which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To combat forced organ harvesting and trafficking in persons for purposes of the removal of organs, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="H37B5B2B832CA416C8A6690E46BF5753E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Forced Organ Harvesting Act of 2021</short-title></quote>.</text></section><section id="HC983AF09EC32416E944779F1779AC857"><enum>2.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It shall be the policy of the United States—</text><paragraph id="H04452FF847C3464A9E977698B29F7C1C"><enum>(1)</enum><text>to combat international trafficking in persons for purposes of the removal of organs; </text></paragraph><paragraph id="HE9198CE56F914E8E99754DD23E45362C"><enum>(2)</enum><text>to promote the establishment of voluntary organ donation systems with effective enforcement mechanisms in bilateral diplomatic meetings and in international health forums; and </text></paragraph><paragraph id="HC19828F8594C499F9792A5CC324243BB"><enum>(3)</enum><text>to promote the dignity and security of human life in accordance with the Universal Declaration of Human Rights, adopted on December 10, 1948.</text></paragraph></section><section id="HC6AE8C66BAC64E3489F3478FF1874BA6"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H1B38CA3092584B56AB42E93718949B26"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="H43B9A80BC3EB4281BBD0BFF0DDB257E8"><enum>(A)</enum><text>the Committee on Foreign Relations of the Senate; and </text></subparagraph><subparagraph id="H1A33177CE6014FBA828B25343D7FB69F"><enum>(B)</enum><text>the Committee on Foreign Affairs of the House of Representatives. </text></subparagraph></paragraph><paragraph id="H30E89CD7E74343DEB1041CC418ABAAA1"><enum>(2)</enum><header>Forced organ harvesting</header><text>The term <term>forced organ harvesting</term> means the removal of one or more organs from a person by means of coercion, abduction, deception, fraud, or abuse of power or a position of vulnerability. </text></paragraph><paragraph id="H1A92B02639E84B10B114704E3A50D7EA"><enum>(3)</enum><header>Organ</header><text>The term <term>organ</term> has the meaning given the term <term>human organ</term> in section 301(c)(1) of the National Organ Transplant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/274e">42 U.S.C. 274e(c)(1)</external-xref>). </text></paragraph><paragraph commented="no" id="HDA412E183A66471EB19131DB2B478E5A"><enum>(4)</enum><header>Trafficking in persons for purposes of the removal of organs</header><text>The term <term>trafficking in persons for purposes of the removal of organs</term> means the recruitment, transportation, transfer, harboring, or receipt of a person for the purpose of removing one or more of such person’s organs, by means of—</text><subparagraph commented="no" id="H0BD474F2A0234AD8BBC1B9D234DD6893"><enum>(A)</enum><text>coercion;</text></subparagraph><subparagraph commented="no" id="H7931DEF732C04A51870E85BF3BD09137"><enum>(B)</enum><text>abduction; </text></subparagraph><subparagraph commented="no" id="HAA5BFA91839C41CE9B4C6C8E96688005"><enum>(C)</enum><text>deception; </text></subparagraph><subparagraph commented="no" id="HD231D8EBA31B4A759F994723B34181F4"><enum>(D)</enum><text>fraud; </text></subparagraph><subparagraph commented="no" id="H0E29BA7B8FF44E6AB37EA9A5CC33798D"><enum>(E)</enum><text>abuse of power or a position of vulnerability; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBEE41B01119542D3ADA26683A68CBBC4"><enum>(F)</enum><text>transfer of payments or benefits to achieve the consent of a person having control over a person described in the matter preceding subparagraph (A). </text></subparagraph></paragraph></section><section id="H578A176FEA5646C3A61AE18094F2201A"><enum>4.</enum><header>Authority to deny or revoke passports</header><text display-inline="no-display-inline">Section 4076 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/22/212">22 U.S.C. 212</external-xref>) is amended—</text><paragraph id="H67EF1B64AD504900B124A16F5F708D50"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(a)</quote> before <quote>No passport</quote>; and</text></paragraph><paragraph id="H228B0AD96893422EAC99AD01FE1AF35C"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H64629649A99F40C59B729C247717B8F6"><subsection id="H8F69864E9D3946A498EE1FE3432ABA1C"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H709D4182762540688153937B58CA17E7"><enum>(1)</enum><text>The Secretary of State may refuse to issue a passport to any individual who has been convicted of an offense under section 301 of the National Organ Transplant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/274e">42 U.S.C. 274e</external-xref>) if such individual, in the commission of such an offense, used a passport or crossed an international border.</text></paragraph><paragraph id="HCF3B6EF977AF45C58C5A5CE5390B9B7D" indent="up1"><enum>(2)</enum><text>The Secretary of State may revoke a passport previously issued to any individual described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H2476AF68806144BAA5329BBB3BE06A20"><enum>5.