<congress display="yes">117th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 583</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To promote innovative acquisition techniques and procurement strategies, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="ID31184B49F2724544B4D65217C4705C1A" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Rigorous and Innovative Cost Efficiencies for Federal Procurement and Acquisitions Act of 2021</short-title></quote> or the <quote><short-title>PRICE Act of 2021</short-title></quote>.</text></section><section id="idEAC79F82D8874AB2AFC9D23D44B00E7C" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="id3a621d86afe84f2ca4b887db1e09ab1c" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">small business participation in the Federal marketplace is key to ensuring a strong industrial base;</text></paragraph><paragraph id="id204639A8385C44B483F9EEF254442352" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the Business Opportunity Development Reform Act of 1988 (<external-xref legal-doc="public-law" parsable-cite="pl/100/656">Public Law 100–656</external-xref>) sets forth the requirement for the President to establish Government-wide goals for procurement contracts awarded to small businesses;</text></paragraph><paragraph id="id63ce59c872b441f68c738f0c2fade697" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">each year, the Small Business Administration works with each Federal agency to set their respective contracting goals and publishes a scorecard to ensure that the total of all Federal agency goals meets the required targets for the Federal Government;</text></paragraph><paragraph id="id2a9be09066d742eb8767f0089b528ee8" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">the Department has received among the highest scorecard letter grades 10 years in a row and is the largest Federal agency to have such a track record;</text></paragraph><paragraph id="iddcc0c10d46fc40448f1b7fdb3093d922" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">in virtually every segment of the economy of the United States, including the homeland security community, there are small businesses working to support the mission and playing a critical role in delivering efficient and innovative solutions to the acquisition needs of the Federal Government;</text></paragraph><paragraph id="ida6c5aa1b6d3b4bee8d23c401b1d1c618" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">the Procurement Innovation Lab of the Department—</text><subparagraph id="idC857F55DC0424BC59189C3F66EE3A258" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">is aimed at experimenting with innovative acquisition techniques across the Homeland Security Enterprise;</text></subparagraph><subparagraph id="id8b24505166ab4a6db91e40de0da380eb" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">provides a forum to test new ideas, share lessons learned, and promote best practices;</text></subparagraph><subparagraph id="id7b8cfd273f07462486f49e830f2c0f8f" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">fosters cultural changes that promote innovation and managed risk taking through a continuous cycle of testing, obtaining feedback, sharing information, and retesting where appropriate; and</text></subparagraph><subparagraph id="id05404c68f198400a9146231f37fbdb0e" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">aims to make the acquisition process more smooth and innovative within the construct of the Federal Acquisition Regulation for both the Federal Government and contractors; and</text></subparagraph></paragraph><paragraph id="idDC9F176805D24823B0CABFDA4C6E0966" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">despite progress in the adoption of new and better business practices by many Federal agencies, the overall adoption of modernized business practices and advanced technologies across the Federal Government remains slow and uneven.</text></paragraph></section><section id="idB8D5AAFC59FD4DAB851F6056A57B7B58" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id91E31B2F58D944DAA58835E2ABB0FF5C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator for Federal Procurement Policy.</text></paragraph><paragraph id="idEDD1CDE90AFC4835B4F38FA5302EF26E" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id75c7f7d984934625ae5f22560702011f" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs and the Committee on Small Business and Entrepreneurship of the Senate; and</text></subparagraph><subparagraph id="id903e87a4c7604a5ebb2f0bdad3baedd6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security, the Committee on Oversight and Reform, and the Committee on Small Business of the House of Representatives.</text></subparagraph></paragraph><paragraph id="idE4D1BBD887014578B1DB2A474C31DE68" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Council</header><text display-inline="yes-display-inline">The term <term>Council</term> means the Chief Acquisition Officers Council established under section 1311 of title 41, United States Code.</text></paragraph><paragraph id="id429F792D667D48A0A5ED9A4EBB7AA0EB" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Department</header><text display-inline="yes-display-inline">The term <term>Department</term> means the Department of Homeland Security.</text></paragraph><paragraph id="idF44D1C1A0A3B41468F6E1D0961F0EBB2" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Homeland Security Enterprise</header><text display-inline="yes-display-inline">The term <term>Homeland Security Enterprise</term> has the meaning given the term in section 2211(h) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/661">6 U.S.C. 661(h)</external-xref>).</text></paragraph><paragraph id="id91D38FFB425B4ABDA2F9F77DC05B63B1" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Scorecard</header><text display-inline="yes-display-inline">The term <term>scorecard</term> means the scorecard described in section 868(b) of the National Defense Authorization Act for Fiscal Year 2016 (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644</external-xref> note).