which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>October 18, 2022</action-date><action-desc>Reported under authority of the order of the Senate of October 14, 2022, by <sponsor name-id="S338">Mr. Manchin</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To establish a pilot program for native plant species, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native Plant Species Pilot Program Act of 2021</short-title></quote>.</text></section><section id="idd6822adc5da84c3780cdde4c2bd3a0d2" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="ide6295b4daf9f4e2685ddbd12d0ea039e"><enum>(1)</enum><text>the United States has a significant interest in—</text><subparagraph id="id080EE0873C2441BD8B0661738DA18887"><enum>(A)</enum><text>preserving the worldwide system of richly varied habitats;</text></subparagraph><subparagraph id="id767891183FDF4D17B7DEDC152B25A07D"><enum>(B)</enum><text>protecting native plant biodiversity and the ecosystems that support that biodiversity; and</text></subparagraph><subparagraph id="id953780FBBD894758A8A5CB2612A0F00B"><enum>(C)</enum><text>protecting the quality of life of people in the United States;</text></subparagraph></paragraph><paragraph id="idd3114b42cddc4ed1bad69e7390deb6fa"><enum>(2)</enum><text>native plants are an inseparable part of the natural beauty of the landscape of the United States, which must be preserved;</text></paragraph><paragraph id="id7adb0e34e5e14e8bb4dbc5b514eb2db9"><enum>(3)</enum><text>the extensive root systems of native plants control erosion, moderate floods, filter water to improve water quality, decrease the amount of water needed for landscape maintenance, and sequester carbon to combat climate change;</text></paragraph><paragraph id="id4a167122c7264d86b8aa288fd236cd6c"><enum>(4)</enum><text>native plants provide food and habitat for pollinators and wildlife;</text></paragraph><paragraph id="ide3d07d2b60474e64afd1b8e619904c15"><enum>(5)</enum><text>native plants supply an important genetic record for future food, agriculture, and plant-derived products;</text></paragraph><paragraph id="id5b4ccda3f6534578abcd68f1a6657967"><enum>(6)</enum><text>native plant communities are important components of cultural landscapes;</text></paragraph><paragraph id="idEEB0732239DA4681B9BE438A6C2DA20E"><enum>(7)</enum><text>the use of native plant materials for restoration or enhancement contributes to the preservation of cultural landscapes;</text></paragraph><paragraph id="id0347caba9c1543a792b7b629613a56d9"><enum>(8)</enum><text>the use of native plant species in revegetation efforts after construction activities and adjacent to roadways increases habitat for a variety of pollinators and other native animal species;</text></paragraph><paragraph id="ideb1b0a44c75e4fe1ab0f3a5940992bb4"><enum>(9)</enum><text>supporting native plant communities within or adjacent to agricultural areas provides important wildlife habitat that would not otherwise be available;</text></paragraph><paragraph id="id419fd8e3e7e04d5b83713762d685c738"><enum>(10)</enum><text>the use of native plants in landscaping can reduce the need for herbicides and water use; and</text></paragraph><paragraph id="id078E0E7A737A4409840FA110BACA9DC5"><enum>(11)</enum><text>of the 20,000 known native plant species in North America, it has been estimated that nearly 25 to 30 percent are at risk of extinction as a result of factors such as habitat loss, invasive species, temperature shifts, and pesticide use.</text></paragraph></section><section id="id5c8e3958ce0047e59bd152fa6960b289" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idd91899d0d500452dbc3fc5ab241e297f"><enum>(1)</enum><header>Control</header><text>The term <term>control</term> means, with respect to invasive species, containing, suppressing, or reducing populations of invasive species.</text></paragraph><paragraph id="idf80d97f8e17148ccbdbbbec81f42d323"><enum>(2)</enum><header>Eradicate</header><text>The term <term>eradicate</term> means, with respect to invasive species, removing or destroying an entire population of invasive species.