which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, to improve the transportation alternatives program, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transportation Alternatives Enhancements Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="idF62AB0A25FDA426E8F34EB3573FD1BD4"><enum>2.</enum><header>Transportation alternatives program</header><subsection id="id9EFFD3C540AE434081228185859419A0"><enum>(a)</enum><header>Set-Aside</header><text display-inline="yes-display-inline">Section 133(h)(1) of title 23, United States Code, is amended—</text><paragraph id="id758000023BA04C59A795517E44AAC868"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">Reservation of funds</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">In general</header-in-text></quote>; and</text></paragraph><paragraph id="idA297DFDA2D114BBF87567A0B6B44E817"><enum>(2)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>for each fiscal year</quote> and all that follows through the period at the end of subparagraph (B)(ii) and inserting <quote>for fiscal year 2022 and each fiscal year thereafter, the Secretary shall set aside an amount equal to 10 percent to carry out this subsection.</quote>.</text></paragraph></subsection><subsection id="id6799E01116414B25AC385C942D1323B1"><enum>(b)</enum><header>Allocation</header><text>Section 133(h) of title 23, United States Code, is amended by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA4CE26D6A59747A582E6E8F7E5A32523"><paragraph id="id7FFFB4B5460E4CEDA120BE42FD590F79"><enum>(2)</enum><header>Allocation within a State</header><subparagraph id="id67F7919CE62246098D753887FFD7883B"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), funds set aside for a State under paragraph (1) shall be obligated within that State in the manner described in subsection (d), except that, for purposes of this paragraph (after funds are made available under paragraph (5))—</text><clause id="id65344244EBF649CB86EEDEAFABF25E73"><enum>(i)</enum><text>for fiscal year 2022 and each fiscal year thereafter, the percentage referred to in paragraph (1)(A) of that subsection shall be deemed to be 66 percent; and</text></clause><clause id="id1BCFE9BAB9E140279EAD6A419BC0BE49"><enum>(ii)</enum><text>paragraph (3) of subsection (d) shall not apply.</text></clause></subparagraph><subparagraph id="id14AC753B9E72406EA727BE2F95333E73"><enum>(B)</enum><header>Local control</header><text>A State may allocate up to 100 percent of the funds referred to in subparagraph (A)(i) if—</text><clause id="idEC6D3F991F424E178130726EB96CA695"><enum>(i)</enum><text>the State submits to the Secretary a plan that describes—</text><subclause id="idc9e367f5044544ce99427f56dacc51ca"><enum>(I)</enum><text>how funds will be allocated to counties, metropolitan planning organizations, regional transportation planning organizations as described in section 135(m), or local governments;</text></subclause><subclause id="ida13a1c6b3d444f47abbb347a84444e41"><enum>(II)</enum><text>how the entities described in subclause (I) will carry out a competitive process to select projects for funding and report selected projects to the State;</text></subclause><subclause id="id942b58ed3015483f83606af7196b97e0"><enum>(III)</enum><text>how input was gathered from the entities described in subclause (I) to ensure those entities are able and willing to comply with the requirements of this subsection; and</text></subclause><subclause id="id622b2f607b88485ca7608c2791d94b90"><enum>(IV)</enum><text>how the State will comply with paragraph (8); and</text></subclause></clause><clause id="id6E20D1CC894E44AB8FC1123BE6273769"><enum>(ii)</enum><text>the Secretary approves the plan submitted under clause (i).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id3CD561BE2B9E43B880F5FC087C2DEFE5"><enum>(c)</enum><header>Eligible projects</header><text>Section 133(h)(3) of title 23, United States Code, is amended by striking <quote>reserved</quote> and inserting <quote>set aside</quote>.</text></subsection><subsection id="idE0D902884FF74180A2C6F0AA005E19BD"><enum>(d)</enum><header>Access to funds</header><text>Section 133(h)(4) of title 23, United States Code, is amended—</text><paragraph id="idFE4D8454CEB54DAD99F95460F037A2E8"><enum>(1)</enum><text>by striking subparagraph (A);</text></paragraph><paragraph id="id929DFA6B73C142C4AACE2D16E2EE31C1"><enum>(2)</enum><text>by redesignating subparagraph (B) as subparagraph (A); </text></paragraph><paragraph id="id93387A337EF64EEB8E04BEAD2B20D94B"><enum>(3)</enum><text>in subparagraph (A) (as so redesignated)—</text><subparagraph id="id58EB2EDAA65D49E1B9414AC7C0DB8A28"><enum>(A)</enum><text>by redesignating clauses (vii) and (viii) as clauses (viii) and (ix), respectively;</text></subparagraph><subparagraph id="idFFFBE9AF9BA0453F8881BEB144C0FE51"><enum>(B)</enum><text>by inserting after clause (vi) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF93D05236BC8432EB22B2AA3C04F39EE"><clause