<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 5</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20221117">November 17, 2022</action-date><action-desc><sponsor name-id="S277">Mr. Carper</sponsor> (for himself and <cosponsor name-id="S317">Mr. Barrasso</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to ensure appropriate supervision requirements for outpatient physical therapy and outpatient occupational therapy.</official-title></form><legis-body><section id="idd47584b3487b47f4afa515d2d5bcfe91" section-type="section-one"><enum>1.</enum><header>Ensuring appropriate supervision requirements for outpatient physical therapy and outpatient occupational therapy</header><subsection id="id47e6a8b937b54386886cd972aae094ef"><enum>(a)</enum><header>In general</header><paragraph id="idE525517EDF85414AA55789733BE18EB4" commented="no"><enum>(1)</enum><header>Payment</header><text>Section 1834(v)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(v)(1)</external-xref>) is amended, in the second sentence (as amended by subsection (a)), by inserting <quote>, but in no case shall the Secretary impose a supervision requirement on such services that is different than any such requirement under applicable State law</quote> before the period at the end.</text></paragraph><paragraph id="id1B8D5ABBFA7D479FA153CCD0F939ED49"><enum>(2)</enum><header>Definition</header><text>Section 1861(p) of the Social Security Act, is amended, in the first sentence of the flush matter following subparagraph (4)(B), by inserting <quote>, but in no case may those conditions impose a supervision requirement that is different than any such requirement under applicable State law</quote> after <quote>as the Secretary may find necessary</quote>.</text></paragraph><paragraph id="idfac3229078634c57a968344bfa4d369f"><enum>(3)</enum><header>Effective date</header><text>The amendments made this subsection shall take effect on July 1, 2023.</text></paragraph></subsection><subsection id="idf7a4e5df46de473096a585d78952323b"><enum>(b)</enum><header>Implementation</header><text>Notwithstanding any other provision of law, the Secretary may implement the provisions of, and the amendments made by, this section by program instruction or otherwise. </text></subsection></section></legis-body></bill>
