which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Agriculture to conduct a study on the establishment of, and the potential land that could be included in, a unit of the National Forest System in the State of Hawaii, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id4B40BC1D0C7E4D9581260F5A4B3EF5F0"><enum>1.</enum><header>Hawaii national forest study</header><subsection id="id494ff0ebdaca44509359cee05235e25d"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id49bd849bd5814bdd927b1c41290690ce"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph><paragraph id="id29109e07376f491fbe53a5c2542953af"><enum>(2)</enum><header>Study area</header><text>The term <term>study area</term> means the islands of Hawaii, Maui, Molokai, Lanai, Oahu, and Kauai in the State of Hawaii.</text></paragraph></subsection><subsection id="id32b61a85b7c74e1ca666ee7a5c1845ba"><enum>(b)</enum><header>Study</header><paragraph id="id8f7da3c020354409a4e16e88356c00d3"><enum>(1)</enum><header>In general</header><text>The Secretary shall conduct a study—</text><subparagraph id="id24ffb4eb2f2246cabb604bb901bd5cc0"><enum>(A)</enum><text>to determine the suitability and feasibility of establishing a unit of the National Forest System in the study area; and</text></subparagraph><subparagraph id="idf2f9ec1fee064029b64293dc4cd16d78"><enum>(B)</enum><text>to identify available land within the study area that could be included in the unit described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="idca93b287f8364b6097767839f0cbbd7a"><enum>(2)</enum><header>Coordination and consultation</header><text>In conducting the study under paragraph (1), the Secretary shall—</text><subparagraph id="id97438e70c234469d88348358d69c03d4"><enum>(A)</enum><text>coordinate with the Hawaii Department of Land and Natural Resources; and</text></subparagraph><subparagraph id="id7426b46cc3974346b2cf20e9521f5217"><enum>(B)</enum><text>consult with the Hawaii Department of Agriculture and other interested governmental entities, private and nonprofit organizations, and any interested individuals.</text></subparagraph></paragraph><paragraph id="id001c674a281f469896c82c8fca86fe68"><enum>(3)</enum><header>Contents</header><text>In conducting the study under paragraph (1), the Secretary shall—</text><subparagraph id="iddbb70b16f61942deb1eb388e716f5225"><enum>(A)</enum><text>consider unique vegetation types that occur in the study area and that should be targeted for inclusion in the unit of the National Forest System described in paragraph (1)(A);</text></subparagraph><subparagraph id="id769b1c6ae06040869946f9fcdb5f644e"><enum>(B)</enum><text>evaluate the ability of the Secretary—</text><clause id="id16d9d9ae185646829c4603ec4fb683b3"><enum>(i)</enum><text>to improve and protect forest areas within the study area; and</text></clause><clause id="id0a45cac74ad64048961e775fd7be18e9"><enum>(ii)</enum><text>to secure favorable water flows within the study area;</text></clause></subparagraph><subparagraph id="id31d451f5e57241d0876e4a887de23e41"><enum>(C)</enum><text>determine whether the unit of the National Forest System described in paragraph (1)(A) would expand, enhance, or duplicate—</text><clause id="idceb3bbaa69f84e358b9b3e630bb0ef65"><enum>(i)</enum><text>resource protection; and</text></clause><clause id="id93dc8af6845243f99a3140f08b07ad4b"><enum>(ii)</enum><text>visitor-use opportunities;</text></clause></subparagraph><subparagraph id="ideb108523ce7045f596ff66d3f2b140ac"><enum>(D)</enum><text>consider parcels of an appropriate size or location to be capable of economical administration as part of the National Forest System separately or jointly with the other land identified under paragraph (1)(B);</text></subparagraph><subparagraph id="id3deefe9cfa2649b3af0f58a1812cbca5"><enum>(E)</enum><text>evaluate the willingness of landowners to sell or transfer land in the study area to the Secretary;</text></subparagraph><subparagraph id="idfeb7d867836443579451ec288e7981d8"><enum>(F)</enum><text>evaluate the suitability of land in the study area for potential selection and designation as a research natural area or an experimental forest;</text></subparagraph><subparagraph id="idd529c31004994caf80cf38d01f5f4ecb"><enum>(G)</enum><text>identify cost estimates for any Federal acquisition, development, operation, and maintenance that would be needed to establish the unit of the National Forest System described in paragraph (1)(A); and</text></subparagraph><subparagraph id="id0b80c0e7b4e44d61b207fecd76a50d0b"><enum>(H)</enum><text>consider other alternatives for the conservation, protection, and use of areas within the study area by the Federal Government, State or local government entities, or private and nonprofit organizations.</text></subparagraph></paragraph></subsection><subsection id="id0e23b8d875cf44e991114735bc70e97b"><enum>(c)</enum><header>Effect</header><text>Nothing in this section authorizes the Secretary to take any action that would affect the use of any land owned by the United States or not owned by the United States.</text></subsection><subsection id="id5b2291d50a6442929b62c347176d9e19"><enum>(d)</enum><header>Report</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report that describes—</text><paragraph id="id788c4c0c73254b62965d2bd02139df6d"><enum>(1)</enum><text>the results of the study; and</text></paragraph><paragraph id="id0151bae23a3c4e0890a8d18aad8ae91e"><enum>(2)</enum><text>any conclusions and recommendations of the Secretary. </text></paragraph></subsection></section></legis-body></bill>
