<congress display="yes">117th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 590</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To establish limitations regarding Confucius Institutes, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE9943598AD1F40C29FA8203113E9CB1F"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="S1"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Concerns Over Nations Funding University Campus Institutes in the United States Act</short-title></quote> or the <quote><short-title>CONFUCIUS Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id81C07F121D1D4943ADD84656F974DDF0"><enum>2.</enum><header display-inline="yes-display-inline">Restrictions on Confucius Institutes</header><subsection commented="no" display-inline="no-display-inline" id="idC7C71FAA54C945309971189CB8D87274"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section, the term <term>Confucius Institute</term> means a cultural institute directly or indirectly funded by the Government of the People’s Republic of China.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id94F8E06C051D4F91B7E2AD159415F770"><enum>(b)</enum><header display-inline="yes-display-inline">Restrictions on Confucius Institutes</header><text display-inline="yes-display-inline">An institution of higher education or other postsecondary educational institution (referred to in this section as an <quote>institution</quote>) shall not be eligible to receive Federal funds from the Department of Education (except funds under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070</external-xref> et seq.) or other Department of Education funds that are provided directly to students) unless the institution ensures that any contract or agreement between the institution and a Confucius Institute includes clear provisions that—</text><paragraph commented="no" display-inline="no-display-inline" id="id3C2E78F82CC948809224C4575ED2476B"><enum>(1)</enum><text display-inline="yes-display-inline">protect academic freedom at the institution;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4B5176FC7FD24AA48E13103E53F81AD0"><enum>(2)</enum><text display-inline="yes-display-inline">prohibit the application of any foreign law on any campus of the institution; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id395ADFFB99844E92825F5DACDA3D71E2"><enum>(3)</enum><text display-inline="yes-display-inline">grant full managerial authority of the Confucius Institute to the institution, including full control over what is being taught, the activities carried out, the research grants that are made, and who is employed at the Confucius Institute.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20210304" chamber="Senate">Passed the Senate March 4, 2021.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
