which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 14, United States Code, to require the Coast Guard to conduct icebreaking operations in the Great Lakes to minimize commercial disruption in the winter months, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HF3F74DBA05A44B469A435B055F8FD38A"><section section-type="section-one" id="H9227424D6F754DA2A3EBFA3D97B6ED4C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Great Lakes Winter Commerce Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="H6497E954566C494BB87E55D594342A80"><enum>2.</enum><header>Great Lakes icebreaking operations</header><subsection id="HB6AF3BDD28734F07A43F02A68753DA36"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/5">chapter 5</external-xref> of title 14, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HAF85321F0D3B4CA78EC37B38731B9ADD"><section id="HBB6CE9AE483E4CE18DF9496BEB2BBD82"><enum>564.</enum><header>Great Lakes icebreaking operations</header><subsection id="H2C8E7A3BCED24B6F865882795F161C4A"><enum>(a)</enum><header>Icebreaking operations</header><text display-inline="yes-display-inline">The Commandant shall conduct icebreaking operations in the Great Lakes in accordance with the standard for icebreaking operations under subsection (b).</text></subsection><subsection id="HB092B23D12CB4F2F9D58073754A019FF"><enum>(b)</enum><header>Standard for icebreaking operations</header><text>In carrying out subsection (a)—</text><paragraph id="H74C48E63AFC64511A27F11C5A99B3597"><enum>(1)</enum><text display-inline="yes-display-inline">except as provided in paragraph (2), the Commandant shall keep ice-covered waterways in the Great Lakes open to navigation not less than 90 percent of the hours that commercial vessels and ferries attempt to transit such ice-covered waterways; and</text></paragraph><paragraph id="HB7A2636FD32A4A9A89B787CAEEA7FC42"><enum>(2)</enum><text display-inline="yes-display-inline">in a year in which the Great Lakes are not open to navigation because of ice of a thickness that occurs on average only once every 10 years, the Coast Guard shall keep ice-covered waterways in the Great Lakes open to navigation at least 70 percent of the hours that commercial vessels and ferries attempt to transit such ice-covered waterways.</text></paragraph></subsection><subsection id="HAF1CF8EF521445F9B89F0EEA409780CA"><enum>(c)</enum><header>Report to Congress</header><paragraph id="H57D47A519A224370A200A377681DFB8A"><enum>(1)</enum><header>Deadline</header><text display-inline="yes-display-inline">Not later than July 1 of each year, the Commandant shall submit to Congress a report on the icebreaking operations conducted by the Coast Guard in the Great Lakes for the fiscal year.</text></paragraph><paragraph id="H858F397A4E614FCA90D8EA727EDC8211"><enum>(2)</enum><header>Content</header><text display-inline="yes-display-inline">The report required under paragraph (1) shall include the total number of hours that United States icebreakers conducted icebreaking operations in each of the types of Great Lakes waters described in paragraph (3) and the total number of hours that Canadian icebreakers conducted icebreaking operations in the type of Great Lakes waters described in subparagraphs (3)(A) and (3)(C).</text></paragraph><paragraph id="H0783DEA185A24A76A4F8E77B1B758589"><enum>(3)</enum><header>Types of Great Lakes waters</header><text display-inline="yes-display-inline">The types of waters described in this paragraph are—</text><subparagraph id="H9E31C0D2BC3046EEBB1CE0EC1F44F533"><enum>(A)</enum><text display-inline="yes-display-inline">United States waters, excluding waters described in subparagraph (C);</text></subparagraph><subparagraph id="H2CA0D81BF8D1485F93F348C0D7C424B2"><enum>(B)</enum><text display-inline="yes-display-inline">Canadian waters, excluding waters described in subparagraph (C); and</text></subparagraph><subparagraph id="HE436E7D09580451EB279AA99D0DDB620"><enum>(C)</enum><text>frequent border crossing waters.</text></subparagraph></paragraph></subsection><subsection id="H79B347A497C1487FAD336862BD3B869D"><enum>(d)</enum><header>Coordination with industry</header><text display-inline="yes-display-inline">The Commandant shall coordinate Great Lakes icebreaking operations with operators of commercial vessels.</text></subsection><subsection id="H9769C2069B7F4386BA206E730023EF1B"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H6E5A88703C9B42D681360CB2E822D6AF"><enum>(1)</enum><header>Commercial vessel</header><text display-inline="yes-display-inline">The term <quote>commercial vessel</quote> means any privately owned cargo vessel of at least 500 tons, as measured under section 14502 of title 46 or an alternate tonnage measured under section 14302 of such title as prescribed by the Secretary under section 14104 of such title, operating in the Great Lakes during the winter season.