<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 599</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210304">March 4, 2021</action-date><action-desc><sponsor name-id="S370">Mr. Booker</sponsor> (for himself and <cosponsor name-id="S365">Mr. Scott of South Carolina</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Department of State Student Internship Program as a paid internship program to provide students with the opportunity to learn about a career in diplomacy and foreign affairs, and for other purposes.</official-title></form><legis-body><section id="id20DFFE44207246A5AE273DCB4D8E32F8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of State Student Internship Program Act</short-title></quote>.</text></section><section id="id92d7b93c18074f5eb2dbf83de6aea5d4"><enum>2.</enum><header>Department of state student internship program</header><subsection id="id2a7667ceef2047808c39ff7b8470e146"><enum>(a)</enum><header>In general</header><text>The Secretary of State shall establish the Department of State Student Internship Program (in this section referred to as the <quote>Program</quote>) to offer internship opportunities at the Department of State to eligible students to raise awareness of the essential role of diplomacy in the conduct of United States foreign policy and the realization of United States foreign policy objectives.</text></subsection><subsection id="id215f97b8c7f048cc8bedb0e35b90e507"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to participate in the Program, an applicant shall—</text><paragraph id="ida0a16d20146944c69ad67055457607c9"><enum>(1)</enum><text>be enrolled, not less than half-time, at—</text><subparagraph id="id5726072a5b2d423c92f033cba56aefea"><enum>(A)</enum><text>an institution of higher education (as such term is defined section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)); or</text></subparagraph><subparagraph id="id49b1977f2aba4880b0d9a304aba2b647"><enum>(B)</enum><text>an institution of higher education based outside the United States, as determined by the Secretary of State;</text></subparagraph></paragraph><paragraph id="id09254b8a25224954a32211a145583e05"><enum>(2)</enum><text>be able to receive and hold an appropriate security clearance; and</text></paragraph><paragraph id="id91bd30c771604b469e434ddd96768723"><enum>(3)</enum><text>satisfy such other criteria as established by the Secretary.</text></paragraph></subsection><subsection id="idf4b94f29939541d4869a151a492ef798"><enum>(c)</enum><header>Selection</header><text>The Secretary of State shall establish selection criteria for students to be admitted into the Program that includes the following:</text><paragraph id="id82cbca28334640f695a17103ca7bcfd1"><enum>(1)</enum><text>Demonstrable interest in a career in foreign affairs.</text></paragraph><paragraph id="id5636c01a39354630bd473bfc5260079c"><enum>(2)</enum><text>Academic performance.</text></paragraph><paragraph id="iddd64631dbe7d4a1b830e17284d5a49d7"><enum>(3)</enum><text>Such other criteria as determined by the Secretary.</text></paragraph></subsection><subsection id="idd3d4e2f647d04bed8d71b5fa061d4e66"><enum>(d)</enum><header>Outreach</header><text>The Secretary of State shall advertise the Program widely, including on the internet, through the Department of State’s Diplomats in Residence program, and through other outreach and recruiting initiatives targeting undergraduate and graduate students. The Secretary shall actively recruit people belonging to traditionally under represented groups, including by conducting targeted outreach at minority serving institutions (as such term is described in section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>), to promote diversity, as defined in subsection (e).</text></subsection><subsection id="id9366182dea494adc82a056ca18e602c8"><enum>(e)</enum><header>Diversity</header><text>The term <term>diversity</term> means those classes of persons protected under the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000a">42 U.S.C. 2000a</external-xref> et seq.) and the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101</external-xref> et seq.). </text></subsection><subsection id="id91858040565e41dc83c5f8af9fc2be45"><enum>(f)</enum><header>Compensation</header><paragraph id="id495f43d227eb4ffdb9e163b049faaa2f"><enum>(1)</enum><header>In general</header><text>Students participating in the Program shall be paid at least—</text><subparagraph id="id369d1a9ff93d47bcb351d54328970d71"><enum>(A)</enum><text>the amount specified in section 6(a)(1) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)(1)</external-xref>); or</text></subparagraph><subparagraph id="iddb540191ed0c403183526e40ea701f66"><enum>(B)</enum><text>the minimum wage of the jurisdiction in which the internship is located, whichever is greatest.</text></subparagraph></paragraph><paragraph id="idf1e283c30461462da57aaa4fb672daff"><enum>(2)</enum><header>Housing assistance</header><subparagraph id="idf0a58c426f1b4049b1feb7efce0dfb1c"><enum>(A)</enum><header>Abroad</header><text>The Secretary of State shall provide housing to a student participating in the Program whose permanent address is within the United States if the location of the internship in which such student is participating is outside the United States.