<congress display="yes">117th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 578</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To improve the health and safety of Americans living with food allergies and related disorders, including potentially life-threatening anaphylaxis, food protein-induced enterocolitis syndrome, and eosinophilic gastrointestinal diseases, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="id854918dc3b5f42429b623e0eae6dc147" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food Allergy Safety, Treatment, Education, and Research Act of 2021</short-title></quote> or the <quote><short-title>FASTER Act of 2021</short-title></quote>.</text></section><section id="id1f194347d537486f9e1626de2155acc2" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Food allergy safety</header><subsection id="idc3ae7b9e438c4530a6d073c186eed737" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 201(qq)(1) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(qq)(1)</external-xref>) is amended by striking <quote>and soybeans</quote> and inserting <quote>soybeans, and sesame</quote>. </text></subsection><subsection id="id75daeca9a6974010b2f6fa7a42884057" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply to any food that is introduced or delivered for introduction into interstate commerce on or after January 1, 2023.</text></subsection></section><section id="id667777b98a304eb1afa0484951c0f75d" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Report to Congress</header><subsection id="idacde368d971a472091ff1b084b7b0f90" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Secretary of Health and Human Services (referred to in this section as the <quote>Secretary</quote>) shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that includes—</text><paragraph id="id735c8686a3f643da83977dd48cfbc56e" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">descriptions of ongoing Federal activities related to—</text><subparagraph id="id07a9cdcea59a4682b9d3a34578d05197" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the surveillance and collection of data on the prevalence of food allergies and severity of allergic reactions for specific food or food ingredients, including the identification of any gaps in such activities;</text></subparagraph><subparagraph id="id2d465ce24b6249ee8d88b76c57421758" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the development of effective food allergy diagnostics;</text></subparagraph><subparagraph id="id43379cfc3c2b4695b03aff1b41b61984" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the prevention of the onset of food allergies;</text></subparagraph><subparagraph id="id811bbf1394b945f1add2cddfae395aaa" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the reduction of risks related to living with food allergies; and</text></subparagraph><subparagraph id="id46cf0781c10e46fbadd3faf97cec71d9" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">the development of new therapeutics to prevent, treat, cure, and manage food allergies; and</text></subparagraph></paragraph><paragraph id="idfcb91ef117ff4207936eb6207e5d0a57" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">specific recommendations and strategies to expand, enhance, or improve activities described in paragraph (1), including—</text><subparagraph id="idd07513a10e494260a9ade2c0f4da862b" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">strategies to improve the accuracy of food allergy prevalence data by expanding and intensifying current collection methods, including support for research that includes the identification of biomarkers and tests to validate survey data and the investigation of the use of identified biomarkers and tests in national surveys;</text></subparagraph><subparagraph id="id41a6717b2df44ee88a1d986b544ea3eb" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">strategies to overcome gaps in surveillance and data collection activities related to food allergies and specific food allergens; and</text></subparagraph><subparagraph id="idf3bb8bb1e47c4e7987f80140f7a39cc0" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">recommendations for the development and implementation of a regulatory process and framework that would allow for the timely, transparent, and evidence-based modification of the definition of <quote>major food allergen</quote> included in section 201(qq) of the Federal Food, Drug and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(qq)</external-xref>), including with respect to—</text><clause id="idE1A03C0294B242F8B87CE34A3A82A018" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the scientific criteria for defining a food or food ingredient as a <quote>major food allergen</quote> pursuant to such process, including recommendations pertaining to evidence of the prevalence and severity of allergic reactions to a food or food ingredient that would be required in order to establish that such food or food ingredient is an allergen of public health concern appropriate for such process; and</text></clause><clause id="id884894630B7C45C2A01D93C6451B2CC4" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">opportunities for stakeholder engagement and comment, as appropriate, in considering any such modification to such definition.</text></clause></subparagraph></paragraph></subsection><subsection id="idcd37bc5fc10d46d9979edfb9f76e5826" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Publication</header><text display-inline="yes-display-inline">The Secretary shall make the report under subsection (a) available on the internet website of the Department of Health and Human Services.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20210303" chamber="Senate">Passed the Senate March 3, 2021.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
