which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize the Neighborhood Stabilization Program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Affordable Housing Redevelopment Act</short-title></quote>.</text></section><section id="idDEDBF4840CFE4CD28F4382BA32399E91"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="id4efd4c2b7f6043cb85fcb69ca4cfb69f"><enum>(1)</enum><text>even before the economic hardship caused by the COVID–19 pandemic, the United States faced a shortage of more than 7,000,000 affordable rental homes to meet the needs of extremely low-income renters;</text></paragraph><paragraph id="idd86fdd7a4ac9445cb8ba26038e74fe23"><enum>(2)</enum><text>due to financial burdens and loss of income resulting from the pandemic, millions of people in the United States are at risk of eviction or foreclosure, and the need for affordable housing is expected to increase dramatically;</text></paragraph><paragraph id="id68603f13d5ca4531b6efdb2b752f9247"><enum>(3)</enum><text>homelessness is projected to rise by as much as 45 percent across the United States as a result of the pandemic and economic crisis, meaning nearly 1,000,000 people in the United States could be experiencing homelessness in the very near future;</text></paragraph><paragraph id="id6bb7efcfd2dd48be88076e371213bde1"><enum>(4)</enum><text>in addition to making long-term investments in the affordable housing stock in the United States, it is also critically important to focus resources on more immediate solutions, such as acquiring and rehabilitating existing buildings and placing affordability requirements on the housing that is produced;</text></paragraph><paragraph id="id27f0170c37774fa99c3cb5a0ba3deb6b"><enum>(5)</enum><text>acquisition and rehabilitation provides two distinct advantages by lowering per-unit construction costs and making affordable housing units available to low-income households much faster;</text></paragraph><paragraph id="id1f0938aad7dd4e6c97ac13232477d715"><enum>(6)</enum><text>in addition to rehabilitation of residential properties, there are opportunities for adaptive reuse and the conversion of non-residential office and retail properties to create new affordable housing in communities across the United States; and </text></paragraph><paragraph id="idf0bdf6140e9848e1a3e4705e9be01aab"><enum>(7)</enum><text>helping States, local governments, and nonprofit organizations acquire blighted, abandoned, vacant, foreclosed, or surplus properties and convert them into affordable housing will allow for the rapid development of new affordable units, while stimulating local economies and creating jobs.</text></paragraph></section><section id="id6D640F87EE4A4D4CA709C595D07A5733"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idB2605B75B60842F9A4AFCD92100AC0DB"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="idc44fac1fc9e84902981b8a2588982866"><enum>(A)</enum><text>a State, a city, county, or other political subdivision of a State, a consortium of political subdivisions of a State, a Tribal government, a public housing authority, or a redevelopment agency; or</text></subparagraph><subparagraph id="id522BBE76A8754A34AA002469E384A00F"><enum>(B)</enum><text>any nonprofit entity or consortium of nonprofit entities, which may submit an application for a grant under this section in partnership with a for-profit entity.</text></subparagraph></paragraph><paragraph id="id3DB4EE39A34C4CB19CC7C230D58AE9ED"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph></section><section id="idE8FE17724081477C87BB603804CCBB41"><enum>4.</enum><header>Reauthorization of Neighborhood Stabilization Program</header><subsection id="id30869E82296C4F1489B279E5477F4ABA"><enum>(a)</enum><header>Authorization of funds</header><paragraph id="idFED985BAEEEF4980BE946A4B129F9727"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary $1,500,000,000 for fiscal year 2021, to remain available until expended, for the provision of emergency assistance for the redevelopment of abandoned and foreclosed homes, as authorized under title III of division B of the Housing and Economic Recovery Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/110/289">Public Law 110–289</external-xref>), in addition to other related uses of funds authorized under this section.</text></paragraph><paragraph id="id9CA1D9C1FC114CDBAAB52E2EBCA079A8"><enum>(2)</enum><header>Applicability of provisions</header><subparagraph id="idDD3D69203CA94EE389DBD65B444156D4"><enum>(A)</enum><header>In general</header><text>Except as otherwise provided in this section, the provisions under the second undesignated paragraph under the heading <quote><header-in-text level="appropriations-small" style="appropriations">community development fund</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="appropriations">community planning and development</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-major" style="appropriations">department of housing and urban development</header-in-text></quote> in title XII of division A of the American Recovery and Reinvestment Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law 111–5</external-xref>) relating to assistance authorized under title III of division B of the Housing and Economic Recovery Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/110/289">Public Law 110–289</external-xref>) shall apply with respect to the emergency assistance authorized under paragraph (1).