id="idB59B0C518F3D4DCBAECEE3907A048AC8"><enum>(vii)</enum><text>a metropolitan planning organization that serves an urbanized area with a population of 200,000 or fewer;</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="id1CD8489768794E908520FE1D2C94F1D5"><enum>(C)</enum><text>in clause (viii) (as so redesignated), by striking <quote>responsible</quote> and all that follows through <quote>programs</quote>; and</text></subparagraph><subparagraph id="idDB812B5F6A8C4D70A929DEA22E727633"><enum>(D)</enum><text>in clause (ix) (as so redesignated), by inserting <quote>that serves an urbanized area with a population of over 200,000</quote> after <quote>metropolitan planning organization</quote>; and</text></subparagraph></paragraph><paragraph id="idF713BCC8723E491197A55C5A74E4C732"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF4580C8F09D3448F8786BE9576FBD577"><subparagraph id="idC8E7EAB5EE304152B5EE53D5914DCCE3"><enum>(B)</enum><header>Competitive process</header><text>A State or metropolitan planning organization required to obligate funds in accordance with paragraph (2) shall develop a competitive process to allow eligible entities to submit projects for funding that achieve the objectives of this subsection. </text></subparagraph><subparagraph id="id93EA414C31E140599C8DAEA699C9E844"><enum>(C)</enum><header>Selection</header><text>A metropolitan planning organization for an area described in subsection (d)(1)(A)(i) shall select projects under the competitive process described in subparagraph (B) in consultation with the relevant State. </text></subparagraph><subparagraph id="idA2534A9A4A664F30A63536706334B645"><enum>(D)</enum><header>Prioritization</header><text>The competitive process described in subparagraph (B) shall include prioritization of project location and impact in high-need areas as defined by the State, such as low-income, transit-dependent, rural, or other areas.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idB70E8316C652463494D51653680DCAB6"><enum>(e)</enum><header>Continuation of certain recreational trails projects</header><text>Section 133(h)(5)(A) of title 23, United States Code, is amended by striking <quote>reserved under this section</quote> and inserting <quote>set aside under this subsection</quote>.</text></subsection><subsection id="id968FD0BAA9C94CC3861158CAB58D6738"><enum>(f)</enum><header>State flexibility</header><text>Section 133(h)(6) of title 23, United States Code, is amended—</text><paragraph id="id221A9521C0BC407EABBF3C83F5BF2328"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>reserved</quote> and inserting <quote>set aside</quote>; and</text></paragraph><paragraph id="idC80339D598E14C8B9E21A017F8E21120"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id08A3BC8332E14A528E0EB5A2E284D748"><subparagraph id="id7F2915BEAF2F442F92E4729855EDBD32"><enum>(C)</enum><header>Improving accessibility and efficiency</header><clause id="id75FBEFA6EB4C4FF2A9D07754FA9E22F5"><enum>(i)</enum><header>In general</header><text>A State may use an amount equal to not more than 5 percent of the funds set aside for the State under this subsection, after allocating funds in accordance with paragraph (2)(A), to improve the ability of applicants to access funding for projects under this subsection in an efficient and expeditious manner by—</text><subclause id="idFB85EC53AA7B4514AB13B2EF4E1846D5"><enum>(I)</enum><text>providing to applicants for projects under this subsection application assistance, technical assistance, and assistance in reducing the period of time between the selection of the project and the obligation of funds for the project; and</text></subclause><subclause id="id33A7BBE74DEE4C4DBF36BE75766865EE"><enum>(II)</enum><text>by providing funding for 1 or more full-time State employee positions to administer this subsection.</text></subclause></clause><clause id="id4E3AFBF425A04E028C44F22DC095F9DA"><enum>(ii)</enum><header>Use of funds</header><text>Amounts used under clause (i) may be expended—</text><subclause id="idDFF391B3D53740B2AE5C8DEC24135378"><enum>(I)</enum><text>directly by the State; or</text></subclause><subclause id="id45E220C763C5414C9971CAEE296ADB85"><enum>(II)</enum><text>through contracts with State agencies, private entities, or nonprofit entities.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idBB6E4093B03F4D6C9E0BD5BBCC592AE9"><enum>(g)</enum><header>Federal share</header><text>Section 133(h) of title 23, United States Code, is amended—</text><paragraph id="id03A6CA2CF88D48168A04ECE9AD5D9821"><enum>(1)</enum><text>by redesignating paragraph (7) as paragraph (8); and</text></paragraph><paragraph id="idB5C0A76C075A4C589D3880B01354ADBB"><enum>(2)</enum><text>by inserting after paragraph (6) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC1FBE79411DC4D7ABD8AB7A853DE1393"><paragraph id="idF2A855A7C8E943F5952E8FA3A6FCE31E"><enum>(7)</enum><header>Federal share</header><subparagraph id="idac4b1f433e314c57a1f751d4a7b463fb"><enum>(A)</enum><header>Required aggregate non-federal share</header><text>The average annual non-Federal share of the total cost of all projects for which funds are obligated under this subsection in a State for a fiscal year shall be not less than the non-Federal share authorized for the State under section 120(b).