</enum><header>Reports on forced organ harvesting and trafficking in persons for purposes of the removal of organs in foreign countries</header><subsection id="H0628D73E43F54994A00D09163FE5414B"><enum>(a)</enum><header>Inclusion of information in annual country reports on human rights practices</header><text display-inline="yes-display-inline">The Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151</external-xref> et seq.) is amended—</text><paragraph id="H63F50A57441544889170D4B473CBAC37"><enum>(1)</enum><text display-inline="yes-display-inline">in section 116 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n</external-xref>), by adding at the end the following: </text><quoted-block style="OLC" id="H70C64E6331A241F5846FCDB9AC5157C3" act-name=""><subsection id="HEE21DCC09783460FA5CBEDD5AABD32E7"><enum>(h)</enum><header>Forced organ harvesting and trafficking in persons for purposes of the removal of organs</header><paragraph id="H72EE38E08249487696A230CB8CEE080C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The report required by subsection (d) shall include an assessment of forced organ harvesting and trafficking in persons for purposes of the removal of organs in each foreign country. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF95C399CC6294565805B451658E51C62"><enum>(2)</enum><header>Definitions</header><text>In this subsection: </text><subparagraph commented="no" display-inline="no-display-inline" id="H2749F82CDAB74D56A17B77A94887266D"><enum>(A)</enum><header>Forced organ harvesting</header><text>The term <term>forced organ harvesting</term> means the removal of one or more organs from a person by means of coercion, abduction, deception, fraud, or abuse of power or a position of vulnerability.</text></subparagraph><subparagraph id="H22A0978632E1420397B29A5B735CA59B"><enum>(B)</enum><header>Organ</header><text>The term <term>organ</term> has the meaning given the term <term>human organ</term> in section 301(c)(1) of the National Organ Transplant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/274e">42 U.S.C. 274e(c)(1)</external-xref>).</text></subparagraph><subparagraph commented="no" id="HCB4C43F1978B4A36897D7877A6EB5B5B"><enum>(C)</enum><header>Trafficking in persons for purposes of the removal of organs</header><text>The term <term>trafficking in persons for purposes of the removal of organs</term> means the recruitment, transportation, transfer, harboring, or receipt of a person for the purpose of removing one or more of such person’s organs, by means of—</text><clause commented="no" id="H1C7E8665E4414AAFAFC35A97807FB672"><enum>(i)</enum><text>coercion;</text></clause><clause commented="no" id="HA3D4D6AE1C5044CDB2F2FFFA36C75DEE"><enum>(ii)</enum><text>abduction; </text></clause><clause commented="no" id="H79056FE5EC9047F5A1AE6E365E5E5AFA"><enum>(iii)</enum><text>deception; </text></clause><clause commented="no" id="H7C622A2955DF43C499BDA8CDF150F5B9"><enum>(iv)</enum><text>fraud; </text></clause><clause commented="no" id="H9AC5DE4FDECB4C93BDC2B0B0AF7B418E"><enum>(v)</enum><text>abuse of power or a position of vulnerability; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H430C44BE579D473AA850DE5A09C84C47"><enum>(vi)</enum><text>transfer of payments or benefits to achieve the consent of a person having control over a person described in the matter preceding clause (i). </text></clause></subparagraph></paragraph></subsection><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="H4F7F547B4D7C4C00866E4163CCF6EDAD"><enum>(2)</enum><text>in section 502B (<external-xref legal-doc="usc" parsable-cite="usc/22/2304">22 U.S.C. 2304</external-xref>)—</text><subparagraph id="H1434E1FF4A6F48E38BE1696386C12A88"><enum>(A)</enum><text>by redesignating the second subsection (i) (relating to child marriage status) as subsection (j); and </text></subparagraph><subparagraph id="HE9CFFAFA07DC4085B19C479A6F5DAC99"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H0982B935127D4852901528E9DDF5F4BF" act-name=""><subsection id="H78976B1820A146FCACC8C44C10832842"><enum>(k)</enum><header>Forced organ harvesting and trafficking in persons for purposes of the removal of organs</header><paragraph id="H520A152CB772447395B20E0E147EF4DA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The report required by subsection (b) shall include an assessment of forced organ harvesting and trafficking in persons for purposes of the removal of organs in each foreign country.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H788A159DF6054747921F62531FBB63AA"><enum>(2)</enum><header>Definitions</header><text>In this subsection, the terms <term>forced organ harvesting</term>, <term>organ</term>, and <term>trafficking in persons for purposes of the removal of organs</term> have the meanings given those terms in section 116(h)(2).