</text></paragraph><paragraph id="idC44BF4898BB14000B1649645E1DE3796" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph><paragraph id="id0123FCBA1A014F59834654D26EC2D904" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Small business</header><text display-inline="yes-display-inline">The term <term>small business</term> means—</text><subparagraph id="idAA64A5C07C12435785C209581587BE17" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a qualified HUBZone small business concern, a small business concern, a small business concern owned and controlled by service-disabled veterans, or a small business concern owned and controlled by women, as those terms are defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>);</text></subparagraph><subparagraph id="id6BEA39CFC2A043C9840DFCC88C63A3D4" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a small business concern owned and controlled by socially and economically disadvantaged individuals, as defined in section 8(d)(3)(C) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(d)(3)(C)</external-xref>); or</text></subparagraph><subparagraph id="id5913EEC699B14595892003AAEB15B54B" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">a small business concern unconditionally owned by an economically disadvantaged Indian tribe or an economically disadvantaged Native Hawaiian organization that qualifies as a socially and economically disadvantaged small business concern, as defined in section 8(a)(4) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(a)(4)</external-xref>).</text></subparagraph></paragraph><paragraph id="id436B3C19922C4BAA8CEC0693A7D296B9" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header display-inline="yes-display-inline">Under Secretary</header><text display-inline="yes-display-inline">The term <term>Under Secretary</term> means the Under Secretary for Management of the Department.</text></paragraph></section><section id="idDB4DAF4F9187434793BA383DE2611942" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Procurement Innovation Lab report</header><subsection id="id364619FDD4284C19B9D99C02914D55BB" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">The Under Secretary shall publish an annual report on a website of the Department on Procurement Innovation Lab projects that have used innovative techniques within the Department to accomplish—</text><paragraph id="idBE847572D4624CC6802441B7B0829B67" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">improving or encouraging better competition;</text></paragraph><paragraph id="id8FCD5D6C253B4026A64F70DD05B51F8B" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">reducing time to award;</text></paragraph><paragraph id="idDF5793F0ABCD4A1E896B767C256E89B8" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">cost savings;</text></paragraph><paragraph id="idF8C59DD6CDAE407FBFF19120D73B27F6" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">better mission outcomes; or</text></paragraph><paragraph id="id05A3779F0C1D40178B53A1DA6701DEB7" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">meeting the goals for contracts awarded to small business concerns under section 15(g) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(g)</external-xref>).</text></paragraph></subsection><subsection id="id55b737b7ca2245ba89f1a8442affd10b" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Education</header><text display-inline="yes-display-inline">The Under Secretary shall develop and disseminate guidance and offer training for contracting officers, contracting specialists, program managers, and other personnel of the Department, as determined appropriate by the Under Secretary, concerning when and how to use the innovative procurement techniques of the Department.</text></subsection><subsection id="idF767BE32A4474C9DB7A670429408CF2F" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Best practices</header><text display-inline="yes-display-inline">The Under Secretary shall share best practices across the Department and make available to other Federal agencies information to improve procurement methods and training, as determined appropriate by the Under Secretary.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id8501276605394BB98FEB21A2A809BD96"><enum>(d)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">This section shall cease to be effective on the date that is 3 years after the date of enactment of this Act.</text></subsection></section><section id="id1D06FB30E8CB45839D5B7B927198D02F" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Council</header><subsection id="ID9094F1A9C08E470F98EFD4A6441E648B" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 45 days after the date of enactment of this Act, the Administrator shall convene the Council to examine best practices for acquisition innovation in contracting in the Federal Government, including small business contracting in accordance with the goals established under section 15(g) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(g)</external-xref>).</text></subsection><subsection id="id1FE0E59AE07F433E835CEBF3AF6DB9EB" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Working group</header><text display-inline="yes-display-inline">The Council may form a working group to address the requirements of this section, which, if formed, shall—</text><paragraph id="id41684EB2A03D4CE087D4F4E03A2CAF0F" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">be chaired by the Administrator or a designee of the Administrator; and</text></paragraph><paragraph id="idA35EBAA82DA7471E98578AEFA2DF0692" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">be composed of—</text><subparagraph id="id99EF95AD641944879DFBDE6A617A6EDD" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Chief Procurement Officer of the Department;</text></subparagraph><subparagraph id="id6903C94ECDD940E2B1791B341A587EFF" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">Council members from—</text><clause id="id4C3E76DE1C2A4157AC38AD3F21429C01" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the General Services Administration;</text></clause><clause id="idA1A0DC5D6127449E8E97EAFF3EB9A6C6" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the Department of Defense;</text></clause><clause id="idCAF8FCE4B27B4AE1B60DD14653FB26FC" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">the Department of the Treasury;</text></clause><clause