which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a reserve fund for the proceeds of the C-band auction conducted by the Federal Communications Commission.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Broadband Reserve Fund Act of 2021</short-title></quote>.</text></section><section id="id0A939EBDD6F64C6194BA2326F9EA7728"><enum>2.</enum><header>Broadband and connectivity reserve fund</header><subsection id="idC96AA5B9B99A47D9A02884748AF8E993"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id9E7DD8D4B0DF45ABAE8E06C3B6312A6C"><enum>(1)</enum><text>the term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information; and</text></paragraph><paragraph id="idFF0F0F941D3A4B3999604C5B217B5EAA"><enum>(2)</enum><text>the term <term>Commission</term> means the Federal Communications Commission.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="P1F195B844200D5EF2C51ACB94FCA28F"><enum>(b)</enum><header>Establishment of reserve fund</header><paragraph id="P4F5D104C4BC54EAA3F8705AED5F78EE"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury of the United States a fund to be known as the <quote>Broadband Reserve Fund</quote> (referred to in this section as the <term>Fund</term>).</text></paragraph><paragraph id="P87E631754C8C9F7F166645901B42B72" commented="no"><enum>(2)</enum><header>Availability</header><subparagraph id="id17615D4247B8405A89894DC025FD2149" commented="no"><enum>(A)</enum><header>In general</header><text>Amounts deposited in the Fund shall remain available through fiscal year 2030.</text></subparagraph><subparagraph id="idFC24A7FC54DB4681BA45D849A031EA68" commented="no"><enum>(B)</enum><header>Use for deficit reduction</header><text>Any amounts remaining in the Fund after the end of fiscal year 2030 shall be deposited in the general fund of the Treasury for the sole purpose of deficit reduction.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="PAD3CE53941ABB7495E53599993C6C72"><enum>(c)</enum><header>Use of fund</header><paragraph commented="no" display-inline="no-display-inline" id="idD9337ABA4CF447BBAB43A74F44BD6983"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5143B2D499434B42B1286A2510AA4F89"><enum>(A)</enum><text>amounts in the Fund shall be available for use by the Commission; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id7A61F09174A345738679308590E9E3B7"><enum>(B)</enum><text>the Commission—</text><clause display-inline="no-display-inline" commented="no" id="id383B596052FD4F94BB279FDE156AB1A4"><enum>(i)</enum><text>shall reserve not less than 20 percent of the amounts in the Fund for use by the Assistant Secretary; and</text></clause><clause display-inline="no-display-inline" commented="no" id="id2483BAB7A506408890C7F5B49F310750"><enum>(ii)</enum><text>shall transfer the amounts reserved under clause (i) to the Assistant Secretary upon request.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF0DDF2F5FCE849A6A3F1C25F13D84984"><enum>(2)</enum><header>Limitation</header><text>The Commission and the Assistant Secretary may not access or use amounts in the Fund for any purpose unless specifically authorized by an Act of Congress enacted after the date of enactment of this Act.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id4D6D5AE49A794EAF8DF43EE72E712932"><enum>(3)</enum><header>Sense of Congress regarding permissible uses of Fund</header><text>It is the sense of Congress that Congress should enact further legislation specifying the purposes for which amounts in the Fund may be used, which may include—</text><subparagraph id="id16c609f35c8b4488a3dfd3fa10965a18"><enum>(A)</enum><text>broadband deployment to unserved areas;</text></subparagraph><subparagraph id="idF3DA52D9B8B5416FA37D330BB7804DF3"><enum>(B)</enum><text>distance and remote learning;</text></subparagraph><subparagraph id="id12D6D7E40F8B45ED8A298926DC66353C"><enum>(C)</enum><text>digital equity and expanding broadband access in minority communities and on Tribal land;</text></subparagraph><subparagraph id="idC64CF8063E8B4A32ABA9197461E3F8DA"><enum>(D)</enum><text>securing the telecommunications supply chain;</text></subparagraph><subparagraph id="id4CAD75FECB4C41728BC668956784DB32"><enum>(E)</enum><text>promoting spectrum efficiency;</text></subparagraph><subparagraph id="id4D450DAF6F6F492387A5AD4C47197F5E"><enum>(F)</enum><text>investment in public safety communications infrastructure;</text></subparagraph><subparagraph id="id77044E1C350443169E2E1721ACEBFEB2"><enum>(G)</enum><text>precision agriculture technologies; and</text></subparagraph><subparagraph id="idCF486D9088EA4B34A10400C853B8725C"><enum>(H)</enum><text>telehealth technologies.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="P3001E62C45611F7607E4BCBAE4CAD69"><enum>(d)</enum><header>Investment</header><text>Amounts in the Fund shall be invested in accordance with section 9702 of title 31, United States Code, and any interest on, and proceeds from, any such investment shall be credited to, and become a part of, the Fund.</text></subsection><subsection id="idC2528E8436674BB089165D69E74B1019"><enum>(e)</enum><header>Deposit of C-Band spectrum auction proceeds in Fund</header><text display-inline="yes-display-inline">Section 309(j)(8) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(8)</external-xref>) is amended—</text><paragraph id="idC3A3C4BA3AD44A43B458D11E92DBACE1"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>and (G)</quote> and inserting <quote>(G), and (H)</quote>;</text></paragraph><paragraph id="idE44637077F614E7FB3BFC89A9037681A"><enum>(2)</enum><text>in subparagraph (C)(i), by striking <quote>and (G)</quote> and inserting <quote>(G), and (H)</quote>; and</text></paragraph><paragraph id="id6306494D6066435382226E85B4950E39"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA258482C672E4EFCB2FBB7E98DFAB5E9"><subparagraph id="id3E25EFE051154837A14B28E3DDD48864"><enum>(H)</enum><header>C-band auction proceeds</header><text>Notwithstanding subparagraph (A), and except as provided in subparagraph (B), of the proceeds (including deposits and upfront payments from successful bidders) from the use of a system of competitive bidding under this subsection to award licenses in the band of frequencies between 3700 megahertz and 3980 megahertz (designated by the Commission as <quote>Auction 107</quote>), $65,000,000,000 shall be deposited in the Broadband Reserve Fund established under section 3 of the <short-title>Broadband Reserve Fund Act of 2021</short-title>.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