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H4642C97B3C464055993A888603885705"><enum>(b)</enum><header>Additional reports</header><paragraph id="H3830CD0CECA94A98837F65081A5938FE"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date on which each annual report required by sections 116 and 502B of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n</external-xref>, 2304), as amended by subsection (a), is submitted, the Assistant Secretary of State for Democracy, Human Rights, and Labor (in this subsection referred to as the <quote>Assistant Secretary</quote>), shall submit to the appropriate committees of Congress a report that includes the following:</text><subparagraph id="H149E2EF8F4DB467794A3E6C8D14B71DB"><enum>(A)</enum><text display-inline="yes-display-inline">With respect to each foreign country, an identification of any agencies, instrumentalities, or officials of the country that are responsible for forced organ harvesting or trafficking in persons for purposes of the removal of organs.</text></subparagraph><subparagraph id="HB7BE09635FDC491F90B3E3755482A2E0"><enum>(B)</enum><text>A tiered ranking described in paragraph (2).</text></subparagraph></paragraph><paragraph id="HFB359D77E2DB40E6896A8EA0768B90EA"><enum>(2)</enum><header>Tiered ranking</header><text display-inline="yes-display-inline">The tiered ranking described in this paragraph is a tiered ranking of all foreign countries as follows:</text><subparagraph id="HFE2FA50F66F8401BAB00A5B3F932B5D7"><enum>(A)</enum><header>Tier 1 countries</header><text>The Assistant Secretary shall designate a country as tier 1 if the country has low levels of forced organ harvesting or trafficking in persons for purposes of the removal of organs and the government of such country is making significant efforts to combat those practices.</text></subparagraph><subparagraph id="H4437E23F5FBF470D95F7C56F1F00B360"><enum>(B)</enum><header>Tier 2 countries</header><text>The Assistant Secretary shall designate a country as tier 2 if the country has—</text><clause id="H2D637A429CF847BF9F745DF57C71C7CC"><enum>(i)</enum><text>low or intermediate levels of forced organ harvesting or trafficking in persons for purposes of the removal of organs and the government of such country is not making significant efforts to combat those practices; or</text></clause><clause id="HD7A649FFA6F4425B9A8C31E88D30F82F"><enum>(ii)</enum><text>intermediate levels of forced organ harvesting or trafficking in persons for purposes of the removal of organs and the government of such country is making significant efforts to combat those practices.</text></clause></subparagraph><subparagraph id="H6E42B502197340CC9D8FCE904924D40E"><enum>(C)</enum><header>Tier 3 countries</header><text>The Assistant Secretary shall designate a country as tier 3 if—</text><clause id="H845AA44BD0CC4F2E850098B46C21F42F"><enum>(i)</enum><text>the country has high levels of forced organ harvesting or trafficking in persons for purposes of the removal of organs; or</text></clause><clause id="H735CF8A711D8465089C6689FDA0AFD47"><enum>(ii)</enum><text>the government of such country is directly or indirectly supporting forced organ harvesting or trafficking in persons for purposes of the removal of organs.</text></clause></subparagraph></paragraph><paragraph id="HB73B00DAC5CC4D3298258B39E0FA5515"><enum>(3)</enum><header>Form</header><text>The report required by this subsection shall be submitted in unclassified form.</text></paragraph></subsection><subsection id="H71CB278AB9094F17B0C2EDFFD1864A44"><enum>(c)</enum><header>Interim reports</header><text>In addition to the annual reports required by sections 116 and 502B of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n</external-xref>, 2304), as amended by subsection (a), the Secretary of State may submit to the appropriate committees of Congress at any time one or more interim reports with respect to the status of forced organ harvesting and trafficking in persons for purposes of the removal of organs in foreign countries, including information about countries whose governments have begun or ceased to make significant efforts to combat those practices since the date on which the most recent annual report was submitted under such sections. </text></subsection><subsection id="HBF7993E475664A91B018237D3F5D0477"><enum>(d)</enum><header>Consideration of significant efforts</header><text>In determining whether the government of a country is making significant efforts to combat forced organ harvesting and trafficking in persons for purposes of the removal of organs under subsections (b) and (c), the Secretary of State shall consider—</text><paragraph id="H0FC01D78AF3D4BBFA0B16A60985E9A8C"><enum>(1)</enum><text>the extent to which the country is a country of origin, transit, or destination for forced organ harvesting and trafficking in persons for purposes of the removal of organs;</text></paragraph><paragraph id="H9D7233939D1B4CFE85561BBE8E6D6A86"><enum>(2)</enum><text>the extent of efforts by the government to combat forced organ harvesting and trafficking in persons for purposes of the removal of organs, and, particularly, the extent to which officials or employees of the government have participated in, facilitated, or condoned, or are otherwise complicit in, those practices; and </text></paragraph><paragraph id="H19B3C402EF234AA589215F77C507E670"><enum>(3)</enum><text>the measures that would be reasonable for the government to combat forced organ harvesting and trafficking in persons for purposes of the removal of organs, considering the resources and capabilities of the government. </text></paragraph></subsection></section><section id="H942B5AA267654A129CB79AA0FEB9744E"><enum>6.