which was read twice and referred to the <committee-name committee-id="SSJU00" added-display-style="italic" deleted-display-style="strikethrough">Committee on the Judiciary</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>July 12, 2021</action-date><action-desc>Reported by <sponsor name-id="S253">Mr. Durbin</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To amend section 3661 of title 18, United States Code, to prohibit the consideration of acquitted conduct at sentencing.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prohibiting Punishment of Acquitted Conduct Act of 2021</short-title></quote>.</text></section><section id="id76e87379a7eb4eb8bb5c19bcd5eebb53" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>2.</enum><header>Acquitted conduct at sentencing</header><subsection id="idefca659cd38b4db59133c915eea20b1c"><enum>(a)</enum><header>Use of information for sentencing</header><paragraph id="idc5284b6e2d1845d4b2acf2c5b9dee251"><enum>(1)</enum><header>Amendment</header><text>Section 3661 of title 18, United States Code, is amended by inserting <quote>, except that a court of the United States shall not consider, except for purposes of mitigating a sentence, acquitted conduct under this section</quote> before the period at the end.</text></paragraph><paragraph id="id996fcf3cddae41eb8c51dd6e0ea82609"><enum>(2)</enum><header>Applicability</header><text>The amendment made by paragraph (1) shall apply only to a judgment entered on or after the date of enactment of this Act.</text></paragraph></subsection><subsection id="id7908283b963f4fc9abb47aa5a024efc1"><enum>(b)</enum><header>Definitions</header><text>Section 3673 of title 18, United States Code, is amended—</text><paragraph id="id0112d9f8da5e466cb37a4d550d364079"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>As</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf720df86220040a6bf44b4cc4cc6348a" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><subsection id="id225ab56a60a24b158a88b8d75568c730"><enum>(a)</enum><text>As</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idf29d3fef12d74a9cb9cb03e9ee689070"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide0128bf36c32484480da196cc9793991" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><subsection id="id9a6d73bdb7994a55a62d5094940fd779"><enum>(b)</enum><text>As used in this chapter, the term <term>acquitted conduct</term> means—</text><paragraph id="id5bbaaaf3401c41e88290b6899b1b1358"><enum>(1)</enum><text>an act—</text><subparagraph id="idE023B90F2EC84E9D83D12EF9D9760AE3"><enum>(A)</enum><text>for which a person was criminally charged and adjudicated not guilty after trial in a Federal, State, or Tribal court; or</text></subparagraph><subparagraph id="idCE2F70CDFA5F496D8F1CD70E91F78F12"><enum>(B)</enum><text>in the case of a juvenile, that was charged and for which the juvenile was found not responsible after a juvenile adjudication hearing; or</text></subparagraph></paragraph><paragraph id="ide12ca2e2623c4dae85cb1c3d81a293b6"><enum>(2)</enum><text>any act underlying a criminal charge or juvenile information dismissed—</text><subparagraph id="idd52511af1eec459ba95e764cfeb864d8"><enum>(A)</enum><text>in a Federal court upon a motion for acquittal under rule 29 of the Federal Rules of Criminal Procedure; and</after-quoted-block></quoted-block></paragraph><paragraph id="id0b8e21f2-83b4-423a-94b6-2f0743802316"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="id53b39b94-7a4a-4b29-a9ac-08e8b80ceef0" display-inline="no-display-inline" style="OLC" changed="added" reported-display-style="italic" committee-id="SSJU00"><subsection id="id7e61d6f8-f707-41ac-b356-9b00d340825b"><enum>(b)</enum><text>As used in this chapter, the term <term>acquitted conduct</term>—</text><paragraph id="id45E36ACD538B4DADB92BE640B6558D6C"><enum>(1)</enum><text>means—</text><subparagraph id="id9217eeb0-d86f-4a05-8028-0811e2db2d50"><enum>(A)</enum><text>an act—</text><clause id="id22fa34a4-b917-4d45-91eb-4c3d78feec62"><enum>(i)</enum><text>for which a person was criminally charged and adjudicated not guilty after trial in a Federal, State, military, or Tribal court; or</text></clause><clause id="id5cb94259-c79c-413b-aecb-5ffd760c89b1"><enum>(ii)</enum><text>in the case of a juvenile, that was charged and for which the juvenile was found not responsible after a juvenile adjudication hearing; or</text></clause></subparagraph><subparagraph id="id0f9ea710-ce2b-41fa-9617-bff10937c9c1"><enum>(B)</enum><text>any act underlying a criminal charge or juvenile information dismissed—</text><clause id="idc2b52b34-a21c-4725-836b-7839755fe800"><enum>(i)</enum><text>in a Federal court upon a motion for acquittal under rule 29 of the Federal Rules of Criminal Procedure; or</text></clause><clause id="id31369eee-e883-450f-aaeb-296caf478245" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>in a State, military, or Tribal court upon a motion for acquittal or an analogous motion under the applicable State, military, or Tribal rule of criminal procedure; and</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5D8E34E982D747D395A6D6E106C198F3"><enum>(2)</enum><text>does not include an act for which a person was criminally charged and convicted.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id7BCB51295434454EB823A6C8AC13FB7C"><enum>(c)</enum><header>Victims' rights</header><text>Section 3661 of title 18, United States Code, as amended by subsection (a) of this section, is amended—</text><paragraph id="id82FF72C53813456CA19145A38C5135A7"><enum>(1)</enum><text>by striking <quote>No limitation</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF4F5608590354E7A9AADF49C72B368CD" changed="added" reported-display-style="italic" committee-id="SSJU00"><subsection id="id69AE5FAEDC1E40DC8634FA7D64AA130D"><enum>(a)</enum><header>In general</header><text>Except as described in subsection (b), no limitation</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id993383ADF1F7445DB43D339E078D8DB2"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD8F24DA73B6D4E5FA265E51BF44C782A" changed="added" reported-display-style="italic" committee-id="SSJU00"><subsection id="idD21449C290874421BAF5C211F0F0FD5E"><enum>(b)</enum><header>Consideration of acquitted conduct</header><text>In determining an appropriate sentence, a court of the United States shall not consider acquitted conduct under this section for the purposes of determining the appropriate sentencing range pursuant to the United States Sentencing Guidelines, or to sentence a person outside of that sentencing range, except for the purposes of mitigation. </text></subsection><subsection id="id8B26728AD6354A4E968E640478594739"><enum>(c)</enum><header>Victims' rights</header><text>Nothing in this section shall limit the rights of a victim under section 3771 (commonly known as the <quote>Crime Victims’ Rights Act</quote>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body><endorsement><action-date>July 12, 2021</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