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id045b50f1cedc48b7b7db58bf31019456"><enum>(3)</enum><header>Invasive species</header><text>The term <term>invasive species</term> means, with respect to a particular ecosystem, a nonnative organism, the introduction of which causes or is likely to cause economic or environmental harm or harm to human, animal, or plant health.</text></paragraph><paragraph commented="no" id="id35e115451c1a4660b789af9e258e146b"><enum>(4)</enum><header>Locally adapted</header><text>The term <term>locally adapted</term> means, with respect to plants, plants that—</text><subparagraph commented="no" id="id0A01F844631F4A459208C3D9426D9769"><enum>(A)</enum><text>originate from an area that is geographically proximate to a planting area; and</text></subparagraph><subparagraph commented="no" id="idBE4E93A56C4C4D63BC31B112BA1389E0"><enum>(B)</enum><text>are environmentally adapted to and likely to become established and persist in that planting area.</text></subparagraph></paragraph><paragraph commented="no" id="id294D95FB9BEF4618B4C8C72151985A1B"><enum>(5)</enum><header>National Park Service region</header><text>The term <term>National Park Service region</term> means each of the following unified Interior regions designated by the Secretary of the Interior:</text><subparagraph id="id9d45dfc936344aabb80f6be61052cd07"><enum>(A)</enum><text>Alaska.</text></subparagraph><subparagraph id="id87ea32c7f46a4daf94dc4581c2cba3c2"><enum>(B)</enum><text>Arkansas-Rio Grande-Texas-Gulf.</text></subparagraph><subparagraph id="id353b4dfb4f864a9681c642f240f0fb9c"><enum>(C)</enum><text>Columbia-Pacific Northwest.</text></subparagraph><subparagraph id="id2caf050c2e3442e39f75cf3df63ceb1d"><enum>(D)</enum><text>California-Great Basin.</text></subparagraph><subparagraph id="idbdd5a358d13a410bb64085c989364c3b"><enum>(E)</enum><text>Great Lakes.</text></subparagraph><subparagraph id="id7bf071081450477495271e2b394d9e82"><enum>(F)</enum><text>Lower Colorado-Basin.</text></subparagraph><subparagraph id="idd7f2f6919460485fb25037c638bdf142"><enum>(G)</enum><text>Mississippi-Basin.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb6de32432bee4158b2513c480badb294"><enum>(H)</enum><text>Missouri-Basin.</text></subparagraph><subparagraph id="id129babaa35e14b89a02e51f798337622"><enum>(I)</enum><text>North Atlantic-Appalachian.</text></subparagraph><subparagraph id="id46b80db4ee78467998fc166eea78d907"><enum>(J)</enum><text>Pacific Islands.</text></subparagraph><subparagraph id="id0ce8e18250a842908b88fc2c84202a0e"><enum>(K)</enum><text>South Atlantic-Gulf.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id20e3d37f085c4737840d3c9ef36d97aa"><enum>(L)</enum><text>Upper Colorado-Basin.</text></subparagraph></paragraph><paragraph id="id246d81d46ae540f99a78218a926a81d2"><enum>(6)</enum><header>Native plant species</header><text>The term <term>native plant species</term> means, with respect to a particular ecosystem, a species that, other than as a result of an introduction, historically occurred or currently occurs in that ecosystem.</text></paragraph><paragraph id="id4c137cf5a2a04a6c9867a67289c50fa9"><enum>(7)</enum><header>Nonnative or alien</header><text>The term <term>nonnative or alien</term> means, with respect to a particular ecosystem, an organism, including the seeds, eggs, spores, or other biological material of the organism capable of propagating that species, that occurs outside of the natural range of the organism.</text></paragraph><paragraph id="id6996884B4E07472887D896AAB386A1F8"><enum>(8)</enum><header>Plant material</header><text>The term <term>plant material</term> means a plant or the seeds, eggs, spores, or other biological material of a plant capable of propagating the species of the plant.</text></paragraph><paragraph id="iddd1039ab21f6494ba6d226d8dc352100"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the National Park Service.</text></paragraph></section><section id="idda255695093641ec944c2bf9dfc278ed" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>4.