</enum><header>Report on United States medical and educational institutions at which organ transplant surgeons from tier 3 countries are trained</header><subsection id="H205F073B014A498BAEF974C433711AE6"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date on which each annual report required by sections 116 and 502B of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n</external-xref>, 2304), as amended by section 5(a), is submitted, the Secretary of State, in consultation with the Secretary of Health and Human Services, shall submit to Congress a report on medical and educational institutions and other entities in the United States at which organ transplant surgeons are trained.</text></subsection><subsection id="H97251D7E991B4403A5745C6E050ED099"><enum>(b)</enum><header>Elements</header><paragraph id="H5F6A446494BF4AE68AF97E8688858143"><enum>(1)</enum><header>In general</header><text>Each report required by subsection (a) shall include an identification of each medical or educational institution or other entity in the United States at which one or more organ transplant surgeons described in paragraph (2) are trained as of the date on which the report is submitted. </text></paragraph><paragraph id="HBC303BF09E2E427DA44D05F953BBF94B"><enum>(2)</enum><header>Organ transplant surgeon described</header><text>An organ transplant surgeon described in this paragraph is an organ transplant surgeon who—</text><subparagraph id="H4A5B45771F344888966913164D908FA8"><enum>(A)</enum><text>as of the date on which the report required by subsection (a) is submitted, is employed by or affiliated with an agency or instrumentality identified in the most recent additional report required by section 5(b) as being responsible for forced organ harvesting or trafficking in persons for purposes of the removal of organs; and </text></subparagraph><subparagraph id="HCA27BC60F0EF47F6B9C3C4882345329A"><enum>(B)</enum><text>is a citizen or national of a country designated as a tier 3 country in the most recent additional report required by section 5(b).</text></subparagraph></paragraph></subsection></section><section id="H1CFA3D1EFADE45CCAF5EA8F4F1AE550C"><enum>7.</enum><header>Prohibition on the export of organ transplant surgery devices to certain entities</header><text display-inline="no-display-inline">Section 801 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9490A391693447AD92B0F3FED7E918F4"><subsection id="H7F19EAE5680B4B739B24687AC9A3963E"><enum>(v)</enum><header>Prohibition on export of organ transplant surgery devices to certain entities</header><paragraph id="H3346981FF7A5488296DA0A77FFB9EF19"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, a device that is intended for use in organ transplant surgery may not be exported to any entity that is identified in the most recent additional report required by section 5(b) of the <short-title>Stop Forced Organ Harvesting Act of 2021</short-title> as being responsible for forced organ harvesting or trafficking in persons for purposes of the removal of organs. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA9441BC58FF64DFD90CB373FD6F9EA9D"><enum>(2)</enum><header>Coordination with the Secretary of Commerce</header><text>The Secretary shall coordinate with the Secretary of Commerce to ensure compliance with paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H7817F06699914604881E601A06337F2E"><enum>8.</enum><header>Imposition of sanctions with respect to forced organ harvesting or trafficking in persons for purposes of the removal of organs facilitated by tier 3 countries</header><subsection id="H5332DBC797394122BA5E5FF469AB990C"><enum>(a)</enum><header>List required</header><text>Not later than 180 days after the date on which each annual report required by sections 116 and 502B of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n</external-xref>, 2304), as amended by section 5(a), is submitted, the President shall submit to Congress a list of each person that the President determines—</text><paragraph id="H578AB65FB8D241E5A6E6A4B6125A2BEF"><enum>(1)</enum><text>funds, supports, sponsors, or otherwise facilitates forced organ harvesting or trafficking in persons for purposes of the removal of organs; and</text></paragraph><paragraph id="H66E7F9EE31CA4D8BA5F4AEAB86AFC717"><enum>(2)</enum><text>is—</text><subparagraph id="H682F8CF60CC74A83A78E17F318E69D14"><enum>(A)</enum><text>an individual who is a citizen or national of a country designated as a tier 