<official-title>To amend title 11, United States Code, to promote the investigation of fraudulent claims against certain trusts, to amend title 18, United States Code, to provide penalties against fraudulent claims against certain trusts, and for other purposes. </official-title>

<section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Responsible Oversight of Trusts to Ensure Compensation and Transparency for Asbestos Victims Act of 2021</short-title></quote> or the <quote><short-title>PROTECT Asbestos Victims Act of 2021</short-title></quote>.</text></section> <section id="id747AA3C403104402A49FEA485ECAED2E"><enum>2.</enum><header>Reduction of fraudulent claims and demands relating to certain trusts</header> <subsection id="idEAD5D188E2B645E09AA0031279BD51EE"><enum>(a)</enum><header>In general</header><text>Section 524(g) of title 11, United States Code, is amended—</text>
<paragraph id="id7D4A7D73B8644E549DB45F862B507033"><enum>(1)</enum><text>in paragraph (4)(B)(i), by striking <quote>the court appoints a legal representative</quote> and inserting <quote>the United States trustee or bankruptcy administrator appoints, under paragraph (10), a future claims representative</quote>; and</text></paragraph> <paragraph id="id3186229DE3A940779BBF7E25CB2864E9"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
<quoted-block style="USC" display-inline="no-display-inline" id="id38BB5B7F1F6F4913A3958F6C04299B8A">
<paragraph id="idAA66CC1298B84FB5A157782580D238AD"><enum>(8)</enum><header>Investigation of fraudulent claims and demands</header>
<subparagraph id="idB127FBDB93414BE5ADB81E2E23D5121F"><enum>(A)</enum><header>In general</header><text>Notwithstanding section 302(d)(3) of the Bankruptcy Judges, United States Trustees, and Family Farmer Bankruptcy Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/28/581">28 U.S.C. 581</external-xref> note), rule 9035 of the Federal Rules of Bankruptcy Procedure, or any other provision of law, in any judicial district of the United States, the United States trustee may investigate the administration and operation of a trust described in paragraph (2)(B)(i), including a trust described in paragraph (2)(B)(i) that was created before the date of enactment of the <short-title>PROTECT Asbestos Victims Act of 2021</short-title>.</text></subparagraph> <subparagraph id="id83B09BDF4D1A4C239FA29684CB67B75E"><enum>(B)</enum><header>Authority of the United States trustee</header><text>In conducting an investigation under subparagraph (A), the United States trustee shall have the authority—</text>
<clause id="id4E02E717C7A1469EAA7E723A904B832E"><enum>(i)</enum><text>to conduct discovery, including by any means of discovery available to a trustee in an action under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/11/5">chapter 5</external-xref> of title 11, relating to the trust, a claimant of the trust, or a claim against the trust, including a claim filed by a claimant against the trust in a bankruptcy court or other forum, notwithstanding the effect of any order purporting to limit the access of the United States trustee to any information relating to that discovery;</text></clause> <clause id="id0EE6907C2516437EB7F90D2C71015A97"><enum>(ii)</enum><text>to conduct an audit or contract for an audit of any claim or demand paid, or to be paid, in whole or in part by the trust;</text></clause>
<clause id="id9972C88031CC48BAA5AFC60BF92FAD29"><enum>(iii)</enum><text>if the United States trustee has reasonable grounds to believe that a false claim or demand to be paid in whole or in part by a trust was made, to refer the matter to the United States attorney for the relevant judicial district, and, on the request of the United States attorney, assist the United States attorney in carrying out a prosecution based on that false claim or demand; and</text></clause> <clause id="id9E2F3B4A89D64854A8DEECA42597186E"><enum>(iv)</enum><text>to request that the court exercise any authority and impose remedies available to it, including those—</text>
<subclause id="id80D8B6FC4DBC49B1965359602DF645B5"><enum>(I)</enum><text>under the terms of the plan of reorganization to prevent abuse or mismanagement of the trust; and</text></subclause> <subclause id="id703FF4A23B61403095F4743FFEB1F3D1"><enum>(II)</enum><text>under section 105.</text></subclause></clause></subparagraph>
<subparagraph id="id34C1E26241994C858194960870B32FA4"><enum>(C)</enum><header>Standing</header><text>In carrying out this paragraph, the United States trustee shall have standing to raise, to appear, and to be heard on any matter for which the court has jurisdiction or for which the court has reserved jurisdiction under the terms of the plan of reorganization.</text></subparagraph></paragraph> <paragraph id="id77A90A60D0A6439CA5566280988DCB88"><enum>(9)</enum><header>Accessing trust information</header> <subparagraph id="IDc2c741390f324a2c8f059996b2ca1ea3"><enum>(A)</enum><header>In general</header><text>Subject to section 107 and any appropriate protective order, a trust described in paragraph (2)(B)(i) shall, on written request, provide, in a timely manner, any information relating to any payment from, and any demand for payment from, the trust to a party to an action at law or equity if the action relates to liability for asbestos exposure.</text></subparagraph>
