which was read twice and referred to the <committee-name committee-id="SSCM00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>December 16, 2021</action-date><action-desc>Reported by <sponsor name-id="S275">Ms. Cantwell</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To amend title 14, United States Code, to require the Coast Guard to conduct icebreaking operations in the Great Lakes to minimize commercial disruption in the winter months, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HF3F74DBA05A44B469A435B055F8FD38A"><section section-type="section-one" id="H9227424D6F754DA2A3EBFA3D97B6ED4C" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Great Lakes Winter Commerce Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="H6497E954566C494BB87E55D594342A80" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>2.</enum><header>Great Lakes icebreaking operations</header><subsection id="HB6AF3BDD28734F07A43F02A68753DA36"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/5">chapter 5</external-xref> of title 14, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HAF85321F0D3B4CA78EC37B38731B9ADD" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><section id="HBB6CE9AE483E4CE18DF9496BEB2BBD82"><enum>564.</enum><header>Great Lakes icebreaking operations</header><subsection id="H2C8E7A3BCED24B6F865882795F161C4A"><enum>(a)</enum><header>Icebreaking operations</header><text display-inline="yes-display-inline">The Commandant shall conduct icebreaking operations in the Great Lakes in accordance with the standard for icebreaking operations under subsection (b).</text></subsection><subsection id="HB092B23D12CB4F2F9D58073754A019FF"><enum>(b)</enum><header>Standard for icebreaking operations</header><text>In carrying out subsection (a)—</text><paragraph id="H74C48E63AFC64511A27F11C5A99B3597"><enum>(1)</enum><text display-inline="yes-display-inline">except as provided in paragraph (2), the Commandant shall keep ice-covered waterways in the Great Lakes open to navigation not less than 90 percent of the hours that commercial vessels and ferries attempt to transit such ice-covered waterways; and</text></paragraph><paragraph id="HB7A2636FD32A4A9A89B787CAEEA7FC42"><enum>(2)</enum><text display-inline="yes-display-inline">in a year in which the Great Lakes are not open to navigation because of ice of a thickness that occurs on average only once every 10 years, the Coast Guard shall keep ice-covered waterways in the Great Lakes open to navigation at least 70 percent of the hours that commercial vessels and ferries attempt to transit such ice-covered waterways.</text></paragraph></subsection><subsection id="HAF1CF8EF521445F9B89F0EEA409780CA"><enum>(c)</enum><header>Report to Congress</header><paragraph id="H57D47A519A224370A200A377681DFB8A"><enum>(1)</enum><header>Deadline</header><text display-inline="yes-display-inline">Not later than July 1 of each year, the Commandant shall submit to Congress a report on the icebreaking operations conducted by the Coast Guard in the Great Lakes for the fiscal year.</text></paragraph><paragraph id="H858F397A4E614FCA90D8EA727EDC8211"><enum>(2)</enum><header>Content</header><text display-inline="yes-display-inline">The report required under paragraph (1) shall include the total number of hours that United States icebreakers conducted icebreaking operations in each of the types of Great Lakes waters described in paragraph (3) and the total number of hours that Canadian icebreakers conducted icebreaking operations in the type of Great Lakes waters described in subparagraphs (3)(A) and (3)(C).</text></paragraph><paragraph id="H0783DEA185A24A76A4F8E77B1B758589"><enum>(3)</enum><header>Types of Great Lakes waters</header><text display-inline="yes-display-inline">The types of waters described in this paragraph are—</text><subparagraph id="H9E31C0D2BC3046EEBB1CE0EC1F44F533"><enum>(A)</enum><text display-inline="yes-display-inline">United States waters, excluding waters described in subparagraph (C);</text></subparagraph><subparagraph id="H2CA0D81BF8D1485F93F348C0D7C424B2"><enum>(B)</enum><text display-inline="yes-display-inline">Canadian waters, excluding waters described in subparagraph (C); and</text></subparagraph><subparagraph id="HE436E7D09580451EB279AA99D0DDB620"><enum>(C)</enum><text>frequent border crossing waters.