</text></paragraph><paragraph id="H41BE39E80C264D78BA0803D5F6569E1A"><enum>(2)</enum><header>Great Lakes</header><text display-inline="yes-display-inline">The term <quote>Great Lakes</quote>—</text><subparagraph id="id60C05C15FF484D238205D2BDB45046EE"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given such term in section 118 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1268">33 U.S.C. 1268</external-xref>); and </text></subparagraph><subparagraph id="idB2B5DFACB4234C5DB5464187C3847F6D"><enum>(B)</enum><text>includes harbors.</text></subparagraph></paragraph><paragraph id="H135DD89529E141DE9A7F83AA80A430D3"><enum>(3)</enum><header>Ice-covered waterway</header><text display-inline="yes-display-inline">The term <quote>ice-covered waterway</quote> means any portion of the Great Lakes in which commercial vessels operate that is 70 percent or greater covered by ice, but does not include any waters adjacent to piers or docks for which commercial icebreaking services are available and adequate for the ice conditions.</text></paragraph><paragraph id="HAAEC697DE9A5499BBD245E6A06D94E1C"><enum>(4)</enum><header>Open to navigation</header><text display-inline="yes-display-inline">The term <quote>open to navigation</quote> means navigable to the extent necessary to meet the reasonable demands of commerce, minimize delays to passenger ferries, extricate vessels and persons from danger, prevent damage due to flooding, and conduct other Coast Guard missions as required.</text></paragraph><paragraph id="HD8E6CF874B3B446DA9DD1515CE0DDB7A"><enum>(5)</enum><header>Reasonable demands of commerce</header><text display-inline="yes-display-inline">The term <quote>reasonable demands of commerce</quote> means the safe movement of commercial vessels transiting ice-covered waterways in the Great Lakes, regardless of type of cargo, at a speed consistent with the design capability of Coast Guard icebreakers operating in the Great Lakes.</text></paragraph><paragraph id="HE664A0000F4B48C1A75F60C27E5C6A21"><enum>(6)</enum><header>Frequent border crossing waters</header><text display-inline="yes-display-inline">The term <quote>frequent border crossing waters</quote> means the United States waters and Canadian waters of—</text><subparagraph id="H9E01F62F943E49919775DEB6099D354A"><enum>(A)</enum><text>Whitefish Bay in Lake Superior;</text></subparagraph><subparagraph id="H3EA560A7F123412893ACC1C46BD7FD39"><enum>(B)</enum><text>the St. Mary’s River;</text></subparagraph><subparagraph id="H0C5DFB33ED8447239F2A72B5CA121EB4"><enum>(C)</enum><text>the Detroit and St. Clair rivers system; and</text></subparagraph><subparagraph id="H13CD42136EF649F2B62B902DDF4F7473"><enum>(D)</enum><text display-inline="yes-display-inline">Western Lake Erie from the Detroit River to Pelee Passage.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8AB021FD2C93478AAC1865BE9FC85929"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/5">chapter 5</external-xref> of title 14, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HCE07FB9C14544E60856FFAB488C8037F"><toc regeneration="no-regeneration"><toc-entry level="section">564. Great Lakes icebreaking operations.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2362A929C65E4BE096E878FCB728C044"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than the first July 1 after the first winter in which the Commandant of the Coast Guard is subject to the requirements of section 564 of title 14, United States Code, the Commandant shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the cost to the Coast Guard of meeting the requirements of such section.</text></subsection></section><section id="HFE3F25C2BF9842E8A62D22B1726A468A"><enum>3.</enum><header>Great Lakes icebreaker acquisition</header><subsection id="HB81D8B45C19C459BAE46AFDB6D590217"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">Section 8107(a) of the Elijah E. Cummings Coast Guard Authorization Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>) is amended by striking <quote>$160,000,000</quote> and inserting <quote>$350,000,000</quote>.</text></subsection><subsection id="H9BA39AF44A9F40E589C335706E7019B9"><enum>(b)</enum><header>Exemption</header><text display-inline="yes-display-inline">Notwithstanding sections 1105(a)(2), 1131, and 1132 of title 14, United States Code, and the requirements in the Competition in Contracting Act (<external-xref legal-doc="usc" parsable-cite="usc/10/2304">10 U.S.C. 2304</external-xref>), and subject to the availability of appropriations, the Commandant shall acquire the icebreaker described in section 8107(a) of the Elijah E. Cummings Coast Guard Authorization Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>) through other than full and open competition in an accelerated timeframe and award the contract on the basis of contractor qualification and price.</text></subsection></section></legis-body></bill>
