb49e3ae36e68a2ff"><enum>(vi)</enum><text>owned and controlled by veterans;</text></clause><clause id="id18025f0ee6374a6fa640869f832f9de3"><enum>(vii)</enum><text>owned and controlled by service-disabled veterans; or</text></clause><clause id="idd06a2451cf884ecf9efd6f6d6ffc5e44"><enum>(viii)</enum><text>not less than 51 percent owned and controlled by one or more—</text><subclause id="id741012cc1ff843558f9947e6b49c2e67"><enum>(I)</enum><text>members of the Armed Forces participating in the Transition Assistance Program of the Department of Defense;</text></subclause><subclause id="id7c047d73540f4fdd992ee6cf72094b11"><enum>(II)</enum><text>Reservists;</text></subclause><subclause id="idc97197bdd4e14658b60585fad7f270e5"><enum>(III)</enum><text>spouses of veterans, members of the Armed Forces, or Reservists;</text></subclause><subclause id="idf063edab145340a78b473da8a01e4da8"><enum>(IV)</enum><text>surviving spouses of veterans who died on active duty or as a result of a service-connected disability; or</text></subclause><subclause id="id5F2AD7D3E2FE41C584004EB03E4A3BD2"><enum>(V)</enum><text>individuals with a disability, as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></subclause></clause></subparagraph></paragraph><paragraph id="idE6E084A7453D48BBA02029BBCD06533D"><enum>(2)</enum><header>Establishment</header><text>There is established within the Administration the Office of Emerging Markets, which shall be—</text><subparagraph id="id888E51443C9E4A52949826F5D6E0E7B8"><enum>(A)</enum><text>under the general management and oversight of the Administration; and</text></subparagraph><subparagraph id="id68999F40DABD47709028696CF884AD6F"><enum>(B)</enum><text>responsible for the planning, coordination, implementation, evaluation, and improvement of the efforts of the Administrator to enhance the economic well-being of small business concerns in an emerging market.</text></subparagraph></paragraph><paragraph id="id603d15557e9c4fb08065f4e1891c1045"><enum>(3)</enum><header>Director</header><subparagraph id="id68CF7595EC524B4EB58EE7BC81FDBBB3"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of the <short-title>Unlocking Opportunities in Emerging Markets Act of 2021</short-title>, the Administrator shall appoint a Director of the Office of Emerging Markets, who shall—</text><clause id="id26A647982E43402485D3C5C5DF35E7B8"><enum>(i)</enum><text>supervise the Office of Emerging Markets and report to the Associate Administrator; and</text></clause><clause id="idD1509DA889B14908BE76A753749EDE60"><enum>(ii)</enum><text>be in the Senior Executive Service.</text></clause></subparagraph><subparagraph id="id411b1d98868e44f5843aab160e7b4adb"><enum>(B)</enum><header>Duties</header><text>The Director shall—</text><clause id="id60A0345057DC4249A2A78A85AAD122F0"><enum>(i)</enum><text>create and implement strategies and programs that provide an integrated approach to the development of small business concerns in an emerging market;</text></clause><clause id="idf3265e4322f0473eab9e457096d515a1"><enum>(ii)</enum><text>develop and recommend policies concerning the microloan program and any other access to capital program of the Administration, as such programs pertain to small business concerns in an emerging market;</text></clause><clause id="id3fcbe96349e646f1b89fef9f04dc0fae"><enum>(iii)</enum><text>establish partnerships to advance the goal of improving the economic success of small business concerns in an emerging market; and</text></clause><clause id="id61b85f0946844d71b34094f3f8d04eb1"><enum>(iv)</enum><text>review the effectiveness and impact of the microloan program and any other access to capital program of the Administration that is targeted to serve small business concerns in an emerging market.</text></clause></subparagraph><subparagraph id="id84db75adf2ce44a0916f2643bd749fbf"><enum>(C)</enum><header>Consultation</header><text>In carrying out the duties under this paragraph, the Director shall consult with district offices of the Administration.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