id="idFC41D6517DB24E3CA32C54FF3B13B426" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">the Department of Veterans Affairs;</text></clause><clause id="idC6E90A873299446B888EB2A8247AD472" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">the Department of Health and Human Services;</text></clause><clause id="idB6622EA1BD044639B8B924488A13C9B5" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text display-inline="yes-display-inline">the Small Business Administration; and</text></clause><clause id="idD49AD93FC39945A3A62FBA3613F295EE" commented="no" display-inline="no-display-inline"><enum>(vii)</enum><text display-inline="yes-display-inline">such other Federal agencies as determined by the chair of the Council from among Federal agencies that have demonstrated significant, sustained progress using innovative acquisition practices and technologies, including for small business contracting, during each of the 3 years preceding the date of enactment of this Act; and</text></clause></subparagraph><subparagraph id="id24B1618DE0384C2EB1525730F7729950" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">other employees, as determined appropriate by the chair of the Council, of Federal agencies with the requisite senior experience to make recommendations to improve Federal agency efficiency, effectiveness, and economy, including in promoting small business contracting.</text></subparagraph></paragraph></subsection><subsection id="id8E8961D5A0E9458F9CF34CC179678816" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Duties of the Council</header><text display-inline="yes-display-inline">The Council, or a working group formed under subsection (b), shall—</text><paragraph id="idD335B1E1C5CE497AA5CB8EF88CB1657D" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">convene not later than 90 days after the date of enactment of this Act and thereafter on a quarterly basis until the Council submits the report required under subsection (d)(1); and</text></paragraph><paragraph id="id895B753A1A704FBBA51EC88A3DBAFB58" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">conduct outreach with the workforce and the public in meeting the requirements under subsection (d)(1).</text></paragraph></subsection><subsection id="IDE532E66A39BA47A4B3C6C106FE7AFC3E" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Report</header><paragraph id="id945361F3A6014FBA8BBC696BF6F28B15" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Council shall submit to the appropriate congressional committees a report that describes—</text><subparagraph id="id737ae6fb988c421eb1a9f443c1a4d1ca" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">innovative acquisition practices and applications of technologies that have worked well in achieving better procurement outcomes, including increased efficiency, improved program outcomes, better customer experience, and meeting or exceeding the goals under section 15(g) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(g)</external-xref>), and the reasons why those practices have succeeded;</text></subparagraph><subparagraph id="idb1f1c37d67b84ea495f74e218885a2a1" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">steps to identify and adopt transformational commercial business practices, modernized data analytics, and advanced technologies that allow decision making to occur in a more friction-free buying environment and improve customer experience; and</text></subparagraph><subparagraph id="idefdc5aba95a044589d19d4e7bc6195bd" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">any recommendations for statutory changes to accelerate the adoption of innovative acquisition practices.</text></subparagraph></paragraph><paragraph id="id2EE7498854CC4D918AE3452D31AE1CC5" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Briefing</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Administrator shall brief the appropriate congressional committees on the means by which the findings and recommendations of the report have been disseminated under paragraph (3).</text></paragraph><paragraph id="id7AC2B61EB1E84354B24F91B9648CBEFE" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Publication and dissemination of report findings</header><text display-inline="yes-display-inline">To promote more rapid adoption of acquisition best practices, the Administrator shall—</text><subparagraph id="idF848AAA387394ADDB41240122A9DA724" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">publish the report required under paragraph (1) on the website of the Office of Management and Budget and on the Innovation Hub on the Acquisition Gateway or any successor Government-wide site available for increasing awareness of resources dedicated to procurement innovation; and</text></subparagraph><subparagraph id="id97df9a3193ee44819819f7527c35d974" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">encourage the head of each Federal agency to maintain a site on the website of the Federal agency for acquisition and contracting professionals, program managers, members of the public, and others as appropriate that is—</text><clause id="id6F6A3137B90246A0A13356E37BF369A9" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">dedicated to acquisition innovation; and</text></clause><clause id="id4C7FA2D5E73849239732BCD209F6797F" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">identifies—</text><subclause id="id7957be1299ec49bfbfd61d7a7c484300" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">resources, including the acquisition innovation advocate and industry liaison of the Federal agency;</text></subclause><subclause id="idd6d4987675ec4cb39bd1df1cf2631b71" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">learning assets for the workforce, including the findings and recommendations made in the report required under paragraph (1);</text></subclause><subclause id="id1c1912a04df64e92b5b7e397cb5304e2" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">events to build awareness and understanding of innovation activities;</text></subclause><subclause id="id5b17d386974b4a02ac26d6bd7da1345e" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text display-inline="yes-display-inline">award recognition programs and recent recipients;