</text></subparagraph><subparagraph id="id5DCCF6D4C40B47538A19540941D1DB98"><enum>(B)</enum><header>Certain criteria not applicable</header><text>The fourth proviso in the second undesignated paragraph described in subparagraph (A) of this paragraph (relating to grantees in areas with foreclosures and the ability to expend funding within a certain period) shall not apply with respect to the emergency assistance authorized under paragraph (1) of this subsection.</text></subparagraph></paragraph></subsection><subsection id="idF6127C74DDF4424EAEE8D80E150E8E70"><enum>(b)</enum><header>Grants; application</header><paragraph id="id227E7EB7D7724401A61B22E4C0190BFD"><enum>(1)</enum><header>In general</header><text>The Secretary shall award grants under this section to eligible entities through a competitive process.</text></paragraph><paragraph id="id9ADF6092B1A54563939764D01357E29B"><enum>(2)</enum><header>Criteria</header><text>Not later than 75 days after the date of enactment of this Act, the Secretary shall publish the criteria for awarding grants under this section.</text></paragraph><paragraph id="id3835072AB73043449AD986537037881C"><enum>(3)</enum><header>Application</header><text>An eligible entity desiring a grant under this section shall submit to the Secretary an application—</text><subparagraph id="id0FA6C7DAA42148758C2675BBD3F03A98"><enum>(A)</enum><text>in such manner and containing such information as the Secretary may require; </text></subparagraph><subparagraph id="idF73BE8F31653480584F43C2D7968B1BB"><enum>(B)</enum><text>that demonstrates a capacity to execute projects and leverage potential, and any other additional factors as determined by the Secretary; and</text></subparagraph><subparagraph id="id7CD597F0EF2942FC95FE8F6A9A8336A3"><enum>(C)</enum><text>not later than 200 days after the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="id8F2429EF11624E01ACF61DEF3B00AF3B"><enum>(4)</enum><header>Preference</header><text>The Secretary shall award preference to an application for a grant under this section to applicants that submit proposals—</text><subparagraph id="id32BF817418DA4DA2AF31322415F70563"><enum>(A)</enum><text>to provide assistance in areas with high levels of cost-burdened households; </text></subparagraph><subparagraph id="idB8E5F58875AA4BE08354F6796DEC1F0A"><enum>(B)</enum><text>to provide assistance in rural areas;</text></subparagraph><subparagraph id="idf8c2df32f76348ecb02673a021aad243"><enum>(C)</enum><text>to provide assistance in communities that have adopted local land-use policies, building codes, or related regulations that favor greater housing production, such as—</text><clause id="idCD8E5FED912941E1B43222FF0D124DE2"><enum>(i)</enum><text>allowing greater density near public transportation lines;</text></clause><clause id="id7AA38A06E00E46EBBFD8C58F1D2600DA"><enum>(ii)</enum><text>establishing by-right development;</text></clause><clause id="id4B5591B40D7B45C6AD1805E2C935FF1A"><enum>(iii)</enum><text>eliminating off-street parking requirements;</text></clause><clause id="idD6FE83B5AEAB4D3AA67D5DC93D2C18AD"><enum>(iv)</enum><text>granting density bonuses;</text></clause><clause id="id6715147D3253483FA7E4CEEC84165625"><enum>(v)</enum><text>employing inclusionary zoning;</text></clause><clause id="id07B8A66932CF4559B0D6B3D9FA8429DC"><enum>(vi)</enum><text>relaxing minimum lot sizes;</text></clause><clause id="id9DEFF6C7639C4187B50975411C5FE83C"><enum>(vii)</enum><text>authorizing conversion of commercial properties into mixed-use and residential properties; or</text></clause><clause id="idE907C649837342288B0F9D8EA4C831A2"><enum>(viii)</enum><text>other local land-use policies, building codes, or related regulations that favor greater housing production;</text></clause></subparagraph><subparagraph id="id70EBBA5388744AB6BB7F12F001FAE3FB"><enum>(D)</enum><text>to provide assistance in areas that are in close proximity to high-frequency public transportation; or</text></subparagraph><subparagraph id="id604B15AF36EE4FFDA0BCDEBA0D8BAFE9"><enum>(E)</enum><text>that have a higher proportion of affordable units for households with incomes that are less than 50 percent of the area median income.</text></subparagraph></paragraph><paragraph id="idCCB2C9E97A8D4767A945ECFB9D16E401"><enum>(5)</enum><header>Diversity</header><text>In awarding grants under this section, the Secretary shall ensure a geographic diversity of grantees from across the United States.