which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To help small business broadband providers keep customers connected.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id4C5EC95C00CB4807BBAB53B7D5E48BEE"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keeping Critical Connections Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="id48239E17A8404FCF83740D4C706655B3"><enum>2.</enum><header>Keeping Critical Connections Emergency Fund</header><subsection id="idBEE88EC79E38474AAF485031C1472640"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idD0CB09BA42A24BB794AF4473C6D6D70D"><enum>(1)</enum><text>the term <term>Commission</term> means the Federal Communications Commission;</text></paragraph><paragraph id="id00B62AC916EF4A618069ED4494BC5DAA"><enum>(2)</enum><text>the term <term>covered program</term> means a program established by a small business broadband provider under which the small business broadband provider, at any time during the COVID–19 emergency period, voluntarily—</text><subparagraph id="id4E597D8C8AC1495CABEB194706A6FACE"><enum>(A)</enum><text>provides a customer with free or discounted broadband service, or free upgrades of existing service to meet certain capacity and speed needs, due specifically to the presence of a student in the household of the customer who needs distance learning capability; or</text></subparagraph><subparagraph id="id47200255ABA84A6B9FCFB6F684EB5D61"><enum>(B)</enum><text>refrains from disconnecting broadband service provided to an existing customer due to nonpayment or underpayment if the customer—</text><clause id="idC30EE2B7D0324C8F8D9CE0C554D5433F"><enum>(i)</enum><text>has a household income, at the time of the nonpayment or underpayment, that does not exceed 135 percent of the Federal poverty guidelines (as determined by the Secretary of Health and Human Services);</text></clause><clause id="idB5ABD40640054465AF0A8E1EF14C811F"><enum>(ii)</enum><text>is unable to make a full payment due specifically to the economic impact of the national emergency described in paragraph (3); and</text></clause><clause id="id46FA12E1F3B045D5819EB028292D8DD9"><enum>(iii)</enum><text>provides sufficient documentation to the provider to show that the customer meets the criteria under clauses (i) and (ii); </text></clause></subparagraph></paragraph><paragraph id="idE6EE895A62EA4EA0B1045C00F4C9061E"><enum>(3)</enum><text>the term <term>COVID–19 emergency period</term> means the period during which the national emergency declaration by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.) with respect to the Coronavirus Disease 2019 (COVID–19) is in effect; and</text></paragraph><paragraph id="id562C24068B2C4C13B8CEBC52E28399D4"><enum>(4)</enum><text>the term <term>small business broadband provider</term> means a broadband provider that provides broadband service to fewer than 250,000 customers.</text></paragraph></subsection><subsection id="id571087D0F26E419CB23D65D6E080D0BF"><enum>(b)</enum><header>Funding</header><paragraph id="id4D9024A1C7CD4AF4B0421670625FE1C0"><enum>(1)</enum><header>Appropriation</header><text>Out of any funds in the Treasury not otherwise appropriated, there is appropriated to the Commission $2,000,000,000 for fiscal year 2021, to remain available until expended, to reimburse small business broadband providers for the costs of carrying out a covered program.</text></paragraph><paragraph id="id9E44D025CDD94918ABDCFA5A8ECED65A"><enum>(2)</enum><header>Rules</header><text>The Commission shall promulgate rules on an expedited basis, and without regard to section 553 of title 5, United States Code, regarding the provision of reimbursements to small business broadband providers under paragraph (1).</text></paragraph></subsection></section></legis-body></bill>