</text></subparagraph><subparagraph id="idcef00a889a82498790bfa320de3c634b"><enum>(B)</enum><header>Flexible financing</header><text>Subject to subparagraph (A), notwithstanding section 120—</text><clause id="id2c35acf8ded74d11a2f985eaaa4f09df"><enum>(i)</enum><text>funds made available to carry out section 148 may be credited toward the non-Federal share of the costs of a project under this subsection if the project—</text><subclause id="idE38AE8B88BC14DFD927D5641861F275D"><enum>(I)</enum><text>is an eligible project described in section 148(e)(1); and</text></subclause><subclause id="idF89A1E6189A04EBFA2A0B3EFEA9148E0"><enum>(II)</enum><text>contributes to the annual safety performance targets of the State;</text></subclause></clause><clause id="id776e889100844cb8b5115adab39aa83a"><enum>(ii)</enum><text>the non-Federal share for a project under this subsection may be calculated on a project, multiple-project, or program basis; and</text></clause><clause id="id9b380b36ce0647828452034b17a9034b"><enum>(iii)</enum><text>the Federal share of the cost of an individual project in this section may be up to 100 percent.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id9F4150D4F2C9417B939E616A36A9342C"><enum>(h)</enum><header>Improved transparency</header><text>Paragraph (8)(A) of section 133(h) of title 23, United States Code (as redesignated by subsection (g)(1)), is amended—</text><paragraph id="id49E29C7846A14104A08CD4EB37A01B31"><enum>(1)</enum><text>in the matter preceding clause (i), by striking <quote>describes</quote> and inserting <quote>includes</quote>; and</text></paragraph><paragraph id="id358DF652DFDD4B19AFAD137FF54BB584"><enum>(2)</enum><text>by striking clause (ii) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfb04967b93ce40e7a9b603c5ff49665c"><clause id="id9aa4afc42b5d4789b34468a106fb310c"><enum>(ii)</enum><text>a list of each project selected for funding for each fiscal year, including, for each project—</text><subclause id="idCF82716B58DB4D85A0FCC459A57CBA05"><enum>(I)</enum><text>the fiscal year during which the project was selected; </text></subclause><subclause id="idBA3F474F87C74FC98E3081560AEC642B"><enum>(II)</enum><text>the fiscal year in which the project is anticipated to be funded;</text></subclause><subclause id="id6726321ACC79417D94EEDB8E7751D0CB"><enum>(III)</enum><text>the recipient;</text></subclause><subclause id="id6CB962C91B7C4E86B90D88DE63A212CB"><enum>(IV)</enum><text>the location, including the congressional district;</text></subclause><subclause id="idB7BBBD96378941B4AD8772AF078BA782"><enum>(V)</enum><text>the type; and</text></subclause><subclause id="id6BB03531F0AD499A9EBC600FAD887615"><enum>(VI)</enum><text>a brief description.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id62A90CFBD35A4A989C36716499EAFC3C"><enum>(i)</enum><header>State transferability</header><text>Section 126(b)(2) of title 23, United States Code, is amended—</text><paragraph id="idEC09160BC28A4273BB867A721F1B6099"><enum>(1)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; </text></paragraph><paragraph id="id5F42A0FF45DC4644BFF11A242ECD7421"><enum>(2)</enum><text>by striking <quote>for a fiscal year may</quote> and inserting the following: “for a fiscal year—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id57E2097B557D4446AF6D70595CBDE025"><subparagraph id="idA384233D0A5E4F8EBE24A9A06D2AD877"><enum>(A)</enum><text>may</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idDDC532EECA124CB2AFB68E76E5181FAC"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD531E7BD793540F3B268BC33DDFEC4AD"><subparagraph id="idB6C9F1FF2E5D475D82C9681E06C9CE96"><enum>(B)</enum><text>may only be transferred if the Secretary certifies that the State—</text><clause id="id95a60e8659844742a4d177b5503f66ff"><enum>(i)</enum><text>held a competition in compliance with the guidance issued to carry out section 133(h) and provided sufficient time for applicants to apply;</text></clause><clause id="id443b89d44b3549daa33bd34ff97024b5"><enum>(ii)</enum><text>offered to each eligible entity, and provided on request of an eligible entity, technical assistance; and</text></clause><clause id="iddf64a175f669411ba6926c72d4a63ab5"><enum>(iii)</enum><text>demonstrates that there were not sufficiently suitable applications from eligible entities to use the funds to be transferred.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="idCD0C201569A54499B01E228A4B0AB41A"><enum>(j)</enum><header>Effective date</header><text>This section and the amendments made by this section shall take effect on October 1, 2021.</text></subsection></section></legis-body></bill>