</text></subparagraph></paragraph></subsection><subsection id="H79B347A497C1487FAD336862BD3B869D"><enum>(d)</enum><header>Coordination with industry</header><text display-inline="yes-display-inline">The Commandant shall coordinate Great Lakes icebreaking operations with operators of commercial vessels.</text></subsection><subsection id="H9769C2069B7F4386BA206E730023EF1B"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H6E5A88703C9B42D681360CB2E822D6AF"><enum>(1)</enum><header>Commercial vessel</header><text display-inline="yes-display-inline">The term <quote>commercial vessel</quote> means any privately owned cargo vessel of at least 500 tons, as measured under section 14502 of title 46 or an alternate tonnage measured under section 14302 of such title as prescribed by the Secretary under section 14104 of such title, operating in the Great Lakes during the winter season.</text></paragraph><paragraph id="H41BE39E80C264D78BA0803D5F6569E1A"><enum>(2)</enum><header>Great Lakes</header><text display-inline="yes-display-inline">The term <quote>Great Lakes</quote>—</text><subparagraph id="id60C05C15FF484D238205D2BDB45046EE"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given such term in section 118 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1268">33 U.S.C. 1268</external-xref>); and </text></subparagraph><subparagraph id="idB2B5DFACB4234C5DB5464187C3847F6D"><enum>(B)</enum><text>includes harbors.</text></subparagraph></paragraph><paragraph id="H135DD89529E141DE9A7F83AA80A430D3"><enum>(3)</enum><header>Ice-covered waterway</header><text display-inline="yes-display-inline">The term <quote>ice-covered waterway</quote> means any portion of the Great Lakes in which commercial vessels operate that is 70 percent or greater covered by ice, but does not include any waters adjacent to piers or docks for which commercial icebreaking services are available and adequate for the ice conditions.</text></paragraph><paragraph id="HAAEC697DE9A5499BBD245E6A06D94E1C"><enum>(4)</enum><header>Open to navigation</header><text display-inline="yes-display-inline">The term <quote>open to navigation</quote> means navigable to the extent necessary to meet the reasonable demands of commerce, minimize delays to passenger ferries, extricate vessels and persons from danger, prevent damage due to flooding, and conduct other Coast Guard missions as required.</text></paragraph><paragraph id="HD8E6CF874B3B446DA9DD1515CE0DDB7A"><enum>(5)</enum><header>Reasonable demands of commerce</header><text display-inline="yes-display-inline">The term <quote>reasonable demands of commerce</quote> means the safe movement of commercial vessels transiting ice-covered waterways in the Great Lakes, regardless of type of cargo, at a speed consistent with the design capability of Coast Guard icebreakers operating in the Great Lakes.</text></paragraph><paragraph id="HE664A0000F4B48C1A75F60C27E5C6A21"><enum>(6)</enum><header>Frequent border crossing waters</header><text display-inline="yes-display-inline">The term <quote>frequent border crossing waters</quote> means the United States waters and Canadian waters of—</text><subparagraph id="H9E01F62F943E49919775DEB6099D354A"><enum>(A)</enum><text>Whitefish Bay in Lake Superior;</text></subparagraph><subparagraph id="H3EA560A7F123412893ACC1C46BD7FD39"><enum>(B)</enum><text>the St. Mary’s River;</text></subparagraph><subparagraph id="H0C5DFB33ED8447239F2A72B5CA121EB4"><enum>(C)</enum><text>the Detroit and St. Clair rivers system; and</text></subparagraph><subparagraph id="H13CD42136EF649F2B62B902DDF4F7473"><enum>(D)</enum><text display-inline="yes-display-inline">Western Lake Erie from the Detroit River to Pelee Passage.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8AB021FD2C93478AAC1865BE9FC85929"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/5">chapter 5</external-xref> of title 14, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HCE07FB9C14544E60856FFAB488C8037F" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><toc regeneration="no-regeneration" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><toc-entry level="section">564. Great Lakes icebreaking operations.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2362A929C65E4BE096E878FCB728C044"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than the first July 1 after the first winter in which the Commandant of the Coast Guard is subject to the requirements of section 564 of title 14, United States Code, the Commandant shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the cost to the Coast Guard of meeting the requirements of such section.