<subparagraph id="IDdf7300a2d5814d9d92f444fd0003d797"><enum>(B)</enum><header>Costs</header><text>A trust described in paragraph (2)(B)(i) may require, from the person making a request under subparagraph (A), payment of any reasonable cost incurred to comply with the requirements under subparagraph (A).</text></subparagraph></paragraph> <paragraph id="id460D0D37CA5E4F45845CA757AA4F6942"><enum>(10)</enum><header>Appointment of future claims representatives</header> <subparagraph id="id078A1D8F66F04175BFF641DB2701EFDA"><enum>(A)</enum><header>In general</header><text>On notification by a plan proponent of the intention of the plan proponent to seek an injunction under this subsection, the United States trustee or bankruptcy administrator, after consultation with parties in interest, shall appoint, subject to the approval of the court, a disinterested individual to serve as the future claims representative.</text></subparagraph>
<subparagraph id="id295F5C31E3F346AB8F49958714D92F2C"><enum>(B)</enum><header>Support</header>
<clause id="id85E11A7F5E5146F1999A237A0DBE3CB4"><enum>(i)</enum><header>In general</header><text>The future claims representative, subject to the approval of the court, may employ 1 or more attorneys, accountants, or other professional persons to represent the future claims representative or assist the future claims representative in carrying out the duties of the future claims representative under this subsection.</text></clause> <clause id="idDF327476492F42F9B8373430C6CC2D1F"><enum>(ii)</enum><header>Qualifications</header><text>An attorney, accountant, or other professional person employed under clause (i) to represent or assist the future claims representative—</text>
<subclause id="id368B887B416B4CD8AE1046A172AD4797"><enum>(I)</enum><text>shall be a disinterested person; and</text></subclause> <subclause id="idA76B67F3A4BA4BA2B8CF73A7221267B9"><enum>(II)</enum><text>may not represent any other entity having an adverse interest in connection with the case.</text></subclause></clause></subparagraph></paragraph>
<paragraph id="id448951A1C7014D3F889505B5DF66A5CC"><enum>(11)</enum><header>Power of the court</header><text>Notwithstanding any other provision of law, including paragraph (1)(B), sections 1127, 1141, and 1144 of this title, and section 157 of title 28, the court may issue any order, process, or judgment that is necessary and appropriate—</text> <subparagraph id="id0E00C8A726F447F7BEC35B5A9D8DD25E"><enum>(A)</enum><text>to carry out the provisions of paragraphs (8) and (9); or</text></subparagraph>
<subparagraph id="idB5AA0847AF71475395A086CDC580FF29"><enum>(B)</enum><text>to enforce or implement a court order or prevent an abuse of process relating to a trust described in paragraph (2)(B)(i).</text></subparagraph></paragraph> <paragraph id="idB34BFF936D3D4A77A250D7643151F3EE"><enum>(12)</enum><header>Benefits under Medicare</header> <subparagraph id="id3DDBFEFB47604433ABD52EA64A152AE8"><enum>(A)</enum><header>Potential eligible claimants</header><text>Not later than 60 days after a claim is submitted to a trust described in paragraph (2)(B)(i), the administrator of the trust shall determine whether the claimant is entitled to benefits under the Medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.).</text></subparagraph>
<subparagraph id="idD3207EA8155E44C48DE9DE2C4D7224DA"><enum>(B)</enum><header>Required information</header><text>If a claimant is determined to be entitled to benefits under subparagraph (A), the administrator of the trust shall submit to the Secretary of Health and Human Services, in the form and manner (including frequency) specified by the Secretary of Health and Human Services, the information described in section 1862(b)(8)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(b)(8)(B)</external-xref>).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="id4854AEFBF9B94F91A05B12AA9E64F580"><enum>(b)</enum><header>Compensation</header><text>Section 330(a)(1) of title 11, United States Code, is amended—</text>
<paragraph id="id987186E9C41044D3A084E1ADFA5372AF"><enum>(1)</enum><text>by inserting <quote>a future claims representative appointed under section 524(g)(10)(A),</quote> after <quote>section 333,</quote>; and</text></paragraph> <paragraph id="id541A65F5DAF84618B32A504874B7004F"><enum>(2)</enum><text>by inserting <quote>, 524(g)(10)(B),</quote> after <quote>section 327</quote>.</text></paragraph></subsection>
<subsection id="idD32F0A845C544BCB8E957C33EA51A499"><enum>(c)</enum><header>Reopening cases</header><text>Section 350 of title 11, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="id8214F301383C4C6EB2B728CB86A5A5DB"> <subsection id="id64C68325428943E089F79BF6A62DE59F"><enum>(c)</enum><header>Investigations by United States trustee</header><text>On the request of the United States trustee, a case shall be reopened in the court in which that case was closed in order to enable the United States trustee to conduct an investigation under section 524(g)(8).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="idABB82E18E4CF41A29621FAB314ADA3CD"><enum>3.</enum><header>Criminal penalties</header><text display-inline="no-display-inline">Section 152 of title 18, United States Code, is amended—</text> <paragraph id="idE44508EE715C414BBAC8C9890B84ADDA"><enum>(1)</enum><text>in paragraph (8), by striking <quote>or</quote> after the semicolon;</text></paragraph>