</enum><header>Pilot program for native plant species</header><subsection id="id81137a95ad5d4777926c89a4d29a8a56"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a pilot program in 2 or more National Park Service regions to promote the use of native plant materials.</text></subsection><subsection id="ida662dbad0cc445f5b1b21fdb688bc4e4"><enum>(b)</enum><header>Implementation</header><text>In carrying out land management activities on Federal land under the jurisdiction of the Secretary, including maintenance and restoration in response to degradation caused by human activity or natural events (such as fire, flood, or infestation), the Secretary shall—</text><paragraph id="id217110E11F3A427B98CE8E49E93DA3AD"><enum>(1)</enum><text>to the extent practicable, give preference to the use of locally adapted native plant materials;</text></paragraph><paragraph id="id09d8a3dd5a42416f8140a9703a86c3f5"><enum>(2)</enum><text>incorporate efforts to prevent, control, or eradicate the spread of invasive species; and</text></paragraph><paragraph id="idE038979D3E07474D8B31D2392848ACE1"><enum>(3)</enum><text>identify situations in which the use of nonnative or alien plant materials may be warranted, including situations in which—</text><subparagraph id="ida2ed36c4e2fa4e0f8d8512ca0537b778"><enum>(A)</enum><text>emergency conditions require the protection of basic resource values;</text></subparagraph><subparagraph id="id0736812d95e74821bd1068cdfd25cef3"><enum>(B)</enum><text>an interim nonpersistent measure is needed to aid in the reestablishment of a native plant species;</text></subparagraph><subparagraph id="idae7e012d3b5d49b9b7545b2c2bd09608"><enum>(C)</enum><text>native plant materials are not reasonably available; and</text></subparagraph><subparagraph id="ida8a93edac2344e71ad8141f2cd1c7520"><enum>(D)</enum><text>the plant community subject to a land management activity has been permanently altered.</text></subparagraph></paragraph></subsection><subsection id="id8748da2eeaab4441b9ce59a90f185a69"><enum>(c)</enum><header>Coordination</header><text>To accelerate the adoption of native plants throughout programs of the Department of the Interior, the Secretary shall, in carrying out the pilot program, coordinate activities with—</text><paragraph id="id03681FE4465540DAB5E39963A83FE1A0"><enum>(1)</enum><text>the National Seed Strategy of the Bureau of Land Management;</text></paragraph><paragraph id="idda5871c3439b4735b5e4bc43ce585e39"><enum>(2)</enum><text>the Plant Conservation Alliance; and</text></paragraph><paragraph id="id2a35bf2a643d4c27bfcf3f696b600142"><enum>(3)</enum><text>the Plant Materials Centers of the Natural Resources Conservation Service.</text></paragraph></subsection><subsection id="id5DB49A3C45A243EDB17E1E612DB002FB"><enum>(d)</enum><header>Duration</header><text>The authority to carry out the pilot program terminates on the date that is 5 years after the date on which the pilot program is established under subsection (a).</text></subsection><subsection commented="no" id="idDE08EF9ECEC346B6A710EC7643CE74AF"><enum>(e)</enum><header>Report</header><text>Not later than 1 year after the date on which the authority to carry out the pilot program terminates under subsection (d), the Secretary shall submit to Congress a report describing the results of the pilot program.</text></subsection><subsection id="idb2e3f74340c94d44af98b4827ce984f6"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this Act.</text></subsection></section><section id="id221e45c67e954f39b245e3df15a82c76" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>5.