3 country in the most recent additional report required by section 5(b); or</text></subparagraph><subparagraph id="H8DBAB5F7D3274FDFA0AF2CADB0080C31"><enum>(B)</enum><text>an entity organized under the laws of such a country or otherwise subject to the jurisdiction of the government of such a country. </text></subparagraph></paragraph></subsection><subsection id="HCDC7030EEF494E33844ED644BCCCEF6A"><enum>(b)</enum><header>Imposition of sanctions</header><text>The President shall impose the following sanctions with respect to a person on the list required by subsection (a): </text><paragraph id="HC82A8BA90EC34566A059DF0FD36168D7"><enum>(1)</enum><header>Property blocking</header><text>The President shall exercise all of the powers granted by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) (except that the requirements of section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply) to the extent necessary to block and prohibit all transactions in all property and interests in property of the person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph><paragraph id="H25449D7D5CE443FA84FEB1C468153D4D"><enum>(2)</enum><header>Aliens inadmissible for visas, admission, or parole</header><subparagraph id="HADA39807F3784C1E9BCB0956626399A1"><enum>(A)</enum><header>Visas, admission, or parole</header><text>In the case of an individual, that individual is—</text><clause id="HE3986565E0924E6B95A6D5DA692BF9E0"><enum>(i)</enum><text>inadmissible to the United States;</text></clause><clause id="HFCE8596193244EA8B8FB553301488299"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></clause><clause id="H29170226CE3946898B7777F6A66820C7"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.).</text></clause></subparagraph><subparagraph id="HEA3F3BCA4EC94F6B95B72EB2A25A99E5"><enum>(B)</enum><header>Current visas revoked</header><clause id="HC201395904AD43EF8C6CB9B04CC82962"><enum>(i)</enum><header>In general</header><text>The visa or other entry documentation of the individual shall be revoked, regardless of when such visa or other entry documentation is or was issued.</text></clause><clause id="H9BFCC80889E0451580E8476295E395B8"><enum>(ii)</enum><header>Immediate effect</header><text>A revocation under clause (i) shall—</text><subclause id="HE51B268447AF4E76AC346BA7249E1A87"><enum>(I)</enum><text>take effect immediately; and</text></subclause><subclause id="HC66DD029FD544071A508414CC11CBF90"><enum>(II)</enum><text>automatically cancel any other valid visa or entry documentation that is in the individual’s possession. </text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H81BC88AD401D4BB4A8BB77651D237A19"><enum>(c)</enum><header>Exceptions</header><paragraph id="H03430FA313E34D4287B021C8F1BAA0A4"><enum>(1)</enum><header>Exception relating to importation of goods</header><subparagraph id="HEAA57F451EEA498984A9049D86B24513"><enum>(A)</enum><header>In general</header><text>The authorities and requirements to impose sanctions under subsection (b)(1) shall not include the authority or a requirement to impose sanctions on the importation of goods.</text></subparagraph><subparagraph id="HC41B14FE4A4F4CE39E685833E97F4D86"><enum>(B)</enum><header>Good defined</header><text>In this paragraph, the term <term>good</term> means any article, natural or manmade substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text></subparagraph></paragraph><paragraph id="H603C1E2071A14474BE61E62ED628FA88"><enum>(2)</enum><header>Exception to comply with international obligations</header><text>Subsection (b)(2) shall not apply to the admission of an individual if the admission of the individual is necessary to comply with United States obligations under the Agreement between the United Nations and the United States of America regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, under the Convention on Consular Relations, done at Vienna April 24, 1963, and entered into force March 19, 1967, or under other international agreements. </text></paragraph></subsection><subsection id="H89FD508F265B4589814C1DACD6278B52"><enum>(d)</enum><header>Implementation; penalties</header><paragraph id="HFA38FCE5534241D4AC2215B7A78EBE3F"><enum>(1)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref> and 1704) to carry out this section.</text></paragraph><paragraph id="HB4D55468796440DB813D1062C76614DE"><enum>(2)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of this section or any regulation, license, or order issued to carry out this section shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></paragraph></subsection><subsection id="H882ED71F67114B9CB26563DB73A37457"><enum>(e)</enum><header>United states person defined</header><text>In this section, the term <term>United States person</term> means—</text><paragraph id="HB8510986A86544448E27E4D59AFAC9A0"><enum>(1)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H918F357B9A0C4B16B1420A81023645B4"><enum>(2)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity. </text></paragraph></subsection></section></legis-body></bill>