<paragraph id="id5B8335F456134C9F8214CCEF448F5AA3"><enum>(2)</enum><text>by striking the comma at the end of paragraph (9) and inserting a semicolon; and</text></paragraph> <paragraph id="id5C7BDE08EA284A818B41DCA00C6AA1F3"><enum>(3)</enum><text>by inserting after paragraph (9) the following:</text>
<quoted-block style="USC" display-inline="no-display-inline" id="id9122F8C589004670B1BDBBA7FE5BE74B">
<paragraph id="id7DB7DFAB4D7B490E9274745992CEF9E4"><enum>(10)</enum><text>knowingly and fraudulently makes a false representation to a trust described in section 524(g)(2)(B)(i) of title 11, or any official of a trust described in that section, in relation to an investigation conducted under section 524(g)(8)(A) of that title; or</text></paragraph> <paragraph id="id6AD3774AF56A40A98625DE3B55CB883D"><enum>(11)</enum><text>knowingly and fraudulently makes a false claim or demand to be paid in whole or in part by a trust described in section 524(g)(2)(B)(i) of title 11,</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="id4c956dbb444049bba499319d8e8bf0d6"><enum>4.</enum><header>Authority of United States trustee</header><text display-inline="no-display-inline">Section 586 of title 28, United States Code, is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id8479ecfbfa164006a126817ad44cdbbd"> <subsection id="id4a95b7e4c2494c0caae48849bb611386"><enum>(g)</enum><header>Investigation of fraudulent claims and demands</header> <paragraph id="id01CC4EE6E0FB43129FCF42F3BA7E25F6"><enum>(1)</enum><header>In general</header><text>The United States trustee may investigate the administration and operation of a trust, including a trust that was created before the date of enactment of the <short-title>PROTECT Asbestos Victims Act of 2021</short-title>—</text>
<subparagraph id="id18090E4B58A749FDB21D7AD61E02DC53"><enum>(A)</enum><text>described in section 524(g)(2)(B)(i) of title 11; or</text></subparagraph> <subparagraph id="id487C4E902EE244CE809E63AB32293DE9"><enum>(B)</enum><text>established under section 105(a) of title 11 for the purpose of assuming the asbestos-related liabilities of a debtor.</text></subparagraph></paragraph>
<paragraph id="idD343B850DB524342B01D79F1FDEA56D6"><enum>(2)</enum><header>Authority of the United States trustee</header><text>In conducting an investigation under subparagraph (A), the United States trustee shall have the authority—</text> <subparagraph id="idf153c2b13871436ba3cdd790c4ee19eb"><enum>(A)</enum><text>to conduct discovery, including by any means of discovery available to a trustee in an action under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/11/5">chapter 5</external-xref> of title 11, relating to the trust, a claimant of the trust, or a claim against the trust, including a claim filed by a claimant against the trust in a bankruptcy court or other forum, notwithstanding the effect of any order purporting to limit the access of the United States trustee to any information relating to that discovery;</text></subparagraph>
<subparagraph id="idcc0904545f3c453a9e7eb6467870a18e"><enum>(B)</enum><text>to conduct an audit or contract for an audit of any claim or demand paid, or to be paid, in whole or in part by the trust;</text></subparagraph> <subparagraph id="idd5b20622663d4ed2a3d64a8699188657"><enum>(C)</enum><text>if the United States trustee has reasonable grounds to believe that a false claim or demand to be paid in whole or in part by a trust was made, to refer the matter to the United States attorney for the relevant judicial district, and, on the request of the United States attorney, assist the United States attorney in carrying out a prosecution based on that false claim or demand; and</text></subparagraph>
<subparagraph id="id767d337f1dab4b169182deb504212800"><enum>(D)</enum><text>to request that the court exercise any authority and impose remedies available to it, including those—</text> <clause id="idecd15e8006fc445fb8f1caea2e819077"><enum>(i)</enum><text>under the terms of the plan of reorganization to prevent abuse or mismanagement of the trust; and</text></clause>
<clause id="idfaf25428207d44aebdf0ff1659bd9718"><enum>(ii)</enum><text>under section 105.</text></clause></subparagraph></paragraph> <paragraph id="id970c58cc26734898900d9d8499f1961f"><enum>(3)</enum><header>Standing</header><text>In carrying out this subsection, the United States trustee shall have standing to raise, to appear, and to be heard on any matter for which the court has jurisdiction or for which the court has reserved jurisdiction under the terms of the plan of reorganization.</text></paragraph>
<paragraph id="id1a9efbcc7d36473cb692ef5de27c236d"><enum>(4)</enum><header>Judicial districts established for Alabama and North Carolina</header><text>Notwithstanding section 302(d)(3) of the Bankruptcy Judges, United States Trustees, and Family Farmer Bankruptcy Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/28/581">28 U.S.C. 581</external-xref> note), rule 9035 of the Federal Rules of Bankruptcy Procedure, or any other provision of law, the United States trustee for the appropriate region described in section 581(a) shall have the authority to carry out this subsection with respect to a trust described in paragraph (1) in a case that is filed in a judicial district established for the State of Alabama or North Carolina.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body> </bill>