</text></subsection></section><section id="HFE3F25C2BF9842E8A62D22B1726A468A" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>3.</enum><header>Great Lakes icebreaker acquisition</header><subsection id="HB81D8B45C19C459BAE46AFDB6D590217"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">Section 8107(a) of the Elijah E. Cummings Coast Guard Authorization Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>) is amended by striking <quote>$160,000,000</quote> and inserting <quote>$350,000,000</quote>.</text></subsection><subsection id="H9BA39AF44A9F40E589C335706E7019B9"><enum>(b)</enum><header>Exemption</header><text display-inline="yes-display-inline">Notwithstanding sections 1105(a)(2), 1131, and 1132 of title 14, United States Code, and the requirements in the Competition in Contracting Act (<external-xref legal-doc="usc" parsable-cite="usc/10/2304">10 U.S.C. 2304</external-xref>), and subject to the availability of appropriations, the Commandant shall acquire the icebreaker described in section 8107(a) of the Elijah E. Cummings Coast Guard Authorization Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>) through other than full and open competition in an accelerated timeframe and award the contract on the basis of contractor qualification and price.</text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="id5ab5637a-4030-4326-b71c-17a2f98f052a" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Great Lakes Winter Commerce Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="idfc002eb1-c3ee-404d-b9ad-b0b4b1db845f" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>2.</enum><header>Great Lakes icebreaking operations</header><subsection id="id42ff4af6-ae4d-407a-a439-a6c4d4e6f93f"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/5">chapter 5</external-xref> of title 14, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="id32d6b282-ef92-42d8-9853-68c16be3c721" changed="added" reported-display-style="italic" committee-id="SSCM00"><section id="id1c370f37-87dd-4539-a220-4cafcb0665e2"><enum>564.</enum><header>Great Lakes icebreaking operations</header><subsection id="id0fb2faca-2b00-45d6-a210-c18be469aa38"><enum>(a)</enum><header>GAO report</header><paragraph id="id8F7D8E309B9E43FC98294C1D3F45CC7F"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this section, the Comptroller General of the United States shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report on the Coast Guard Great Lakes icebreaking program.</text></paragraph><paragraph id="id761B716352374D5DBC90084C2C927D27"><enum>(2)</enum><header>Elements</header><text>The report required under paragraph (1) shall include the following:</text><subparagraph id="id6F40FF3D086241319BD3BDF9FB899307"><enum>(A)</enum><text>An evaluation of the economic impact related to vessel delays or cancellations associated with ice coverage on the Great Lakes.</text></subparagraph><subparagraph id="idBC2AC5D4E3D243789645EA6484854A68"><enum>(B)</enum><text>An evaluation of mission needs.</text></subparagraph><subparagraph id="idD37BE8C0928A4115A87EABC32845F10E"><enum>(C)</enum><text>An evaluation of the impact that the proposed standards described in subsection (b) would have on—</text><clause id="id8E68D90E135F4D518CB44429027F5B81"><enum>(i)</enum><text>Coast Guard operations in the Great Lakes; </text></clause><clause id="id1CC528E2B9CB43958421E25E14275C0F"><enum>(ii)</enum><text>Northeast icebreaking missions; and</text></clause><clause id="idCB58ADB36420494B9E39BE42C8F7B691"><enum>(iii)</enum><text>inland waterway operations.</text></clause></subparagraph><subparagraph id="idCD6577C152284821B10FAA1A52EA7CE3"><enum>(D)</enum><text>A fleet mix analysis for meeting such proposed standards.</text></subparagraph><subparagraph id="id5DB0488DA1DC4BC896CC5014110D15EC"><enum>(E)</enum><text>A description of any resources necessary to support the fleet mix resulting from such fleet mix analysis, including for crew and operating costs.</text></subparagraph><subparagraph id="id9978432BBBD54F6E8146DDECF6260313"><enum>(F)</enum><text>Recommendations to the Commandant for improvements to the Great Lakes icebreaking program, including with respect to facilitating commerce and meeting all Coast Guard mission needs.