</enum><header>Study on cost-effectiveness of using native plant materials in carrying out land management activities on Federal land</header><subsection id="id8fded5d968924a20b9954ff63201e33d"><enum>(a)</enum><header>In General</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall, consistent with section 4, conduct a study to review existing data to determine the cost-effectiveness of using native plant materials in land management activities on Federal land under the jurisdiction of the Secretary or other Federal land management agencies. </text></subsection><subsection id="id8a4bf78a7b704396b599b33957764ac7"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report describing the results of the study required under subsection (a). </text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="idEADCBFFA397E4F7BBA56379E317E9AC1" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native Plant Species Pilot Program Act of 2022</short-title></quote>.</text></section><section id="id2092df1a6633431a9cfde1db9a02157a" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>2.</enum><header>Pilot program for native plant species</header><subsection id="ideb8e6648c9564d52848ed0ddd9737300"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date on which funds are made available to carry out this Act, the Secretary of the Interior (referred to in this section as the <quote>Secretary</quote>) shall, in accordance with any existing laws and management policies, carry out a pilot program to prioritize the use of native plant species within geographically diverse units of the National Park System and public land administered by the Bureau of Land Management.</text></subsection><subsection id="id855e4f853e0247a79415f5583b925ff6"><enum>(b)</enum><header>Implementation</header><text>In carrying out the pilot program under subsection (a), the Secretary shall, to the extent practicable—</text><paragraph id="id40b91c3fbdad4d968d8cabcefd83ab32"><enum>(1)</enum><text>give preference to the use of locally adapted native plant materials where appropriate;</text></paragraph><paragraph id="id69724c83943b4d5a8a364e737c930d4b"><enum>(2)</enum><text>incorporate efforts to prevent, control, or eradicate the spread of invasive species;</text></paragraph><paragraph id="ideb23524a15bc401b8ffa5cb35f5ac424"><enum>(3)</enum><text>incorporate efforts to use native plants in areas that have experienced a recent wildfire event; and</text></paragraph><paragraph id="id7cd5277f733342659b401b3eb75cc022"><enum>(4)</enum><text>identify situations in which the use of non-native plants may be warranted.</text></paragraph></subsection><subsection id="id052da80d82d545feb44a3046b96ee26c"><enum>(c)</enum><header>Coordination</header><text>The Secretary shall, in carrying out the pilot program under subsection (a), coordinate activities with—</text><paragraph id="id503829f037794d98a6a8e02911e61884"><enum>(1)</enum><text>the National Seed Strategy of the Bureau of Land Management;</text></paragraph><paragraph id="id50e6517ab67a42659f6fa40f7d6d2df8"><enum>(2)</enum><text>the Plant Conservation Alliance; and</text></paragraph><paragraph id="ide8d3c8df5f6b4913a70b9d16f666d012"><enum>(3)</enum><text>the Plant Materials Centers of the Natural Resources Conservation Service.</text></paragraph></subsection><subsection id="id2b8600e6ac354a98928ee9a6ca64efbe"><enum>(d)</enum><header>Termination of authority</header><text>The authority to carry out the pilot program under subsection (a) terminates on the date that is 5 years after the date on which the pilot program is established under that subsection.</text></subsection><subsection id="id8e09a5eee3bc4a8aa3081daa279a3ade"><enum>(e)</enum><header>Report</header><text>Not later than 1 year after the date on which the authority to carry out the pilot program terminates under subsection (d), the Secretary shall submit to Congress a report describing—</text><paragraph id="idce33cc24f89a454d8b84a07f48e51e2e"><enum>(1)</enum><text>the results of the pilot program carried out under subsection (a); and</text></paragraph><paragraph id="id4454af8fbf644e1ca0305aba6af0623a"><enum>(2)</enum><text> the cost-effectiveness of using native plants in units of the National Park System and public land administered by the Bureau of Land Management.</text></paragraph></subsection></section></legis-body><endorsement><action-date>October 18, 2022</action-date><action-desc>Reported under authority of the order of the Senate of October 14, 2022, with an amendment</action-desc></endorsement></bill>