</text></paragraph></subsection><subsection id="idDB5A5492919B4B74ACAFFCBC5561A6B9"><enum>(c)</enum><header>Use of funds</header><paragraph id="id9CDCEDE9D81B4FC486A12518FC68244F"><enum>(1)</enum><header>In general</header><text>A recipient of a grant under this section—</text><subparagraph id="id0D8E663088B34222BD0463E970FAF85D"><enum>(A)</enum><text>shall use grant funds to purchase blighted, abandoned, vacant, foreclosed, or surplus property and convert the property into affordable housing, which shall serve individuals and families with a household income that does not exceed the area median income; </text></subparagraph><subparagraph id="id7A24BEF2E71647329CDE7C1B6B89C027"><enum>(B)</enum><text>may use grant funds for mixed-use development projects, conversion of non-residential office and retail properties, and other redevelopment requiring changes to land use restrictions; and</text></subparagraph><subparagraph id="idCBB51EA66C6D47C6912541D7CDF19405"><enum>(C)</enum><text>shall, to the maximum extent feasible—</text><clause id="idD3CB3D6B29AB4B2DB1B936B4B6528DCA"><enum>(i)</enum><text>provide for the hiring of employees who reside in the vicinity, as such term is defined by the Secretary, of projects funded under this section; or</text></clause><clause id="idE1632256AFDF4D11BD4EE174B3EA3476"><enum>(ii)</enum><text>contract with small business concerns owned and controlled by socially and economically disadvantaged individuals (as defined in section 8(d)(3)(C) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(d)(3)(C)</external-xref>)) residing in the vicinity of projects funded under this section.</text></clause></subparagraph></paragraph><paragraph commented="no" id="id05B04D55DDBE4B7F9F87C0BA1E845B8A"><enum>(2)</enum><header>Set aside for extremely low-income and very low-income families</header><text>Not less than 25 percent of the affordable housing described in paragraph (1) shall service individuals and families with a household income that does not exceed 50 percent of the area median income.</text></paragraph><paragraph commented="no" id="id484F744ED6DD41829855CCDDA3227E18"><enum>(3)</enum><header>Affordability periods</header><subparagraph commented="no" id="id7ADF7493E91742FEBEC1074FA9C62C88"><enum>(A)</enum><header>In general</header><text>The affordability period for housing assisted under this section—</text><clause commented="no" id="idA2F3F99EF37D4B14855019453AC53C14"><enum>(i)</enum><text>with respect to rental housing or housing with resale restrictions, shall be not less than 30 years, beginning on project completion; and</text></clause><clause commented="no" id="id5140A8700CAC4571B8E8DEA8748B22BE"><enum>(ii)</enum><text>with respect to housing with recapture restrictions, shall be not less than 10, 20, or 30 years in accordance with the affordability period requirements under section 93.305 of title 24, Code of Federal Regulations, or any successor regulation.</text></clause></subparagraph><subparagraph commented="no" id="idF2A52FC8E883468994C3BA231DB72DC8"><enum>(B)</enum><header>Longer periods permitted</header><text>Nothing in subparagraph (A) shall be construed to prohibit a recipient of a grant under this section from establishing a longer affordability period than is required under that subparagraph.</text></subparagraph></paragraph><paragraph id="id7A7AAD63E19A496C895D5D173D33ABBB"><enum>(4)</enum><header>Deadline for expending funds</header><text>A recipient of a grant under this section shall expend—</text><subparagraph id="idBA678FDDF5DB47F3A8F718515B4FC3B8"><enum>(A)</enum><text>not less than 50 percent of allocated funds under this section not later than 3 years after the date on which the funds become available to the grantee for obligation; and </text></subparagraph><subparagraph id="id7038D4555F6448BBA42D3F8CA43E5948"><enum>(B)</enum><text>100 percent of allocated funds under this section not later than 6 years after the date on which the funds become available to the grantee for obligation.</text></subparagraph></paragraph></subsection><subsection id="ide8c73de2c0a14854b0e184a967b1aba0"><enum>(d)</enum><header>Technical assistance</header><paragraph id="idAF6C2B96C1D246C1A2CC6F1EE6CFEFB1"><enum>(1)</enum><header>In general</header><text>The Secretary may use not more than 2 percent of the funds made available under this section to provide technical assistance to grantees under this section.</text></paragraph><paragraph id="id07FAEE478959473F963273A85FC803D8"><enum>(2)</enum><header>Sense of Congress</header><text>It is the sense of Congress that, to the extent practicable, the Secretary shall provide technical assistance directly to grantees under this section.</text></paragraph></subsection><subsection id="id3DF0E673C17E4378B8CCCBE8F4EE39E4"><enum>(e)</enum><header>Deadline for awarding funds</header><text>The Secretary shall award all grant funds authorized under this section not later than 1 year after the date of enactment of this Act.</text></subsection><subsection id="idE0DAD93C148A46978240B87363BE848E"><enum>(f)</enum><header>Existing regulations</header><text>Except to the extent that a regulation is in conflict with the provisions of this Act, the regulations applicable to the provision of emergency assistance for the redevelopment of abandoned and foreclosed homes, as authorized under title III of division B of the Housing and Economic Recovery Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/110/289">Public Law 110–289</external-xref>) and subsequent Acts, as in effect on the day before the date of enactment of this Act, shall apply to the provision of assistance under this Act.</text></subsection></section></legis-body></bill>