</text></subparagraph></paragraph></subsection><subsection id="idea3c51b3-383a-4c90-a3c6-fe5cb3902cd4"><enum>(b)</enum><header>Proposed standards for icebreaking operations</header><text>The proposed standards described in this subsection are the following:</text><paragraph id="ide2513cfd-e7e5-4332-ba93-e6ce93aaec35"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (2), the Commandant shall keep ice-covered waterways in the Great Lakes open to navigation not less than 90 percent of the hours that commercial vessels and ferries attempt to transit such ice-covered waterways.</text></paragraph><paragraph id="id8f628f0e-d6b3-4b7c-84a4-72c8fcd8bd8a"><enum>(2)</enum><text display-inline="yes-display-inline">In a year in which the Great Lakes are not open to navigation because of ice of a thickness that occurs on average only once every 10 years, the Commandant shall keep ice-covered waterways in the Great Lakes open to navigation at least 70 percent of the hours that commercial vessels and ferries attempt to transit such ice-covered waterways.</text></paragraph></subsection><subsection id="id3055f6a8994b4e088c88cbed688c8794"><enum>(c)</enum><header>Report by Commandant</header><text>Not later than 90 days after the date on which the Comptroller General submits the report under subsection (a), the Commandant shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that includes the following:</text><paragraph id="idD14EB4BD360346F18D658788C14402C9"><enum>(1)</enum><text>A plan for Coast Guard implementation of any recommendation made by the Comptroller General under subparagraph (F) of subsection (a)(2) the Commandant considers appropriate.</text></paragraph><paragraph id="idF0BFFF88B5E341E583CBFFF8660B92E0"><enum>(2)</enum><text>With respect to any recommendation made under such subparagraph that the Commandant declines to implement, a justification for such decision.</text></paragraph><paragraph id="id7082B8B7AB79468A966A4F8330D2B8D8"><enum>(3)</enum><text>A review of, and a proposed implementation plan for, the results of the fleet mix analysis under subparagraph (D) of that subsection.</text></paragraph><paragraph id="idFC2C488377B64F508CEA3467E0078ED2"><enum>(4)</enum><text>Any proposed modifications to the standards for icebreaking operations in the Great Lakes.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id38efe330-a173-4334-bdcc-a138ebbeb9ef"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/5">chapter 5</external-xref> of title 14, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="id0f8b9b63-3cd9-4dfd-b6c0-545e162775a7" changed="added" reported-display-style="italic" committee-id="SSCM00"><toc regeneration="no-regeneration" changed="added" reported-display-style="italic" committee-id="SSCM00"><toc-entry level="section">564. Great Lakes icebreaking operations.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id2936C9AB83D74E82A836DEFF142CE4F0" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>3.</enum><header>Database on icebreaking operations in the Great Lakes</header><subsection id="id5E062C67DE654CA78EED1D1BF0D51B9D"><enum>(a)</enum><header>In general</header><text>The Commandant of the Coast Guard (referred to in this Act as the <quote>Commandant</quote>) shall establish and maintain a database for collecting, archiving, and disseminating data on icebreaking operations and commercial vessel transit in the Great Lakes during ice season. </text></subsection><subsection id="id49122E1BBA634538B7011461EEF0F8BA"><enum>(b)</enum><header>Elements</header><text>The database required under subsection (a) shall include the following:</text><paragraph id="ide7c3ebf7de874ae58b846f35dd311b4f"><enum>(1)</enum><text>Attempts by commercial vessels and ferries to transit ice-covered waterways in the Great Lakes that are unsuccessful because of inadequate icebreaking.</text></paragraph><paragraph id="id4CFD7376F77E4E6AA6DA05E0F05C8A3F"><enum>(2)</enum><text>The period of time that each commercial vessel or ferry was unsuccessful at transiting due to inadequate icebreaking.</text></paragraph><paragraph id="idBBD9220578B44EFF83C82C4DECFDAA02"><enum>(3)</enum><text>The amount of time elapsed before each such commercial vessel or ferry was successfully broken out of the ice and whether it was accomplished by the Coast Guard or commercial icebreaking assets.</text></paragraph><paragraph id="id88E5F310F9154E13AE38FD0F1786BF65"><enum>(4)</enum><text>Relevant communications of each such commercial vessel or ferry with the Coast Guard and commercial icebreaking services during such period.