</text></subparagraph><subparagraph id="id92fbbe0f3dd14b939f9dc364f6feafcb"><enum>(B)</enum><header>Domestic</header><text>The Secretary of State is authorized to provide housing to a student participating in the Program whose permanent address is within the United States if the location of the internship in which such student is participating is more than 50 miles away from such student’s permanent address.</text></subparagraph></paragraph><paragraph id="id7c61f5a18caa4da7a4c60b87ae7cc479"><enum>(3)</enum><header>Travel assistance</header><text>The Secretary of State shall provide a student participating in the Program whose permanent address is within the United States financial assistance to cover the costs of travel once to and once from the location of the internship in which such student is participating, including travel by air, train, bus, or other transit as appropriate, if the location of such internship is—</text><subparagraph id="idfcf9596fb16b440db5de9ccdd88abf25"><enum>(A)</enum><text>more than 50 miles from such student’s permanent address; or</text></subparagraph><subparagraph id="id4748c8256e4f4289ba01c046b263f134"><enum>(B)</enum><text>outside the United States.</text></subparagraph></paragraph></subsection><subsection id="idc6d10bd8e35a40bd868ff32683e6b780"><enum>(g)</enum><header>Working with institutions of higher education</header><text display-inline="yes-display-inline">The Secretary of State is authorized to enter into agreements with institutions of higher education to structure internships to ensure such internships satisfy criteria for academic programs in which participants in such internships are enrolled.</text></subsection><subsection id="id87a2b8369d664b23a61472f736dc5b6d"><enum>(h)</enum><header>Transition period</header><paragraph id="id23f16b82ff4948a5a373a2b5ac4c7444"><enum>(1)</enum><header>In general</header><text>Not later than three years after the date of the enactment of this Act, the Secretary of State shall transition all unpaid internship programs of the Department of State, to the maximum extent practicable and excluding internships not administered by the Department, to internship programs that offer compensation, such as the Program and the Foreign Service Internship Program.</text></paragraph><paragraph id="ide6d4dda457f8416baf6f200405f34891"><enum>(2)</enum><header>Waiver authority</header><text>The Secretary of State may waive the transition requirement under paragraph (1) for a period of not more than one year if the Secretary of State—</text><subparagraph id="id0801f4e0911847f89508cdb18987f26d"><enum>(A)</enum><text>determines that such a waiver is necessary; and</text></subparagraph><subparagraph id="id3e100df4c67d40f08f47d6a5280fa772"><enum>(B)</enum><text>submits to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report providing a justification for such a waiver.</text></subparagraph></paragraph></subsection><subsection id="id6fdf21b0ed37483d8f06b24f52b271c2"><enum>(i)</enum><header>Reports</header><text>Not later than 18 months after the date of the enactment of this Act, the Secretary of State shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report that includes the following:</text><paragraph id="idd46ee3921c19469191f03660bf166edb"><enum>(1)</enum><text>Information regarding the number of students, disaggregated by race, ethnicity, gender, institution of higher learning, home State, State where each student graduated from high school, and disability status, who applied to the Program, were offered a position, and participated.</text></paragraph><paragraph id="id8813c077ae7a4f2da48c499f371d2fcc"><enum>(2)</enum><text>Information on the number of security clearance investigations started and the timeline for such investigations, including whether such investigations were completed or if, and when, an interim security clearance was granted.</text></paragraph><paragraph id="idcb142747e26d40299ffa67cc04fab0a6"><enum>(3)</enum><text>Information on expenditures on the Program.</text></paragraph><paragraph id="id4da8882bfb324a13bb6835e1b028c8db"><enum>(4)</enum><text>Information regarding the Department of State’s compliance with subsection (g).</text></paragraph></subsection><subsection id="idb73215682ad147bba8ac95930d2c508b"><enum>(j)</enum><header>Voluntary participation</header><paragraph id="idfa40d1285a444c3797a4a93849dfc919"><enum>(1)</enum><header>In general</header><text>Nothing in this section may be construed to compel any student to participate in the collection of data or divulge any personal information described in subsection (h). Students shall be informed that their participation in the data collection contemplated by this title is voluntary.</text></paragraph><paragraph id="idffa9865f8acf4ee59473090f6ca277af"><enum>(2)</enum><header>Privacy protection</header><text>Any data collected under this section shall be subject to the relevant privacy protection statutes and regulations applicable to Federal employees. </text></paragraph></subsection></section></legis-body></bill>