</text></paragraph><paragraph id="id3007AFF7BD1A40DA88084EF2E78DB83D"><enum>(5)</enum><text>A description of any mitigating circumstance, such as Coast Guard icebreaker diversions to higher priority missions that may have contributed to the amount of time described in paragraph (3). </text></paragraph></subsection><subsection id="id8308E755DCD54A459243462E3791CC75"><enum>(c)</enum><header>Voluntary reporting</header><text>Any reporting by operators of commercial vessels or ferries under this Act shall be voluntary.</text></subsection><subsection id="id15C89AE5953C4CD298F98B79FCF12711"><enum>(d)</enum><header>Public availability</header><text>The Commandant shall make the database available to the public on a publicly accessible internet website of the Coast Guard.</text></subsection><subsection id="idf9284d29-3290-4b24-88eb-8f14927b611e"><enum>(e)</enum><header>Consultation with industry</header><text display-inline="yes-display-inline">With respect to the Great Lakes icebreaking operations of the Coast Guard and the development of the database required under subsection (a), the Commandant shall consult operators of commercial vessels and ferries.</text></subsection><subsection id="ida86e11a0-ba4f-4678-bc3d-2c910d433d1f"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="idf9e8f057-e711-441f-867d-5b0025a64593"><enum>(1)</enum><header>Commercial vessel</header><text display-inline="yes-display-inline">The term <term>commercial vessel</term> means any privately owned cargo vessel of at least 500 tons, as measured under section 14502 of title 46, or an alternate tonnage measured under section 14302 of such title as prescribed by the Secretary under section 14104 of such title, operating in the Great Lakes during the winter season.</text></paragraph><paragraph id="ida13d863e-6d4a-41b2-8534-a9a7410d512c"><enum>(2)</enum><header>Great Lakes</header><text display-inline="yes-display-inline">The term <term>Great Lakes</term> means the United States waters of Lake Superior, Lake Michigan, Lake Huron, Lake Erie, and Lake Ontario, their connecting waterways, and their adjacent harbors.</text></paragraph><paragraph id="id0554a258-7dc5-417a-9890-92216baad0f4"><enum>(3)</enum><header>Ice-covered waterway</header><text display-inline="yes-display-inline">The term <term>ice-covered waterway</term> means any portion of the Great Lakes in which commercial vessels operate that is 70 percent or greater covered by ice, but does not include any waters adjacent to piers or docks for which commercial icebreaking services are available and adequate for the ice conditions.</text></paragraph><paragraph id="idee1e6a5b-70fc-4c9e-8431-0ce4ac868014"><enum>(4)</enum><header>Open to navigation</header><text display-inline="yes-display-inline">The term <term>open to navigation</term> means navigable to the extent necessary to meet the reasonable demands of commerce, minimize delays to passenger ferries, extricate vessels and persons from danger, prevent damage due to flooding, and conduct other Coast Guard missions as required.</text></paragraph><paragraph id="id1f2d49e7-0175-438a-a9f9-7bf6f2976e45"><enum>(5)</enum><header>Reasonable demands of commerce</header><text display-inline="yes-display-inline">The term <term>reasonable demands of commerce</term> means the safe movement of commercial vessels transiting ice-covered waterways in the Great Lakes, regardless of type of cargo, at a speed consistent with the design capability of Coast Guard icebreakers operating in the Great Lakes.</text></paragraph></subsection><subsection id="id0ff980f9-ccff-42fd-a4e9-31f56051fbf4"><enum>(g)</enum><header>Public briefing</header><text display-inline="yes-display-inline">Not later than the first July 1 after the first winter in which the Commandant is subject to the requirements of section 564 of title 14, United States Code, the Commandant shall publish on a publicly accessible internet website of the Coast Guard a briefing on the cost to the Coast Guard of meeting the requirements of such section.</text></subsection></section><section id="idd5006813-b26e-4fc9-a725-ae3e61872797" changed="added" commented="no" display-inline="no-display-inline" section-type="subsequent-section" reported-display-style="italic" committee-id="SSCM00"><enum>4.</enum><header>Great Lakes icebreaker acquisition</header><text display-inline="no-display-inline">Of the amounts authorized to be appropriated by section 4902(2)(A)(ii) of title 14, United States Code, $350,000,000 shall be made available to the Commandant for fiscal year 2022 for the acquisition of a Great Lakes icebreaker at
